• a)Sale of crafts: the sale of crafts shall be understood as the artisanal manufacture and national fabrication of souvenirs, with greater emphasis on Caribbean motifs.

The sale of finished articles of industrial manufacture shall not be permitted; in case of doubt, the permit holder (permisionario) must demonstrate that the finished goods are part of their own artisanal work.

No sale of food or drinks by the artisans shall be permitted, nor shall the sale of crafts by employees of JAPDEVA be permitted.

• b)Sale of tourist services and transportation: For the sale of tourist services (buses and minibuses) and public transport (taxis), the vehicle must be in a perfect state of operation and upkeep, and priority shall be given to authorized transportation service for the province of Limón, complying with the regulations established for this purpose by the Ministry of Public Works and Transport (MOPT) and the Costa Rican Tourism Institute (ICT).
• c)Tourist Service Buses: These must have the following: air conditioning in good condition, bilingual guides, up-to-date insurance with coverage for the vehicle and passengers, a minimum capacity of 15 persons and a maximum of fifty passengers; permit holders (permisionarios) must have proven experience in handling tourists.
• d)Transportation (Taxis): These must be recent models, in accordance with the Traffic Law, and have all up-to-date insurance, doors marked with the yellow triangle, and the entire vehicle must be in good condition.

A. Sale of crafts: The sale of crafts shall only be permitted in the area specifically designated by JAPDEVA for that purpose.

B. Sale of transportation services: The sale of services must be offered through the installation of a stand, where clients may request the service, which shall be located in the area specifically designated by JAPDEVA.

The rates shall be uniform and must be placed in a visible location for passengers, inside the vehicle and at the sales stand.

C. Sale of tourist services: The sale of tourist services shall be that offered by Tour Operators that have established contracts with the Cruise Lines.

By local entrepreneurs who enter the port and through the installation of a stand, where clients may request the service. The rates shall be uniform and must be placed in a visible location for passengers at the stand, and they must comply with the Traffic Law regulations for this type of service mode.

All offerors of transportation services and tourist services must remain outside the port area until: a) their service is requested by the client; b) according to the sold tour program, it is their turn to enter; c) when they return to drop off the tourist to board the ship. Afterwards, they must return to form the line again.

D. Number of permit holders (permisionarios): the number of permit holders (permisionarios) for the sale of crafts, public transportation, and tourist services shall be defined by the JAPDEVA Tourism Section in coordination with the Superintendencies of the port terminals, in accordance with the needs of service provision within the port area.

In any case, said permits must be renewed for the next season, by submitting the documents cited in Article 7, one month before the start of the corresponding season.

Within its functions, the Tourism Section shall analyze and recommend to the JAPDEVA Port Management the granting of use permits for facilities for the temporary sale of crafts, tourist services, and tourist transportation, for approval by the Board of Directors (Art. 17 of the Organic Law of JAPDEVA).

1. Submit a written request indicating the type of permit requested and a description of the conditions under which the service will be offered, with a copy.

2. Attach a copy of the identity card for a natural person or the legal entity identification card, as the case may be.

3. Certify that, during their performance, they will have all the necessary conditions to offer a quality service, as requested by the JAPDEVA Tourism Section.

4. Certify that, for the sale of their services, they will have a stand with the following characteristics: dimensions of 150 x 122, properly painted blue, blue canvas, height of 2.20 m; in the case of using an apron, it must be blue, for the case of the artisans.

5. All vehicles must display on the front part the temporary authorization permit plate issued by JAPDEVA, through the Superintendency of Limón.

6. Certify that during their performance they will have trash cans with plastic bags available for the public, for the case of the artisans.

7. Certify that they have, during their performance, the appropriate packaging prepared for the merchandise sold, if required or at the tourist's request.

8. Once the permit is granted, they must submit a statement by means of an affidavit stating that they accept all the terms requested by the Tourism Section for the Granting of the Use Permit for Port Facilities:

• a)That they submit to the guidelines issued by the Tourism Section, the Port Management, and JAPDEVA regulations.
• b)That they commit to behaving decorously and treating tourists and members of other groups working at the port with respect and understanding.
• c)That all the information stated in the application is true.
• d)That the permit holders (permisionarios) shall be uniformed within the port facilities, and will maintain good conduct.
• e)Provide a detailed list of the associates or natural persons who will effectively offer the service on the pier.
• f)Provide the information on the tours they will offer and the exact times they are scheduled to depart.

