On the basis of the provisions of Articles 140 and 240 of Law Nº6227, General Law of Public Administration, dated 2 May 1978, and its amendments; Law Nº59, Law on the Creation and Organization of the National Geographic Institute, of 4 July 1944, and its amendments; Law Nº8905, Amendment to Article 2 of Law N°5695, Creation of the National Registry, and its amendments; and amendment of Law N°59, Creation and Organization of the National Geographic Institute, of 4 July 1944, and its amendments, dated 7 December 2010; Law Nº6043, Law on the Maritime-Terrestrial Zone, of 2 March 1977, and its corresponding regulation; and Articles 2 and 3 of Law Nº5695, Law on the Creation of the National Registry, dated 28 May 1975, and its amendments.
1.- Whereas, in accordance with Law N°59, Law on the Creation and Organization of the National Geographic Institute, of 4 July 1944, and its amendments, the National Geographic Institute (IGN) is “the leading scientific and technical body for national cartography, responsible for preparing the official basic map and the basic geographic description of the Republic of Costa Rica, as well as for studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to those works, in order to support planning processes”; and is permanently constituted, on behalf of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any kind that originate from the work entrusted to it.
2.- Whereas, by means of Law Nº8905, Amendment to Article 2 of Law N°5695, Creation of the National Registry, and its amendments; and amendment of Law N°59, Creation and Organization of the National Geographic Institute, of 4 July 1944, and its amendments, dated 7 December 2010, the IGN was established as a unit of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions.
3.- Whereas, by means of Executive Decree N°37773-JP-H-MINAE-MICITT, Establishes the National Territorial Information System (SNIT), dated 7 May 2013, and pursuant to Articles 10, 11, 12, 13, and 15 of Law N° 59 establishing the National Geographic Institute and its amendment by Law N° 8905, the National Territorial Information System (SNIT) was established as a technological infrastructure developed to promote the generation, access to, and use of updated and reliable georeferenced geographic (geospatial) information, standardized and positionally harmonized with the fundamental databases of Costa Rican territory at national, regional, and local coverage, produced by public entities and bodies, as well as by private individuals or legal entities, that is useful in supporting decision-making in all fields of public and private management, while also meeting citizens’ needs, within the framework of a shared data infrastructure.
In addition, the SNIT is defined as the set of policies, organizations, standards, and technologies that work together to produce, share, and use the geographic information needed for planning and land-use planning, national security, and the country’s development in various fields, and is the official platform through which fundamental geographic information is published in a standardized manner and in accordance with the technical standards used to generate geospatial information nationally.
4.- Whereas georeferencing to the national coordinate system as a mechanism for demarcating the public zone of the Maritime-Terrestrial Zone (ZMT) makes it possible to correctly demarcate the public zone for purposes of preparing regulatory plans, approving cadastral survey plans, granting concessions in the Restricted Zone, and other aspects of coastal territorial planning.
5.- Whereas the IGN refers to the georeferenced digital information it holds on the demarcation of the ZMT public zone as the IGN’s Georeferenced Digital Geodatabase (GDG) on the Maritime-Terrestrial Zone.
6.- Whereas the IGN’s Georeferenced Digital Geodatabase (GDG) on the Maritime-Terrestrial Zone is technically based on the application of the regulations established by:
7.- Whereas Article 63 of Executive Decree N°7841-P, Regulation to the Law on the Maritime-Terrestrial Zone, of 16 December 1977, and its amendments, states that “The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.” 8.- Whereas Executive Decree N°36642-MP-MOPT-MINAET, Regulation on Specifications for Demarcating the Public Zone of the Maritime-Terrestrial Zone, of 28 June 2011, provides in Article 18 that, to demarcate the public zone of the Maritime-Terrestrial Zone, the IGN may use either of two implementation methods, set out in Articles 19 and 20, corresponding to demarcation of the public zone of the Maritime-Terrestrial Zone by placing boundary markers and/or by digital georeferenced demarcation, in order to expedite demarcations and provide greater technical certainty to interested parties.
9.- Whereas Article 13 of Law N°7575, Ley Forestal, of 13 February 1996, and its amendments, provides that: “The State’s natural heritage shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for properties securing credit transactions with the National Banking System that become part of its estate.
The Ministry of Environment and Energy shall administer the heritage. Where appropriate, through the Procuraduría General de la República, it shall register the lands in the Public Property Registry as individual properties belonging to the State. (…)” 10. Whereas Article 16 of Law N°7575 establishes the obligation of the Ministry of Environment and Energy (MINAE) to demarcate on the ground the boundaries of the areas that make up the State’s Natural Heritage.
11.- Whereas Executive Decree N°36786-MINAET, Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, of 12 August 2011, lists among its objectives: “To identify, within the Maritime-Terrestrial Zone, lands classified as forests, lands suitable for forestry (Class VII and VIII soils), wetlands (mangroves, estuaries, tidal inlets, marshes, coastal lagoons, swamps, flooded forests, salt flats), in order to certify them and incorporate them as part of the State’s Natural Heritage (PNE).” 12.- Whereas Executive Decree N°36786-MINAET, at Point III—Competencies for Demarcation and Certification, provides that “The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and duly accredited private professionals, accredited by the respective professional associations, to classify forests, lands suitable for forestry (Class VII and VIII soils), (mangroves, estuaries, tidal inlets, marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.
