The ratification by Costa Rica of the Protocol to the American Convention on Human Rights Concerning the Abolition of the Death Penalty, signed on October 28, 1991, is approved in each and every one of its parts. The text is as follows:
"PROTOCOL TO THE AMERICAN CONVENTION ON HUMAN RIGHTS CONCERNING THE ABOLITION OF THE DEATH PENALTY PREAMBLE THE STATES PARTIES TO THIS PROTOCOL;
That Article 4 of the American Convention on Human Rights recognizes the right to life and restricts the application of the death penalty; That every person has the inalienable right to have their life respected, a right which cannot be suspended for any reason; That the trend among the American States is favorable to the abolition of the death penalty; That the application of the death penalty produces irreparable consequences that prevent the correction of judicial error and eliminate any possibility of amendment and rehabilitation of the accused; That the abolition of the death penalty helps to ensure more effective protection of the right to life; That it is necessary to reach an international agreement that signifies a progressive development of the American Convention on Human Rights, and That States Parties to the American Convention on Human Rights have expressed their intention to commit themselves by means of an international agreement, in order to consolidate the practice of not applying the death penalty within the American continent, HAVE AGREED to sign the following PROTOCOL TO THE AMERICAN CONVENTION ON HUMAN RIGHTS CONCERNING THE ABOLITION OF THE DEATH PENALTY
DECREES:
Considering:
1. No reservations shall be admitted to this Protocol. However, at the time of ratification or accession, the States Parties to this instrument may declare that they reserve the right to apply the death penalty in time of war in accordance with International Law for extremely serious crimes of a military nature.
2. The State Party that formulates such a reservation shall communicate to the Secretary General of the Organization of American States, at the time of ratification or accession, the relevant provisions of its national legislation applicable in time of war referred to in the preceding paragraph.
3. Said State Party shall notify the Secretary General of the Organization of American States of the beginning or end of any state of war applicable to its territory.
The ratification of this Protocol or accession to it shall be effected by depositing an instrument of ratification or accession with the General Secretariat of the Organization of American States.

Apruébase, en cada una de sus partes, la ratificación de Costa Rica del Protocolo de la Convención Americana sobre Derechos Humanos Relativo a la Abolición de la Pena de Muerte, suscrito el 28 de octubre de 1991. El texto es el siguiente:
"PROTOCOLO A LA CONVENCIÓN AMERICANA SOBRE DERECHOS HUMANOS RELATIVO A LA ABOLICIÓN DE LA PENA DE MUERTE PREÁMBULO LOS ESTADOS PARTES EN EL PRESENTE PROTOCOLO;
Que el artículo 4 de la Convención Americana sobre Derechos Humanos reconoce el derecho a la vida y restringe la aplicación de la pena de muerte; Que toda persona tiene el derecho inalienable a que se le respete su vida sin que este derecho pueda ser suspendido por ninguna causa; Que la tendencia en los Estados americanos es favorable a la abolición de la pena de muerte; Que la aplicación de la pena de muerte produce consecuencias irreparables que impiden subsanar el error judicial y eliminar toda posibilidad de enmienda y rehabilitación del procesado; Que la abolición de la pena de muerte contribuye a asegurar una protección más efectiva del derecho a la vida; Que es necesario alcanzar un acuerdo internacional que signifique un desarrollo progresivo de la Convención Americana sobre Derechos Humanos, y Que Estados Partes en la Convención Americana de Derechos Humanos han expresado su propósito de comprometerse mediante un acuerdo internacional, con el fin de consolidar la práctica de la no aplicación de la pena de muerte dentro del continente americano, HAN CONVENIDO En suscribir el siguiente PROTOCOLO A LA CONVENCIÓN AMERICANA SOBRE DERECHOS HUMANOS RELATIVO A LA ABOLICIÓN DE LA PENA DE MUERTE
DECRETA:
