No. 29835-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by subsections 3) and 18) of article 140 of the Political Constitution, articles 26 and 27 of the General Public Administration Act, Laws No. 7554 of October 4, 1995, No. 7174 of June 28, 1990, No. 7575 of April 16, 1996, Executive Decrees No. 24652-MIRENEM of September 20, 1995 and No. 25721-MINAE.
DECREES
Considering:
7554 and the Forest Law No. 7575, the Costa Rican State, through the Ministry of Environment and Energy (MINAE), is responsible for ensuring the conservation, protection and management of natural forests and for the production, use, industrialization and promotion of the country's forest resources destined for that purpose within the framework of adequate and sustainable use of natural resources.
7174 and 42 of Forest Law No. 7575, a general forest tax is established and its calculation and collection methodology are specified, which constitutes one of the sources of financing for the Forest Fund, according to the distribution of such revenues provided for in the cited laws.
7174 and No. 7575 was not properly determined, therefore, if there is no taxable base there is no obligation and consequently no tax, so the Costa Rican State is obliged to refund the revenues collected for the cited levy.
28639-H, published in La Gaceta No. 101 of May 26, 2000 and its amendments, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2001, which were made known to the Government Council and approved by the President of the Republic, establishing the budgetary expenditure and effective expenditure limits for the present year, as well as the budgetary current expenditure and effective current expenditure limits, for the entities covered by the scope of the aforementioned Collegiate Body.
