No. 29084-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the provisions of Article 140, subsections 3) and 18) of the Political Constitution and Article 1 of Forest Law No. 7575.

1That Article 1 of Forest Law No. 7575 of February 13, 1996, establishes as an essential and priority function of the State to ensure the conservation, protection, use, industrialization, and promotion of the country's forest resources in accordance with the principle of adequate and sustainable use of renewable resources.
2That our farmers demand better production alternatives that allow not only satisfying their food security but also successfully facing new market trends, through more efficient, diversified, and environmentally friendly production systems.
3That many farmers have developed traditional agroforestry systems (sistemas agroforestales, SAF) and successfully adopted innovative SAF, effectively contributing to a process of economically, socially, and environmentally sustainable development, particularly in the buffer zones of our Protected Wild Areas (Áreas Silvestres Protegidas, ASP).
4That the Forest Law, in its Articles 3 and 46, respectively, defines SAF and recognizes the importance of providing them with financing.
5That since 1997, a National Agroforestry Commission and an ad hoc Agroforestry Network have been functioning de facto within the State Forest Administration, made up of persons and institutions interested in promoting agroforestry development in our country. Therefore,

They decree:

DECREES

Considering:

a)To advise the National System of Conservation Areas, the Ministry of Environment and Energy, and other entities on agroforestry matters.
b)To support the Environmental Education programs of the Ministry of Environment and Energy in the field of agroforestry.
c)To facilitate the liaison between the Ministry of Environment and Energy and other public and private entities related to the agroforestry field at the national and international levels.
d)To promote the conservation and sustainable use of natural, economic, and human resources through the knowledge and practice of SAF.
e)To promote fair compensation and participation with gender equity for the goods and services provided by SAF.
f)To foster the consolidation of the National Agroforestry Network (RAF).

For the fulfillment of this decree, in addition to the definitions established in the Forest Law and its regulations, the following concepts shall apply:

Agroforestry: the body of knowledge, techniques, and practices related to SAF.

Forest species: a tree or shrub that produces various goods and services, except for those agricultural crops with commercial value (coffee, cacao, fruit trees, etc.).

Sustainable production: the rational use of the products generated by the system that ensures its stability and permanence over time.

a)To advise the Ministry of Environment and Energy and other public and private entities in the formulation of policies and review of legislation on agroforestry matters.
b)To promote the incorporation of Agroforestry into the policies, strategies, and operational plans of the different State institutions and other entities.
c)To facilitate multi-disciplinary and inter-institutional coordination and collaboration for the formulation, execution, and monitoring of agroforestry research, extension, and development projects, of a participatory nature and with gender equity.
d)To facilitate the compilation, systematization, and dissemination of knowledge, experiences, and information in the agroforestry field at the national and international levels.
e)To manage financing for the execution of the Commission's own activities.
f)To represent the State in official national and international activities.
g)To prepare an annual work plan.
h)To coordinate and facilitate the activities of the National Agroforestry Network.

b)The Ministry of Agriculture and Livestock (MAG).
c)The National Council of Rectors (CONARE).
d)From the other agricultural and forestry education institutions e) The organizations of small and medium-sized producers.
f)The productive private sector.
g)Two institutions or projects involved in agroforestry activity.

The 2 representatives of the institutions or projects referred to in Article 5, subsection g), shall be appointed by the Commission, based on the work performed and proven experience in the agroforestry field.

Both the members of the Commission appointed by organizations and those appointed by the Commission itself, pursuant to the preceding paragraph, may be re-elected.

1Que el artículo 1º de la Ley Forestal Nº 7575 del 13 de febrero de 1996, establece como función esencial y prioritaria del Estado, velar por la conservación, protección, aprovechamiento, industrialización y fomento de los recursos forestales del país de acuerdo con el principio de uso adecuado y sostenible de los recursos renovables.
2Que nuestros agricultores (as) demandan mejores alternativas de producción que permitan no sólo satisfacer su seguridad alimentaria, sino también enfrentar con éxito las nuevas tendencias de los mercados, mediante sistemas de producción más eficientes, diversificados y amigables con nuestro ambiente.
3Que muchos agricultores (as) han desarrollado sistemas agroforestales (SAF) tradicionales y adoptado exitosamente SAF innovadores, contribuyendo efectivamente a un proceso de desarrollo económico, social y ambientalmente sostenible, particularmente en las zonas de amortiguamiento de nuestras Áreas Silvestres Protegidas (ASP).
4Que la Ley Forestal en sus artículos 3º y 46, respectivamente, define los SAF y reconoce la importancia de darles financiamiento.
5Que desde 1997 funciona de hecho en la Administración Forestal del Estado, una Comisión Agroforestal Nacional y una Red Agroforestal ad hoc, constituidas por personas e instituciones interesadas en promover el desarrollo agroforestal de nuestro país. Por tanto,

Considerando:

Decretan:

a)Asesorar al Sistema Nacional de Áreas de Conservación, al Ministerio del Ambiente y Energía y otros entes en materia agroforestal.
b)Apoyar en materia de agroforestería los programas de Educación Ambiental del Ministerio del Ambiente y Energía.
c)Facilitar el enlace entre el Ministerio del Ambiente y Energía y otros entes públicos y privados relacionados con el campo agroforestal a nivel nacional e internacional.
d)Fomentar la conservación y uso sostenible de los recursos naturales, económicos y humanos a través del conocimiento y práctica de los SAF.
e)Promover una compensación y participación justa con equidad de género de los bienes y servicios prestados por los SAF.
f)Propiciar la consolidación de la Red Agroforestal Nacional (RAF).

