1. 1That

the Forestry Law (Ley Forestal) establishes as an essential function of the State to ensure the protection, use, conservation, administration, and promotion of the country's forest resources, in accordance with the principle of rational use of Renewable Natural Resources.

2°-In accordance with the principles and regulations established in the Forestry Law (Ley Forestal) No. 7575 of April 16, 1996 and its amendment by Law (Ley) 7761 of April 24, 1998; the Regulation of the Law (Ley) 7575 by Executive Decree No. 2572I-MINAE published in La Gaceta # 16 of January 23, 1997 and its amendments, establishes that the State Forest Administration (Administración Forestal) del Estado will define by administrative provision guidelines and procedures that facilitate the application of forestry legislation.

1. 3That

the State Forest Administration (Administración Forestal) del Estado must ensure rational and sustained management of the forest resource consistent with the interests of the other economic and social sectors of the country.

4°-In order to standardize the activities of production, use, industrialization, and promotion of the country's forest resources; a provision is required that allows the administered party and officials to have a common language regarding legal and technical requirements. Therefore, THE DIRECTOR GENERAL OF THE NATIONAL SYSTEM OF CONSERVATION AREAS, RESOLVES 1°-To issue the following directives for the issuance and use of plastic transport guides and tags for timber.

1.1. Parties Responsible for the custody and issuance of guides and tags.

1.1.1. Each Conservation Area (Área de Conservación, AC) through the administrative officer or official designated by the Director, will process before the MINAE Department of Procurement the procurement of guides and tags for all subregions and will distribute them to each Subregional Office.

1.1.2. The administrative department or office of each Area must include within the quarterly report sent to the SINAC Information Systems Component a table with the SEMEC (1) requirements containing the following information:

(1)SEMEC: Monitoring of Continuous Improvement (SINAC commission) 1.1.3. Each Subregional Office of the corresponding Conservation Area will designate a responsible official for the custody and issuance of guides and tags for timber transport; who will keep a record in an official logbook opened in the Subregional Office where the issuance information will be recorded, as follows:

The issuance of guides and tags must be made against an authorization slip signed by the Subregional Chief or the competent official designated for this purpose, which must remain in the file. The referred slip must be designed in the following manner:

1.2.1. The Subregional Chief or designee will issue the slip for the delivery of guides and tags, prior review of the Forest Management Report (Informe de Regencia), when applicable; this report must comply with the following conditions:

1.2.1.1 The Forest Management Contract (Contrato de Regencia) must be current and registered with the College of Agronomists (Colegio de Ingenieros Agrónomos) (review the file).

1.2.1.2. When dealing with reports for the opening of the harvesting phase, it must indicate the main technical recommendations for executing the harvesting based on the management plan, its corrections, and the approval resolution, indicating in said report that the base map and final list of trees to cut have been delivered to the workers responsible for the harvesting.

1.2.1.3. The Forest Management Report (Informe de Regencia) must be submitted no more than 20 business days after the visit is made.

1.2.1.4. Each of the sections or parts of the form must contain all the predetermined information, especially the two final tables, one relating to the # of logs per species in the yard and the other regarding the # of trees per species authorized versus # trees cut per species; as well as the report of guides and tags delivered and used.

1.2.1.5. Only Forest Management Reports (Informes de Regencia) submitted on the form designed by the College of Agronomists (Colegio de Ingenieros Agrónomos, CIA) for this purpose are accepted.

1.2.1.6. Its content must be clear and written in legible handwriting.

1.2.1.7. When dealing with Closure Reports, they must record the fulfillment of the recommendations indicated in the previous report, construction of erosion control works (water bars, ditches) and closure of roads, removal of solid and chemical waste from roads and yards, clearance of watercourses obstructed as a consequence of the harvesting.

1.2.1.8. When the Forest Management Report (Informe de Regencia) does not comply with the above conditions, it will not be accepted and consequently guides and tags will not be granted.

1.2.1.9. When anomalies are reported in the Forest Management Report (Informe de Regencia), the Subregional Chief, by resolution, will open the administrative proceeding to investigate the reported facts. For cases where these anomalies include the cutting of trees not authorized in the approval resolution and/or opening of roads not included in the management plan, in that resolution to open the proceeding, a temporary suspension of the harvesting activities and the seizure of forest products from illegally cut trees must be decreed as a precautionary measure. Once the AFE verifies the reported facts in the field (in case the forest manager has not reported them), a complaint will be filed before the Public Prosecutor's Office (Ministerio Público), as established in article 283 of the Code of Criminal Procedure and articles 57, 61 and 62 of the Forestry Law (Ley Forestal) 7575.

