in the entirety of the text - Complete Text of Regulation 30059 Declares a State of Emergency the situation caused by intense rains and floods on the Caribbean Slope and Northern Zone of Costa Rica Complete Text of record: D46C8 Nº 30059-MP Nº 30059-MP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE PRESIDENCY (This decree was repealed by Article 1 of Executive Decree N° 36240 of September 14, 2010) In exercise of the powers conferred in Articles 140, subsections 3) and 18) and 180 of the Political Constitution; based on Articles 1, 3, 5, 13, 23, 25, 35, 37, 39, 42 and 44 of the National Emergency Law, Law Nº 7914 of September 28, 1999, and the General Law of Public Administration, Law Nº 6227 of May 2, 1978.
1.—That since December 11, 2001, a hydrometeorological-type event has occurred, causing intense rains and floods along the Caribbean Slope and Northern Zone, associated with a Low Pressure system.
2.—That the indirect effects of this natural phenomenon have caused abundant rains, which in turn cause a strong increase in the flow of rivers and high soil saturation, provoking landslides and floods that result in serious damage to property and persons, affecting infrastructure, communications, agriculture, among others.
3.—That in accordance with the progress reports issued by the National Meteorological Institute and by the National Commission for Risk Prevention and Emergency Response, the affected geographic areas are the Caribbean Slope and the Northern Zone of Costa Rica.
4.—That by reason of the foregoing, the enactment of a legal framework is necessary to take the exceptional measures indicated by the National Emergency Law, to confront the effects caused by the aforementioned hydrometeorological phenomenon, and thus mitigate the consequences caused by its impact on the Caribbean Slope and the Northern Zone of Costa Rica. Therefore, They Decree:
Considering:
The contributions, donations, and contributions shall enter the National Emergency Fund, in accordance with the procedures stipulated in Articles 35, 37, and 39 of the National Emergency Law. Assets shall be managed in accordance with what is indicated in Article 44 of said law.
The emergency appointment of officials shall be subject to what is provided in the final paragraph of Article 19 of the National Emergency Law.

Los aportes, donaciones y contribuciones ingresarán al Fondo Nacional de Emergencias, conforme a los procedimientos que se estipulan en los artículos 35, 37 y 39 de la Ley Nacional de Emergencia. Los bienes se manejarán de conformidad con lo indicado en el artículo 44 de dicha ley.
El nombramiento de emergencia de funcionarios estará sujeto a lo que se dispone en el párrafo final del artículo 19 de la Ley Nacional de Emergencia.
