Complete Text file: 42DD2 No. 29953-H No. 29953-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by subsections 3) and 18) of article 140 of the Political Constitution, articles 26 and 27 of the General Public Administration Law, Laws No. 7554 of October 4, 1995, No. 6084 of August 17, 1977, and Executive Decree No. 24652-MIRENEM of September 20, 1995.

1. 1That by constitutional mandate, the State is responsible for guaranteeing citizens the enjoyment of a healthy and ecologically balanced environment.
2. 2That the Organic Environmental Law No. 7554 establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental matters, and must therefore ensure the protection, conservation, and use of natural resources as an indispensable condition for sustainable economic development.
3. 3That the National Parks Fund is part of the National System of Conservation Areas, through which the protection, conservation, control, and promotion of these areas are carried out, and it requires the incorporation of additional resources to implement actions aimed at fulfilling its institutional mission.
4. 4That unavoidable operational obligations in the Conservation Areas must be met, making it necessary to incorporate additional resources into the National Parks Fund's budget for the payment of such expenditures.
5. 5That through Executive Decree No. 28639-H, published in La Gaceta No. 101 of May 26, 2000, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2001, which were made known to the Government Council and approved by the President of the Republic, establishing the budgetary spending and effective spending limits for the current year for the entities covered under the scope of said Collegiate Body.
6. 6That Executive Decree No. 29319-H, published in La Gaceta No. 41 of February 27, 2001, amends Decree No. 28639-H and establishes the budgetary and effective spending limit for the National Parks Fund for 2001.
7. 7That in view of the foregoing, it is necessary to amend the spending limits set for the National Parks Fund in the cited Decrees. Therefore,

Texto Completo acta: 42DD2 Nº 29953-H Nº 29953-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los incisos 3) y 18) del numeral 140 de la Constitución Política, los artículos 26 y 27 de la Ley General de la Administración Pública, las Leyes Nº 7554 del 4 de octubre de 1995, N° 6084 del 17 de agosto de 1977 y el Decreto Ejecutivo N° 24652-MIRENEM del veinte de setiembre de 1995.

1. 1Que por imperativo constitucional, le corresponde al Estado garantizar a los ciudadanos el disfrute de un ambiente sano y ecológicamente equilibrado.
2. 2Que la Ley Orgánica del Ambiente N° 7554, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia ambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos naturales como condición indispensable para el desarrollo económico sostenible.
3. 3Que el Fondo de Parques Nacionales forma parte del Sistema Nacional de Áreas de Conservación, mediante el cual se lleva a cabo la protección, conservación, control y fomento de las mismas y requiere incorporar recursos adicionales para implementar acciones con miras al cumplimiento de su misión institucional.
4. 4Que se deben atender obligaciones ineludibles de naturaleza operativa en las Áreas de Conservación, por lo que resulta necesario incorporar recursos adicionales en el presupuesto del Fondo de Parques Nacionales para el pago de dichas erogaciones.
5. 5Que mediante el Decreto Ejecutivo N° 28639-H, publicado en La Gaceta N° 101 del 26 de mayo del 2000, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2001, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo los límites de gasto presupuestario y de gasto efectivo del presente año, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
6. 6Que el Decreto Ejecutivo N° 29319-H, publicado en La Gaceta N° 41 del 27 de febrero del 2001, modifica el Decreto N° 28639-H y establece el límite de gasto presupuestario y efectivo del Fondo de Parques Nacionales para el 2001.
7. 7Que por lo anterior, resulta necesario modificar los límites de gasto fijados al Fondo de Parques Nacionales en los Decretos citados. Por tanto,
