General Provisions
CHAPTER I
To establish the rules for regularizing precarious land-use permits in the Maritime Terrestrial Zone, pursuant to the General Law on Public Administration N.°6227 (Art.154), within the sphere of competence of the Municipality of Golfito.
This regulation shall apply to the regularization of precarious use permits in the Maritime Terrestrial Zone of the canton of Golfito. It must be borne in mind that this authorization or use permit is provisional in nature and shall remain in effect only until the Coastal Regulatory Plan enters into force. Therefore, it creates no right for occupants in relation to future concession applications.
To regulate matters concerning the form and procedure the Municipality of Golfito will follow to grant use permits in the Maritime Terrestrial Zone of the canton of Golfito, until the respective coastal regulatory plans exist that allow full application of the provisions of Law Nº6043. In this way, this regulation is implemented with the express intention of complying with the spirit of that Law in an orderly and effective manner, using the instruments made available for that purpose by the Costa Rican legal system.
Hereinafter, for purposes of this regulation and, in general, in applying the procedures, the following shall be understood:
Excluded from application of this regulation are those sectors of the Maritime Terrestrial Zone of the canton of Golfito that have a declaration of tourism suitability issued by ICT, demarcation of the Public Zone by IGN, and a regulatory plan in force, which together enable the Municipality to grant concessions. Likewise, the Municipality may not grant any use permit over portions of the Maritime Terrestrial Zone covered by forest, or over forest land or land suitable for forest, or areas defined as PNE, nor in the Public Zone of the ZMT.
Requirements and procedure for applying for and granting Land-Use Permits
CHAPTER II
Use permits shall be granted directly to applicants, who must personally handle the procedure or do so through an attorney-in-fact, and express their interest in obtaining the permit before the Department of the Maritime Terrestrial Zone. To that end, they must submit a duly completed application, in legible writing, on the official form issued by the Municipality, together with all the requirements listed below.
Natural or legal persons interested in obtaining a Land-Use Permit shall submit the following documents and requirements to the ZMT Department:
An original certificate of legal standing (issued by the National Registry or by a Notary Public) issued less than three months earlier.
A certificate of distribution of share capital, based on inspection of the shareholders’ book, issued less than three months earlier.
A certified photocopy of the articles of incorporation and the identity document of the legal representative and any special attorneys-in-fact (all must be valid).
A sworn statement by the applicant stating, under oath, that the existing constructions were built before the entry into force of the Law for the Regularization of Existing Constructions in the Restricted Zone of the Maritime Terrestrial Zone N°9242, published in La Gaceta N°109 on Monday, 9 June 2014, including a general description of them (area, construction characteristics, age, among other details).
Submission of evidence conclusively demonstrating that the existing constructions were built before the entry into force of Law N°9242.
Once the foregoing application is received by the responsible official, that official shall immediately review the submitted documents and requirements in accordance with the following guidelines:
The form must be correctly completed, legible, and free of cross-outs, and duly signed by the legal representative in the case of legal persons or by the applicant in the case of natural persons.
The signature on the application must match the identity document supporting it and must be duly authenticated by a Notary Public in accordance with the guidelines established in the Notarial Code (seals, stamps, or otherwise).
The use for which the permit is sought must be indicated in the application.
The area requested must match the area shown on the plan.
The survey-marker numbers must be indicated, if any exist.
The adjoining properties must not be identified by names, but must be referred to generally as the Restricted Zone or Public Zone; if there are access routes, their nature (street or pedestrian access) and corresponding width must be indicated.
In general, the names and identification numbers on the application, certificates, identity documents, powers of attorney, and other requirements must match and be correctly written and legible. A Land-Use Permit application that does not meet the requirements set out in the preceding article shall be rejected, with clear reasons for non-receipt stated in an administrative decision signed by the head or officer in charge of the ZMT Department.
The responsible official who receives an application meeting all the requirements set out in Article 7, and having reviewed them, shall complete the acknowledgment of receipt, clearly stating: time, date, place, documents submitted, name and identity-card number of the person delivering the application, name and signature of the responsible official, and seal of the receiving office.