Anomaly is understood as any activity not authorized by means of the resolution approving the management plan and activities that contravene the Forestry Law (Ley Forestal) and related laws.

1.2.1.10. Unused guides must be returned to the AFE , together with the used guides duly sealed by the industry that received the timber (the seals must bear address and corporate name) and will be attached to the file, otherwise no further guides and tags will be granted.

1.2.1.11. Modifications to the management plan referred to in article 23 subsection 4 of the Regulation to the Forestry Law (Ley Forestal) which indicate changes of trees to cut or trajectory of skid trails to build, may only be executed in the field once they have been approved by the AFE (after field inspection) through an administrative resolution that modifies the original resolution. The changes introduced to the components (roads and trees to cut) may not exceed 10% of what was indicated for each one in the management plan originally approved by the AFE. Neither will modifications be approved that refer to the inclusion of areas not contemplated in the approved management plan.

Modifications subject to approval are not considered to be all those that involve the non-cutting of trees authorized by the AFE.

1.3. When starting harvesting in management plans, once the Opening Report prepared by the forest manager (regente forestal) has been submitted, referred to in article 15 of the Forest Management Regulation (Reglamento de Regencias Forestales), a maximum of one third (1/3) of the total guides and tags required for transporting the timber to be extracted in the initial harvesting stage may be granted. This provision will also apply for permits on lands for agricultural use and without forest for which an opening report is provided. Otherwise, the quantity of guides and tags will be delivered according to the volume in the yard reported in the progress reports or in the report of the technician from the AFE, when applicable.

To estimate the quantity of guides and tags required, the calculation will be based on the type of vehicle to be used and the volume to be transported. This information on machinery and equipment must be contained in the management plan that is approved and furthermore, the forest manager must verify that the means of transport to be used for transporting the timber comply with the current weight and dimension regulations for the hauling of cargo on public roads.

1.4.Guides may not be renewed by a note or observation on the expired document (guide). When it is required to renew a guide, it will be prepared anew.

1.5.The issuance of guides and tags for the transport of products from planted trees and Agroforestry Systems (Sistemas Agroforestales, SAF), as applicable, will be done upon delivery of the Certificate of Origin (Certificado de Origen, CO), and the respective copy of the forest management contract (contrato de regencia forestal) registered with the College of Agronomists (Colegio de Ingenieros Agrónomos). This Certificate will be stamped with a received stamp from the corresponding Subregional Office of the AFE, indicating the date received, name, and signature of the official designated by the Subregional Chief for this act.

1.5.1. The Certificate of Origin (Certificado de Origen, CO), will be unique and formulated on CIA security paper, with a copy for the AFE. A document that will be prepared and signed by a Forest Manager; it must contain at least the following information.

Header certifying the existence of a forest plantation or an agroforestry system (sistema agroforestal).

Name of the professional or Forest Manager issuing the document and membership number.

No. of the Forest Management Contract (Contrato de Regencia Forestal).

Validity of the Forest Management Contract (Contrato de Regencia).

Name of the owner; natural person or legal entity.

Name of the Legal Representative in the case of corporations).

Registration data of the farm (# Real Property Folio Registration;# certificate from the Court where possessory information is processed).

Administrative Location.

Geographical location by coordinates.

Number of trees per species included in the certificate (in the case of individually planted trees) or effective area in the case of forest plantations.

Volume per species.

Type of transport: Description of the type of vehicle to be used in transport. It must correspond to those authorized for hauling cargo on the road that will be used to transport the timber.

In the case of Certificates of Origin for Agroforestry Systems (SAF), the # of trees per species/ hectare that will be maintained in the system to guarantee its processes and functions as such, once the harvesting has been carried out, must be indicated. Likewise; the species indicated must correspond to those that the AC has previously defined as possibly found in an SAF, because they are pioneer species or due to other technically justified circumstances.

Date of issuance and expiration of the document. The validity of the CO may only extend until the both in writing.

