Full Text of record: 3BFD3 No. 29276-MINAE No. 29276-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution and based on the provisions of Articles 82 and 87 of Law No. 7317, Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre), published in La Gaceta No. 235 of December 7, 1992, and Articles 6, 11, and 27 of the General Law of Public Administration.

1. 1That through Executive Decree No. 24638 MIRENEM of August 8, 1995, published in La Gaceta No. 190 of Friday, October 6, 1995, the Rancho La Merced Mixed-Ownership National Wildlife Refuge (Refugio Nacional de Vida Silvestre Propiedad Mixta Rancho La Merced) was created, located in Barú, first district, Cortés, fifth canton, Osa, province of Puntarenas.
2. 2That the properties belonging to Rancho La Merced, S. A., legal identification number 3-101-018592-37, registered in the Public Registry, Commercial Section, volume 1991, folio 518, entry 4; with a total area of 341 hectares 7,565.90 square meters, described in cadastral map No. P-589925 of July 9, 1985, with an area of 315 hectares 2,762.90 m², and cadastral map No. P-585415-85 of July 9, 1985, with an area of 26 hectares 4,803 m², located in Barú, first district, Cortés, fifth canton, Osa, province of Puntarenas, were incorporated at the owner's request into the aforementioned National Wildlife Refuge.
3. 3That in accordance with the indicated Executive Decree, the designation (afectación) of these farms as a Wildlife Refuge was for a period of 5 years, which expired on October 7, 2000.
4. 4That during the 5 years of designation (afectación) of these properties to the Wildlife Refuge regime, the management objectives were met, as demonstrated by the results of the monitoring of the management carried out, which establishes that the area continues to constitute a very important nucleus for wildlife conservation, observing a process of natural regeneration due to the abandonment of the area dedicated to livestock, that there have been no changes in infrastructure, and that it also lacks problems of squatting (precarismo).
5. 5That Mr. Wálter Odio Victory, on behalf of his represented company Rancho La Merced, Sociedad Anónima, requested that the submission of these farms to the Rancho La Merced Wildlife Refuge, mixed category, be extended for a period of 10 years.
6. 6That the Commission in charge of carrying out the inspection of these properties has recommended accepting the previous request. Therefore,

Texto Completo acta: 3BFD3 Nº 29276-MINAE Nº 29276-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DEL AMBIENTE Y ENERGÍA En ejercicio de las facultades conferidas por el artículo 140, incisos 3) y 18) de la Constitución Política y con fundamento en lo dispuesto en los artículos 82 y 87 de la Ley Nº 7317, Ley de Conservación de la Vida Silvestre, publicada en La Gaceta Nº 235 del 7 de diciembre de 1992 y los artículos 6º, 11 y 27 de la Ley General de la Administración Pública.

1. 1Que mediante Decreto Ejecutivo Nº 24638 MIRENEM del día 8 de agosto de 1995, publicado en La Gaceta Nº 190 del día viernes 6 de octubre de 1995, se creó el Refugio Nacional de Vida Silvestre Propiedad Mixta Rancho La Merced, situado en Barú, distrito primero, Cortés, cantón quinto, Osa, provincia de Puntarenas.
2. 2Que los inmuebles pertenecientes a Rancho La Merced, S. A., cédula jurídica Nº 3-101-018592-37, inscrita en el Registro Público, Sección Mercantil, tomo 1991, folio 518, asiento 4; con un área total de 341 hectáreas 7 565,90 metros cuadrados, descritos en los planos catastrados Nº P-589925 del 9 de julio de 1985, con un área de 315 hectáreas 2 762,90 m² y plano catastrado Nº P-585415-85 del 9 de julio de 1985, con un área de 26 hectáreas 4 803 m², situados en Barú, distrito primero, Cortés, cantón quinto, Osa, provincia de Puntarenas, fueron incorporados a solicitud del propietario al citado Refugio Nacional de Vida Silvestre.
3. 3Que de conformidad con el Decreto Ejecutivo, indicado, la afectación de estas fincas, como Refugio de Vida Silvestre lo era por un plazo de 5 años, el cual venció el 7 de octubre del 2000.
4. 4Que durante los 5 años de afectación de estos inmuebles al régimen de Refugio de Vida Silvestre se cumplió con los objetivos de manejo, según lo demuestran los resultados del monitoreo sobre el manejo realizado, donde se establece que el área sigue constituyendo un núcleo muy importante para la conservación de la vida silvestre, observándose un proceso de regeneración natural debido al abandono del área dedicada a la ganadería, que no se han dado cambios en la infraestructura y que además carece de problemas de precarismo.
5. 5Que el señor Wálter Odio Victory, en nombre de su representada Rancho La Merced, Sociedad Anónima, solicitó se amplíe por un período de 10 años el sometimiento de estas fincas al Refugio de Vida Silvestre Rancho La Merced, categoría mixto.
6. 6Que la Comisión encargada de realizada de hacer la inspección sobre estos inmuebles, ha recomendado acoger la solicitud anterior. Por tanto,
