The purpose is to unite the efforts of the Ministry, the Caja, and the Foundation to strengthen the development of Training Programs for health personnel promoted by the Ministry of Health, the Caja, and other educational institutions.

The need to expand health coverage (cobertura de salud) and to prepare qualified personnel to meet health needs immediately and in the long term is recognized. To help meet this need, the Foundation joins the Ministry to collaborate in the retraining of existing health personnel, through the Continuing Education Program, and for the training of new technical and auxiliary personnel necessary to meet the immediate demand of the Ministry and the Caja.

• a)Provide technical assistance in the development and implementation of training programs in the health field that are mutually agreed upon and defined with the Ministry and the Caja. These programs will be based on the priorities of the Ministry and the Caja and will be compatible with the objectives expressed in Article 2.
• b)Provide duly qualified personnel to effectively implement these programs.
• c)Pay all salaries of the Foundation's personnel.
• d)Commit to ensuring that Foundation staff members do not charge any fees or remuneration to Costa Rican institutions or third parties during the development of their programs.
• e)Foundation members may not engage in the private practice of medicine. Medical care as part of the training programs will be provided only to those patients who do not have the resources to pay for medical services and who, in the judgment of the Ministry or the Caja, benefit from such care.
• f)Comply with all laws of Costa Rica when implementing the Foundation's programs.
• g)Donation of equipment for the projects undertaken under this Agreement.

• a)Accept the Foundation as a private, non-profit entity, whose sole purpose in the Republic of Costa Rica is to assist in the development and expansion of health services, and to respond to the need to increase the number of qualified personnel providing services in this field.
• b)When appropriate, process with the relevant authorities the titles or diplomas for visiting professors to the Foundation's teaching staff, so that the Foundation's professionals can function within the institutions to which they are assigned.
• c)Persons in training will be under the financial responsibility of the respective Costa Rican organizations or institutions; the Ministry and the Caja will provide assurance, within their budgetary possibilities, to use the experience acquired by them during their training programs, providing them with adequate placement according to their knowledge.

ch) For the duration of the Foundation's program, the Foundation will be in charge of the administration and exclusive use of the goods donated by it.

• d)Provide the Foundation with appropriate support services for the development of activities. These services will include secretarial services and stationery printing. Occasionally, also the assistance of non-specialized support personnel (assistants).
• e)Provide the following program-related material:
• 1)Appropriate space and furniture for the offices of the Foundation's personnel.
• 2)Telephones for the office, installed and functioning.
• 3)Use of vehicles from the Caja and the Ministry, in accordance with the respective regulations.
• 4)Transportation and lodging for the personal use of the Foundation by the Caja within its means and where it indicates.
• f)Process with the Ministry of Finance the granting of licenses so that the goods (e.g., vehicle, household effects, personal effects, etc.) of the Foundation's officials enter the country with temporary import permits; on the understanding that said goods may not be sold or pledged without the owners first covering all the taxes stipulated by law.

Likewise, it will process with the Ministry of Finance so that the supplied vehicles, medicines, and other equipment or materials that the Foundation allocates to the program enter the country under the protection of temporary import treatment, on the understanding that all goods will be donated to the Ministry of Public Health and the Caja upon termination of the program.

• g)Process the payment of customs clearance and transportation fees for equipment from their points of destination abroad to Costa Rica; this will be the responsibility of the Caja.
• h)Upon the signing of this agreement, the Ministry will process with the respective authorities the granting of visas and permits for the Foundation's personnel while they are working on the program that is the subject of this agreement.
• i)The Ministry and the Caja undertake to process with the Legislative Assembly the exoneration of all types of taxes for the Foundation's foreign technical personnel, based on similar previous agreements. It is understood that this action is subject to approval by the Legislative Assembly.

In witness whereof, the Ministry, the Caja, and the Foundation, each acting through its authorization, sign this Agreement in three copies of equal tenor in Millwood, Virginia, USA, at ten o'clock on the twenty-eighth day of September, nineteen hundred and eighty-two.

El propósito es unir los esfuerzos del Ministerio, la Caja y la Fundación para fortalecer el desarrollo de los Programas de Adiestramiento para personal de salud impulsados por el Ministerio de Salud, la Caja y otras instituciones educativas.

Se reconoce la necesidad de ampliar la cobertura de salud y de preparar personal calificado para satisfacer las necesidades de salud inmediatamente y a largo plazo. Para ayudar a satisfacer esta necesidad, la Fundación se une al Ministerio para colaborar en el readiestramiento del personal de salud, existente, mediante el Programa de Educación Continua y para el adiestramiento del nuevo personal técnico y auxiliar necesario para satisfacer la demanda inmediata del Ministerio y de la Caja.

