I.Whereas Article 28, paragraph 2), subparagraph a), of the General Law of Public Administration provides that the Minister is the highest hierarchical authority of the respective Ministry and has the exclusive responsibility of directing and coordinating all services of the Ministry.
II.Whereas, by Agreement N° 186-2019-MSP of 28 October 2019, published in Supplement N° 59 to La Gaceta N° 225 of 26 November 2019, the Creation of the Institutional Commission for the Preparation of Environmental Management Programs of the Ministry of Public Security was ordered.
III.Whereas the Comprehensive Waste Management Law, N° 8839 of 24 June 2010, published in La Gaceta N° 135 of 13 July 2010, establishes powers for the Administration to acquire environmentally friendly goods and services, including percentages in the scoring methodologies for assessing compliance with these characteristics. It also refers to the units responsible for preparing public tender or direct-purchase documents and establishing environmental and product life-cycle criteria for evaluating tenders, in accordance with the criteria established in the Regulation to the aforementioned Law.
IV.Whereas the Ministry of Finance, through the General Directorate of Administration of Goods and Administrative Procurement, adopted the Capacity-Building Program for Sustainable Public Procurement, promoted by the United Nations Environment Programme, of which our country is a pilot country, and coordinated by the Environmental Quality Management Directorate of MINAET as one of the most relevant topics in the Strategic Plan for the Modernization of Public Procurement.
V.
Whereas, pursuant to Article 1 of Directive N° 031- MINAE of 25 May 2015, published in La Gaceta N° 193 of 05 October 2015, and the obligations established in the Regulations for the Preparation of Institutional Environmental Management Programs in Costa Rica’s Public Sector, Executive Decree N° 36499, all institutions that make up the Central Government must:
a)have an active Institutional Environmental Commission;
b)prepare and submit the Institutional Environmental Management Program to MINAE;
c)be up to date with implementation of the PGAI; and
d)submit progress reports every six months.
VI.Whereas, in order to comply with the foregoing, it is necessary to restructure the Environmental Commission of the Ministry of Public Security and broaden its scope through the participation of representatives of the Programs and Subprograms comprising the Ministry, thereby seeking better coverage and effectiveness in addressing the Institutional Environmental Management Program. Therefore,
AGREES:
Considering:

The Institutional Commission for the Environmental Management Program of the Ministry of Public Security is hereby created. It shall be composed of the persons holding the following positions in the Ministry:
1)Institutional Environmental Manager.
2)Director of Institutional Procurement.
3)Director of Transportation.
4)Head of the Department of Infrastructure Projects.
5)Head of the Occupational Health Department or their alternate.
6)Head of the Support Services Department or their alternate.
7)Head of the Institutional Planning Office or their alternate.
8)Administrative Vice Minister or alternate.
9)Vice Minister for Regular Units or alternate.
10)Vice Minister for Special Units or alternate.
Each member shall have an alternate appointed by the officeholder, who shall participate in the officeholder’s absence and perform the same functions during the substitution.

The Commission shall have a President, who shall serve on a rotating basis every two years and be elected by a majority vote of the Commission members. It shall also have a Secretary, who shall be responsible for preparing and keeping the minutes of the meetings, recording the agreements adopted by the Commission, communicating meeting notices and agreements at the direction of the President, and following up on their implementation. The Secretary shall be appointed by the Commission itself.

The Commission shall have the following functions:
1)Conduct the diagnoses or assessments of the institution’s facilities necessary to determine their condition with respect to the rating areas of the Institutional Environmental Management Program.
2)Formulate and make known the institutional environmental policy.
3)Prepare the Institutional Environmental Management Program (PGAI) for submission to the Environmental Quality Management Directorate of MINAE.
4)Prepare and submit the reports requested by MINAE.
5)Establish quantifiable internal indicators to measure, verify, and report the degree of progress of the PGAI, using as a basis the instruments established by MINAE.

The Commission shall meet at least once every 3 months at the place and time designated for that purpose by this body; however, more than one meeting may be called during that same period if necessary.
No special notice shall be required for an ordinary meeting. However, an extraordinary meeting shall always require notice by email to all Commission members at least twenty-four hours in advance, except in urgent cases. A copy of the agenda shall accompany the notice, except in urgent cases. Nevertheless, the Commission shall be validly constituted without meeting all the requirements relating to notice or the agenda when all its members attend and so agree unanimously.
The Commission’s ordinary and extraordinary meetings may be held virtually, using telematic systems that permit comprehensive, simultaneous, and uninterrupted communication by video, audio, and data among its members and that guarantee in real time the oral nature of deliberations, the identity of attendees, the authenticity and integrity of the collegial body’s will, the preservation and unalterability of the proceedings, and their recording on media that permit complete reproduction.

