For the purposes of applying this regulation, the following shall be understood as:
ARESEP: Public Services Regulatory Authority (Autoridad Reguladora de los Servicios Públicos).
CONCESSION (CONCESIÓN): Administrative act, issued by ARESEP or MINAE, for the exploitation of private power plants of limited capacity and transmission and distribution systems.
EIA: Environmental Impact Study (Estudio de Impacto Ambiental).
ELIGIBILITY (ELEGIBILIDAD): Declaration of Eligibility of an electricity generation project, granted by ICE at the request of a natural or legal person, for the purpose of regulating and ordering the selection process.
ICE: Costa Rican Electricity Institute (Instituto Costarricense de Electricidad).
MINAE: Ministry of Environment and Energy (Ministerio de Ambiente y Energía).
COMMERCIAL OPERATION PERIOD (PERIODO DE OPERACION COMERCIAL): Corresponds to the maximum term of the contract (15 years), less the duration of the following periods: the period for consolidating financing, the construction period, and the plant acceptance testing period.
POWER OR OFFERED CAPACITY (POTENCIA O CAPACIDAD OFRECIDA): The power in kW that the private producer makes available to ICE, after satisfying its own needs.
NOMINAL POWER OR CAPACITY (POTENCIA O CAPACIDAD NOMINAL): The maximum power value attributed to a plant, based on its nameplate data or a technical estimate.
PRIVATE PRODUCER (PRODUCTOR PRIVADO): Natural person, private company, or cooperative that wishes to contract with ICE the sale of energy from a non-conventional or hydraulic source, generated in power plants of 20,000 kW or less capacity.
SEN: National Electric System (Sistema Eléctrico Nacional, SEN).
SNI: National Interconnected System (Sistema Nacional Interconectado, SNI). Components of the SEN interconnected with each other.
VIABILITY (VIABILIDAD): Defined in the Regulations to Law 7200, as a declaration issued by ICE based on a report detailing the technical and financial studies at the viability or feasibility level, which demonstrate to ICE the suitability of the project and its merits for future contracting.