In those cases where the owner of the forest plantation, in any of the different modalities noted herein, meaning plantations with timber trees on areas less than one hectare, trees planted individually in linear systems, dispersed among agricultural crops or on the perimeter of farms, and timber trees naturally regenerated in agricultural areas and whose species have been previously defined and made official by each Conservation Area as viable naturally regenerated species for use, does not have a property title registered with the Public Registry or another document proving ownership of the property where the plantation was carried out, the State Forest Administration (Administración Forestal del Estado, AFE) will accept as a requirement to seal the Certificate of Origin, a sworn statement made by the possessor of the land, in which case the possessor and the owner of the plantation must be the same person, in these cases the sworn statement must indicate; time of possessing the property, age of the planted trees, planting modality, species or species to be harvested with the initial planting density, adjoining landowners, and mode of acquisition of possession. In the case where the possessor of the property and the owner of the plantation are not the same person, a sworn statement from the plantation owner will be accepted indicating; the age of the planted trees, planting modality, species or species to be harvested with the initial planting density, attaching a copy of the respective lease contract for the property where the forest harvest will be carried out.

The sworn statement must be notarized before a notary public and the College of Agronomists (Colegio de Ingenieros Agrónomos) must accept the original of this document for the purposes of the Forest Manager’s contract.

In the event the property in question belongs to the Institute of Agrarian Development (Instituto de Desarrollo Agrario, IDA), apart from what is established in the previous point, this sworn statement must be accompanied by an authorization from the IDA Board of Directors to carry out the harvest of the plantation.

(This preceding requirement was added by resolution No. 128 of December 5, 2007).

Under no circumstances will any Certificate of Origin be sealed by the AFE where the tree species requested to be harvested are not strictly coming from a forest plantation in the modalities expressly noted in this resolution, with this measure the possibility is ruled out that remnant tree species from the natural forest that are found mixed with the planted tree species or regenerated on these properties are included within the CO for their harvest.

1.5.2. That Certificate of Origin that does not comply with the provisions in point 1.5.1. will not have the received stamp affixed to it referred to in point 1.5 of this resolution and consequently the guides and tags will not be granted, this does not prevent the owner from processing a harvest authorization by providing the requirements established by the Law (Ley) and its regulation.

To process requests submitted to the AFE for quantities of 20 trees or less, the certification of ownership, a copy of the farm plan or location of the property on the Cartographic Sheet (Hoja Cartográfica), and a complete application must be submitted. For larger quantities, the procedure will be in accordance with the provisions of article 91 of the Regulation to the Forestry Law (Ley Forestal) 7575.

1.5.3. When clear-cutting is intended within an SAF, a harvest authorization must be obtained through the procedure indicated in the preceding paragraph.

1.5.4. For the transport of timber in log form, the tag system defined in Executive Decree #27240-MINAE will be used, using tags of orange color for timber from agroforestry systems and yellow color for logs from forest or lands for agricultural use without forest.

1 .5.5. The last week of each month, the Subregional Office must send a report to the municipalities in its jurisdiction regarding the forest harvest permits and certificates of origin received. The information will be presented in the following form:

Signature of the Subregional Chief:__________________ 1.6. For the transport of sawn timber, it must be backed by an authorized (stamped) sales or sawmilling invoice. If it is sawn timber in situ, it must carry the transport guide for sawn timber plus the sawmilling invoice issued by the authorized responsible party (owner of the portable sawmill), except if it is the landowner (of the farm and the sawmill machinery) in which case he must carry the transport guide.

1.7. The natural or legal persons who have integrated their raw material coming from forest plantations or agroforestry systems into a forest industry may benefit from an alternative system for transport guides; the same that has been described in the Administrative Resolution (Resolución Administrativa) # 613-SINAC, published in La Gaceta # 154 of August 12, 1997. The "seal (marchamo)" containing a consecutive number printed on adhesive security paper that must be placed on the upper distal corner of the triangle, will be made by each AC in the color and size indicated in the referred resolution.

1.8. For the use of the emblems (flags) referred to in article 31 of the Regulation to the Forestry Law (Ley Forestal) 7575, the provisions established in the resolution indicated in the previous paragraph will be followed.

1.9. The interested party will pay the net cost of the guides and tags according to what is established in Resolution N ° 049, published in La Gaceta N ° 234 of December 2, 1999. The direct sale of tags and guides will be carried out in the AFE Subregional Offices, whose payment may be made through two mechanisms: (1) payment in cash at the subregional office of the AFE and (2) payment at the Offices of the National Banking System, deposited into the Bank Account # 31-844-4 of the Forest Fund (Fondo Forestal), whose deposit receipt (duplicate or photocopy) must be delivered to the Subregional Office.

In both cases, the official who issues and delivers the guides and tags will give the administered party a receipt, using only the forms authorized by the General Directorate (Dirección General) of SINAC. A copy of these documents must be inserted into the respective file.