9. Always carry in a visible place the ID card of their group or company or another one granted by JAPDEVA.

10. Applications must be submitted to the JAPDEVA Tourism Section of the Marketing Department, which in turn will analyze them and process them for approval.

11. Pay the fee (canon) for the use of the facilities, in the case of the Artisans. Said fee (canon) must be paid according to the terms established by JAPDEVA, and its amount shall be established according to the rates approved by JAPDEVA and ARESEP (La Gaceta No. 93 of 5-16-2001 and No. 64 of 3-30-2001), for the use of port areas, which is subject to modifications.)

12. No natural person or legal entity that has a pending account with JAPDEVA for non-payment of the fee (canon) or other service that JAPDEVA has provided may apply for a use permit for the facilities.

13. No natural person or legal entity that was awarded a space in the previous season and abandoned the space without any justification may apply for a new space in this season.

14. The permit shall be valid only for the Cruise Season of the respective period.

15. Once the permits are granted, the permit holders (permisionarios) for the sale of crafts must have a Workers' Compensation Insurance policy, for both the offeror and the personnel working in the provision of services.

16. The permit holders (permisionarios) for the sale of crafts shall have 8 business days to analyze, complete, and return the permit application. After this period, no application will be received.

17. JAPDEVA shall assume no civil liability or any other type of liability for accidents or other situations that arise due to the provision of these services and sale of crafts in the Port Terminals.

18. JAPDEVA shall also assume no liability whatsoever for any irregularity and non-compliance that may occur in the arrival and docking of cruises.

19. In the event of non-compliance with the aforementioned and if any anomaly occurs on the part of the organizations or natural persons, JAPDEVA may unilaterally revoke the granted permits, without liability to the Administration.

1. Indicate which of the members of the group will be dedicated to the sale or manufacture and sale of crafts at the ports.

2. Clearly indicate the type of crafts they manufacture and sell to the tourist. The Port Authority shall require that every provider of the transportation service comply with:

1. Certify the insurance policies with civil liability coverage that protect the passengers and cover damages to third parties.

2. Date on which it is submitted, full name of the group, exact address, telephone, and fax; the data of each and every one of the members who will be providing the service must be recorded, the vehicle license plate number, the model, year, general characteristics of the condition of each vehicle, a certified copy of the registration card as well as the property title to demonstrate that the vehicle is in the name of the requesting person or organization.

3. Each Person or Organization must ensure that their vehicles comply with the provisions established by the Ministry of Public Works and Transport (MOPT), in Decrees 15203 and 20141 "Regulations for the La Gaceta No. 38 of February 22, 1984, and La Gaceta No. 13 of January 18, 1991, respectively, as well as the regulations established by the Costa Rican Tourism Institute (ICT) for the tourist transport service.

The applicant must expressly state in writing their acceptance of submitting to the regime established in these Regulations.

The applications must be submitted to the JAPDEVA Tourism Section, which shall analyze them and issue a recommendation for approval by the Board of Directors.

Said fee (canon) must be paid at the time the stall is assigned, and its amount is established according to the rates approved by JAPDEVA and ARESEP (La Gaceta No. 93 of 5-16-2000 and No. 64 of 3-30-2001), for the use of port areas, which is subject to modifications.

• a)That they will submit to the guidelines issued by the Tourism Section, the Port Management, and the regulations in force.
• b)That they commit to behaving decorously and treating tourists and members of other groups working at the port with respect and understanding.
• c)That all the information provided in the application is true.
• d)That the permit holders (permisionarios) shall be uniformed within the port facilities and will maintain good conduct.
• e)A detailed list of the associates or natural persons who will effectively offer the service on the pier.

1. For the sale of crafts:

• a)Duly authorized artisans must certify that, for the sale of their services, they will have a stand with the following characteristics: dimensions of 150 x 122, properly painted blue, blue canvas, height of 2.20 m; in the case of using an apron, it must be blue.
• b)Its transport to and from the port facilities shall be at the expense and risk of the permit holder (permisionario).

