Of the Members of the Natural Resources Vigilance Committees

Watchers (vigilantes) of natural resources may be minors but over 15 years of age.

To acquire the status of watcher (vigilante) of natural resources, it is sufficient to comply with the requirements stipulated in this Regulation. Both the ad-honorem inspectors of natural resources and the Watchers (Vigilantes) of Natural Resources shall be issued an identification card and the corresponding badge, thus acquiring the respective rights and obligations inherent to their status as members of a natural resources vigilance committee. The validity of this card is 2 years, but it may be revoked by the National Secretariat at any time, after a prior hearing of the interested party, if any of the grounds contemplated in this Regulation are verified.

• a)Be a Costa Rican or have resident status.
• b)Be of legal age.
• c)Complete the application form that the National Secretariat will provide for this purpose.
• d)Satisfactorily complete the instructional aspects and practices that the National Secretariat determines.
• e)Join one of the Natural Resources Vigilance Committees or form a new committee.

• a)Be a Costa Rican or have resident status.
• b)Be over 15 years of age.
• c)Complete the application form that the National Secretariat will provide for this purpose.
• d)Satisfactorily complete the instructional and training aspects determined by the National Secretariat, in accordance with the rules that it shall issue.

• a)Comply with current legal provisions, as well as with the directives issued by the National Secretariat for this purpose.
• b)Collaborate with competent public officials in inspections and environmental tasks.
• c)Carry out, in accordance with the law, vigilance and protection tasks for natural resources and the environment. Likewise, as a group, they may carry out tasks in favor of the environment, subsequently providing a report to the National Secretariat, which shall inform the nearest MINAE Office to each committee as well as the authorities it deems pertinent.
• d)Participate in the tasks inherent to the care of protected areas, in coordination with the public officials in charge and as stipulated in the Wildlife Conservation Law 7317 and the Forestry Law 7575.
• e)File complaints before the corresponding authorities regarding infractions of current environmental legislation.
• f)Comply with and enforce the laws, decrees, and regulations governing this matter.
• g)Maintain, in the exercise of the work as an Inspector, a permanent attitude of serenity, prudence, and attention, as well as courtesy and kindness towards the citizenry.
• h)Faithfully comply with the provisions of this Regulation and with any other stipulated in current legislation.
• i)Have lifestyle habits and personal conduct consistent with the principles of conservation and protection of natural resources and the environment.
• j)Act in the fulfillment of their duties in groups of duly formalized and identified Inspectors, of no fewer than 3 individuals.
• k)Guide, coordinate, and advise the Watchers (Vigilantes) of Natural Resources. l) Request the renewal of the card that accredits them as an Inspector fifteen days prior to its expiration.

• a)Receive training and advice on the protection of natural resources and provide that which is necessary to achieve greater awareness among the population, according to the programs that the National Secretariat develops for this purpose.
• b)Elect and be elected as a representative of the committee to which they belong to the regional assembly where the Regional Committee shall be named, or as a representative of the regional committees to the national meetings that shall name the members of the National Secretariat.
• c)Give faithful testimony of everything seen, heard, and acted upon in the fulfillment of their duties.
• d)Request reports from the leadership structures of COVIRENA.
• e)Request the support of the COVIRENA coordinators for the execution of their activities.
• f)Have their card that accredits them as an Inspector of Natural Resources.

• a)Exercise vigilance work in the rural and urban zones of the country in collaboration with the regular and ad-honorem inspectors of natural resources in the enforcement of current environmental legislation.
• b)Promote within their communities, actions of education and awareness of the importance of protecting natural resources and the environment.
• c)Coordinate with different civil society organizations, campaigns, programs, and actions for the improvement of the natural environment and the urban and rural environment.
• d)Have lifestyle habits and personal conduct consistent with the principles of conservation and protection of natural resources and the environment.
• e)Receive training and advice on the protection of natural resources and provide that which is necessary to achieve greater awareness among the population, according to the programs that the National Secretariat develops for this purpose.
• f)Maintain, in the exercise of the work as an Inspector, a permanent attitude of serenity, prudence, and attention, as well as courtesy and kindness towards the citizenry.
• g)Request the renewal of the card that accredits them as a watcher (vigilante) fifteen days prior to its expiration.