Applications received in accordance with the preceding article shall immediately be entered in the “Land-Use Permit Opening Book for the Maritime Terrestrial Zone,” kept in the Service Platform Archive. The receiving official shall request the book and immediately enter the required information.
Once the file number has been assigned, the Department of the Maritime Terrestrial Zone shall issue an administrative decision informing the interested party that the file has been opened and stating the internal administrative number assigned to the application. This decision may be served immediately or later at the address or through the means indicated for receiving notices, as agreed with the responsible official.
The following subjective requirements shall be met in the process of granting precarious Use Permits:
Once the administrative file has been opened, it shall be verified that the land for which the Land-Use Permit is requested is entirely under municipal administration pursuant to Article 73 of Law N°6043.
For that purpose, the topographic engineer of the ZMT Department shall be asked—or, in that professional’s absence, the Department of Real Estate and Valuations—to prepare the respective overlays on the land-survey plan for the requested property, in order to verify the following:
Impact on areas of State Natural Heritage (PNE), in accordance with certificates issued by MINAE.
Orthophoto of the requested parcel.
Overlaps with other applications, if any.
The request for overlays shall be processed through the Golfito Municipal Integrated System (SIMGOL), using the procedures module.
The results of the overlays shall be sent to the Department of the Maritime Terrestrial Zone together with a technical report prepared by the professional responsible for them. The report shall detail the results obtained, clearly indicate whether the land-survey plan is accepted or rejected, and state the observations in the event of rejection.
Once it has been verified that the area requested in the Land-Use Permit corresponds entirely to land administered by the Municipality of Golfito and that the plan meets all technical guidelines, the Department of the Maritime Terrestrial Zone shall prepare an administrative decision communicating the result and informing the applicant that the administrative processing may continue.
If the verification results are negative, whether due to defects such as errors in control ties, discrepancies in the area of the plan’s polygon, partial impact from PNE areas, overlap with public roads, overlap with other Use Permit applications, or other defects identified by the professional responsible for the overlays, the Department of the Maritime Terrestrial Zone shall notify the interested parties of the defects found by administrative decision. The interested parties shall have 30 business days to remedy the issues identified. This period may be extended for equal periods, upon an express request duly justified by the interested party.
Once a land-survey plan addressing the notice indicated in the preceding paragraph has been submitted, it shall be sent again to the person responsible for the overlays to verify that the observations identified in the technical report have been corrected.
Once all notices have been addressed and all defects remedied, and it is known that the requested property is entirely under municipal administration, the Department of the Maritime Terrestrial Zone shall issue an administrative decision informing the interested party that payment of the amount due for the field inspection may proceed. It shall state the amount payable and the available means of payment (bank accounts, municipal cashier, or otherwise), indicate the procedure for reporting payment (email addresses or another digital means), and explain the importance of clearly identifying, at the time of payment, who is making the deposit (the applicant) and what the payment covers (inspection fee and file number). Interested parties shall have 30 business days to pay for the field inspection. This period may be extended for equal periods upon an express request duly justified by the interested party.
The amounts charged for field inspections shall be those established in the Regulation on Inspection Fees for the canton of Golfito, in force.
Once payment for the field inspection has been made and recorded in the Municipal Integrated System, the responsible official shall have a maximum period of eight business days to attach a copy of the payment receipt to the file and arrange the inspection with the Inspectors Unit. If that unit is absent, the request shall be directed to the Department of Urban Development and Control, either by official letter or through the procedures module of the Golfito Municipal Integrated System (SIMGOL). The request shall include the form established by the Department of the Maritime Terrestrial Zone for this purpose, as well as a copy of the land-survey plan for the parcel to be inspected.
The details regarding the time and date of the field inspection shall be provided by the department responsible for inspections, according to the schedule established in the field-trip calendar, and shall be communicated to the interested party by telephone.

