For the purposes of this regulation, the concepts set forth below have the following meaning.
- a)Regulatory Authority: Regulatory Authority for Public Services, also known as ARESEP.
- b)Canon Fee: A periodic pecuniary benefit levied on a governmental concession or an enjoyment within the public domain.
- c)Hydrocarbon Fuels: For the pertinent effects, the definition of hydrocarbon substances stipulated in the Regulation to the Hydrocarbons Law, published in La Gaceta of December 14, 1995, Executive Decree No. 24735-MINAE, and its amendments, governs.
- d)Grantor: Legal entity competent to grant concessions or permits for the provision of a public service regulated by the Law.
- e)Environmental Cost: Any impact on the environment that can be determined by the damage caused, or by the cost that must be incurred to avoid or repair it.
- f)Financial Equilibrium: Financial condition in which total revenues, both operating and capital, are equal to total costs.
- g)Ordinary Fixing of Prices, Tariffs, and Rates: That which is done in order to update prices, tariffs, and rates, so that they reflect the costs and investments of the industry in question.
- h)Extraordinary Fixing of Prices, Tariffs, and Rates: That which considers significant variations in the economic environment, due to fortuitous events or force majeure, and when the conditions of the automatic adjustment models for prices, tariffs, and rates are met. Fixings that must be made applying automatic adjustment models are not subject to the public hearing process.
- i)Environmental Impact Study: A technical study that allows for identifying and predicting the effects on the environment that an activity, work, or project will exert, quantifying and weighing them to lead to a ruling that approves or rejects the project, as well as recommendations to amend the faults committed. It shall include the specific effects, their global evaluation, the alternatives of greatest environmental benefit, a control and minimization program for negative effects, and a monitoring program.
- j)Industry: A productive enterprise that acquires inputs and services (intermediate and primary) to carry out a transformative operation, generating new products or services.
- k)Board of Directors: Board of Directors of ARESEP.
- l)Law: Law of the Regulatory Authority for Public Services, Law No. 7593 and its amendments.
- m)General Law: General Law of the Public Administration, Law No. 6227 and its amendments.
- n)Medium Enterprise: That defined by the Ministry of Economy, Industry, and Commerce.
- o)Small Enterprise: That defined by the Ministry of Economy, Industry, and Commerce.
- p)National Development Plan: Document containing the country's short, medium, and long-term strategies for the Government as a whole, according to the National Planning Law, and Article 5 of Executive Decree No. 5525-PLAN, and its amendments.
- q)Price: Sum of money given or received in exchange for a good or a service.
- r)Provider: A subject of public law or private law, authorized to provide the public services regulated in the Law.
- s)Tariff: A list or catalog of prices to be paid for the provision of a service.
- t)Rate: A compulsory payment to the State for a specific service, whether used or not.