A quorum for the Commission to meet validly shall be one-half plus one of its total members.
If there is no quorum, the Commission may meet validly at a second call twenty-four hours after the time set for the first call, except in urgent cases, when it may meet after half an hour; for this purpose, the attendance of one-third of its members shall be sufficient.
If a meeting is held virtually, each member present through telematic links shall count toward the quorum. Participants must remain connected by audio and video throughout the meeting, regardless of where the connection originates, provided that the connection allows uninterrupted simultaneous communication.
In all cases where a vote on a matter is tied among Commission members, the President shall have a casting vote by virtue of that position to resolve the tie.

The Commission may adopt agreements in the exercise of its functions to achieve the purposes and objectives of Executive Decree 36499, “Regulations for the Preparation of Institutional Environmental Management Programs in Costa Rica’s Public Sector.”

The President shall have the following functions and powers:
1)Coordinate with the Technical Evaluation Commission (CTE) of the Ministry of Environment and Energy regarding visits.
2)Preside over Commission meetings.
3)Call ordinary, extraordinary, and working meetings.
4)Prepare and propose the agenda for ordinary meetings, prioritizing the institutional interest, and submit it for the Commission’s approval immediately after confirming the quorum for the meeting.
5)Declare meetings open at the appointed time and close them after the matters scheduled for consideration have been addressed.
6)When deemed appropriate for reasons of convenience and timeliness, suspend the meeting.
7)Direct discussions, guiding debate toward the fundamental points and requiring proper order and mutual respect among participants.
8)Grant members permission to leave the meeting, provided this does not break the quorum.
9)Represent the Commission at meetings with the institution’s senior authorities, serving as its spokesperson regarding the plans and proposals prepared by the body, without prejudice to delegating that representation for a specific case when appropriate.
10)Appoint the commissions necessary to study or carry out specific work, in accordance with the established work program, in order to make the Commission’s work more effective.
11)Follow up on and update the Institutional Environmental Management plan and prepare the Summary Table of the Institutional Environmental Management Program.
12)Appoint a Commission member to serve as President during a temporary absence.
13)The President shall also have all other functions granted by the Commission.
14)Coordinate implementation of the officials’ development and training plan on environmental management matters inherent to the institution’s work, which shall be carried out every three months with the support of the Institutional Environmental Manager.

The Commission members shall have the following functions and powers:
1)Attend ordinary, extraordinary, and working meetings to which they are called punctually and, if unable to attend, submit the corresponding justification to the President.
2)Propose to the President that matters be included for consideration on the agenda of ordinary meetings, and approve the agenda as the initial act of the meeting.
3)Carry out the commissions assigned by the President and report the results in writing within the agreed period.
4)Ask the President for the floor to address matters under discussion.
5)Request reconsideration of the Commission’s agreements and their revocation or modification.
6)Cast an affirmative or negative vote on matters submitted for their consideration.
7)Formulate projects, proposals, and motions they deem appropriate.
8)Obtain and study the necessary information, and consult minutes, books, or correspondence relating to environmental matters and related topics, in order to form a better judgment on matters resolved or to be resolved at meetings.
9)Participate in all activities in which the Ministry has an interest in environmental matters.
10)Call the President to order whenever, in performing the duties of office, the President departs from the activities conferred by this regulation.
11)Ask the Secretary to record their words in the minutes when they deem it necessary.
12)Submit the reports and documents requested by the Commission in a timely and proper manner.
13)Other powers granted to them by the Commission through an agreement.