Name and identity-card number of the inspectors responsible, as well as of any other person present or participating in the inspection.
File number to which the inspection pertains.
Full name and identity-card number of the applicant.
Exact location of the parcel: address, beach name, district, canton, province, and geographic coordinates.
Number of meters fronting the Public Zone.
Number of meters fronting a public road.
Area requested, in square meters or hectares.
Number of survey markers visible in the Public Zone in front of the requested area, stating their number and year of installation (a photograph of the condition of each marker must be included). ? Parcel boundaries (north, south, east, and west).
Period of occupancy, if stated by the interested party.
Use requested for the parcel.
Topographic description of the parcel, indicating whether it matches the graphic representation on the submitted plan.
Indication of any conflicts arising during the inspection, or whether another permit holder has previously had an inspection conducted at the same site.
Presence of crops and specific type of crop.
Presence of improvements and a detailed description, including: number, area, materials used, whether they are inhabited and their use, number of floors, state of preservation, number of rooms (if possible), fences or walls, type of existing vegetation, approximate number of inhabitants (if possible), apparent age, proximity to bodies of water such as estuaries, mangroves, rivers, or streams, and whether they are located in the Public Zone or Restricted Zone.
Presence of roads on the parcel: width, condition, type of material, and available public services (drinking water, electricity, street lighting, telephone service, cable television, internet, solid-waste collection, among others).
Existence of a Declaration of Tourism Suitability.
Comments, observations, and any other relevant information.
Photographic annex and drawing of the land showing existing constructions, referenced to points of interest such as rivers, streams, survey markers, roads, or other relevant features of the surroundings.
Once the municipal inspector submits the inspection report to the Department of the Maritime Terrestrial Zone, the Department shall have a maximum period of eight business days to transmit its result to the interested party by administrative decision. This is intended to allow the interested party to state agreement or disagreement with the report; tacit agreement shall apply if no comments are received within 10 business days after notice.
Once the municipal inspection has been conducted and the existence of constructions confirmed, the Department of the Maritime Terrestrial Zone shall have ten business days to conduct the corresponding analysis to determine whether those constructions may be retained under the regulations currently in force on the matter. For this verification, the responsible official shall consider the requirement established in subsection g) of Article 7 of this regulation, the information in the administrative file, and the field inspection report.
Based on the result of the foregoing analysis, the following actions shall be determined:
• If it is conclusively established that the existing constructions are covered by the Law for the Regularization of Existing Constructions in the Restricted Zone of the Maritime Terrestrial Zone N°9242, they may be retained, subject to amendments to the regulations governing the matter or implementation of a Coastal Regulatory Plan that warrants modifying or removing those constructions.
• Existing constructions regulated by Article 4 of Law N°9242 may be used on a precarious basis, provided that a land-use fee set by the Municipality is paid; such payment shall create no right for the applicant.
• If it is established that the existing constructions were built after the entry into force of Law N°9242, the Department of the Maritime Terrestrial Zone shall proceed in strict accordance with Article 13 of the Law on the Maritime Terrestrial Zone N°6043 and shall also file the corresponding complaints with the Courts of Justice for usurpation of Public-Domain Property.
Municipal services constitute consideration authorized by Article 83 of the Municipal Code; therefore, applicants are required to pay for them. Accordingly, if constructions are found on parcels for which an application is pending or a Use Permit has already been authorized, and if it is certain that waste-collection service is provided in the area, the Department of the Maritime Terrestrial Zone shall register in the SIMGOL system the corresponding solid-waste collection, transfer, and final disposal services. The responsible official shall have eight business days to make that entry and inform the interested party of the municipal action by administrative decision.
For illegal constructions subject to eviction and demolition proceedings, the service charge shall remain in effect until the municipal administration carries out those proceedings.
Payment for solid-waste collection, transfer, and final disposal services shall create no subjective right in favor of the holder, since, as stated above, it is consideration for a service actually provided.
Outstanding amounts for these services shall be entered in the system beginning with the quarter in progress when that work is performed.
Once it has been confirmed that there are no conflicts according to the field inspection report and no constructions subject to eviction and demolition proceedings, the Department of the Maritime Terrestrial Zone shall have eight business days to request that the topographic engineer of the ZMT Department—or, in that professional’s absence, the Department of Real Estate and Valuations—prepare an appraisal of the parcel sought, either by official letter or through the procedures module of the Golfito Municipal Integrated System (SIMGOL). The request shall include the form established by the Department of the Maritime Terrestrial Zone for this purpose, as well as a copy of the land-survey plan for the parcel to be appraised.
Once the appraisal has been prepared and sent to the Department of the Maritime Terrestrial Zone, the responsible official shall have eight business days to transmit it to the interested party in accordance with Article 51 of Executive Decree N°7841-P; this transmission shall be by administrative decision. This is intended to allow the interested party to state agreement or disagreement with the appraisal; tacit agreement shall apply if no objection is received within the prescribed period.
If any ordinary appeal is filed against the valuation performed, it shall be processed in accordance with Article 19 of the Real Estate Tax Law N°7509.
Once the interested parties have met all the subjective requirements previously established, the Department of the Maritime Terrestrial Zone shall have eight business days to inform the Municipal Mayor, by technical report, that the procedure meets all formal and legal requirements for obtaining the Land-Use Permit.
Once the Municipal Mayor has both favorable opinions, technical and legal, the Mayor shall send the Municipal Council, by official letter, a recommendation to grant the Land-Use Permit, attaching the corresponding administrative file.
Once it has considered the recommendation issued by the Mayor, the Municipal Council shall refer the matter to the Maritime Terrestrial Zone Commission for its analysis.
The Commission shall issue an opinion recommending that the Council approve or reject the Land-Use Permit.
The Municipal Council shall consider the Commission’s opinion at its next session and decide on the application as appropriate. In its agreement, it shall authorize the Mayor to prepare and sign the administrative decision informing the interested party that the land-use permit has been approved or rejected.
Finally, the Municipal Council Secretariat shall transcribe the relevant agreement and notify the Mayor’s Office of the outcome.
Upon receipt of the Municipal Council agreement, the Mayor’s Office shall prepare and unilaterally sign the administrative decision formalizing the approved use permit or, as applicable, communicating its rejection.
The administrative decision formalizing approval of the use permit must be duly reasoned and contain the clauses governing that permit. Denial of an application for a use permit must also be duly reasoned and supported.
The decision shall be served through the means indicated by the applicant in the Single Taxpayer Registration Form (RUT).
In the event of disagreement, the applicant shall have the right to challenge the merits of the decision, in accordance with Article 171 of the Municipal Code.

