No. 28772-MEIC-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF ECONOMY, INDUSTRY AND TRADE AND OF AGRICULTURE AND LIVESTOCK In accordance with the powers conferred by subsections 3) and 18) of article 140 of the Political Constitution, subsection 2.b of article 28 and 62 of the General Law of Public Administration, Law No. 6227 of May 2, 1978, the Law of Industrial Standards No. 1698 of November 26, 1953, the Law of the International System of Measurements No. 5292 of August 9, 1973, Law No. 6054 of June 7, 1977, the Organic Law of the Ministry of Economy, Industry and Trade, Law No. 5395 of October 30, 1973, the General Health Law, the Plant Protection Law, Law No. 6243 of May 2, 1978, articles 6, 8 and 29 of the Law for the Promotion of Competition and Effective Defense of the Consumer, Law No. 7472 of December 20, 1994, the Agreements that Comprise the Final Act Approving the Results of the Uruguay Round of Multilateral Trade Negotiations, Law No. 7475 of December 20, 1994,

1. 1That it is an unavoidable duty of the State to safeguard the health of the population by preventing or suppressing those acts or omissions by private parties that pose a risk to the legitimate rights of consumers and end users of goods.
2. 2That among the activities the State must carry out to achieve the aforementioned objective is guaranteeing the population access to foods that meet adequate sanitary, physical, chemical, organoleptic, microbiological, and physiological conditions for human consumption and productive processes in general.
3. 3That any procedure or regulation of internal economic activities affecting commercial exchange must be carried out with respect for freedom of enterprise, the defense of productivity, and consumer rights, requiring only the minimum necessary to protect human, animal, or plant health, the environment, and compliance with minimum quality standards.
4. 4That consumers have the right to protection against risks that may potentially affect their health or their legitimate economic interests, as provided in subsections a) and b) of article 29 of Law No. 7472.
5. 5That any measure the country executes in commercial matters that may have a restrictive effect on trade flows into, out of, and within Costa Rica must be done with absolute adherence to and respect for the legitimate exercise of commercial activity and the commitments the country has undertaken as a member of the World Trade Organization, particularly those that require transparency in the preparation and execution of such measures and the imperative that they pursue legitimate objectives as defined by article 2 of the Agreement on Technical Barriers to Trade.
6. 6That it is necessary to strengthen controls in markets, plazas, and collection centers, means of transport, and other marketing channels for agricultural products and byproducts to guarantee that these products, and especially those intended for human consumption, comply with the plant health and quality standards and requirements in force in the national legal system.
7. 7That the Ministry of Agriculture and Livestock, through the State Plant Health Service (Servicio Fitosanitario del Estado) and the Directorate of Animal Health, has the necessary human resources to effectively and efficiently carry out inspections aimed at verifying that agricultural products and/or byproducts for human consumption comply with the sanitary, plant health, and quality requirements established in the current legislation and regulations.
8. 8That according to article 8 of the Law for the Promotion of Competition and Effective Defense of the Consumer, Law No. 7472 of December 20, 1994, the Ministry of Economy, Industry and Trade is responsible for the accreditation of natural or legal persons, public or private, that meet the technical requirements and material and professional suitability demanded by the regulatory standards issued by the Executive Branch, to operate as certification bodies and testing/assay laboratories, in the fields of human, animal, and plant health, the environment, safety, and quality standards, so that their certificates and analyses are officially recognized.
9. 9That the entities and bodies of the Public Administration that accredit certifying bodies and laboratories to perform accredited assays and analyses are obligated to investigate and sanction the quality control of agricultural products and byproducts. Therefore,

1. 1Que es un deber ineludible del Estado velar por la salud de la población evitando o reprimiendo aquellos actos u omisiones de particulares que impliquen un riesgo para los derechos legítimos de los consumidores y usuarios finales de los bienes.
2. 2Que dentro de las actividades que el Estado debe realizar para alcanzar el logro del objetivo citado se encuentra el garantizar a la población el acceso a alimentos que reúnan condiciones sanitarias, físicas, químicas, organológicas, microbiológicas y fisiológicas adecuadas para el consumo humano y los procesos productivos en general.
3. 3Que cualquier trámite o regulación de las actividades económicas internas que afecten el intercambio comercial debe realizarse con respeto a la libertad de empresa, la defensa de la productividad y de los derechos al consumidor, exigiéndose únicamente el mínimo necesario para proteger la salud humana, animal o vegetal, el ambiente y el cumplimiento de los estándares mínimos de calidad.
4. 4Que es un derecho de los consumidores la protección contra los riesgos que puedan afectar potencialmente su salud o sus legítimos intereses económicos tal y como lo disponen los incisos a) y b) del artículo 29 de la Ley Nº 7472.
5. 5Que cualquier medida que el país ejecute en materia comercial que pueda tener efecto restrictivo sobre los flujos de comercio en, desde y hacia Costa Rica debe hacerse con absoluto apego y respeto hacia el ejercicio legítimo de la actividad comercial y los compromisos que el país ha adquirido como miembro de la Organización Mundial del Comercio, en particular aquellos que disponen la necesidad de otorgar transparencia en la elaboración y ejecución de tales medidas y el imperativo de que las mismas obedezcan a objetivos legítimos tales como los define el artículo 2 del Acuerdo sobre Obstáculos Técnicos al Comercio.
6. 6Que resulta necesario reforzar los controles en mercados, plazas y centros de acopio, medios de transporte y otros canales de comercialización de productos y subproductos agrícolas a efecto de garantizar que estos productos y en especial los destinados al consumo humano cumplan con las normas y requisitos fitosanitarios y de calidad vigentes en el ordenamiento jurídico nacional.
7. 7Que el Ministerio de Agricultura y Ganadería, a través del Servicio Fitosanitario del Estado y de la Dirección de Salud Animal, cuenta con el recurso humano necesario para realizar en forma eficaz y eficiente las inspecciones tendientes a verificar que los productos y/o subproductos agrícolas para consumo humano cumplan con los requisitos sanitarios, fitosanitarios de calidad, establecidos en la legislación y reglamentación vigente.
8. 8Que según el artículo 8 de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, Ley Nº 7472 de 20 de diciembre de 1994, le compete al Ministerio de Economía, Industria y Comercio la acreditación a personas físicas o jurídicas, públicas o privadas que cumplan los requisitos técnicos y de idoneidad material y profesional, exigidos en las normas reglamentarias dictadas por el Poder Ejecutivo, para operar como organismos de certificación y laboratorios de prueba de ensayo, en los campos de la salud humana, animal y vegetal, el medio ambiente, la seguridad y los estándares de calidad, a fin de que sus certificados y análisis se reconozcan oficialmente.
9. 9Que los entes y los órganos de la Administración Pública que acrediten a organismos certificadores y laboratorios para realizar ensayos y análisis acreditados, están obligados investigar y sancionar el control de calidad de los productos y subproductos agrícolas. Por tanto,