1.10. Monthly (no later than the 10th day of each month), the Conservation Areas will send to the SINAC Control and Protection Component a report of liquidation of the sale of guides and tags closing on the last day of the previous month, including a breakdown of the guides and tags delivered per Subregional Office in the following form:

2.1. In accordance with article 42 of the Forestry Law (Ley Forestal) 7575, a log (troza) is considered the section of the tree free of branches, with a diameter greater than or equal to 29 centimeters at the thinnest end, therefore, roundwood pieces that do not meet this condition will not require guides or tags to be transported. This implies that under no circumstances will guides and tags be granted for roundwood pieces with diameters less than 29 centimeters.

2.2. All timber in log, squared, or sawn form, must carry the corresponding transport guide, designed for this purpose by the AFE; a document that may not be issued with a validity exceeding two months.

2.3. Logs (trozas) from plantations may only be transported without tags.

2.4. The marking hammer (mazo) will only be used for the control of timber in the yard of forest industries, leaving the number stamped on the faces of the log, in such a way that recently entered timber (without number) is differentiated from timber already reviewed (numbered).

It may also be used in forest seizures (decomisos forestales), so that on the logs the abbreviation DF (decomiso forestal) and the number of the marking hammer with which it was carried out can be differentiated.

2.5. When guides are granted for "transloading yard (empatiado)" outside the farm, an express request must be made by the Forest Manager and the owner or legal representative of the farm where the project or Management Plan is executed; the request must contain at least the following information:

Name of the project or Management Plan owner. . Project Location (Hamlet, District, Canton, and Province).

Name of the Forest Manager.

Justification for the decision to establish the temporary yard (state and conditions of the road versus vehicle capacity, pressing environmental conditions).

Precise location of the "temporary yard (patio temporal)"; including the name of the owner of the property where the temporary yard will be established.

Estimated time the timber will remain in that yard.

No. of logs (trozas) to transport and their Volume per species.

Type of transport to be used: Specify vehicle or means (license plates, capacity, size in the case of barges; among others).

Type of mark adopted (it is recommended to use distinctive initials of the owner of each permit) with which each log (troza) will be marked.

2.6. The "temporary transloading (empatiado temporal)" procedure will be applied only in qualified cases in which the environmental conditions or immediate access roads to the farm do not allow entry of trucks or restrict the load capacity of the vehicle, or due to the nature of the transport (for example use of barges) and must have the express authorization of the Subregional Chief.

In the "temporary yard (patio temporal)" the logs (trozas) must be grouped separately by permit and permit holder.

3°-Eliminate point 3 " Certificate of Origin Format" from Resolution N ° 613-SINAC at 12 hours on the ninth of May, nineteen ninety-seven, published in La Gaceta N ° 154 of August 12, 1997. In its place and in accordance with what establishes article 2 of the Regulation to the Forestry Law (Ley Forestal) 7575, the following format is designed:

4°-Administrative resolution 054-SINAC, at fifteen hours on the twenty-ninth of November, 1999 and published in La Gaceta number 17 of the twenty-fifth of January of the year two thousand, is left without effect.

5°-Takes effect upon its publication.

1. 1Que

la Ley Forestal establece como función esencial del Estado velar por la protección, aprovechamiento, conservación, administración y fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los Recursos Naturales Renovables.

2°-De conformidad con los principios y regulaciones establecidas en la Ley Forestal N° 7575 del 16 de abril de 1996 y su reforma a través de la Ley 7761 del 24 de abril de 1998; el Reglamento a la Ley 7575 mediante Decreto Ejecutivo N° 2572I-MINAE publicado en La Gaceta # 16 del 23 de enero de 1997 y sus reformas, establece que la Administración Forestal del Estado definirá por disposición administrativa lineamientos y procedimientos que faciliten la aplicación de la legislación forestal.

1. 3Que

la Administración Forestal del Estado debe asegurar un manejo racional y sostenido del recurso forestal congruente con los intereses de los demás sectores económicos y sociales del país.

4°-En aras de normalizar las actividades de producción, aprovechamiento, industrialización y fomento de los recursos forestales del país; se requiere de una disposición que permita al administrado y a los funcionarios tener un leguaje común en cuanto a los requerimientos legales y técnicos. Por tanto, EL DIRECTOR GENERAL DEL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, RESUELVE 1°-Dictar las siguientes directrices para la entrega y empleo de guías y placas plásticas para el transporte de madera.

1.1. Responsables de la custodia y entrega de guías y placas.

1.1.1. Cada Área de Conservación (AC) a través del encargado administrativo o funcionario(a) que el Director designe, gestionará ante el Departamento de Proveeduría del MINAE la obtención de guías y placas para todas las subregiones y las distribuirá a cada Oficina Subregional.

