Amendment to the National Board for the Blind LawReforma a la Ley del Patronato Nacional de Ciegos

2171 of October 18, 1957, are hereby amended, as follows:

“Article 6- The Board (Patronato) shall be composed of a delegate from each of the Ministries of Labor and Social Security (Trabajo y Previsión Social), Public Education (Educación Pública) and Public Health (Salubridad Pública), in addition, by the Director of the Special Education School as representative of that same Institution, a practicing blind teacher, a representative of the School of Social Service of the University of Costa Rica, a delegate of the Association of Friends of the Blind (Asociación de Amigos del Ciego), a delegate of the Hellen Keller Center and an ophthalmologist appointed by the College of Physicians and Surgeons (Colegio de Médicos y Cirujanos), who shall also serve as the ex officio President of the Board of Directors.” “Article 9- The members of the Board (Patronato) who are representatives of the Ministries shall perform this role as part of their public duties; for that purpose, said Ministries must grant them permission on each occasion for up to two hours. All members shall perform their duties gratuitously.” “Article 11- The members of the Board (Patronato) shall be appointed for terms of two years, and may be reelected. The positions of the Board of Directors of the Board (Patronato) shall also last two years, and may also be reelected.” “Article 13- To achieve greater specialization of the matters under its charge, the Board (Patronato) shall form the following study commissions:

• a)Education, b) Social Service; c) Finances d) Legislation; e) Special Affairs; and f) International Affairs”

• j)To administer the funds designated for social assistance; for this purpose, it may install and maintain the necessary administrative bodies.”

2547 of February 22, 1960, is modified, which shall read as follows:

“Article 12 - Four per thousand of the proceeds of the cigarette tax is allocated to the construction and installation of workshops, to the better equipping of the schools for the blind already established, and for homes for the blind. The Costa Rican Social Security Fund (Caja Costarricense de Seguro Social) shall transfer the proceeds of the cited percentage to the National Board for the Blind (Patronato Nacional de Ciegos), which must use it in service programs for the blind cited in the preceding paragraph.”

The Board (Patronato) may negotiate a loan based on this income to carry out its works. The construction and installation of workshops shall be specifically carried out by the Hellen Keller Center, under the direction of the Board of Directors of the Board (Patronato) and with the technical advice of the Engineering Department of the General Directorate of Assistance (Dirección General de Asistencia).

The Comptroller General of the Republic (Contraloría General de la República) shall oversee the investment of these funds.

The workshops that are built shall include comprehensive rehabilitation services and vocational training, paid work, job placement, recreation, and blindness prevention.

The direction of those workshops and the referred services shall be in charge of a national technician in rehabilitation of the blind. A teaching staff must provide service in them, constituted of at least fifty percent by persons trained in Costa Rica, with the assistance of the National University (Universidad Nacional).

50% for workshops; 20% for better equipping of schools already established; and 30% for homes for the blind.

2547 of February 22, 1960, all services provided to the blind shall be in charge of non-profit organizations and institutions, especially founded for that purpose.

"Rehabilitable: Official classification with official diagnosis (Article 2 of Law No. 2171), good physical and mental health, age not exceeding 55 years, and a manifest positive attitude of interest in economic, psychological, and social independence. Individuals of a greater age, with a non-severe double physical impairment, may also be granted this same status when they meet the other conditions in the judgment of the general practitioner, ophthalmologist, clinical psychologist, vocational counselor, graduate social worker, physiotherapist, or other specialists to whom the institutions interested in their eligibility as such may resort.

Non-Rehabilitable (or eligible to receive direct aid from the Board (Patronato)):

• a)To be classified by the Board (Patronato) as "Non-Rehabilitable" b) Not possess real property, except their own private residence; c) Not receive appreciable subsidies from insurance companies or institutions on account of indemnity for their blindness; d) Be a person of recognized poverty, by investigation in which collateral information unknown to the presumed beneficiary is not used; and e) Be a head of family with children under 16 years of age.

Student: A person of any age who is pursuing courses in schools, high schools, the University, or specific vocational education, with satisfactory academic results and with a view toward their professional training.

2171 and by Articles 8 and 9 of this law, the National Board for the Blind (Patronato Nacional de Ciegos) shall issue a confidential form reporting the following data about the interested blind persons: name, address, date of birth, distance vision in each eye with and without correction, near vision in each eye with and without correction (estimated in convenient print size, and if necessary by counting fingers, hand motion at so many centimeters, and light perception), diagnosis including the primary and secondary cause of blindness, etiology including the occurrence of blindness, recommendations, whether the condition is progressive or not, a diagram of the visual fields indicating the size and color of the object used for the test. Said report may be filled out by a general physician where there is no eye specialist, and must bear the signature of the person recording it, as well as the legally required medical stamp. A space shall be reserved for the seal and signature of the Board (Patronato), which shall classify the person as blind, noting the date of classification on the same document.

