THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on Articles 140, subsections 3) and 18) of the Political Constitution, 41 of the Organic Environmental Law No. 7554 of October 4, 1995, and Transitory Provision No. 1 of Law No. 7575, amended by Law No. 7761, published in La Gaceta No. 95 of May 19, 1998.
Considering
276, of August 27, 1942, mangroves and estuaries were established as State property, which legally gives their administration to MINAE.
7210-A of July 19, 1977, mangroves are declared forest reserves. In Decree No. 22550 published in La Gaceta No. 193 of October 8, 1993, they are declared wetlands. Article 41 of the Organic Environmental Law states that wetlands shall be considered of public interest, as they are for multiple use whether or not declared and protected by current legislation.
The Organic Environmental Law, in its Article 32, declares wetlands a protected wilderness area (área silvestre protegida).
7224 of April 2, 1991, wetlands are multiple-use wilderness areas, which must be administered according to what are known as management plans (Planes de Manejo), in order to adopt appropriate measures to uphold their ecological characteristics.
7575 in its Article 1 prohibits the cutting of mangrove, however in Law No. 7761 in its Transitory Provision No. 1, which amended Transitory Provision No. 1 of Law No. 7575, it states: "Notwithstanding, in the Maritime-Terrestrial Zone and mangroves, the State Forestry Administration shall extend the permits, concessions, and contracts covered by previous legislation, provided that by virtue thereof investments in infrastructure have been made and they comply with the environmental requirements for such effect. The Forestry Administration may not grant new permits, concessions, or contracts; nor extend their area."
7575, the General Directorate of Wildlife granted use permits in mangroves for salt works (salineras), aquaculture, and others under Law No. 7317.
10.—That the above problem must be resolved, since in the Subregional Offices of the Conservation Areas, the procedure to follow is not clear.
11.—That based on what is cited in considerandos 6 and 7, within the country's mangroves, the following will be processed:
A. Already established Salt Works Projects (extension only).
B. Already established Aquaculture Projects (extension only).
Therefore,
Decree:
Said plan must contain, at a minimum, what is indicated in Article 2 of this decree. It must be prepared by professionals specialized in the field of natural resources, as established in the General Wildlife Law.
This management plan must have the approval of the Costa Rican Institute of Fisheries and Aquaculture in the technical aspects of its legal competence.
Likewise, other activities not contemplated in the management plan are not permitted.
If the introduction of any species is proposed, the studies established for that purpose by the Wildlife Law must be available.

EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DEL AMBIENTE Y ENERGÍA Con fundamento en los artículos 140, incisos 3) y 18) de la Constitución Política, 41 de la Ley Orgánica del Ambiente N° 7554 del 4 de octubre de 1995 y Transitorio N° 1 de la Ley N° 7575, modificado por Ley N° 7761, publicada en La Gaceta N° 95 del 19 de mayo de 1998.
Considerando
En el Decreto N° 22550 publicado en La Gaceta N° 193 del 8 de octubre de 1993, se declaran humedales. El artículo 41 de la Ley Orgánica del Ambiente refiere que los humedales se comprenderán de interés público, por ser de uso múltiple estén ó no declarados y protegidos por la legislación vigente.
La Ley Orgánica del Ambiente, en su artículo N° 32 declara a los humedales como una área silvestre protegida.
La Administración Forestal no podrá otorgar nuevos permisos, concesiones ni contratos; tampoco extenderles el área.
10.-Que se debe solucionar la anterior problemática, pues en las Oficinas Subregionales de las Áreas de Conservación, no está claro cual es el procedimiento a seguir.
11.-Que en base a lo citado en los considerandos 6 y 7, dentro de los manglares del país se dará trámite a:
A. Proyectos de Salinas ya establecidos (únicamente prorroga).
B. Proyectos de Acuicultura ya establecidos (únicamente prorroga). Por tanto,
Decretan:
El mismo debe contener lo señalado como mínimo en el artículo Nº 2 de este decreto. Deberá ser elaborado por profesionales especialistas en el campo de los recursos naturales, según lo establecido en la Ley General de Vida Silvestre.
Este plan de manejo debe contar con la aprobación del Instituto de Costarricense de Pesca y Acuicultura en los aspectos técnicos de su competencia legal.
De proponerse la introducción de cualquier especie debe contarse con los estudios que para tal propósito establece la Ley de Vida Silvestre.