1.1.2. El departamento u oficina administrativa de cada Area, deberá incluir dentro del informe trimestral enviado al Componente de Sistemas de Información del SINAC una tabla con los requerimientos SEMEC1 conteniendo la siguiente información:

(1)SEMEC: Seguimiento del Mejoramiento Continuo (comisión del SINAC) 1.1.3. Cada Oficina Subregional del Área de Conservación correspondiente designará un funcionario responsable para la custodia y entrega de guías y placas para transporte de madera; quien llevará un registro en un libro de actas abierto en la Oficina Subregional donde se levantará la información de entrega, de la siguiente manera:

La entrega de guías y placas debe efectuarse contra boleta de autorización firmada por el Jefe Subregional o el funcionario competente que este designe para tal fin, misma que debe quedar en el expediente. La boleta referida debe diseñarse de la siguiente forma:

1.2.1. El Jefe Subregional o designado emitirá la boleta de entrega de guías y placas, previa revisión del Informe de Regencia, cuando corresponda; este informe deberá cumplir con las siguientes condiciones:

1.2.1.1 Contrato de Regencia debe estar vigente e inscrito en el Colegio de Ingenieros Agrónomos (revisar el expediente).

1.2.1.2. Cuando se trate de informes de apertura de la fase de aprovechamiento, el mismo debe de indicar las principales recomendaciones técnicas para ejecutar el aprovechamiento basadas en el plan de manejo, sus correcciones y la resolución de aprobación, indicando en el mismo que se ha entre gajo a los operarios responsables del aprovechamiento el mapa base y lista definitiva de árboles a cortar.

1.2.1.3. El Informe de Regencia debe presentarse con no más de 20 días hábiles de efectuada la visita.

1.2.1.4. Cada una de las secciones o apartados del formulario deben contener toda la información predeterminada, en especial los dos cuadros finales, uno relativo al # de trozas por especie en patio y el otro respecto al # de árboles por especie autorizado versus # árboles cortados por especie; así como el reporte de guías y placas entregadas y utilizadas.

1.2.1.5. Sólo se aceptan Informes de Regencia presentados en el formulario diseñado por el Colegio de Ingenieros Agrónomos (CIA) para tal efecto.

1.2.1.6. Su contenido debe ser claro y escrito con letra legible.

1.2.1.7. Cuando se trate de Informes de Cierre, en el mismo debe consignarse el cumplimiento de las recomendaciones indicadas en el informe anterior, construcción de obras de control de erosión (cortes de agua, cunetas) y clausura de caminos, retiro de desechos sólidos y químicos de caminos y patios, liberación de causes hídricos obstruidos consecuencia del aprovechamiento.

1.2.1.8. Cuando el Informe de Regencia no cumpla las condiciones anteriores no será aceptado y en consecuencia no se otorgarán las guías y placas.

1.2.1.9. Cuando en el Informe de Regencia se reporten anomalías, el Jefe Subregional mediante resolución, abrirá el procedimiento administrativo para investigar los hechos denunciados. Para los casos en que se estén reportando dentro de estas anomalías corta de árboles no autorizados en la resolución de aprobación y/o apertura de caminos no incluidos en el plan de manejo, en esa resolución de apertura de procedimiento, tendrá que decretarse como medida cautelar una suspensión temporal de las labores de aprovechamiento y el decomiso de los productos forestales provenientes de árboles cortados ilegalmente. Una vez que la AFE verifique en el campo los hechos reportados (en caso que el regente no haya denunciado) se procedera a interponer la denuncia ante el Ministerio Público, según lo establecido en el artículo 283 del Código Procesal Penal y artículos 57, 61 y 62 de la Ley Forestal 7575.

Entiéndase por anomalía toda aquella actividad no autorizada por medio de la resolución de aprobación del plan de manejo y actividades que contravengan la Ley Forestal y leyes conexas.

1.2.1.10. Las guías no utilizadas deben devolverse a la AFE , conjuntamente con las guías utilizadas debidamente selladas por la industria que recibió la madera (los sellos deben llevar dirección y razón social) y se adjuntaran al expediente, caso contrario no se otorgará más guías y placas.

1.2.1.11. Las modificaciones al plan de manejo a las que se refiere el artículo 23 inciso 4 del Reglamento a la Ley Forestal en los que se indica cambios de árboles a cortar o trayectoria de trochas a construir, sólo podrán ejecutarse en el campo una vez que se hayan aprobado por la AFE (previa inspección de campo) mediante resolución administrativa que modifique la resolución original. Los cambios que se introduzcan a los componentes (caminos y árboles a cortar) no podrán superar un 10% de lo indicado para cada uno en el plan de manejo originalmente aprobado por la AFE. Tampoco se aprobarán modificaciones que se refieran a inclusión de áreas no contempladas en el plan de manejo aprobado.

