in the entirety of the text - Complete Text of Regulation 28845 Repeals Articles on Organization of Police Forces for Public Security, Art. 35, 36, and 37. Assigns to the Coast Guard Service Active Assets and Material and Human Resources Assigned to Maritime Surveillance No. 28845-SP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE, AND PUBLIC SECURITY Exercising the powers conferred in subsections 3) and 18) of the Political Constitution, and in the General Police Law No. 7410.
I.—That in order to guarantee greater efficiency in the service provided by the Ministry of Public Security, it is necessary to seek the maximum utilization of the human and material resources available to this Ministry.
II.—That Articles Nos. 9, 35, and 37 of the Regulation on the Organization of Police Forces Attached to the Ministry of Public Security, Decree No. 23881-SP, establish that the Department of Maritime Surveillance, attached to the Border Police, has as its principal function providing security for the country in its territorial waters and adjacent materials, in addition to monitoring and safeguarding the maritime borders of the country.
III.—That Law No. 8000 creates the National Coast Guard Service, as a police body of the Public Force specialized in safeguarding territorial waters, the continental shelf, the insular shelf, and the seas adjacent to the Costa Rican State; which depends directly on the Ministry of Public Security. Therefore, THEY DECREE:

35, 36, and 37 of the Regulation on the Organization of Police Forces attached to the Ministry of Public Security, Decree No. 23881-SP, insofar as the functions of the Department of Maritime Surveillance, in accordance with Law No. 8000, correspond to the National Coast Guard Service.

I.—Que con el fin de garantizar una mayor eficiencia en el servicio que presta en el Ministerio de Seguridad Pública, es necesario procurar el máximo aprovechamiento de los recursos humanos y materiales con los que cuenta esta Cartera.
II.—Que los artículos Nos. 9, 35 y 37 del Reglamento de Organización de los Cuerpos Policiales Adscritos al Ministerio de Seguridad Pública Decreto N° 23881-SP, establecen que el Departamento de Vigilancia Marítima adscrito a la Policía de Fronteras, posee corno función principal brindar seguridad del país en sus aguas territoriales y materiales adyacentes, además de vigilar y resguardar las fronteras marítimas del país.
III.—Que la Ley N° 8000 crea el Servicio Nacional de Guardacostas, como un cuerpo policial de la Fuerza Pública especializado en el resguardo de las aguas territoriales, la plataforma continental, el zócalo insular y los mares adyacentes al Estado costarricense; el cual depende directamente del Ministerio de Seguridad Pública. Por tanto,

DECRETAN:
35, 36 y 37 del-Reglamento de Organización de los Cuerpos Policiales adscritos al Ministerio de Seguridad Pública Decreto N° 23881-SP, por cuanto las funciones del Departamento de Vigilancia Marítima de conformidad con la Ley N° 8000, corresponden al Servicio Nacional de Guardacostas.