Use permits are temporary in nature, since they are granted when it is impossible to grant concessions. Once the coastal regulatory plan for the area granted is approved, the use permit shall cease to be in force and shall confer no right on the holder.

Given the temporary nature of the use permit, the Municipality may, through an agreement of the Municipal Council, revoke it at any time on grounds of opportunity or convenience, by a duly reasoned administrative act in light of the public interest. In accordance with Article 154 of the General Law on Public Administration N°6227, the decision shall establish a minimum period after which the revocation takes effect. Such annulment or revocation shall not give rise to liability on the part of the Administration unless it acts arbitrarily and not in the public interest.
The authorized use permit may be extinguished on any of the following grounds:
Use permits shall be granted for a term of five years (60 months), renewable for equal periods subject to approval by the Municipal Council and at the interested party’s request. Such permits may remain in force until the Coastal Regulatory Plan for the relevant area is approved.
The minimum areas of parcels for which use permits are granted shall conform to the dimensions established in the Regulation to the Law. Otherwise, they shall be granted for the areas requested in each use-permit application file, subject to modification once the Regulatory Plan for the area is approved.
Permitted uses for the granting of use permits shall be authorized according to the specific conditions of each application and shall conform to the following specifications:
The fees payable by permit holders in the Maritime Terrestrial Zone shall be governed by the percentages established in Article 49 of Executive Decree N.°7841-P, which shall be applied to the respective appraisals.
Based on Article 13 of the Ley de la Zona Marítimo Terrestre N°6043 and Article 22 of its regulations (Decreto Ejecutivo N°7841-P), sanctions shall be imposed on permit holders who violate the rules governing the Maritime-Terrestrial Zone.