Acuerdo 147 Creación de la Comisión Institucional del Programa de Gestión Ambiental del Ministerio de Seguridad Pública Ir a la última versión Versión de la Norma: 1 de 1 MINISTERIO DE SEGURIDAD PÚBLICA Creación de la Comisión Institucional del Programa de Gestión Ambiental del Ministerio de Seguridad Pública N° 147-2026 MSP EL MINISTRO DE SEGURIDAD PÚBLICA Con fundamento en las atribuciones conferidas por el artículo 28 inciso 2), subinciso a), de la Ley General de la Administración Pública, N° 6227 de 2 de mayo de 1978; artículos 6 y 7 de la Ley Orgánica del Ministerio de Seguridad Pública, N° 5482 de 24 de diciembre de 1973.
I.Que el artículo 28, inciso 2), subinciso a), de la Ley General de la Administración Pública, establece que el Ministro es el órgano jerárquico superior del respectivo Ministerio y le corresponde de manera exclusiva, dirigir y coordinar todos los servicios del Ministerio.
II.Que mediante Acuerdo N° 186-2019-MSP de 28 de octubre de 2019, publicado en el Alcance N° 59 a La Gaceta N° 225 de 26 de noviembre del 2019, se dispuso la Creación de la Comisión Institucional para la elaboración de Programas de Gestión Ambiental del Ministerio de Seguridad Pública.
III.Que la Ley para la Gestión Integral de Residuos, N° 8839 del 24 de junio del 2010, publicada en La Gaceta N° 135 del 13 de julio del 2010, establece potestades a la Administración para adquirir bienes y servicios amigables con el ambiente, incluyendo porcentajes en las metodologías de calificación para valorar el cumplimiento de estas características, refiriéndose además a las dependencias a las que les compete elaborar los carteles de licitación o de compra directa, establecer criterios ambientales y de ciclo de vida de los productos para evaluar las licitaciones, de conformidad con los criterios establecidos en el Reglamento de la Ley de cita.
IV.Que el Ministerio de Hacienda a través de la Dirección General de Administración de Bienes y Contratación Administrativa adoptó el Programa de Fortalecimiento de Capacidades para las compras Públicas Sustentables, promovido por el Programa de las Naciones Unidas sobre el Medioambiente del cual nuestro país es plan piloto y es coordinado por la Dirección de Gestión de la Calidad Ambiental del MINAET como uno de los temas de mayor relevancia en el Plan Estratégico de Modernización de las Compras Públicas.
V.
Que de conformidad con lo preceptuado en el artículo 1 de la Directriz N° 031- MINAE de 25 de mayo del 2015, publicada en La Gaceta N° 193 del 05 de octubre de 2015 y las obligaciones establecidas en Reglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público de Costa Rica, Decreto Ejecutivo N° 36499, todas las instituciones que conforman el Gobierno Central deben:
a)contar con una Comisión Ambiental Institucional activa;
b)elaborar y entregar ante el MINAE el Programa de Gestión Ambiental Institucional;
c)estar al día con la implementación del PGAI; y
d)entregar informes de avance cada seis meses.
VI.Que, con la finalidad de dar cumplimiento a lo ordenado, se hace necesario reestructurar la Comisión Ambiental del Ministerio de Seguridad Pública y ampliar su alcance mediante la participación de representantes de los Programas y Subprogramas que comprenden el Ministerio, procurando así una mejor cobertura y efectividad en la atención del Programa de Gestión Ambiental Institucional. Por tanto,
ACUERDA:
Considerando:

Créase la Comisión Institucional del Programa de Gestión Ambiental del Ministerio de Seguridad Pública, la cual estará integrada por las personas que ostenten los siguientes cargos del Ministerio:
1)Gestor (a) Ambiental Institucional.
2)Director (a) de Proveeduría Institucional.
3)Director (a) de Transportes.
4)Jefe (a) del Departamento de proyectos de infraestructura.ente.
5)Jefe (a) del Departamento de Salud Ocupacional o su suplente.
6)Jefe (a) del Departamento de Servicios de Apoyo o su suplente.
7)Jefe (a) de la Oficina de Planificación Institucional o su suplente.
8)Viceministro (a) Administrativa o suplente.
9)Viceministro (a) de Unidades Regulares o suplente.
10)Viceministro (a) de Unidades Especiales o suplente.
Cada miembro contará con un suplente, nombrado por el titular, quien participará en ausencia de este y ejercerá las mismas funciones durante su sustitución.

La comisión contará con un (a) presidente (a), cuyo cargo será ejercido de forma rotativa cada dos años, elegido por mayoría de votos entre los miembros de la Comisión. Así mismo, contará con un secretario (a), que será el responsable de elaborar y custodiar las actas de las sesiones, registrar los acuerdos adoptados por la Comisión, comunicar las convocatorias y los acuerdos por instrucción de la Presidencia, así como dar seguimiento a su cumplimiento, el mismo será asignado por la misma comisión.

La Comisión tendrá las siguientes funciones:

La Comisión sesionará al menos una vez cada 3 meses en el lugar y hora que este cuerpo destine al efecto, sin embargo, en ese mismo periodo se podrá convocar a más de una sesión de ser necesario.
Para reunirse en sesión ordinaria no hará falta convocatoria especial. Sin embargo, para reunirse en sesión extraordinaria será siempre necesaria una convocatoria por medio de correo electrónico a todos los miembros de la Comisión, con una antelación mínima de veinticuatro horas, salvo los casos de urgencia. A la convocatoria se acompañará copia del orden del día, salvo casos de urgencia. No obstante, quedará válidamente constituida la Comisión sin cumplir todos los requisitos referentes a la convocatoria o al orden del día, cuando asistan todos sus miembros y así lo acuerden por unanimidad.
Las sesiones ordinarias y extraordinarias de la Comisión podrán celebrarse de manera virtual, mediante el uso de sistemas telemáticos que permitan una comunicación integral, simultánea e ininterrumpida de video, audio y datos entre sus integrantes y que garanticen en tiempo real la oralidad de la deliberación, la identidad de los asistentes, la autenticidad e integridad de la voluntad colegiada, la conservación e inalterabilidad de lo actuado y su grabación en medios que permitan su íntegra reproducción.