No se consideran modificaciones sujetas a aprobación, todas aquellas que impliquen la no corta de árboles autorizados por la AFE.

1.3. Al iniciar el aprovechamiento en los planes de manejo una vez presentado el Informe de Apertura elaborado por el regente forestal, al que hace referencia el artículo 15 del Reglamento de Regencias Forestales, podrá otorgarse como máximo la tercera parte (1/3) del total de guías y placas requeridas para el transporte de la madera a extraer en la etapa inicial de aprovechamiento. Esta disposición también se aplicara para permisos en terrenos de uso agropecuario y sin bosque en los que se aporte informe de apertura. Caso contrario se entregará la cantidad de guías y placas de acuerdo al volumen en patio reportado en los informes de avance o en el informe del técnico de la AFE , cuando corresponda.

Para estimar la cantidad de guías y placas requeridas, se hará el cálculo basado en el tipo de vehículo a utilizar y el volumen a transportar. Esta información sobre maquinaria y equipo deberá contenerla el plan de manejo que se apruebe y además, el regente deberá constatar que los medios de transporte a utilizar para el traslado de la madera cumplen con las regulaciones de pesos y dimensiones vigentes para el trasiego de carga por las vías publicas.

1.4.No se podrá renovar guías mediante nota u observación sobre el documento vencido (guía). Cuando se requiera renovar una guía, esta se elaborará de nuevo.

1.5.La entrega de guías y placas para transporte de productos procedentes de árboles plantados y Sistemas Agroforestales (SAF), según corresponda, se hará contra entrega del Certificado de Origen (CO), y la respectiva copia del contrato de regencia forestal inscrito en el Colegio de Ingenieros Agrónomos. A este Certificado se le colocará un sello de recibido de la Oficina Subregional correspondiente de la AFE , indicando fecha de recibido, nombre y firma del funcionario designado por el Jefe Subregional para este acto.

1.5.1. El Certificado de Origen (CO), será único y formulado en papel de seguridad del CIA, con copia para la AFE. Documento que será elaborado y firmado por un Regente Forestal; como mínimo deberá contener la Siguiente información.

Encabezado certificando la existencia de una plantación forestal o un sistema agroforestal.

Nombre del profesional o Regente emisor del documento y número de colegiado.

N° del contrato de Regencia Forestal.

Vigencia del Contrato de Regencia.

Nombre del propietario (a); persona física o jurídica.

Nombre del Representante legal en caso de sociedades).

Datos de inscripción de la finca (# Folio Real Matricula;# constancia del Juzgado donde se tramita información posesoria).

Ubicación Administrativa.

Ubicación geográfica por coordenadas .

Cantidad de árboles por especie incluidos en el certificado (en caso de árboles plantados individualmente) o área efectiva en caso de plantaciones forestales.

Volumen por especie.

Tipo de transporte: Descripción del tipo de vehículo a utilizar en el transporte. Este debe corresponder a los autorizados para trasegar carga por el camino que se empleará para transportar la madera.

En el caso de los certificados de origen de Sistemas Agroforestales (SAF) deberá indicarse el # de árboles por especie/ hectárea que se mantendrá en el sistema para garantizar sus procesos y funciones como tal, una vez efectuado el aprovechamiento. Así mismo; las especies señaladas deben corresponder a aquellas que previamente el AC ha definido como posibles de encontrar en un SAF, en razón de ser especies pioneras u otras circunstancias técnicamente justificadas.

Fecha de expedición y expiración de] documento. La vigencia del CO sólo podrá extenderse hasta la fecha de vencimiento del contrato de regencia, sin perjuicio de prorrogarse ambos en forma escrita.