• a)Receive training and advice on the protection of natural resources and provide that which is necessary to achieve greater awareness among the population, according to the programs that the National Secretariat develops for this purpose.
• b)Access the category of Ad-honorem Inspector once reaching legal age.
• c)Request reports from the leadership structures of COVIRENA.
• d)Request the support of the COVIRENA coordinators for the execution of their activities.
• e)Have a voice within the committee to which they are assigned.
• f)Have their card that accredits them as an Inspector of Natural Resources.

Of the Structure of the Natural Resources Vigilance Committees

* A National Council of the Natural Resources Committees or CONACOVIRENA.

* A National Secretariat.

* Regional Directorates, which shall be as many as the National Secretariat deems necessary for its operationality.

* The Natural Resources Vigilance Committees that are necessary throughout the country.

I. The First Lady of the Republic, who presides over it

II. The Minister of Environment and Energy

III. The Former Presidents of the Republic

IV. The Executive Presidents of ICE and AyA

V. Two representatives of the National Secretariat and the Executive Director

• a)Meet at least twice a year in ordinary session.
• b)Direct the global policies and the general guidelines for the functioning of the COVIRENAS.
• c)Carry out periodic evaluations of the work performed by the National Secretariat.
• d)Any other duties that this Regulation or current legislation establishes.

* Three members appointed by the Minister of Environment and Energy.

* Four members appointed by the National Meeting of the Regional Directorates of the COVIRENA, who do not necessarily need to belong to a Regional Directorate, but must be an Ad-honorem Inspector.

• a)Appoint from its body a coordinator of the National Secretariat.
• b)Appoint an executive director of COVIRENA.
• c)Approve the creation of the Natural Resources Vigilance Committees throughout the country.
• d)Revoke the appointments of ad-honorem inspectors and Watchers (Vigilantes) of Natural Resources who incur the grounds for sanction contemplated in this Regulation.
• e)Formalize the dissolution of the committees that incur any of the grounds for sanction contemplated in this Regulation.
• f)Ensure that the management of the COVIRENAS and their members is executed in accordance with current regulations.
• g)Ensure that the regional directorates submit the monthly reports in the proper form and within the established deadlines.
• h)Maintain constant and fluid communication with all the components of the organizational structure.
• i)Launch the action plans and the educational and training programs for the members of the COVIRENAS.
• j)Coordinate with other MINAE and State entities the execution of protection activities, operations, projects, and programs.
• k)Approve the appointment of the watchers (vigilantes) and inspectors of natural resources.
• l)Any other duties that this Regulation or the current law establishes.
• m)Convene the National Meetings of COVIRENA.
• n)Maintain a Registry of Ad-honorem Inspectors and Watchers (Vigilantes), which shall report on its semiannual movements to the Minister of Environment and Energy.
• o)Inform the Regional Directorates and committees about the development of the national movement and its own management.

• a)Appoint from their body a regional coordinator, who shall preside for one year, and may be reelected, as well as establish the organization that best suits their respective region, which must be presented to the National Secretariat for its approval.
• b)Prepare the quarterly work plans for their region, to be presented to the National Secretariat.
• c)Know the actions, operations, campaigns, and projects of each one of the Natural Resources Vigilance Committees in their region.
• d)Meet in ordinary session every fifteen days and in extraordinary session when convened by two-thirds of its members.
• e)Coordinate with competent public officials the execution of control and vigilance operations for natural resources or the environment.
• f)Develop environmental awareness and education programs for their region.
• g)Prepare and process, before the National Secretariat, the monthly activity reports carried out by the committees.
• h)Inform their committees about the development of the national movement reported by the National Secretariat and about their own management.
• i)Appoint delegates for the National Meeting of Regional Directorates, convened for this purpose by the National Secretariat and according to the rules that this body issues for that end.

Each one shall have its own organization and work plan that best adapts to its zone. It shall appoint a coordinator who shall be responsible for the actions of the committee, who shall serve one year in the position and may be reelected.

