in the entirety of the text - Complete Text of Norm 30051 Prohibits the manufacture, import, transit, registration, commercialization, and use of raw material or finished product containing POLYBROMINATED BIPHENYLS Complete Text acta: 46F21 Nº 30051-S Nº 30051-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF HEALTH In use of the powers conferred upon them by Article 140, subsections 3) and 18) of the Political Constitution and in accordance with Articles 1, 2, 239, 241, 252, 262, 263, and 345, subsection 7) of Law No. 5395 of October 30, 1973, General Health Law (Ley General de Salud); and Article 2 of Law No. 5412 of November 5, 1973, Organic Law of the Ministry of Health (Ley Orgánica del Ministerio de Salud).

1. 1That it is the function of the Ministry of Health to ensure Human Health and Environmental Protection.
2. 2That Polybrominated Biphenyls (PBBs) in mixtures or in technical grade (more than 90 percent purity) show unusual chemical stability and resistance to decomposition by acids, bases, heat, and reducing, oxidizing, and biological agents, becoming highly polluting and persistent substances in the environment. They are poorly metabolized and accumulate in tissues and organs of organisms, including humans.
3. 3That these substances can enter the organism via the digestive, dermal, and inhalation routes. PBBs are rapidly and efficiently absorbed by mammals, and reach their highest equilibrium concentration in adipose tissue. Many of the adverse effects are observed after prolonged exposure, due to their marked tendency to bioaccumulate and the limited capacity of the organism to metabolize and eliminate them, causing compensation mechanisms to be overwhelmed with subsequent toxicity by deposit.
4. 4That studies in rats, mice, and rhesus monkeys have shown effects on the liver such as hepatocellular alterations, carcinomas, and adenofibrosis, in addition to effects on the thyroid, hormonal imbalances, immunological dysfunction, and profound alterations in vitamin A homeostasis. PBBs are classified by different international organizations such as the International Agency for Research on Cancer of the WHO and the National Toxicology Program of the United States, within group B2 (probable human carcinogen).
5. 5That PBBs are embryotoxic and have caused abortions, embryo resorption, malformations, high neonatal mortality, and low litter viability in rats, mice, cattle, and rhesus monkeys exposed to them.
6. 6That epidemiological studies carried out by the Michigan Department of Public Health and the Environmental Sciences Laboratory of the Mount Sinai School of Medicine in New York, both of the United States, following the 1973 technological incident in Michigan, have shown that persons exposed to PBBs exhibited a high incidence of harmful effects on the skin, neurological, neuroskeletal effects, hypothyroidism, and chronic Type A hepatic porphyria.
7. 7That the industrial use of products containing mixtures or generics of PBBs used as fire retardants in polymeric materials, with self-extinguishing properties and improvement in durability; in the synthesis of biphenyl esters; in the synthesis of light-sensitive compounds to act as color activators; as agents for relative molecular mass control; as voltage stabilizing agents in electrical insulation; as functional fluids; as dielectric media; in the manufacture of plastics, coatings, and lacquers, and in the textile industry in the manufacture of garments and others, leads to high exposures for prolonged periods for occupationally involved persons and the general public, putting health at unacceptable risk, particularly of children, the elderly, pregnant women, and persons with precarious health.
8. 8That these substances are persistent pollutants of air, water, soil, sediments, and are capable of penetrating food chains where they accumulate and biomagnify their availability until reaching humans.
9. 9That PBBs are subject to trade regulations between importing and exporting countries through the Rotterdam Convention of the joint Secretariat of the World Food and Agriculture Organization and the United Nations World Environment Organization; and subject to regulations as a persistent organic pollutant through the Stockholm Convention of the UNEP Secretariat.