• To foreigners who have resided in the country for fewer than 5 continuous years, as evidenced by a certificate issued for that purpose by the national immigration authorities. • To corporations with bearer shares.
• To companies or entities domiciled abroad.
• To entities established in the country by foreigners.
• To entities whose shares, quotas, or capital are more than fifty percent owned by foreigners.
• To any other type of entity not included in the preceding items, in which more than half of its members are not Costa Rican.
• To natural persons, whether Costa Rican or foreign, who have been granted more than one land-use permit application; in such cases, the Municipality shall exercise discretion in granting that permit.

A precarious-title land-use permit shall impose the following obligations on the permit holder:
• If, for any reason, the permit holder decides not to continue using the permit granted, they must notify the Municipality of their relinquishment in writing so that the Municipality may repossess the property and determine the use it considers appropriate for the parcel in question. At the time of submitting the relinquishment, the permit holder must be current on payment of the applicable fee.
• The fee must be paid annually or quarterly, punctually and in advance, during the first five business days of each year or quarter.
• If payment of the fee is late, the permit holder must pay default interest as defined by Article 57 of the Código de Normas y Procedimientos Tributarios Ley N°4755.
• In the case of legal entities, any transfer or assignment of quotas or shares must be reported to the Municipality’s Maritime-Terrestrial Zone Department. Failure to do so shall result in the immediate revocation of the permit granted.
• Accept and faithfully comply with the clauses contained in the administrative resolution authorizing the land-use permit.
• The permit holder undertakes to maintain the portion of the public zone in front of the permitted land in a clean condition (if it fronts the public zone), to ensure free passage through it, and to keep the land in optimal condition of cleanliness and care.
• If the permit holder changes the place or means for receiving notices, they shall immediately inform the Municipality in writing.
• The permit holder undertakes to allow municipal inspectors free access; they are authorized to verify compliance with the land-use permit granted.

Extensions of land-use permits
CHAPTER V
Natural or legal persons interested in renewing a land-use permit must submit an application for an extension to the Maritime-Terrestrial Zone Department at least six months before the current permit expires. To do so, they must meet the following requirements:
An original certificate of legal status (issued by the Registro Nacional or by a Notary Public) issued less than three months earlier.
A certificate showing the distribution of share capital, based on the shareholders’ register, issued less than three months earlier.
If the previously indicated requirements are not submitted, the Maritime-Terrestrial Zone Department shall have eight business days to notify the interested party, by administrative resolution, of any omitted requirements, if any, or of any questions regarding the information provided.

The following requirements must be met for the process of granting extensions of land-use permits:
Verification of installations (if the PNE certification has been reclassified).
Update of the field inspection.
Update of the appraisal.
Technical report from the Maritime-Terrestrial Zone Department informing the Mayor’s Office that the formal and legal requirements for obtaining an extension of the land-use permit have been met.

CHAPTER VI
Administrative files for land-use permit applications may be closed on the following grounds:
? The interested party’s express relinquishment.
? Application of the provisions of Article 33 of Decreto Ejecutivo N°7841-P. ? Failure to comply with notices to remedy within the stipulated period.
? Death of the holder.
? Dissolution of the company, if it is a legal entity.
? Land-use permits revoked for failure to comply with the stipulated clauses.
Once the aforementioned grounds have been identified, the person in charge of the municipal Maritime-Terrestrial Zone Department shall close and archive the corresponding file by administrative resolution and submit a report to the Mayor’s Office for its information.