• a)Prepare a quarterly plan that must be presented to the respective regional directorates, so that these may forward it to the National Secretariat.
• b)Be properly incorporated into one of the regional directorates.
• c)Present monthly, before their regional directorate, a report on the execution of activities of their ad-honorem inspectors and watchers (vigilantes), which shall include participants, date, time, exact locations of the sites where the activities were carried out, and objectives pursued.
• d)Coordinate and cooperate with the institutions and civil society organizations of their community to carry out awareness and environmental education activities that increase citizen support for the work carried out by each committee.

Of Faults and Sanctions

• a)Oral reprimand.
• b)Written reprimand.
• c)Temporary suspension for a minimum of one month and up to the remaining validity time of their card.
• d)Suspension from the position of committee head, member of the Regional Directorate, or of the National Secretariat, as applicable.
• e)Definitive expulsion.
• f)Dissolution of the sanctioned Natural Resources Vigilance Committee.

The Regional Directorate for subsections a, b, and c. The National Secretariat for subsections a, b, c, d, e, and f.

CONACOVIRENA shall constitute an appellate tribunal for all sanctions applied.

• a)Repeated failure to comply with the duties and responsibilities assumed as an ad-honorem inspector or member of a COVIRENA.
• b)Prolonged inactivity for more than three months without justification.
• c)Exceeding the attributions or powers contemplated in this Regulation.
• d)Violating legal provisions of any nature in the work as an ad-honorem inspector.
• e)Receiving gifts, rewards, favors, or payments of any type during or as a result of the work performed in the capacity of Ad-honorem Inspector.
• f)Acting under the influence of liquor or other drugs during the execution of any activity or operation in the capacity of Ad-honorem Inspector.
• g)Verbally or physically assaulting other persons in the fulfillment of the work.
• h)Illegally detaining or failing to report to the corresponding authorities, articles or objects belonging to violators of current environmental legislation that are under their custody or responsibility.
• i)Subjecting violators who are under their custody or responsibility to cruel or degrading treatment.

Of Recognitions and Incentives

• a)The second paragraph of article 47 of the Regulation to the Wildlife Conservation Law, executive decree No. 22545-MIRENEM of 08-30-93 and its reforms, is repealed.
• b)Article 35 of the Regulation to the Forestry Law, executive decree No. 25721-MINAE of 10-17-96, shall read: 'The AFE shall set policies to ensure the protection and conservation of all forests and forest lands. To assist in the application of the legislation governing the matter, ad-honorem inspectors shall be appointed, who shall be governed by the Regulation of the Natural Resources Vigilance Committees, COVIRENA."

20490-MIRENTM is repealed.

The Minister of Environment and Energy shall appoint, within the same period, the three remaining members.

De los y las integrantes de los Comités de Vigilancia de los Recursos Naturales

Los vigilantes de los recursos naturales podrán ser menores de edad pero mayores de 15 años.

Para adquirir la condición de vigilantes de los recursos naturales basta cumplir con los requisitos estipulados en el presente Reglamento. Tanto a los inspectores de recursos naturales ad-honorem como los Vigilantes de Recursos Naturales se les otorgará un carné de identificación y el distintivo correspondiente, adquiriendo así los respectivos derechos y obligaciones inherentes a su condición de integrantes de un comité de vigilancia de los recursos naturales. La vigencia de este carné es de 2 años, pero el mismo podrá ser revocado por la Secretaría Nacional, en cualquier momento, previa audiencia del interesado, de comprobarse alguna de las causales contempladas en este Reglamento.

• a)Ser costarricense o tener la condición de residente.
• b)Ser mayor de edad.
• c)Llenar el formulario de solicitud que al efecto facilitará la Secretaría Nacional.
• d)Concluir satisfactoriamente los aspectos de instrucción y prácticas que la Secretaría Nacional determine.
• e)Incorporarse a alguno de los Comités de Vigilancia de los Recursos Naturales o formar un nuevo comité.

• a)Ser costarricense o tener la condición de residente.
• b)Ser mayor de 15 años.
• c)Llenar el formulario de solicitud que al efecto facilitará la Secretaría Nacional.
• d)Concluir satisfactoriamente los aspectos de instrucción y capacitación que determine la Secretaría Nacional, de conformidad con las normas que esta dictará.