Para el cumplimiento del presente decreto se aplicarán, además de las definiciones establecidas en la Ley Forestal y su reglamento, los siguientes conceptos:

Agroforestería: conjunto de conocimientos, técnicas y prácticas relativas a los SAF.

Especie forestal: árbol o arbusto que produce diversos bienes y servicios, excepto aquellos cultivos agrícolas con valor comercial (café, cacao, frutales, etc.).

Producción sostenible: aprovechamiento racional de los productos generados por el sistema que asegura su estabilidad y permanencia en el tiempo.

a)Asesorar al Ministerio del Ambiente y Energía y otros entes públicos y privados en la formulación de políticas y revisión de la legislación en materia agroforestal.
b)Promover la incorporación de la Agroforestería dentro de las políticas, estrategias y planes operativos de las diferentes instituciones del Estado y otros entes.
c)Facilitar la coordinación y colaboración multi-disciplinaria e inter-institucional para la formulación, ejecución y seguimiento de proyectos de investigación, extensión y desarrollo agroforestal, de carácter participativo y con equidad de género.
d)Facilitar la recopilación, sistematización y divulgación de conocimientos, experiencias e información en el campo agroforestal a nivel nacional e internacional.
e)Gestionar el financiamiento para la ejecución de las actividades propias de la Comisión.
f)Representar al Estado en actividades oficiales nacionales e internacionales.
g)Elaborar un plan anual de trabajo.
h)Coordinar y facilitar las actividades de la Red Agroforestal Nacional.

Los (las) 2 representantes de las instituciones o proyectos aludidos en el artículo 5º, inciso g), serán nombrados por la Comisión, con base en la labor desempeñada y la experiencia comprobada en el campo agroforestal.

Tanto los miembros de la Comisión nombrados por organizaciones, como los designados por la misma Comisión, según lo dispuesto en el párrafo anterior, podrán ser reelectos.

Artículo 1 — —The National Agroforestry Commission (CAFN) is hereby created, attached to the State Forest Administration, as a technical advisory body in order to facilitate and promote all activity concerning National Agroforestry.

Artículo 2 — —The objectives of this Commission are:

Artículo 4 — —The Commission shall have the following functions:

Artículo 5 — —The Commission shall be composed of one representative from each of the following institutions:

Artículo 6 — —These representatives, as well as their respective alternates, must be appointed by each organization for a period of two years.

Artículo 7 — —The Commission shall elect several of its members to hold the following positions for a period of two years, and may be re-elected: President, Secretary, Treasurer, and Oversight Officer (Fiscal).

Artículo 8 — —The decisions made by the Commission must be approved by simple majority.

Artículo 9 — —Representatives of organizations or persons whom the Commission deems appropriate may attend the Commission's sessions as guests, who shall have the right to speak but not to vote.

Artículo 10 — —The institutions and projects represented on the Commission shall commit to providing it the necessary support so that it can successfully carry out its management.

Artículo 11 — —The activities of the Commission are hereby declared to be of public interest.

Artículo 12 — —It shall enter into force upon its publication.

Artículo 1 — Créase la Comisión Agroforestal Nacional (CAFN), adscrita a la Administración Forestal del Estado, como órgano técnico asesor a fin de facilitar y promover toda actividad concerniente a la Agroforestería Nacional.

Artículo 2 — Son objetivos de esta Comisión:

Artículo 5 — La Comisión estará integrada por un (a) representante de cada una de las siguientes instituciones:

Artículo 6 — Estos representantes, así como sus respectivos suplentes, deberán ser designados por cada organización, por un período de dos años.

Artículo 7 — La Comisión elegirá a varios de sus miembros para desempeñar los siguientes puestos por un período de dos años, pudiendo ser re-electos: Presidente (a), Secretario(a), Tesorero(a), y Fiscal.

Artículo 8 — Las decisiones que tome la Comisión deberán ser aprobadas por mayoría simple.

Artículo 9 — A las sesiones de la Comisión podrán asistir en calidad de invitados (as), representantes de organismos o personas a quienes la Comisión estimare convenientes, los cuales tendrán derecho a voz, pero no a voto.

Artículo 10 — Las instituciones y proyectos representados en la Comisión se comprometerán a darle el apoyo necesario para que ésta pueda desempeñar con éxito su gestión.

Artículo 11 — Se declara de interés público las actividades de la Comisión.

Artículo 12 — Rige a partir de su publicación.