• a)Prestar asistencia técnica en el desarrollo e implementación de programas de adiestramiento en el campo de salud que sean convenidos y definidos mutuamente con el Ministerio y la Caja. Estos programas estarán basados en las prioridades del Ministerio y la Caja y serán compatibles con los objetivos expresados en el artículo 2º.
• b)Proporcionar personal debidamente calificado para poner estos programas en marcha en forma efectiva.
• c)Pagar todos los sueldos al personal de la Fundación.
• d)Comprometerse a que los miembros del personal de Fundación no cobren ningún honorario o remuneración a instituciones de Costa Rica o terceros durante el desarrollo de sus programas.
• e)Los miembros de la Fundación no podrán dedicarse a la práctica privada de la medicina. La atención médica como parte de los programas de adiestramiento será prestada solamente a aquellos pacientes que no tengan recursos para pagar los servicios médicos y que según criterio del Ministerio o la Caja se benefician con esa atención.
• f)Cumplir todas las leyes de Costa Rica al poner en marcha los programas de Fundación.
• g)Donación de equipos para los proyectos asumidos por este Convenio.

• a)Aceptar a la Fundación como una entidad privada, no lucrativa, cuyo único propósito en la República de Costa Rica es ayudar al desarrollo y la expansión de los servicios de salud, y responder a la necesidad de aumentar el número de personal calificado que presta sus servicios en este campo.
• b)Cuando sea apropiado, gestionar ante quien corresponda los títulos o diplomas de profesores visitantes al cuerpo docente de la Fundación, así los profesionales de la Fundación puedan desenvolverse dentro de las instituciones a las cuales se les asigne.
• c)Las personas en adiestramiento estarán bajo la responsabilidad financiera de las organizaciones respectivas o instituciones costarricenses; el Ministerio y la Caja darán seguridad, dentro de sus posibilidades presupuestarias, de usar la experiencia adquirida por ellos durante sus programas de adiestramiento, proporcionándoles la ubicación adecuada de acuerdo con sus conocimientos.

ch) Mientras dure el programa de la Fundación, ésta tendrá a su cargo la administración y uso exclusivo de los bienes donados por ella.

• d)Proporcionar a la Fundación servicios de apoyo apropiados para el desenvolvimiento de las actividades. Estos servicios incluirán servicios de secretariado e impresión de papelería. Ocasionalmente, también el concurso de personal de apoyo, no especializado (ayudantes).
• e)Proporcionar el siguiente material relacionado con el programa:
• 1)Espacio apropiado y muebles para oficinas del personal de la Fundación.
• 2)Teléfonos para la oficina, instalados y funcionando.
• 3)Utilización de vehículos de la Caja y del Ministerio, conforme con los reglamentos respectivos.
• 4)Transporte y hospedaje para uso personal de la Fundación por parte de la Caja dentro de sus posibilidades y donde ella indique.
• f)Gestionar ante el Ministerio de Hacienda, la concesión de licencias para que los bienes (e. g. vehículo, menaje de casa, efectos personales, etc.) de los funcionarios de la Fundación entren al país con permiso de importación temporal; en el entendido que dichos bienes no podrán ser vendidos, o pignorados sin que antes los propietarios no cubran todos los impuestos que la ley señale.

Asimismo gestionará ante el Ministerio de Hacienda que los vehículos suministrados, medicinas y otros equipos o materiales que la Fundación destine al programa, entren al país bajo el amparo de tratamiento de importación temporal, en el entendido que todos los bienes serán donados al Ministerio de Salud Pública y la Caja al terminar el programa.

• g)Gestionar el pago de desalmacenaje y transporte de los equipos de los lugares de destino en el exterior hasta Costa Rica, esto estará a cargo de la Caja.
• h)Al estar firmado el presente convenio, el Ministerio gestionará ante las autoridades respectivas, el otorgamiento de visas y permisos para el personal de Fundación, mientras estén trabajando en el programa objeto de este acuerdo.
• i)El Ministerio y la Caja se comprometen a gestionar ante la Asamblea Legislativa la exoneración de toda clase de impuestos para personal técnico extranjero de la Fundación, con base en acuerdos similares anteriores. Se sobreentiende que la gestión queda supeditada a aprobación de la Asamblea Legislativa.

años desde la fecha de su suscripción, pudiendo cualquiera de las partes unilateralmente rescindir del mismo y ser relevado de toda obligación y responsabilidad adicional, dando aviso escrito con noventa (90) días de anticipación a la otra parte; asì como prorrogarlo por mutuo acuerdo mediante el simple cruce de cartas por períodos iguales.

En fe de lo anterior, el Ministerio, la Caja y la Fundación, actuando cada uno por medio de su autorización, firman este Convenio en tres tantos de igual tenor en Milwood, Virginia, EEUU, a las diez horas del día veintiocho de setiembre de mil novecientos ochenta y dos.