• a)Cumplir con las disposiciones legales vigentes, así como con las directrices que al efecto dicte la Secretaría Nacional.
• b)Colaborar con funcionarios públicos competentes, en las inspecciones y labores de índole ambiental.
• c)Efectuar de acuerdo con la ley, labores de vigilancia y protección de los recursos naturales y del ambiente. Asimismo, como grupo podrá realizar labores a favor del ambiente brindando posteriormente un informe a la Secretaría Nacional, quien informará a la Oficina del MINAE más cercana a cada comité como así también a las autoridades que la misma considere pertinentes.
• d)Participar en las labores propias del cuido de las áreas protegidas, en coordinación con los funcionarios públicos encargados y según lo estipulado en la Ley de Conservación de la Vida Silvestre 7317 y la Ley Forestal 7575.
• e)Presentar las denuncias ante las autoridades correspondientes sobre las infracciones a la legislación vigente en materia ambiental.
• f)Cumplir y hacer cumplir las leyes, decretos y reglamentos que rigen esta materia.
• g)Mantener en el ejercicio de la labor como Inspector, una actitud permanente de serenidad, prudencia y atención, así como de cortesía y amabilidad para con la ciudadanía.
• h)Cumplir fielmente con las disposiciones de este Reglamento y con cualquier otra estipulada en la legislación vigente.
• i)Tener hábitos de vida y una conducta personal acordes con los principios de conservación y protección de los recursos naturales y del ambiente.
• j)Actuar en el cumplimiento de sus deberes en grupos de Inspectores debidamente formalizados e identificados, no menores a 3 individuos.
• k)Orientar, coordinar y asesorar a los Vigilantes de los Recursos Naturales. 1) Solicitar quince días previo a su vencimiento la renovación del carné que lo acredita como Inspector.

• a)Recibir capacitación y asesoría sobre la protección de los recursos naturales y brindar aquella que sea necesaria para alcanzar una mayor concientización de la población, según los programas que al efecto la Secretaría Nacional elabore.
• b)Elegir y ser electo como representante del comité al que pertenece a la asamblea de la región donde se nombrará el Comité Regional, o como representante de los comités regionales a los encuentros nacionales que nombrarán a los miembros de la Secretaría Nacional.
• c)Dar testimonio fiel de todo cuanto hubiere visto, oído y actuado en el cumplimiento de sus deberes.
• d)Pedir informes a las estructuras de dirección del COVIRENA.
• e)Solicitar el apoyo de los coordinadores del COVIRENA para la realización de sus actividades.
• f)Tener su carné que lo acredite como Inspector de los Recursos Naturales.

• a)Ejercer una labor de vigilancia en las zonas rurales y urbanas del país en colaboración con los inspectores de los recursos naturales regulares y ad-honorem en el cumplimiento de la legislación ambiental vigente.
• b)Fomentar dentro de sus comunidades, acciones de .educación y concientización de la importancia de la protección de los recursos naturales y el ambiente.
• c)Coordinar con las diferentes organizaciones de la sociedad civil, campañas, programas y acciones de mejoramiento del entorno natural y del ambiente urbano y rural.
• d)Tener hábitos de vida y una conducta personal acordes con los principios de conservación y protección de los recursos naturales y del ambiente.
• e)Recibir capacitación y asesoría sobre la protección de los recursos naturales y brindar aquella que sea necesaria para alcanzar una mayor concientización de la población, según los programas que al efecto la Secretaría Nacional elabore.
• f)Mantener en el ejercicio de la labor como Inspector, una actitud permanente de serenidad, prudencia y atención, así como de cortesía y amabilidad para con la ciudadanía.
• g)Solicitar quince días previo a su vencimiento la renovación del carné que lo acredita como vigilante.

