I.—That Article 38 of the Ley Forestal establishes a ban on prescribed burns (quemas controladas); however, Article 19, paragraph g) of the same legal body establishes a necessary exception, allowing MINAE to authorize such practices in pursuit of the national interest, provided they are scientifically and technically justified and do not jeopardize natural resources.
II.—That Controlled burns in mountainous and high-slope areas cause serious environmental damage, such as forest fires, erosion, loss of biodiversity, water source depletion, and others.
III.—That title to properties of forest aptitude (aptitud forestal) includes, under the principle of the social function of property, the obligation to maintain the forest cover (cobertura boscosa), which results in the incompatibility of the use of these lands for agrarian activities, an objective that apparently motivates prescribed burns.
IV.—That it is a duty of the State, through the Public Administration, to ensure the proper use of the powers granted by article 19, paragraph g) of the Ley Forestal, and that the granting of a permit for prescribed burning on lands of forest aptitude, under the conditions described, would be contrary to the spirit and purpose of that law.
THEREFORE, Pursuant to the powers conferred by articles 19, paragraph g) and 38 of the Ley Forestal and Decree No. 26435-MINAE.