Communicate to the Executive Branch Given in the Session Hall of the Legislative Assembly. - San José, on the thirtieth day of November, nineteen hundred sixty-one.

Presidential House. - San José, on the twentieth day of December, nineteen hundred sixty-one.

Enacted and published. - "La Gaceta No. 293 of December 24, nineteen hundred sixty-one.

“Artículo 6°- Estará integrado el Patronato por un delegado de cada uno de los Ministerios de Trabajo y Previsión Social, Educación Pública y Salubridad Pública, además, por el Director de la Escuela de Enseñanza Especial representante de esta misma Institución, un profesor ciego en ejercicio, por un representante de la Escuela de Servicio Social de la Universidad de Costa Rica, un delegado de la Asociación de Amigos del Ciego, un delegado9 del Centro Hellen Keller y un médico oftalmólogo nombrado por el Colegio de Médicos y Cirujanos, que será a su vez el Presidente nato de la Junta Directiva”.

Todos los miembros desempeñaran el cargo gratuitamente.”

Los cargos de la Junta Directiva del Patronato durarán también dos años, y también podrán ser reelectos”

• a)Educación, b) Servicio Social; c) Finanzas d) Legislación; e) Asuntos Especiales; y f) Asuntos Internacionales”

• j)Administrar los fondos destinados a asistencia social, para este efecto podrá instalar y mantener los órganos administrativos necesarios.”

“Artículo 12° - Destinase el cuatro por mil del producto del impuesto a los cigarrillos a la construcción e instalación de talleres, a la mejor dotación de las escuelas para ciegos ya establecidas y para hogares de ciegos. La Caja Costarricense de Seguro Social girará el producto del citado porcentaje al Patronato Nacional de Ciegos, el cual deberá usarlo en programas de servicio a los ciegos, el cual deberá usarlo en programas de servicio a los ciegos citados en el párrafo anterior”.

El Patronato podrá negociar un préstamo con base en estos ingresos para la realización de sus obras. La construcción e instalación de talleres, serán específicamente realizados por el Centro Hellen Keller, bajo la dirección de la Junta Directiva del Patronato y con el asesoramiento técnico del Departamento de Ingeniería de la Dirección General de Asistencia.

La Contraloría General de la República fiscalizará la inversión de estos fondos.

Los talleres que se construyan deberán comprender los servicios de rehabilitación integral y entrenamiento vocacional, trabajo remunerado, colocación, recreación y prevención de la ceguera.

La dirección de esos talleres y los referidos servicios estarán a cargo de un técnico nacional en rehabilitación de ciegos. En los mismos deberá prestar su servicio un personal docente, constituido por lo menos en su cincuenta por ciento con personas entrenadas en Costa Rica, con el concurso de la Universidad Nacional.

Un 50% para talleres; Un 20% para mejor dotación de escuelas ya establecidas; y Un 30% para hogares para ciegos.

"Rehabilitable: Clasificación oficial con diagnostico oficial (artículo 2° de la ley N° 2171) buena salud física y mental, edad que no sobrepase de los 55 años y una manifiesta actitud positiva de interés por independencia económica, sicológica y social. También podrán tenerse por esta misma calidad, individuos de más edad, con doble impedimento físico no severo, cuando reúnan las demás condiciones a juicio del médico general, oftalmólogo, sicólogo clínico, consejero vocacional, servidor social graduado, fisioterapista u otros especialistas a quienes recurrieren las instituciones interesadas en su elegibilidad como tal.

No Rehabilitable (o apto para recibir auxilio directo del Patronato):

• a)Ser catalogado en el Patronato como "no Rehabilitable" b) No poseer bienes raíces, excepto su propia casa de rehabilitación; c) No recibir subvenciones apreciables de compañías o instituciones aseguradoras por concepto de indemnización por su ceguera; Ch) Ser persona de reconocida pobreza, por investigación en la que no se use información colateral ignorada por el presunto beneficiario; y d) Ser padre de familia con hijos menores de 16 años.

Estudiante: Persona de cualquier edad que sigue cursos en escuelas, colegios, Universidad o educación vocacional específica, con resultados académicos satisfactorios y con miras hacia su formación profesional.

Dicho reporte podrá ser llenado por un médico general en donde no hubiere especialista de los ojos, y deberá llevar la firma de quien lo consigna, así como el timbre médico de ley. Será reservado un espacio para el sello y firma del Patronato, que clasificará a la persona como ciega, anotando en el mismo documento la fecha de la clasificación.
