Creation of the Executive Office for the Physical Infrastructure Investment Plan of MINAECreación de la Oficina Ejecutora del Plan de Inversiones en Infraestructura Física del MINAE

Said Advisory Office shall report directly to the (*)National System of Conservation Areas and shall be governed by the provisions issued by the latter in matters of investment in physical infrastructure.

• a)To directly manage, in accordance with the policies established by the Ministerial Office, the development, expansion, remodeling, and general conditioning of the physical plant of the Ministry of Environment and Energy in any of its projects, properties, and conservation areas.
• b)To provide technical advice to the Ministerial Office or to whomever it designates, in matters within its competence.
• c)To oversee the development of physical infrastructure carried out through international cooperation projects.

• d)To work in coordination with the Offices and Directorates of the Ministry responsible for other aspects necessary for the execution of the projects.
• e)To propose to the Ministerial Office, in coordination with the Planning Office and any other pertinent office, appropriate plans and policies for the harmonious and rational development of the Ministry's physical plant.
• f)To conduct the necessary studies that serve as a guide for the design of the physical plant in general and of the buildings in particular, as well as their expansions and remodels, that are constructed with own funds, international loans, national loans, through non-governmental organizations, and donations.
• g)To prepare the technical documents necessary to carry out the contracting procedures for preliminary studies, site plans, preliminary project plans, and construction plans for the Ministry's physical plant projects.

• h)To monitor the timelines and priorities established in the development of the Ministry's physical infrastructure.

• i)To monitor the progress of projects and ensure compliance with the corresponding technical specifications, general standards, and other contractual documents established for the development of the Ministry's physical infrastructure.

• j)To coordinate with the entity in charge of the financial administration of resources the management of funds destined for the Ministry's major works.
• k)To coordinate with the Ministry Procurement Office the aspects related to bidding processes and contracting of consulting studies, construction of works, and, when applicable, acquisition of real estate.
• l)To study and recommend the award, in the technical aspects, of bidding processes for consulting services and construction of works.
• m)To coordinate with the team in charge of the legal aspects the preparation and fulfillment of consulting and construction contracts.
• n)To carry out the provisional and final acceptances of each completed work and draw up the corresponding record.
• o)To coordinate the execution of minor works with the General Services Department in those cases where their impact or degree of complexity warrants it.

• a)Be a civil engineer or architect, with a minimum degree of licentiate, with at least five years of professional experience, and preferably with a specialty in environmental sciences.
• b)Be a member of the Federated College of Engineers and Architects of Costa Rica.
• c)Have experience in the field of Project Planning and Administration.

• a)To advise the Ministerial Office, or whomever it designates, in matters within his/her competence.
• b)To act as the hierarchical superior of the office and assign duties and responsibilities to its own personnel and to personnel temporarily assigned to the office to develop specific projects.
• c)To establish mechanisms aimed at achieving the greatest effectiveness and efficiency in the oversight of the development of the Ministry's physical infrastructure.

• d)To ensure that all technical, administrative, and financial aspects related to the Ministry's physical infrastructure development projects are fulfilled effectively and within the established deadlines.

• e)To annually present a work plan and a report on activities to the Ministerial Office.
• f)To coordinate with the respective authorities, as pertinent, the work plans of offices or directorates that carry out tasks related to the functions of the Office.
• g)To propose to the Ministerial Office, in accordance with the established standards, the incorporation of personnel that the Office requires.
• h)To promote training and capacity-building programs for the personnel under his/her charge, with the purpose of achieving the most adequate exercise of their functions.
• i)To prepare, based on the work plan, the draft budget for the Office.
• j)To execute the agreements of the Ministerial Office that pertain to him/her and the tasks assigned by it.
• k)To carry out any other function inherent to the exercise of his/her position.

1.—Once this decree is published, the Executing Unit of the Parque Marino del Pacífico Project shall constitute the Executing Office of the Physical Infrastructure Investment Plan of MINAE, supervising, on a priority basis, the development of both the first stage of the Parque Marino del Pacífico project and any other that is established.

2.—All physical, human, logistical, and material resources currently assigned to the Executing Unit of the Parque Marino del Pacífico Project shall become part of the Executing Office of the Physical Infrastructure Investment Plan once it is created.

3.—The Procedures Manual for the Executing Office shall be prepared within fifteen days following the publication of this decree and shall be submitted for approval to the Minister of Environment and Energy.

Dicha Oficina Asesora dependerá directamente del (*)Sistema Nacional de Áreas de Conservación y se regirá por las disposiciones que éste emita en materia de inversión en infraestructura física.