The validity of classification documents issued by private professionals shall be subject to approval by the AC with territorial jurisdiction. The SINAC ACs with jurisdiction over the ZMT shall also be responsible for verifying, overseeing, demarcating, and certifying State Natural Heritage lands and protection zones. The location and demarcation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (PRC), as defined by Law 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all areas to be granted concessions within the ZMT and classifies it at the cadastral-plan level. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted in the total area available for concessions.” 13.- Whereas, by means of Notice N°20-2025, published on page 59 of Official Gazette La Gaceta N°172 of 16 September 2025, the demarcation corresponding to a mangrove area at Playa Junquillal, including boundary markers numbered 8 through 12, was made official.
14.- Whereas, by means of letter ACT-OSRSCC-1000-2023, dated 31 August 2023 and signed by Engineer Orlando Matarrita Suárez, subregional head of the Tempisque Conservation Area of the National System of Conservation Areas of the Ministry of Environment and Energy, he certified his participation in defining a mangrove area located at Playa Junquillal, in District 03º Veintisiete de Abril, Canton 03º Santa Cruz, Province 05º Guanacaste, relating to tender 2022LA-000021-0021000001.
15.- Whereas, by means of letter DDUR-DCT-IGN-0774-12-2023, dated 8 December 2023 and signed by Alejandra Sancho Perlaza, Topographic Engineer, in her capacity as head and coordinator of the Cadastral and Topography Department, and Karina Cruz Campos, Municipal Topographic Engineer of the Cadastral and Topography Department, both of the Municipalidad de Santa Cruz, they submit the survey report for the demarcation of a mangrove area located at Playa Junquillal, in District 03º Veintisiete de Abril, Canton 03º Santa Cruz, Province 05º Guanacaste.
16.- Whereas the demarcation of the ZMT public zone in the canton of Santa Cruz was carried out under the Cooperation Agreement between the National System of Conservation Areas and the Municipalidad de Santa Cruz, and implemented through the contracting of Stereocarto Centroamérica S.A., tender 2022LA-0000210021000001, according to letter CTPR-SINAC_ACT-0043-10-2023 (DDURDCTSINAC_ ACT-0630-10-2023) of 10 October 2023.
17.- Whereas, by means of letter SINAC-ACT-DR-T-1527-2025, dated 15 October 2025 and sent by Engineer Michael Oldemar Guerrero González, Coordinator of the ACT Topography Department, he indicates that the report DDUR-DCT-IGN-774-12-2023 submitted by the Municipalidad de Santa Cruz included points PC06, PC07, PC08, PC09, and PC10, corresponding to boundary markers 8 through 12 of Notice N°20-2025, which do not form part of the actual demarcation of the mangrove, but instead correspond to forest areas outside the boundary of the officially recognized mangrove ecosystem; therefore, these boundary markers must be cancelled. Accordingly, in accordance with and in response to the powers of imperium that the legal system itself has delegated to MINAE and its units for demarcating public-domain property, the boundary markers 8 through 12 published in Notice N°20-2025 shall be cancelled, pursuant to the powers assigned to the IGN by the regulations (with respect to publication under Article 63 of Executive Decree N°7841-P).
18.- Whereas Article 140 of Law N°6227, General Law of Public Administration, of 2 May 1978, and its amendments, states that “an administrative act shall produce its effect after being communicated to the person administered, except if it grants rights only, in which case it shall produce its effect from the time it is adopted”; this provision must necessarily be read in conjunction with subsection 1 of Article 240 of the same statute, which defines the appropriate means of communicating acts of a general nature by stating that: “General acts shall be communicated by publication, and specific acts by notification.” COMMUNICATES:

Con fundamento en lo dispuesto en los artículos 140 y 240 de la Ley Nº6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978 y sus reformas; Ley Nº59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas; Ley Nº8905 Reforma del artículo 2 de la ley N°5695, Creación del Registro Nacional, y sus reformas; y modificación de la ley N°59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; Ley Nº6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la Ley Nº5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.
1.- Que de conformidad con la Ley N°59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas, el Instituto Geográfico Nacional (IGN) es “la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación”; constituyéndose de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
2.- Que mediante Ley Nº8905 Reforma del artículo 2 de la ley N°5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N°59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas del 07 de diciembre del 2010, se estableció al IGN como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones.
3.- Que mediante Decreto Ejecutivo N°37773-JP-H-MINAE-MICITT Crea Sistema Nacional de Información Territorial (SNIT) del 07 de mayo del 2013, y con fundamento en los artículos 10, 11, 12, 13 y 15 de la Ley N° 59 de creación del Instituto Geográfico Nacional y su reforma por Ley N° 8905, se establece el Sistema Nacional de Información Territorial (SNIT), infraestructura tecnológica desarrollada con el objetivo de promover la generación, el acceso y el uso de información geográfica (geoespacial) georreferenciada, actualizada y confiable, homologada y compatibilizada posicionalmente con las bases fundamentales del territorio costarricense de cubrimiento nacional, regional y local, producida por entes y órganos públicos, así como por personas privadas, físicas o jurídicas, que sea útil para apoyar la toma de decisiones en todos los campos de la gestión pública y privada, atendiendo también a las necesidades ciudadanas, en el marco de una infraestructura de datos común.
