41525-S of 04 December 2018, the “Regulation for the Digital Processing of Registrations and Authorizations of the Ministry of Health in the Integrated Management of Waste on the SINIGIR Platform” was established, with the aim of digitizing and simplifying processes associated with integrated waste management before the Ministry of Health.

8839 of 24 June 2010, “Law for the Integrated Management of Waste,” assigns the Ministry of Health responsibility for directing integrated waste management and establishing the requirements and binding authorizations for regulated actors.

41525-S, the country has advanced technically and operationally in digitization and simplification processes, particularly through strengthening national technological interoperability platforms for institutional procedures.

These include the registration of waste managers; the integrated waste management report established in Article 37 of Law No. 8839 and its Regulation; and the registration of compliance units established by Executive Decree No. 38272-S of 07 January 2014, “Regulation for the Declaration of Waste Requiring Special Handling.” Accordingly, the parallel existence of Executive Decree No. 41525-S and the SINIGIR platform has become unnecessary, given the existence of a unified and more efficient national mechanism for carrying out those procedures.

41525-S in force, in light of the advances cited by PROCOMER and VUI, would result in technological duplication, regulatory fragmentation, unnecessary burdens on regulated parties and the Public Administration itself, as well as conflict with national guidelines on simplification and regulatory improvement.

41525-S of 04 December 2018, “Regulation for the Digital Processing of Registrations and Authorizations of the Ministry of Health in the Integrated Management of Waste on the SINIGIR Platform,” in order to consolidate procedures on the VUI platform, strengthen regulatory simplification, and ensure greater institutional efficiency in integrated waste management.

6227 of 2 May 1978, “General Law of Public Administration,” this Executive Decree was submitted for public consultation from 23 March to 07 April, before the public and interested sectors, on the Ministry of Health’s website. No comments were received from regulated parties.

10.—In accordance with Article 12 bis of Executive Decree No. 37045-MP-MEIC of 22 February 2012, as amended, “Regulation to the Law on Protection of Citizens from Excessive Requirements and Administrative Procedures,” the person in charge of the Ministry of Health’s Office for the Simplification of Procedures has completed, as the first step, Section I, titled “Prior Regulatory Improvement Review,” which forms part of the Cost-Benefit Assessment form. All answers provided in that Section were negative, since the proposal contains no procedures or requirements. Therefore, They decree:

REPEAL EXECUTIVE DECREE NO. 41525-S OF 04 DECEMBER 2018, “REGULATION FOR THE DIGITAL PROCESSING OF REGISTRATIONS AND AUTHORIZATIONS OF THE MINISTRY OF HEALTH IN THE INTEGRATED MANAGEMENT OF WASTE ON THE SINIGIR PLATFORM”

41525-S of 04 December 2018, entitled “Regulation for the Digital Processing of Registrations and Authorizations of the Ministry of Health in the Integrated Management of Waste on the SINIGIR Platform,” is repealed.

Entre ellos se encuentra el trámite de registro de gestores de residuos, reporte de gestión integral de residuos establecido en el artículo 37 de la Ley N° 8839, y su Reglamento, así como el registro de unidades de cumplimiento establecido por Decreto Ejecutivo N° 38272-S del 07 de enero del 2014 “Reglamento para la Declaratoria de Residuos de Manejo Especial”, de manera que la existencia paralela del Decreto Ejecutivo N° 41525-S y de la plataforma SINIGIR se vuelve innecesaria, al existir un mecanismo nacio­nal unificado y más eficiente para realizar dichos trámites.

10.—Que de conformidad con el artículo 12 bis del Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012 y su reforma “Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos”, la persona encargada de la Oficialía de Simplificación de Trámites del Ministerio de Salud ha completado como primer paso la Sección I denominada Control Previo de Mejora Regulatoria, que conforma el formulario de Evaluación Costo Beneficio. Las respuestas brindadas en esa Sección han sido todas negativas, toda vez que la propuesta no contiene trámites ni requisitos. Por tanto,

DEROGAR EL DECRETO EJECUTIVO N° 41525-S DEL 04 DE DICIEMBRE DEL 2018 “REGLAMENTO PARA EL TRÁMITE DIGITAL DE REGISTROS Y AUTORIZACIONES DEL MINISTERIO DE SALUD EN LA GESTIÓN INTEGRAL DE RESIDUOS EN LA PLATAFORMA SINIGIR”