• a)Atender directamente, de acuerdo con las políticas establecidas por el Despacho Ministerial, el desarrollo, ampliación, remodelación y acondicionamiento general de la planta física del Ministerio del Ambiente y Energía en cualquiera de sus proyectos, propiedades y áreas de conservación.
• b)Brindar asesoría técnica al Despacho Ministerial o a quien éste designe, en materia de su competencia.
• c)Fiscalizar el desarrollo de infraestructura física que se realice a través de proyectos de cooperación internacional (Así reformado el inciso anterior mediante el artículo 2 del decreto ejecutivo N°33164 del 10 de mayo del 2006).
• d)Trabajar en coordinación con las Oficinas y Direcciones del Ministerio, responsables de otros aspectos necesarios para la ejecución de los proyectos.
• e)Proponer al Despacho Ministerial, en coordinación con la Oficina de Planificación y con cualquier otra que le corresponda, planes y políticas apropiadas para el desarrollo armónico y racional de la planta física del Ministerio.
• f)Realizar los estudios necesarios que sirvan de guía para el diseño de la planta física en general y de los edificios en particular, así como de sus ampliaciones y remodelaciones, que se construyan con fondos propios, préstamos internacionales, préstamos nacionales, por medio de organismos no gubernamentales y donaciones.
• g)Elaborar los documentos técnicos necesarios para efectuar los procedimientos de contratación de estudios preliminares, planos de conjunto, planos de anteproyecto y planos constructivos de los proyectos de planta física del Ministerio.

• h)Fiscalizar los plazos y prioridades establecidas en el desarrollo de la infraestructura física del Ministerio.

• i)Fiscalizar el avance de los proyectos y vigilar que se cumplan las correspondientes especificaciones técnicas, las normas generales y demás documentos contractuales que se establezcan para el desarrollo de la infraestructura física del Ministerio.

• j)Coordinar con el ente encargado de la administración financiera de los recursos, el manejo de los fondos destinados a las obras mayores del Ministerio.
• k)Coordinar con la Proveeduría Ministerial, los aspectos relacionados con licitaciones y contrataciones de estudios de consultoría, de construcción de obras y, cuando corresponda de adquisición de bienes inmuebles.
• l)Estudiar y recomendar la adjudicación, en los aspectos técnicos, de las licitaciones para las consultorías y construcción de obras.
• m)Coordinar con el equipo encargado de la parte legal, la elaboración y el cumplimiento de los contratos de consultoría y de construcción.
• n)Efectuar las recepciones provisionales y finales de cada obra concluida y levantar el acta correspondiente.
• o)Coordinar la ejecución de las obras menores con el Departamento de Servicios Generales, en aquellos casos en que su impacto o grado de complejidad lo amerite.

• a)Ser ingeniero civil o arquitecto, con el grado mínimo de licenciatura, con al menos cinco años de b) Estar incorporado al Colegio Federado de Ingenieros y Arquitectos de Costa Rica.
• c)Contar con experiencia en el campo de la Planificación y Administración de Proyectos.

• a)Asesorar al Despacho Ministerial, o a quien este designe, en materia de su competencia.
• b)Actuar como superior jerárquico de la oficina y asignar los deberes y responsabilidades al personal propio y al que haya sido asignado a la oficina temporalmente, para desarrollar proyectos específicos.
• c)Establecer mecanismos tendientes a lograr la mayor eficacia y eficiencia para la fiscalización del desarrollo de la infraestructura física del Ministerio.

• d)Vigilar que se cumplan con eficacia y dentro de los plazos establecidos, todos los aspectos técnicos, administrativos y financieros relativos a los proyectos de desarrollo de infraestructura física del Ministerio.

• e)Presentar anualmente un plan de trabajo y un informe de labores al Despacho Ministerial.
• f)Coordinar con las autoridades respectivas, en lo que corresponda, los planes de trabajo de las oficinas o direcciones que lleven a cabo labores relacionadas con las funciones de la Oficina.
• g)Proponer al Despacho Ministerial, de acuerdo con las normas establecidas, la incorporación del personal que la Oficina requiera.
• h)Promover programas de adiestramiento y capacitación para el personal a su cargo, con el propósito de lograr el más adecuado ejercicio de sus funciones.
• i)Preparar, con base en el plan de trabajo, el proyecto del presupuesto de la Oficina.
• j)Ejecutar los acuerdos del Despacho Ministerial que le correspondan y las tareas que éste le asigne.
• k)Realizar cualquier otra función que sea inherente al ejercicio de su cargo.

TRANSITORIOS:

1º—Una vez publicado este decreto, la Unidad Ejecutora del Proyecto Parque Marino del Pacífico se constituirá en la Oficina Ejecutora del Plan de Inversiones en Infraestructura Física del MINAE, supervisando, en forma prioritaria, el desarrollo, tanto de la primera etapa del proyecto Parque Marino del Pacífico, como de cualquier otra que se establezca.

2º—Todos los recursos físicos, humanos, logísticos y materiales, actualmente asignados a la Unidad Ejecutora del Proyecto Parque Marino del Pacifico, formarán parte de la Oficina Ejecutora del Plan de Inversiones en Infraestructura Física, una vez creada ésta 3º—El Manual de Procedimientos para la Oficina Ejecutora será elaborado dentro de los quince días posteriores a la publicación de este decreto y será sometido a aprobación de la Ministra del Ambiente y Energía.