Además el SNIT se define como el conjunto de políticas, organizaciones, estándares y tecnologías que trabajan de forma conjunta para producir, compartir y usar la información geográfica necesaria para la planificación y el ordenamiento territorial, la seguridad nacional, y el desarrollo del país en diversos ámbito y es la plataforma oficial mediante la cual se publica la información geográfica fundamental de forma estandarizada y siguiendo las normas técnicas utilizadas en la generación de información geoespacial a nivel nacional.
4.- Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre (ZMT), posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
5.- Que la información digital georreferenciada sobre delimitación de la zona pública de la ZMT con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.
6.- Que la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por:
7.- Que el artículo 63 del Decreto Ejecutivo N°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, señala que “El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.” 8.- Que el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
9.- Que el artículo 13 de Ley N°7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, dispone que: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. (…)” 10. Que el artículo 16 de la Ley N°7575, establece la obligación por parte del Ministerio del Ambiente y Energía (MINAE) de delimitar en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.
11.- Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011, establece entre sus objetivos “Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).” 12.- Que el Decreto Ejecutivo N°36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que “La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.
La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección. La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.” 13.- Que mediante el Aviso N°20-2025 publicado en la página 59 del Diario Oficial La Gaceta N°172 del 16 de setiembre de 2025 se llevó a cabo la oficialización de la demarcación correspondiente a un sector de manglar en Playa Junquillal incluyendo los mojones enumerados del 8 al 12.
14.-. Que mediante el oficio ACT-OSRSCC-1000-2023 de fecha 31 de agosto de 2023, suscrito por el Ingeniero Orlando Matarrita Suárez, jefe subregional del Área de Conservación Tempisque del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, certificó su participación en cuanto a la definición de un sector de manglar ubicado en Playa Junquillal, en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste, relativo a la licitación 2022LA-000021-0021000001.
15.- Que mediante el oficio DDUR-DCT-IGN-0774-12-2023 de fecha 8 de diciembre de 2023, suscrito por Alejandra Sancho Perlaza Ingeniera Topografía en calidad de jefa y coordinadora Departamento de Catastro y Topografía y Karina Cruz Campos, Ingeniera Topógrafa Municipal de Departamento de Catastro y Topografía, ambas de la Municipalidad de Santa Cruz, presentan el informe de levantamiento para la Delimitación de un sector de manglar ubicado en Playa Junquillal, en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste.
16.- Que la delimitación de la zona pública de la ZMT del cantón de Santa Cruz fue realizada bajo el Convenio de Cooperación entre el Sistema Nacional de Áreas de Conservación y la Municipalidad de Santa Cruz, y concretado por la contratación de la empresa Stereocarto Centroamérica S.A., licitación 2022LA-0000210021000001, según oficio CTPR-SINAC_ACT-0043-10-2023 (DDURDCTSINAC_ ACT-0630-10-2023) del 10 de octubre de 2023.
17.- Que mediante oficio SINAC-ACT-DR-T-1527-2025, de fecha 15 de octubre de 2025 remitida por Ing. Michael Oldemar Guerrero González, Coordinador de Departamento de Topografía de ACT, indica que el informe DDUR-DCT-IGN-774-12-2023 remitido por la Municipalidad de Santa Cruz incluyó los puntos PC06, PC07, PC08, PC09 y PC10, correspondientes a los mojones 8 al 12 del Aviso N°20-2025, los cuales no forman parte de la delimitación real del manglar, sino que corresponden a áreas de bosque fuera del límite del ecosistema de manglar oficialmente reconocido, por lo que estos mojones deben ser cancelados. Consecuentemente, en apego y atención a las potestades de imperio que el mismo ordenamiento jurídico ha delegado en el MINAE y sus dependencias para la delimitación de bienes demaniales; se procederá con la cancelación de los mojones 8 al 12 publicados en el Aviso N°20-2025, al tenor de las competencias dadas por la normativa al IGN (en lo relativo a la publicación conforme a lo dispuesto en el artículo 63 del Decreto Ejecutivo N°7841-P).
18.- Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública del 02 de mayo de 1978 y sus reformas, señala que “el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte”, disposición que necesariamente debe relacionarse con el numeral 240 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: “Se comunicarán por publicación los actos generales y por notificación, los concretos.” COMUNICA:
Primero: Quedan eliminados los mojones 8, 9, 10, 11 y 12 ubicados en Playa Junquillal, en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste publicados en el Aviso N°20-2025 en la página 59 del Diario Oficial La Gaceta N°172 del 16 de setiembre de 2025.
Segundo: Los sectores ubicados en Playa Junquillal en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste que a la fecha cuentan con delimitación de la zona pública de la ZMT a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.
Tercero: Rige a partir de su publicación.