2. For the sale of tourist services and transportation:

• a)The service sales stand must have a counter and chairs to attend to tourists. The roof must be made of canvas and properly installed on the furniture.
• b)Its transport to and from the facilities shall be at the expense and risk of the permit holder (permisionario).
• c)Only the personnel designated for the sale of the service may remain in the stand, which must be duly trained and identified.

The applications shall be analyzed by the JAPDEVA Tourism Section, which shall issue a recommendation for the permits to the Port Management and subsequent approval by the Board of Directors.

In writing, the Tourism Section shall communicate the result of the procedures to each of the permit applicants, within a period of eight (8) days following its granting.

The authorization ends normally under the conditions of Article 4 of these regulations.

The permit may be revoked, without liability to the administration, in the event that the permit holder (permisionario) fails to comply with the obligations established in these regulations; said procedure shall be initiated by the Tourism Section, which shall then elevate it to the Board of Directors for the revocation of the permit.

• a)The sale of food or drinks by the artisans or allowing the sale of crafts to JAPDEVA employees.
• b)Entry to the port premises with minors during the operation is not permitted. It is strictly prohibited, without exception, for a minor to work at the sales stall within the port premises.
• c)Consuming food at the workplace during the operation is strictly prohibited, without exception.
• d)The sale of crafts outside the area specifically designated by the Cruise Commission for that purpose.
• e)Recording false or altered data in the permit application that distort reality.
• f)Not paying the fee (canon) for the use of facilities or the falsification of the respective receipts.
• g)Recording false data in the affidavit.
• h)Behaving indecorously, mistreating, or disrespecting tourists and members of other groups; likewise, the use of incorrect vocabulary is prohibited.
• i)Appearing at the port facilities dressed inappropriately, without their respective uniform.
• j)Providing the service with a stand different from those authorized and specified in these regulations.
• k)In the case of taxis, buses, and minibuses, failing to comply with the standards established by the MOPT and the ICT for the remunerated transport of persons.
• l)Assigning the provision of services to third parties without prior authorization from JAPDEVA.
• m)Providing tourist transport services directly, within the port facilities, both for private individuals and in the case of being a JAPDEVA employee.

Against the recommendation issued by the Tourism Section, only an appeal shall be admissible before the Board of Directors, duly justified in writing, within a period not exceeding three days, counted from the day following the notification.

No artisan or group whose permit has been cancelled shall be allowed entry to the facilities with merchandise, nor may they go beyond the administrative area of the port.

Nor shall it assume any liability whatsoever for any irregularity and non-compliance that may occur in the arrival and docking of cruises.

Portuario de Limón.

• a)Venta de artesanía: deberá entenderse como la venta de artesanía la manufactura artesanal y fabricación nacional de souvenirs, con mayor énfasis en motivos caribeños.

No se permitirá la venta de artículos terminados que sean de fabricación industrial; en caso de duda, el permisionario deberá demostrar que los bienes terminados son parte de un trabajo artesanal propio.

No se permitirá ninguna venta de comidas o bebidas por parte de los artesanos, ni se permitirá la venta de artesanía por parte de empleados de JAPDEVA.

• b)Venta de servicios turísticos y de transportes: para la venta de servicios turísticos (buses y busetas) y transporte público (taxis) el vehículo deberá estar en perfecto estado de funcionamiento y conservación y se le dará prioridad al servicio de transporte autorizado para la provincia de Limón, debiendo cumplir con las regulaciones establecidas al efecto por el Ministerio de Obras Públicas y Transportes (MOPT) y el Instituto Costarricense de Turismo (ICT).
• c)Buses para Servicio Turístico: estos deben contar con lo siguiente: aire acondicionado en buen estado, guías bilingües, seguros al día con cobertura para el vehículo y pasajeros, capacidad mínima de 15 personas y máxima de cincuenta pasajeros, los permisionarios deberán contar con experiencia comprobada en el manejo de turistas.
• d)Transporte (Taxis): deberán ser modelos recientes, conforme a la Ley de Tránsito y contar con todos los seguros al día, puertas rotuladas con el triángulo amarillo, y todo el vehículo debe estar en buenas condiciones.

A. Venta de artesanía: sólo estará permitida la venta de artesanía en el área especialmente designada por JAPDEVA para ese fin.

