No 29903-MP-MTSS THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF THE PRESIDENCY AND OF LABOR AND SOCIAL SECURITY Exercising the powers conferred by articles 140, subsections 3), 8) and 18) of the Political Constitution and 25, 26 and 27 of the General Law of Public Administration.
1.—That in accordance with the provisions of article 2, subsections e), f) and g) of the Organic Law of the Ministry of Labor and Social Security, number 1860 of April 21, 1955 and its amendments, it is the function of said Ministry to ensure that national policy in the field of social welfare has adequate regulation that guarantees effective assistance to Costa Ricans, their families, and the community.
2.—That through Executive Decree No. 18647-TSS, dated November 3, 1988, the work of the National Employment Directorate of the Ministry of Labor and Social Security was adapted, establishing it as the body responsible for carrying out the activities of the Executive Branch aimed at achieving the social welfare of the nation, through an adequate balance between the country's conjunctural socioeconomic and political situations.
3.—That by virtue of the decree mentioned in the preceding recital, the National Employment Directorate is a permanent technical body of the Ministry of Labor and Social Security, which has the authority to provide financial aid to individuals in the private sector who are unemployed and in a distressing situation.
4.—That through Law No. 7384 of May 16, 1994, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA), it is established as an attribution and competence of said Institute to protect and conserve the biological resources of the sea and of aquaculture, for the sake of guaranteeing to future generations the living resources of the sea.
5.—That, based on the foregoing, the Costa Rican Institute of Fisheries and Aquaculture, through agreement A1DP/142, dated May 14 of the current year, established a series of regulations applicable in the Gulf of Nicoya, which include: Prohibiting trawling vessels from operating during the period from June 1 to October 31, 2001, as well as prohibiting the shrimp trawling fleet from carrying out its activity during the entire year 2001, in the aforementioned zone.
6.—That a significant percentage of the population surrounding the Gulf of Nicoya has fishing as its main, and in some cases, its only economic and subsistence activity.
7.—That, as the results of the national census indicate, the province of Guanacaste is one of those with the highest level of unemployment in the country, in addition to being one of those with the lowest relative economic development.
8.—That for people whose primary work activity is fishing, the closed season ordered by INCOPESCA, indicated in the preceding recital four, implied and has had as direct and immediate consequences pressing economic hardships, which require State assistance, through aid mechanisms, to be mitigated at least temporarily.
9.—That, precisely for the purposes indicated in the preceding section, the final paragraph of article 73 of the Labor Code provides for the possibility of the Executive Branch to "... issue emergency measures that, without harming employer interests, result in the relief of the economic situation of the workers"; and the Budget of the Ministry of Labor and Social Security for the year 2001 includes line item number 605, "Aid to Workers," which includes expenditures intended to economically assist individuals from the private sector who are unemployed and in a distressing situation. Therefore, THEY DECREE:

For the above purposes, "fishing activity" is understood as any operation or action carried out with the object of capturing fish, shellfish (moluscos), crustaceans (crustáceos), and other species of aquatic fauna and flora, for commercial, industrial purposes, etc.

Para los efectos anteriores, se entiende como actividad pesquera toda operación o acción realizada con el objeto de aprehender peces, moluscos, crustáceos y otras especies de fauna y flora acuáticos, con fines comerciales, industriales, etc.