• a)Recibir capacitación y asesoría sobre la protección de los recursos naturales y brindar aquella que sea necesaria para alcanzar una mayor concientización de la población, según los programas que al efecto la Secretaría Nacional elabore.
• b)Acceder a la categoría de Inspector ad-honorem una vez adquirida la mayoría de edad.
• c)Pedir informes a las estructuras de dirección del COVIRENA.
• d)Solicitar el apoyo de los coordinadores del COVIRENA para la realización de sus actividades.
• e)Tener voz dentro del comité al cual está adscrito.
• f)Tener su carné que lo acredite como Inspector de los Recursos Naturales.

De la estructura de los Comités de Vigilancia de los Recursos Naturales

* Un Consejo Nacional de los Comités de los Recursos Naturales o CONACOVIRENA.

* Una Secretaría Nacional.

* Direcciones Regionales, que serán tantas como la Secretaría Nacional considere necesarias para su operacionalidad.

* Los Comités de Vigilancia de los Recursos Naturales que sean necesarios en todo el país.

I. La Primera Dama de la República, quien lo preside

II. El Ministro del Ambiente y Energía

III. Los Expresidentes de la República

IV. Los Presidentes Ejecutivos del ICE y el AyA

V. Dos representantes de la Secretaría Nacional y el Director Ejecutivo

• a)Reunirse por lo menos dos veces al año en forma ordinaria.
• b)Dirigir las políticas globales y los lineamientos generales para el funcionamiento de los COVIRENAS.
• c)Efectuar evaluaciones periódicas de las labores realizadas por la Secretaría Nacional.
• d)Cualquier otro que el presente Reglamento o la legislación vigente establezcan.

* Tres integrantes nombrados por el Ministro del Ambiente y Energía.

* Cuatro integrantes nombrados por el Encuentro Nacional de las Direcciones Regionales de los COVIRENA, los cuales no necesariamente deberán pertenecer a una Dirección Regional, pero que deberá ser Inspector ad-honorem.

• a)Nombrar de su seno a un coordinador de la Secretaría Nacional.
• b)Nombrar un/a director/a ejecutivo/a de COVIRENA.
• c)Aprobar la creación de los Comités de Vigilancia de los Recurso Naturales de todo el país.
• d)Revocar los nombramientos de los inspectores ad-honorem y de los Vigilantes de los Recursos Naturales que incurran en las causales di sanción contempladas en el presente Reglamento.
• e)Oficializar la disolución de los comités que incurran en alguna de las causales de sanción contempladas en este Reglamento.
• f)Velar para que la gestión de los COVIRENAS y sus integrantes se ejecute de conformidad con las normas vigentes.
• g)Procurar que las direcciones regionales presenten los informes mensuales en la forma debida y dentro de los plazos establecidos.
• h)Mantener una comunicación constante y fluida con todos los componentes de la estructura organizativa.
• i)Poner en marcha los planes de acción y los programas educativos y de capacitación para los integrantes de los COVIRENAS.
• j)Coordinar con las otras instancias del MINAE y del Estado la realización de actividades, operativos, proyectos y programas de protección.
• k)Aprobar el nombramiento de los vigilantes e inspectores de los recursos naturales.
• l)Cualquier otro que el presente Reglamento o la ley vigente establezcan.
• m)Convocar los Encuentros Nacionales de COVIRENA.
• n)Mantener un Registro de Inspectores y Vigilantes ad-honorem, el cual informará acerca de sus movimientos semestrales al Ministro del Ambiente y Energía.
• o)Informar a las Direcciones Regionales y comités acerca del desarrollo del movimiento nacional y de su propia gestión.

• a)Nombrar de su seno a un o una coordinadora regional, quien presidirá durante un año, pudiendo ser reelecto, así como darse la organización que mejor se adecue a su respectiva región, la cual deberá ser presentada a la Secretaría Nacional para su aprobación.
• b)Elaborar los planes de trabajo trimestrales de su región, para ser presentados a la Secretaría Nacional.
• c)Conocer las acciones, operativos, campañas y proyectos de cada uno de los Comités de Vigilancia de los Recursos Naturales de su región.
• d)Reunirse en forma ordinaria cada quince días y en forma extraordinaria cuando sea convocada por dos terceras partes de sus integrantes.
• e)Coordinar con los funcionarios públicos competentes la realización de operativos de control y vigilancia de los recursos naturales o del ambiente.
• f)Elaborar programas de concientización y educación ambiental para su región.
• g)Realizar y tramitar ante la Secretaría Nacional, los informes mensuales de actividades realizados por los comités.
• h)Informar a sus comités acerca del desarrollo del movimiento nacional reportado por la Secretaría Nacional y de su propia gestión.
• i)Nombrar delegados para el Encuentro Nacional de Direcciones Regionales, convocado al efecto por la Secretaría Nacional y según las normas que este órgano emita para tal fin.