B. Venta de servicios de transporte: la venta de servicios deberá ofrecerse mediante la instalación de un stand, donde los clientes podrán solicitar el servicio, el cual será ubicado en el área especialmente designado por JAPDEVA.

Las tarifas serán uniformes, deberán ser colocadas en un lugar visible para los pasajeros, dentro del vehículo y en el stand de ventas.

C. Venta de servicios turísticos: la venta de servicios turísticos será el ofrecido por los Tours Operadores que tienen contratos establecidos con las Líneas de Cruceros.

Por los empresarios locales que ingresan al puerto y mediante la instalación de un stand, donde los clientes pueden solicitar el servicio. Las tarifas serán uniformes y deberán ser colocados en lugar visible para los pasajeros en el stand, y que cumplan las regulaciones de la Ley de Tránsito para este tipo de modalidad de servicio.

Todos los oferentes de servicios de transporte y servicios turísticos deberán permanecer fuera del área portuaria hasta que: a) su servicio sea solicitado por el cliente; b) según programa de tours vendidos les corresponda ingresar; c) cuando regresa a dejar al turista para que aborde el barco. Luego de regresar a formar fila de nuevo.

D. Número de permisionarios: el número de permisionarios para la venta de artesanía, transporte público y de servicios turísticos serán definidos por la Sección de Turismo de JAPDEVA en coordinación con las Superintendencias de las terminales portuarias, de acuerdo con las necesidades de prestación de los servicios dentro del área portuaria.

En todo caso, dichos permisos deberán ser renovados para la próxima temporada, mediante la presentación de los documentos citados en el artículo 7°, un mes antes del inicio de la temporada correspondiente.

Dentro de sus funciones, la Sección de Turismo analizará y recomendará a la Gerencia Portuaria de JAPDEVA, el otorgamiento de los permisos de uso de las instalaciones para la venta temporal de artesanía servicios turísticos y transporte de turistas, para la aprobación por parte del Consejo de Administración (art. 17 de la Ley Orgánica de JAPDEVA).

1. Presentar una solicitud por escrito indicando la modalidad del permiso solicitado y descripción de las condiciones en que se ofrecerá el servicio, con copia.

2. Adjuntar copia de la cédula de identidad persona física o cédula jurídica, según sea el caso.

3. Acreditar que contará, durante su desempeño, con todas las condiciones necesarias para ofrecer un servicio de calidad, según lo solicite la Sección de Turismo de JAPDEVA.

4. Acreditar que contará para la venta de sus servicios con un stand con las siguientes características: medidas de 150 x 122, debidamente pintados en azul, lona azul, altura de 2.20 m, en el caso de usar delantal el mismo debe ser azul, para el caso de los artesanos.

5. Todos los vehículos deben portar en la parte delantera la placa de permiso temporal de autorización entregado por JAPDEVA, a través de la Superintendencia de Limón.

6. Acreditar que durante el desempeño contarán con basureros con bolsas plásticas disponibles para el público, para el caso de los artesanos.

7. Acreditar que se tiene preparado durante el desempeño los empaques adecuados para la mercancía vendida, si ésta lo requiere o/a solicitud del turista.

8. Una vez otorgado el permiso deberán presentar manifestación por medio de declaración jurada que aceptan todos los términos solicitados por la Sección de Turismo para el Otorgamiento de Permiso de uso de las Instalaciones Portuarias:

• a)Que se somete(n) a los lineamientos que emane la Sección de Turismo, la Gerencia Portuaria y reglamentación de JAPDEVA.
• b)Que se compromete(n) a comportarse en forma decorosa y tratar con respeto y comprensión a los turistas y a los miembros de las demás agrupaciones que laboren en el puerto.
• c)Que toda la información que manifiestan en la solicitud es verdadera.
• d)Que los permisionarios estarán uniformados dentro de las instalaciones del puerto, y mantendrán una buena conducta.
• e)Suministrar lista detallada de los asociados o personas físicas que efectivamente ofrecerá el servicio en el muelle.
• f)Suministra la información de los tours que van a ofrecer y las horas exactas en que están programados para salir.

