In exercise of the powers conferred in Articles 140, subsections 3) and 18) and 180 of the Political Constitution; based on Articles 1, 3, 5, 13, 23, 25, 35, 37, 39, 42 and 44 of the National Emergency Law, Law Nº 7914 of September 28, 1999, and the General Law of Public Administration, Law Nº 6227 of May 2, 1978.

Considering:

Therefore, They Decree:

a)Initial or critical phase; b) Intermediate phase; and c) Conclusion phase.

The contributions, donations, and contributions shall enter the National Emergency Fund, in accordance with the procedures stipulated in Articles 35, 37, and 39 of the National Emergency Law. Assets shall be managed in accordance with what is indicated in Article 44 of said law.

The emergency appointment of officials shall be subject to what is provided in the final paragraph of Article 19 of the National Emergency Law.

En ejercicio de las facultades conferidas en los artículos 140, incisos 3) y 18) y 180 de la Constitución Política; con fundamento en los artículos 1°, 3°, 5°, 13, 23, 25, 35, 37, 39, 42 y 44 de la Ley Nacional de Emergencia, Ley Nº 7914 del 28 de setiembre de 1999, y la Ley General de la Administración Pública, Ley Nº 6227 del 2 de mayo de 1978.

Considerando:

Por tanto,

Decretan:

a)Fase inicial o crítica; b) Fase intermedia y; c) Fase de conclusión.

Los aportes, donaciones y contribuciones ingresarán al Fondo Nacional de Emergencias, conforme a los procedimientos que se estipulan en los artículos 35, 37 y 39 de la Ley Nacional de Emergencia. Los bienes se manejarán de conformidad con lo indicado en el artículo 44 de dicha ley.

El nombramiento de emergencia de funcionarios estará sujeto a lo que se dispone en el párrafo final del artículo 19 de la Ley Nacional de Emergencia.

Artículo 1 — That since December 11, 2001, a hydrometeorological-type event has occurred, causing intense rains and floods along the Caribbean Slope and Northern Zone, associated with a Low Pressure system.

Artículo 3 — That in accordance with the progress reports issued by the National Meteorological Institute and by the National Commission for Risk Prevention and Emergency Response, the affected geographic areas are the Caribbean Slope and the Northern Zone of Costa Rica.

Artículo 1 — —The situation caused by intense rains and floods on the Caribbean Slope and the Northern Zone of Costa Rica is declared a state of emergency.

Artículo 2 — —For the corresponding effects, the three response phases of a state of emergency are included within this emergency declaration, in accordance with the terms and scope set forth by the National Emergency Law, in its Article 6, namely:

Artículo 6 — —The National Commission for Risk Prevention and Emergency Response is authorized, while this state of emergency declaration is in effect, to carry out all contracts for goods and services necessary in accordance with the applicable exceptional regulations.

Artículo 7 — —The National Commission for Risk Prevention and Emergency Response is authorized, in responding to this state of emergency, to use uncommitted remaining funds from previous declarations that are still in effect, provided that current works or projects are not affected thereby.

Artículo 10 — —It takes effect as of December 11, 2001.

Artículo 1 — Que desde el día 11 de diciembre del año 2001, se ha presentado un evento de tipo hidrometeorológico, causante de lluvias intensas e inundaciones a lo largo de la Vertiente Caribe y Zona Norte, asociadas a un sistema de Baja Presión.

Artículo 3 — Que de conformidad con los informes de evolución emitidos por el Instituto Meteorológico Nacional y por la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, las áreas geográficas afectadas son la Vertiente Caribe y la Zona Norte de Costa Rica.

Artículo 1 — —Se declara estado de emergencia la situación provocada por las lluvias intensas e inundaciones en la Vertiente Caribe y la Zona Norte de Costa Rica.

Artículo 2 — —Para los efectos correspondientes, están comprendidas dentro de la presente declaratoria de emergencia las tres fases de atención de un estado de emergencia, de conformidad con los términos y alcances perceptuados por la Ley Nacional de Emergencia, en su artículo 6º, a saber:
