For all purposes, when the Law or this regulation uses the following terms, they shall be given the meanings indicated below:
- 1)Tax Administration (Administración Tributaria): Refers to the municipalities, as those responsible for the valuation, administration, collection, and oversight of the Real Estate Tax.
- 2)Appraisal (Avalúo): Is the set of calculations, reasoning, and operations used to determine the value of a real estate (bien inmueble), whether rural or urban according to its use.
- 3)Taxable base (Base imponible): Is the value of all real estate registered in the respective Tax Administration (Administración Tributaria), as of January first of each year.
- 4)Real Estate (Bien Inmueble): Is that land, installation, fixed and permanent construction that exists in real property, both urban and rural.
- 5)Age of the Real Estate (Edad del Inmueble): number of years that the construction has existed.
- 6)Condition of the real estate (Estado del inmueble): Defines the state of conservation of the construction at the time of making the declaration or the appraisal (avalúo).
- 7)Correction or Adjustment Factor (Factor de Corrección o de Ajuste): Refers to the influence of each variable in determining the land value, starting from the zonal value, expressed through a mathematical relationship.
- 8)Public Faith (Fe Pública): Attributed to municipal officials designated to carry out different notifications to taxpayers, where their actions shall have probative force, veracity, and authenticity.
- 9)Law: Real Estate Tax Law Nº 7509 and its amendments.
- 10)Standard or reference lot (Lote tipo o de referencia): Is the most frequent land lot within a homogeneous zone (zona homogénea).
- 11)Body: Refers to the Technical Standardization Body (Organo de Normalización Técnica), created in article 12 of the Law, is a specialized entity whose objective is to guarantee greater precision and homogeneity in determining the values of real estate throughout the national territory. Said determination refers to the base reference values, which will be defined by the cited Body and to optimize tax administration.
- 12)Price and Cost (Precio y Costo): Price is the value of a thing in money, what is asked for it, its estimation. Cost is the value that a thing has, without profit.
- 13)Construction typology (Tipología constructiva): Document containing the codes of the different types of construction existing in the country, their corresponding replacement values, and the depreciation method to be used.
- 14)Base value or reference value for land (Valor base o valor de referencia para terreno): Is the unit value corresponding to the standard lot of each homogeneous zone (zona homogénea).
- 15)Declared value (Valor declarado): Is that derived from the declaration filed before the Municipality, by the owners or possessors of real estate.
- 16)Registered Value (Valor Registrado): is that which appears in the records of the Tax Administration (Administración Tributaria), upon which the tax is charged.
- 17)Useful Life (Vida Util): Corresponds to the probable life in years that, according to the type of construction and maintenance, a real estate will remain functional and useful for the objectives for which it was designed.
- 18)Homogeneous zone (Zona homogénea): set of real estate with similar characteristics regarding their development and specific use.
General provisions Origin, Object, and Administration of the Tax