9. Portar siempre en un lugar visible el carné de su grupo o empresa u otra que le otorgue JAPDEVA.

10. Las solicitudes deberán ser presentadas ante la Sección de Turismo de JAPDEVA del Departamento de Mercadeo, que a su vez las analizará y dará tramite para la aprobación.

11. Cancelar el canon por uso de las instalaciones, en el caso de los Artesanos. Dicho canon deberá pagarse conforme a los términos que establezca JAPDEVA y su monto será establecido conforme a las tarifas aprobadas por JAPDEVA y laARESEP (La Gaceta No 93 del 16-5-2001 y No 64 del 30-3-2001), para uso de áreas portuarias, el cuál esta sujeto a modificaciones.)

12. Ninguna persona física y jurídica que tenga cuenta pendiente con JAPDEVA por no pagar el canon u otro servicio que JAPDEVA le haya brindado podrá optar por permiso de uso de las instalaciones.

13. Ninguna persona física o jurídica que ha sido adjudicado (a) con un espacio en la temporada anterior y haya abandonado el espacio sin justificación alguna, puede optar por un nuevo espacio en esta temporada.

14. El permiso regirá únicamente para la Temporada de Cruceros del período respectivo.

15. Una vez otorgados los permisos, los permisionarios de venta de artesanía deberán contar con una póliza de Riesgos del Trabajo, tanto para el oferente como el personal que tenga laborando en la prestación de los servicios.

16. Los permisionarios de venta de artesanía, tendrán 8 días hábiles para analizar , llenar y devolver la solicitud de permiso. Después de este período no se recibirá ninguna solicitud.

17. JAPDEVA no asumirá ninguna responsabilidad civil ni de ningún otro tipo por accidentes u otras situaciones que se presenten con motivo de la prestación de estos servicios y venta de artesanía en las Terminales Portuarias.

18. JAPDEVA tampoco asumirá responsabilidad alguna por la irregularidad e incumplimiento que pueda producirse en el arribo y atraque de los cruceros.

19. En caso de que se incumpliera con lo antes mencionado y se diera alguna anomalía por parte de las organizaciones o personas físicas, JAPDEVA podrá revocar unilateralmente los permisos otorgados, sin responsabilidad para la Administración.

1. Indicar cuáles de los miembros de la agrupación se dedicarán a la venta o manufactura y venta de artesanía en los puertos.

2. Indicar claramente el tipo de artesanía que fabrica y vende al turista. La Autoridad Portuaria exigirá que todo prestatario del servicio de transporte cumpla con:

1. Acreditar las pólizas de seguros con la cobertura de responsabilidad civil que protejan a los pasajeros y cubran daños a terceros.

2. Fecha del día en que ésta se presenta, nombre completo de la agrupación, dirección exacta, teléfono y fax, debe consignarse los datos de todos y cada uno de los miembros que estarán prestando el servicio, el número de placa del vehículo, el modelo, año, características generales de la condición de cada vehículo, copia certificada de la tarjeta de circulación así como del título de propiedad para demostrar que el vehículo está a nombre de la persona u organización solicitante.

3. Cada Persona u Organización deberá asegurarse de que sus vehículos cumplan con lo establecido por el Ministerio de Obras Públicas y Transporte, en los Decretos 15203 y 20141 "Reglamento para la La Gaceta No 38 del 22 de febrero de 1984 y La Gaceta No 13 del 18 de enero de 1991, respectivamente, así como las normativas establecidas por el Instituto Costarricense de Turismo para el servicio de transporte a Turistas.

El solicitante deberá manifestar por escrito su aceptación expresa de someterse al régimen establecido en el presente Reglamento.

Las solicitudes deberán ser presentadas ante la Sección de Turismo de JAPDEVA, que las analizará y emitirá recomendación para la aprobación por parte del Consejo de Administración.

Dicho canon deberá pagarse al momento de ser asignado el puesto, y su monto es establecido conforme a las tarifas aprobadas por JAPDEVA y la ARESEP (La Gaceta No 93 del 16-5-2000 y No 64 del 30- 3-2001), para uso de áreas portuarias, el cuál esta sujeto a modificaciones.