En aquellos casos en que el propietario de la plantación forestal, en cualquiera de las diferentes modalidades aquí anotadas, entiéndase plantaciones con árboles maderables en superficies menores a una hectárea, árboles plantados individualmente en sistemas lineales, dispersos entre cultivos agrícolas o en contorno de fincas y árboles maderables regenerados naturalmente en áreas agrícolas y cuyas especies hayan sido previamente definidas y oficializadas por cada Área de Conservación como especies de regeneración natural viables para su aprovechamiento, no cuente con título de propiedad inscrito ante el Registro Público u otro documento que demuestre la titularidad del inmueble donde se llevó a cabo la plantación, la Administración Forestal del Estado (AFE) aceptará como requisito para sellar el Certificado de Origen, una declaración jurada hecha por el poseedor del terreno, en cuyo caso el poseedor y el propietario de la plantación deben coincidir en la misma persona, en estos casos la declaración jurada debe indicar; tiempo de poseer el inmueble, edad de los árboles plantados, modalidad de plantación, especie o especies a aprovechar con la densidad inicial de plantación, colindantes y modo de adquisición de la posesión. En el caso donde el poseedor del inmueble y el propietario de la plantación no sea la misma persona, se aceptará una declaración jurada del propietario de la plantación que indique; la edad de los árboles plantados, modalidad de plantación, especie o especies a aprovechar con la densidad inicial de la plantación, adjuntando copia del respectivo contrato de arrendamiento del inmueble donde se llevará a cabo el aprovechamiento forestal.

La declaración jurada deberá ser protocolizada ante notario público y el Colegio de Ingenieros Agrónomos deberá aceptar para efectos del contrato del Regente Forestal el original de este documento.

En caso que el inmueble en cuestión pertenezca al Instituto de Desarrollo Agrario (IDA), aparte de lo establecido en el punto anterior, esta declaración jurada deberá hacerse acompañar por una autorización de la Junta Directiva del IDA para realizar el aprovechamiento de la plantación.

Bajo ninguna circunstancia será sellado ningún Certificados de Origen por parte de la AFE en donde las especies de árboles solicitados para ser aprovechados no sean estrictamente procedentes de una plantación forestal en las modalidades expresamente anotadas en esta resolución, con esta medida se descarta la posibilidad de que especies de árboles remantes del bosque natural que se encuentren mezcladas con las especies de árboles plantados o regenerados en estos inmuebles sean incluidas dentro del CO para su aprovechamiento.

1.5.2. Aquel Certificado de Origen que no cumpla con lo establecido en el punto 1.5.1. no se le estampará el sello de recibido al que hace referencia el punto 1.5 de la presente resolución y en consecuencia no se otorgará las guías y placas, esto no imposibilita al propietario de tramitar autorización de aprovechamiento aportando los requisitos establecidos por la Ley y su reglamento.

Para tramitar solicitudes planteadas a la AFE por cantidades de 20 árboles o menos, deberá presentar la certificación de propiedad, copia del plano de la finca o ubicación del inmueble en la Hoja Cartográfica y solicitud completa. Para cantidades superiores se procederá de conformidad con lo establecido en el artículo 91 del Reglamento a la Ley Forestal 7575.

1.5.3. Cuando se pretenda efectuar tala rasa dentro de un SAF, deberá obtenerse autorización de aprovechamiento por el procedimiento señalado en el párrafo anterior.

1.5.4. Para el transporte de madera en troza se utilizará el sistema de placas plásticas definido en el Decreto Ejecutivo #27240 ­MINAE, empleando placas color anaranjado para madera procedente de sistemas agroforestales y color amarillo para trozas procedentes de bosque o de terrenos de uso agropecuario y sin bosque.

1 .5.5. La última semana de cada mes, la Oficina Subregional deberá enviar informe a las municipalidades de su jurisdicción sobre los permisos de aprovechamiento forestal y certificados de origen recibidos. La información será presentada de la siguiente forma:

Firma del Jefe Subregional:__________________ 1.6. Para el transporte de madera aserrada deberá respaldarse con una factura autorizada (timbrada) de venta o aserrío. Si se trata de madera aserrada in situ deberá portar la guía de transporte para madera aserrada más la factura de aserrío extendida por el responsable autorizado (dueño del aserradero ambulante), salvo que se trate del propietario (de la finca y de la maquinaria de aserrío) en cuyo caso debe portar la guía de transporte.

1.7. Las personas físicas o jurídicas que tengan integrada su materia prima proveniente de plantaciones forestales o sistemas agroforestales a una industria forestal podrán acogerse a un sistema alternativo para las guías de transporte; mismo que se ha descrito en la Resolución Administrativa # 613-SINAC, publicada en La Gaceta # 154 del 12 de agosto de 1997. El "marchamo" conteniendo un número consecutivo impreso en papel adhesivo de seguridad que debe colocarse en la esquina distal superior del triángulo, será confeccionado por cada AC del color y tamaño indicado en la referida resolución.

1.8. Para el empleo de los emblemas (banderas) a que se refiere artículo 31 del Reglamento a la Ley Forestal 7575, se seguirá lo establecido en la resolución señalada en el párrafo anterior.

