REGLAMENTO DE FRACCIONAMIENTO Y URBANIZACIONES (Regulations for Subdivision and Urban Developments) No. 28741-MIVAH-S-MOPT-MINAE LA PRESIDENTA DE LA REPÚBLICA, EL MINISTRO DE VIVIENDA Y ASENTAMIENTOS HUMANOS, LA MINISTRA DE SALUD, EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES Y EL MINISTRO DEL AMBIENTE Y ENERGÍA In exercise of the powers conferred by Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Law No. 4240, Organic Law of the Instituto Nacional de Vivienda y Urbanismo (INVU), dated 15 November 1968; Law No. 5395, General Health Law, dated 30 October 1973; Law No. 3155, of 5 August 1963; Law No. 7554, Environmental Organic Law, dated 4 October 1995; Law No. 7575, Forest Law (Ley Forestal), dated 13 February 1996; Law No. 5525, National Planning Law, dated 6 May 1974; and the regulations to the aforementioned laws.
**Whereas:** I. —That in accordance with Law No. 3155 of 5 August 1963, Law No. 4240 of 15 November 1968, and Law No. 5395 of 30 October 1973; the Executive Branch, through the INVU and the Ministry of Health, established the necessary standards to regulate subdivisions (fraccionamientos) and urban developments (urbanizaciones), which culminated in the issuance of the "Regulations for National Subdivision and Urban Development Control", Executive Decree No. 15823-MIVAH-MOPT-S, published in La Gaceta No. 232 of 5 December 1984.
II. —That the growth of urban centers, the densification of existing ones, and the advancement of technology have generated the need to update said regulations, incorporating new implementation techniques, adjusting applicable standards for subdivisions and urban developments, and establishing the relevant administrative procedures to ensure greater efficiency in the approval process, all in accordance with the guidelines issued by the Ministry of Environment and Energy (MINAE) and the provisions of the Law No. 7575.
**Therefore,** THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF HOUSING AND HUMAN SETTLEMENTS, THE MINISTER OF HEALTH, THE MINISTER OF PUBLIC WORKS AND TRANSPORT, AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers legally conferred upon them, decree the following:
**REGLAMENTO DE FRACCIONAMIENTO Y URBANIZACIONES** (Regulations for Subdivision and Urban Developments) **CHAPTER I** **General Provisions** **Article 1.** —The purpose of these regulations is to establish the legal and technical standards for the creation, approval, construction, and operation of subdivisions and urban developments, with the objective of achieving the proper utilization of land, the orderly provision of services, the protection of the environment, and the safety of persons and property.
**Article 2.** —All subdivisions and urban developments, whether carried out by public or private entities, and all types of parcels or lots resulting from a subdivision (fraccionamiento) or urban development (urbanización) are subject to these regulations, regardless of the legal form of the act, and must obtain the respective approval from the corresponding Municipality and the necessary permits, as established herein.
**Article 3.** —For the purposes of these regulations, the following definitions are established:
**a) Subdivision (Fraccionamiento):** The division of a parcel of land into two or more lots, the layout of streets, and the reservation of areas for public use, without the execution of urbanization works, except for those strictly necessary for roadways and the installation of basic public service connections.
**b) Urban Development (Urbanización):** The division of a parcel of land into two or more lots, the layout of streets, the reservation of areas for public use, and the execution of all works required to provide the land with public services, such as potable water supply, sanitary sewerage, storm drainage, electricity, street paving, curbs, sidewalks, and any other facilities deemed necessary.
**c) Plot (Lote):** A portion of land resulting from a subdivision or urban development, with access to a public road, and which meets the minimum area, frontage, and service conditions established in these regulations.
**d) Lot with frontage on two streets (Lote con frente a dos calles):** A lot that has frontage on two opposite or non-adjacent public roads.
**e) Corner lot (Lote en esquina):** A lot that has frontage on two adjacent public roads forming an angle.
**f) Internal lot (Lote interno):** A lot whose access is provided through an easement (servidumbre) or private driveway, not having direct frontage on a public road.
**g) Remnant parcel (Remanente):** The portion of the original parcel that remains after one or more segregations have been made.
**h) Right-of-way (Derecho de vía):** The strip of land destined for the construction and operation of public roadways and public service infrastructure.
**i) Easement (Servidumbre):** An encumbrance imposed upon a property for the benefit of another property belonging to a different owner.
**j) Park (Parque):** The area of land intended for public recreation, dedicated to playgrounds, gardens, or sports fields, which must be located in accordance with the provisions of these regulations.
**k) Public facilities area (Área de equipamiento):** The area destined for the construction of public buildings and facilities for community service, such as schools, health centers, childcare centers, community halls, public safety facilities, and others.
**l) Public area (Área pública):** The area composed of streets, parks, and public facilities areas, which the urbanizer or subdivider must transfer free of charge to the respective Municipality.
**m) Usable area (Área útil):** The area of a parcel obtained by subtracting from the total area the lands affected by riverbank protection zones, the maritime-terrestrial zone, natural drainage channels, steep slopes, protected areas, forest reserves, and other areas that according to law or regulation are not buildable.
**n) Earthworks (Movimientos de tierra):** The set of activities involving cuts, fills, excavations, and leveling of land, required for the construction of streets and the preparation of lots.
**o) Lot densification (Densificación de lote):** The subdivision of an existing lot into two or more new lots, or the construction of horizontal property on an existing lot, authorized by the respective Municipality, as long as the lot is located in an area that has all public services and the project complies with the provisions of these regulations and the respective regulatory plan.
