in the entirety of the text - Complete Text of Regulation 29147 Amendment to the Regulation of the Forestry Law Complete Text of act: ABA6A (This decree was repealed by article 6 of executive decree No. 33815 of February 15, 2007) No. 29147-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by article 140, subsections 3) and 18) of the Political Constitution and in accordance with the provisions of the Forestry Law No. 7575 published in Supplement No. 21 to La Gaceta No. 72 of Tuesday, April 16, 1996.

1That in accordance with the Forestry Law No. 7575, published in Supplement No. 21 to La Gaceta No. 72 of April 16, 1996, its article 1 establishes the essential and priority function of the State to ensure the conservation, protection, and administration of natural forests, the harvesting, industrialization, and promotion of the country's forest resources destined for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources.
2That article 6 of the Forestry Law No. 7575 of April 6, 1996, establishes in subsection o) that it is the competence of the State Forestry Administration (Administración Forestal del Estado) to grant licenses for forest certifiers, at the proposal of a Commission composed of representatives of recognized academic and scientific entities, national and foreign, prominent in environmental matters. 1Que de conformidad con la Ley Forestal N° 7575, publicada en el Alcance N° 21 a La Gaceta N° 72 del dia 16 de abril de 1996, se establece en su articulo 1° la funcion esencial y prioritaria del Estado, en velar por la conservacion, proteccion y administracion de los bosques naturales, el aprovechamiento, la industrializacion y el fomento de los recursos forestales del pais destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.
2Que el articulo 6 de la Ley Forestal N° 7575 del 6 de abril de 1996 establece en el inciso o), que es competencia de la Administracion Forestal del Estado otorgar las licencias de certificadores forestales, a propuesta de una Comision integrada por representantes de entes academicos y cientificos reconocidos, nacionales y extranjeros, destacados en el tema ambiental. A esta Comision, tambien, se le encomendar regular y vigilar el sistema de sellos verdes o certificaciones forestales.
3Que el articulo 26 del Reglamento a la Ley Forestal N° 7575, Decreto Ejecutivo 25721-MINAE, crea la Comision Nacional de Certificacion Forestal, como un organo de la Administracion Forestal Estado, dicha Comision est integrada por ocho miembros de reconocida solvencia tecnica y moral y tendr n un nombramiento que regir por tres años.
4Que la Academia Nacional de Ciencias no ha mostrado interes en participar y formar parte de la Comision Nacional de Certificacion Forestal.
5Que es de vital importancia para la Administracion Forestal del Estado y la Comision Nacional de Certificacion forestal contar con un mecanismo de renovacion de sus miembros que garantice la continuidad del trabajo del Sistema Nacional de Certificacion Forestal.

Por tanto, Decretan:

Considerando:

a)Fungir n en sus cargos por un año mas los actuales representantes de: una de las universidades, dos de los organismos cientificos internacionales y uno de las entidades cientificas de reconocida trayectoria en el campo de la investigacion forestal.
b)Los demas representantes deberan ser nombrados en el periodo y por el plazo establecido en este articulo. En caso de renuncia, separacion del cargo, o cualquier otro supuesto, el nombramiento del sustituto se realizar por el periodo faltante, siguiendose el mismo procedimiento de terna establecido en este articulo.
