4 and which shall take effect as of January 1, 1986, are hereby approved.
BASIC RULES FOR THE PARTICIPATION OF CUSTOMS AGENTS IN THE CONTROL OF CUSTOMS OPERATIONS BASIC RULES FOR THE PARTICIPATION OF CUSTOMS AGENTS IN THE CONTROL OF CUSTOMS OPERATIONS 1.- Taking into account the participation of customs agents in customs operations and procedures, their legal constitution into an "Asociación de Agentes de Aduana" (Customs Agents Association) is advisable.
2.- It is the obligation of every customs agent to report to the Board of Directors of the Association any irregular act of which they become aware and which occurs in any of the phases of the customs process. Likewise, it is the obligation of the Board of Directors of the Association to ensure that customs agents carry out their duties within strict standards of ethics and honesty, fully complying with their customs, professional, and Association obligations.
3.- The Board of Directors of the Association, through an Honor Tribunal designated for this purpose, shall study the complaints it receives from private individuals or from customs agents against them, and in accordance with its findings, may request the Ministry of Finance to apply sanctions in accordance with the laws to customs agents who have engaged in improper acts, or acts that harm tax collection.
4.- For the purpose of strengthening the "Asociación de Agentes de Aduana de Costa Rica", the obligation is established for customs agents to affix to each import declaration (póliza de importación) in which they intervene, a stamp in the amount of ₡50.00. Said stamp shall be issued and administered by the Asociación de Agentes de Aduana de Costa Rica. Its cost shall be borne entirely by the customs agents.
5.- The Association shall allocate the income generated by the levy mentioned in the preceding article, preferentially, to cover the expenses generated by the training and instruction programs of the Escuela Aduanera Braulio Carrillo, up to an amount of no less than 75%. The remaining income shall be allocated to cover the Association's administrative expenses. The training provided by this school shall be open to members and non-members alike.
Transitory.- While the Cámara de Agentes de Aduana de Costa Rica changes its name, transforms itself into the "Asociación de Agentes de Aduana de Costa Rica" and registers under such name; it shall administer said stamp and its proceeds. In any case, a maximum period of six months from the publication of this law is set for the Cámara to complete said transformation and communicate it as such to the Ministry of Finance.