• a)Que se someterá (n) a los lineamientos que emane la Sección de Turismo, la Gerencia Portuaria y la normativa vigente.
• b)Que se compromete (n) a comportarse en forma decorosa y tratar con respeto y comprensión a los turistas y a los miembros de las demás agrupaciones que laboren en el puerto.
• c)Que toda la información que se brinda en la solicitud es verdadera.
• d)Que los permisionarios estarán uniformados dentro de las instalaciones del puerto, y mantendrán una buena conducta.
• e)Lista detallada de los asociados o personas físicas que efectivamente ofrecerá el servicio en el muelle.

1. Para venta de artesanía:

• a)Los artesanos debidamente autorizados deberán acreditar que contará para la venta de sus servicios con un stand con las siguientes características: medidas de 150 x 122, debidamente pintados en azul, lona azul, altura de 2.20 m, en el caso de usar delantal el mismo debe ser azul.
• b)Su acarreo hasta las instalaciones portuarias, así como su salida corre por cuenta y riesgo del permisionario.

2. Para venta de servicios turísticos y transporte:

• a)El stand de venta de servicios debe tener un mostrador y sillas para atender a los turistas. El techo debe ser de lona y debidamente instalado en el mueble.
• b)Su acarreo hasta las instalaciones así como su salida corre por cuenta y riesgo del permisionario.
• c)En el stand deberá permanecer únicamente el personal designado para la venta del servicio, el cual debe estar debidamente capacitado e identificado.

Las solicitudes serán analizadas por la Sección de Turismo de JAPDEVA, que emitirá recomendación para los permisos a la Gerencia Portuaria y posterior aprobación del Consejo de Administración.

En forma escrita, la Sección de Turismo comunicará el resultado de los trámites a cada uno de los solicitantes del permiso, dentro del plazo de los ocho (8) días siguientes al otorgamiento del mismo.

La autorización termina en forma normal por las condiciones del artículo 4° de este reglamento.

El permiso podrá ser revocado, sin responsabilidad para la administración, en caso de que el permisionario incumpla las obligaciones establecidas en este reglamento, dicho procedimiento lo instruirá la Sección de Turismo; y que lo elevará al Consejo de Administración para la revocatoria del permiso.

• a)La venta de comidas o bebidas por parte de los artesanos o permitir la venta de artesanía a empleados de JAPDEVA.
• b)No se permite el ingreso al recinto portuario con personas menores de edad durante la operación. Es terminantemente prohibido, sin excepción, que un menor de edad trabaje el puesto de venta dentro del recinto portuario.
• c)Consumir alimentos en el puesto de trabajo durante la operación, es terminantemente prohibido sin excepción.
• d)La venta de artesanía fuera del área especialmente designada por la Comisión de Cruceros para tal efecto.
• e)Consignar en la solicitud de permiso datos falsos o alterados que distorsionen la realidad.
• f)No pagar el canon por uso de las instalaciones o la falsificación de los recibos respectivos.
• g)Consignar datos falsos en la declaración jurada.
• h)Comportarse en forma indecorosa, maltratar o irrespetar a los turistas y miembros de otros grupos; asimismo, se prohibe el uso del vocabulario incorrecto.

Presentarse en las instalaciones del puerto vestidos en forma inapropiada, sin su respectivo uniforme.

• j)Brindar el servicio con stand diferente a los autorizados y especificados en este reglamento.
• k)En el caso de los taxis, buses y busetas, incumplir las normas establecidas por el MOPT y por el ICT para el servicio remunerado de personas.
• l)Ceder a terceros la prestación de los servicios sin previa autorización de JAPDEVA.
• m)Prestar servicios de transporte turístico en forma directa, dentro de las instalaciones portuarias, tanto para particulares como en caso de ser funcionario de JAPDEVA.

Contra la recomendación que dicte la Sección de Turismo sólo cabrá el recurso de apelación ante el Consejo de Administración, debidamente justificada por escrito, en un plazo no mayor de tres días, contados a partir del día siguiente de la notificación.

No se le permitirá el ingreso a las instalaciones con mercadería ni podrán pasar del área administrativa del puerto, ningún artesano o grupo, a quien se le haya cancelado el permiso.

Tampoco asumirá responsabilidad alguna por la irregularidad e incumplimiento que pueda producirse en el arribo y atraque de los cruceros.