10.-That polybrominated biphenyls (their mixtures and generics) have been banned in several countries such as Canada, Cyprus, Switzerland, Samoa, Malaysia; and severely restricted in countries such as the United States, Japan, the European Community, China, Cuba, India. Therefore,

1. 1Que es función del Ministerio de Salud velar por la Salud Humana y la Protección del Ambiente.
2. 2Que los Bifenilos polibromurados (PBBs) en mezclas o en grado técnico (más del 90 por ciento de pureza) muestran una inusual estabilidad química y resistencia a la descomposición por ácidos, bases, calor y agentes reductores, oxidantes y biológicos, constituyéndose en sustancias altamente contaminantes y persistentes en el ambiente. Son pobremente metabolizadas y se acumulan en tejidos y órganos de los organismos, incluyendo al hombre.
3. 3Que estas sustancias pueden ingresar al organismo por vía digestiva, dérmica e inhalatoria. Los PBBs son rápida y eficientemente absorbidos por los mamíferos, y alcanzan su mayor concentración en equilibrio en el tejido adiposo. Muchos de los efectos adversos se observan después de una

organismo a metabolizarlos y eliminarlos, logrando que los mecanismos de compensación se vean desbordados con la subsecuente toxicidad por depósito.

1. 4Que estudios en ratas, ratones y monos rhesus han mostrado efectos al hígado tales como alteraciones hepatocelulares, carcinomas y adenofíbrosis, además de efectos en tiroides, desbalances hormonales, disfunción inmunológica, y profundas alteraciones en la homeostasis de la vitamina A. Los PBBs son clasificados por diferentes organizaciones internacionales tales como la Agencia Internacional de Investigación de Cáncer de la OMS, el Programa Nacional de Toxicología de los Estados Unidos, dentro del grupo B2 (probable carcinógeno humano).
2. 5Que los PBBs son embriotóxicos y han causado abortos, reabsorción de embriones, malformaciones, alta mortalidad de neonatos y baja viabilidad de las carnadas en ratas, ratones, ganado vacuno y monos rhesus expuestos a ellos.
3. 6Que estudios epidemiológicos llevados a cabo por el Departamento de Salud Pública de Michigan y el Laboratorio de Ciencias del Medio Ambiente de la Facultad de Medicina Mount Sinaí de Nueva York, ambos de los Estados Unidos, a raíz del incidente tecnológico del 1973 en Michigan, han mostrado que personas expuestas a PBBs mostraron alta incidencia en efectos nocivos de piel, neurológicos, neuroesqueléticos, hipotiroidismo y porfiria hepática Tipo A crónica.
4. 7Que el uso industrial de productos conteniendo mezclas o genéricos de PBBs utilizados como retardantes de fuego en materiales poliméricos, con propiedades auto extinguibles y mejoramiento en la durabilidad; en la síntesis de ésteres bifenilos, en la síntesis de compuestos sensibles a la luz para actuar como activadores de colores; como agentes del control relativo a masa molecular; como agentes estabilizadores de voltaje en aislamiento eléctrico; como fluidos funcionales; como medios dieléctricos; en la fabricación de plásticos, capas envolventes y lacas, y en la industria textil en la manufactura de prendas de vestir y otros, conduce a elevadas exposiciones por tiempos prolongados de las personas ocupacionalmente involucradas y de público en general, poniendo en riesgo inaceptable la salud, particularmente de niños, ancianos, mujeres embarazadas y personas de salud precaria.
5. 8Que estas sustancias son contaminantes persistentes de aire, agua, suelo, sedimentos y son capaces de penetrar las cadenas alimenticias donde se acumulan y biomagnifican su disponibilidad hasta llegar al hombre.
6. 9Que los PBBs están sujetos a regulaciones de comercio entre países importadores y exportadores por medio del Convenio de Rotterdam de la Secretaría conjunta de la Organización Mundial para la Agricultura y la Alimentación y la Organización Mundial del Medio Ambiente de Naciones Unidas; y sujetos a regulaciones como contaminante orgánico persistente por medio del Convenio de Estocolmo de la Secretaría del PNUMA.

10.-Que los bifenilos polibromurados (sus mezclas y genéricos) han sido prohibidos en varios países tales como Canadá, Chipre, Suiza, Samoa, Malasia; y severamente restringido en países como los Estados Unidos, Japón, la Comunidad Europea, China, Cuba, India. Por tanto,