1.9. El interesado cancelará el costo neto de las guías y placas de acuerdo a lo establecido en la Resolución N ° 049, publicada en La Gaceta N ° 234 del día 2 de diciembre de 1999. La venta directa de placas y guías se efectuará en las Oficinas Subregionales de la AFE , cuyo pago podrá realizarse por dos mecanismos: (1) pago en efectivo en la oficina subregional de la AFE y (2) pago en las Oficinas del Sistema Bancario Nacional, depositado en la Cuenta Bancaria # 31­844-4 del Fondo Forestal, cuyo recibo de depósito (duplicado o fotocopia) deberá entregarse a la Oficina Subregional.

Para ambos casos, el funcionario que emite y entrega las guías y placas, entregará al administrado un recibo, utilizando únicamente los formularios autorizados por la Dirección General del SINAC. Copia de estos documentos deberá insertarse dentro del respectivo 1.10. Mensualmente (a más tardar el día 10 de cada mes), las Áreas de Conservación enviarán al Componente de Control y Protección del SINAC un informe de liquidación de la venta de guías y placas con cierre el último día del mes anterior, incluyendo un desglose la guías y placas entregadas por Oficina Subregional de la siguiente forma:

2.1. De conformidad con el artículo 42 de la Ley Forestal 7575 se considera troza a la seccíón del árbol libre de ramas, con un diámetro mayor o igual a 29 centímetros en el extremo más delgado, por tanto, las piezas rollizas que no cumplen esta condición no requerirán guías ni placas para ser transportadas. Esto implica que por ninguna razón se otorgará guías y placas para piezas rollizas con diámetros inferiores a 29 centímetros .

2.2. Toda madera en troza, escuadrada o aserrada, deberá portar la guía de transporte correspondiente, diseñada para tal efecto por la AFE ; documento que no podrá extenderse con una vigencía superior a dos meses.

2.3. Sólo podrá transportarse sin placas las trozas procedentes de plantación.

2.4. El mazo sólo será utilizado para el control de la madera en el patio de las industrias forestales, dejando impreso en las caras de la troza el número, de tal forma que se diferencie la madera recién ingresada (sin número) con la ya revisada (numerada).

También podrá ser utilizado en los decomisos forestales, de manera que en las trozas pueda diferenciarse la sigla DF (decomiso forestal) y el número de mazo con que se realizó.

2.5. Cuando se otorguen guías para "empatiado" fuera de la finca, deberá efectuarse una solicitud en forma expresa por el Regente Forestal y el propietario o apoderado de la finca donde se ejecuta el proyecto o Plan de Manejo; la solicitud debe contener como mínimo la siguiente información:

Nombre del propietario del proyecto o Plan de manejo. . Ubicación del Proyecto (Caserío, Distrito, Cantón y Provincia).

Nombre del Regente.

Justificación sobre la decisión de establecer el patio temporal (estado y condiciones de camino versus capacidad del vehículo, condiciones ambientales apremiantes).

Ubicación precisa del "patio temporal"; incluyendo nombre del propietario del fundo donde se establecerá el patio temporal.

Tiempo estimado que permanecerá la madera en ese patio.

N° de trozas a transportar y su Volumen por especie.

Tipo de transporte a utilizar: Especificar vehículo o medio (placas, capacidad, tamaño en caso de barcazas; entre otras).

Tipo de marca adoptado (se recomienda emplear siglas distintivas del propietario de cada permiso) con el cual se marcará cada troza.

2.6. El procedimiento de "empatiado temporal" se aplicará sólo en casos calificados en los que las condiciones ambientales o de las vías de acceso inmediato a la finca no permitan ingreso de camiones o restrinjan la capacidad de carga del vehículo, o por la naturaleza del transporte (por ejemplo uso de barcazas) y deberá contar con la autorización En el "patio temporal" las trozas deben agruparse en forma separada por permiso y permisionario.

3°-Elimínese el punto 3 " Formato de certificado de Origen" de la Resolución N ° 613-SINAC de las 12 horas del día nueve de mayo de mil novecientos noventa y siete, publicada en La Gaceta N ° 154 del 12 de agosto de 1997. En su lugar y de conformidad con lo que establece el artículo 2° del Reglamento a la Ley Forestal 7575, se procede a diseñar el siguiente formato:

4°-Queda sin efecto la resolución administrativa 054-SINAC, de las quince horas del veintinueve de noviembre de 1999 y publicada en La Gaceta número 17 del día veinticinco de enero del dos mil.

5°-Rige a partir de su publicación.
