No. 30050-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF HEALTH In exercise of the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution and in accordance with Articles 1, 2, 239, 241, 252, 262, 263, and 345, subsection 7) of Law No. 5395 of October 30, 1973, General Health Law ("Ley General de Salud"); and Article 2 of Law No. 5412 of November 5, 1973, Organic Law of the Ministry of Health ("Ley Orgánica del Ministerio de Salud").
1.—That it is the function of the Ministry of Health to safeguard Human Health and the Protection of the Environment.
2.—That Polychlorinated biphenyls (PCBs), in mixtures or as generics, display unusual chemical stability and resistance to decomposition by acids, bases, heat, and reducing, oxidizing, and biological agents, thereby becoming highly polluting and persistent substances in the environment.
3.—That these substances can enter the body via the digestive, dermal, and inhalation routes. PCBs are rapidly and efficiently absorbed by mammals, and reach their highest equilibrium concentration in adipose tissue. Many of the adverse effects are observed after prolonged exposure, due to their marked tendency to bioaccumulate and the body's limited capacity to metabolize and eliminate them, causing compensation mechanisms to become overwhelmed with subsequent deposit toxicity.
4.—That rats, mice, and rhesus monkeys exposed to PCBs have shown hepatocellular alterations, carcinomas, and adenofibrosis in the liver, in addition to effects on the thyroid, hematopoietic system, hormonal imbalances, and immunological dysfunction. PCBs are classified by various international organizations such as the WHO International Agency for Research on Cancer, the National Toxicology Program, and the United States Environmental Protection Agency, within group B2 (probable human carcinogen).
5.—That PCBs have been shown to cause breakage of a DNA strand and Unscheduled DNA Synthesis causing mutagenesis and acting as promoters and initiators of carcinogenic events.
6.—That epidemiological studies in exposed workers showed an association between high exposure to PCBs and the appearance of alterations in liver enzymes, hepatomegaly, and dermatological abnormalities. Epidemiological studies carried out at Kyushu University Hospital, Fukuoka, Japan on persons exposed by consuming contaminated rice oil and in a similar accident in Taiwan, have shown that persons exposed to PCBs showed a high incidence of harmful skin effects, neurological and neuro-skeletal effects.
7.—That the industrial use of products containing mixtures or generics of PCBs used as dielectrics in transformers and large capacitors; in heat transfer systems and hydraulic systems; in the formulation of lubricating and cutting oils and in waxes; as plasticizers in paints, and in solvents/carriers in carbonless copy paper inks, adhesives, seals and sealing waxes, fire retardants, and plastics, leads to high exposures for prolonged periods for occupationally involved persons and the general public, posing an unacceptable risk to the health of exposed persons.
8.—That these substances are persistent pollutants of air, water, soil, sediments, and are capable of penetrating food chains where they accumulate and biomagnify their availability until reaching humans.
9.—That PCBs are subject to trade regulations between importing and exporting countries through the Rotterdam Convention of the joint Secretariat of the Food and Agriculture Organization (FAO) and the United Nations Environment Programme (UNEP); and subject to regulations as a persistent organic pollutant through the Stockholm Convention of the UNEP secretariat.
10.—That polychlorinated biphenyls (their mixtures and generics), due to their evident effects on human health and the environment, have been prohibited and severely restricted in several countries such as Austria, the European Union, Finland, the Netherlands, Switzerland, Sweden, the United Kingdom, the United States, New Zealand, Albania, Cyprus, Cuba, Algeria, Japan.