El quórum para que pueda sesionar válidamente la Comisión será la mitad más uno del total de sus miembros.
Si no hubiere quórum, la Comisión podrá sesionar válidamente en segunda convocatoria veinticuatro horas después de la señalada para la primera, salvo casos de urgencia en que podrá sesionar después de media hora y para ello será suficiente la asistencia de la tercera parte de sus miembros.
Si la sesión fuera celebrada de manera virtual, formará quórum cada uno de los integrantes presentes mediante enlaces telemáticos, para lo cual los participantes deben permanecer, durante toda la sesión, conectados con audio y video, independientemente del lugar desde el cual dicha conexión se origine, con tal de que su conexión le permita la comunicación simultánea de forma ininterrumpida.
En todos aquellos casos en que se dé el empate en la votación de algún asunto entre los miembros de la Comisión, el Presidente tendrá, en razón de su condición, doble voto, para dirimir el conflicto existente.

Serán funciones y atribuciones del Presidente, las siguientes:
1)Coordinar con la Comisión Técnica Evaluadora (CTE) del Ministerio de Ambiente, Energía lo concerniente a visitas.
2)Presidir las reuniones de la comisión.
3)Convocar a sesiones ordinarias, extraordinarias y de trabajo.
4)Elaborar y proponer el orden del día de las sesiones ordinarias, guardando un orden prioritario en procura del interés institucional y someterlo a la aprobación de la Comisión inmediatamente después de comprobar el quórum para la sesión.
5)Declarar abiertas las sesiones a la hora señalada y terminarlas después de haber tratado los asuntos que dispusieron conocer.
6)Cuando lo considere procedente, por motivos de conveniencia y oportunidad, podrá disponer la suspensión de la sesión.
7)Dirigir las discusiones orientando el debate hacia los puntos fundamentales y exigir que se observe el orden debido y el respeto mutuo entre los participantes.
8)Conceder permiso a los miembros para ausentarse de la sesión, si con ello no se rompe el quórum.
9)Representar a la comisión en reuniones con los jerarcas de la institución, convirtiéndose en el vocero del mismo con respecto a los planeamientos y propuestas elaboradas por el órgano, sin perjuicio de que, por conveniencia, se delegue esa representación para el caso concreto.
10)Designar las comisiones necesarias para el estudio o realización de trabajos específicos, acorde con el programa de trabajo que se haya dispuesto, en un afán de hacer más efectiva la labor de la Comisión.
11)Dar seguimiento y actualizar el plan de Gestión Ambiental Institucional y elaborar el Cuadro Resumen del Programa de Gestión Ambiental Institucional.
12)Designar un miembro de la Comisión para que ocupe la presidencia en su ausencia temporal.
13)Tendrá además todas aquellas otras funciones que le otorgue la comisión.
14)Coordinar la ejecución del plan de desarrollo y capacitación de los funcionarios respecto a temas de gestión ambiental inherentes al quehacer institucional, que deberá realizarse cada tres meses con el apoyo del Gestor Ambiental Institucional.

Serán funciones y atribuciones de los miembros integrantes de la comisión, las siguientes:
1)Asistir puntualmente a las sesiones ordinarias, extraordinarias y de trabajo para los cuales sean citados y, en caso de no poder asistir, remitir al presidente la justificación correspondiente.
2)Proponer a la presidencia la inclusión de asuntos a tratar en el orden del día de las sesiones ordinarias, y aprobar esta como acto inicial de la reunión.
3)Desempeñar las comisiones que el presidente designe e informar por escrito de los resultados en el plazo convenido.
4)Pedir al presidente la palabra, para referirse a asuntos puestos en discusión.
5)Solicitar la revisión de los acuerdos de la Comisión y la revocatoria o modificación de los mismos.
6)Dar su voto, positivo o negativo, sobre los asuntos que se sometan a su conocimiento.
7)Formular proyectos, proposiciones y mociones que crean oportunos.
8)Procurar y estudiar la información necesaria, consultar actas, libros o correspondencia, referente a la materia ambiental, y otros afines, a efectos de tener mejor criterio sobre los asuntos resueltos o que deben resolverse en las sesiones.
9)Participar en todas aquellas actividades en que tenga interés el ministerio en materia ambiental.
10)Llamar al orden al presidente, cada vez que en el ejercicio de su cargo se separe de las actividades que esta normativa le otorguen.
11)Solicitar al secretario que se hagan constar sus palabras en el acta cuando lo considere necesario.
12)Entregar en tiempo y forma los reportes y documentos solicitados por la comisión.
13)Las demás facultades que la comisión les otorgue mediante acuerdo.