Cada uno tendrá su organización y plan de trabajo que mejor se adapte a su zona. Nombrará un coordinador que será responsable de las acciones del comité, quien durará un año en el puesto, pudiendo ser reelecto.

• a)Realizar un plan trimestral que deberá ser presentado a las respectivas direcciones regionales, para que estas lo hagan llegar a la Secretaría Nacional.
• b)Estar incorporado debidamente a una de las direcciones regionales.
• c)Presentar mensualmente ante su dirección regional, informe de la realización de actividades de sus inspectores y vigilantes ad-honorem en el que se contemplarán participantes, fecha, hora, lugares exactos de los sitios en donde se desarrollaron las actividades, objetivos perseguidos.
• d)Coordinar y cooperar con las instituciones y organizaciones de la sociedad civil de su comunidad la realización de actividades de concientización y de educación ambiental que permitan aumentar el apoyo de los y las ciudadanas al trabajo que realiza cada comité.

De las faltas y sanciones

• a)Amonestación oral.
• b)Amonestación escrita.
• c)Suspensión temporal por un mínimo de un mes y hasta por el tiempo que reste de vigencia de su carné.
• d)Suspensión del puesto de jefe de comité, miembro de la Dirección Regional, de la Secretaría Nacional, según corresponda.
• e)Expulsión definitiva.
• f)Disolución del Comité de Vigilancia de los Recursos Naturales sancionado.

La Dirección Regional para los incisos a, b y c. La Secretaría Nacional para los incisos a, b, c, d, e y f.

El CONACOVIRENA para todas las sanciones aplicadas se constituirá en tribunal de alzada.

• a)Incumplimiento reiterado de los deberes y responsabilidades asumidas como inspector ad-honorem o integrante de un COVIRENA.
• b)Inactividad prolongada por más de tres meses sin justificación.
• c)Excederse en las atribuciones o potestades contempladas en este Reglamento.
• d)Violar las disposiciones legales de cualquier naturaleza en las labores como inspector ad-honorem.
• e)Recibir dádivas, recompensas, favores o pagos de cualquier tipo durante o a raíz del trabajo realizado en la condición de Inspector ad-honorem.
• f)Actuar bajo los efectos del licor u otras drogas durante la realización de alguna actividad u operativo en la condición de Inspector Ad-honorem.
• g)Agredir verbal o físicamente a otras personas en el cumplimiento del trabajo.
• h)Retener ilegalmente o no reportar a las autoridades correspondientes, artículos u objetos pertenecientes a infractores de la legislación ambiental vigente que estén bajo su custodia o responsabilidad.
• i)Someter a un trato cruel o degradante a los infractores que estén bajo su custodia o responsabilidad.

De los reconocimientos y estímulos

• a)Se suprime el párrafo segundo del artículo 47 del Reglamento a la Ley de Conservación de la Vida Silvestre decreto ejecutivo No 22545-MIRENEM del 30-08-93 y sus reformas.
• b)El artículo 35 del Reglamento a la Ley Forestal decreto ejecutivo No y 25721-MINAE del 17-10-96 para que diga: 'La AFE fijará las políticas para velar por la protección y conservación de todos los bosques y terrenos forestales. A efecto de coadyuvar en la aplicación de la legislación que rige la materia, se nombrarán inspectores ad-honorem, los cuales se regirán por el Reglamento de los Comités de Vigilancia de los Recursos Naturales, COVIRENA".

Transitorios

El Ministro del Ambiente y Energía, nombrará en el mismo plazo, a los tres miembros restantes.