CHAPTER VII
The Maritime-Terrestrial Zone Department is responsible for applying this regulation, with mandatory assistance from the Real Estate and Valuation, Urban Development and Control, and Legal Counsel Departments, as well as any others the Mayor’s Office designates according to the nature of their functions.

CAPÍTULO I
Disposiciones Generales
Establecer las normas para la regularización de los permisos de uso de suelo a título precario en la Zona Marítimo Terrestre, al amparo de la Ley General de la Administración Pública N.°6227 (Art.154), dentro del ámbito de competencia de la Municipalidad de Golfito.
Ficha Artículo 1
El presente reglamento será aplicable para la regularización de los permisos de uso a título precario en la Zona Marítimo Terrestre del cantón de Golfito. Se debe tener presente que dicha autorización o permiso de uso tendrá carácter provisional y regirá únicamente hasta la entrada en vigencia del Plan Regulador Costero. Por tanto, no genera derecho alguno para los ocupantes en relación con futuras solicitudes de concesión.
Ficha Artículo 2
Regular lo concerniente a la forma y el procedimiento que seguirá la Municipalidad de Golfito para otorgar permiso de uso en la zona marítimo terrestre del Cantón de Golfito, hasta tanto existan los respectivos planes reguladores costeros que permitan la aplicación cabal de lo dispuesto en la Ley Nº6043. De esta manera, se implementa este reglamento con la intención expresa de cumplir con el espíritu de dicha Ley, de manera ordenada y efectiva, empleando para ello instrumentos que pone a su disposición el ordenamiento jurídico costarricense.
Ficha Artículo 3
En adelante, dentro del presente reglamento, y en general en la aplicación de los procedimientos, deberá entenderse lo siguiente:

Quedan excluidas de la aplicación de este reglamento, aquellos sectores de la Zona Marítima Terrestre del Cantón de Golfito, que cuenten con declaratoria de aptitud turística emitida por el ICT, la demarcatoria de la zona pública por parte del IGN y un Plan Regulador vigente, que en conjunto permitan a la Municipalidad el otorgamiento de concesiones. Asimismo, la Municipalidad no podrá otorgar ningún permiso de uso sobre porciones en la zona marítima terrestre cubiertas de bosque o cuando se trate de terrenos forestales o con esa aptitud, o aquellas definidas como PNE, ni en la Zona Pública de la ZMT.

Requisitos y trámite para la solicitud y el otorgamiento de Permisos de Uso de Suelo
CAPITULO II
Los permisos de uso se otorgarán directamente a los solicitantes, quienes deberán gestionar el trámite de forma personal o mediante apoderado, y manifestar su interés en obtener dicho permiso ante el Departamento de Zona Marítimo Terrestre. Para ello, deberán presentar la solicitud debidamente completada, en letra legible, en el formulario oficial emitido por la Municipalidad, junto con todos los requisitos que se detallan a continuación.
Ficha Artículo 6
Las personas físicas o jurídicas interesadas en obtener un Permisos de Uso de Suelo deberán presentar en el Departamento de ZMT los siguientes documentos y requisitos:
Certificación de personería jurídica original (emitida por el Registro Nacional o por Notario Público) con menos de tres meses de extendida.
Certificación de distribución de Capital Social con vista del libro de accionistas con menos de tres meses de extendida.
Fotocopia certificada del acta constitutiva y del documento de identidad del representante legal y apoderados especiales si los hubiera (todos vigentes).
Declaración jurada del solicitante mediante la cual manifieste, bajo fe de juramento, que las construcciones existentes fueron realizadas antes de la entrada en vigencia de la Ley para la Regularización de las Construcciones existentes en la Zona Restringida de la Zona Marítimo Terrestre N°9242, publicada en La Gaceta N°109, de lunes 9 de junio del 2014, incluyendo una descripción general de las mismas (área, características constructivas, antigüedad, entre otros).
Presentación de pruebas que demuestren fehacientemente que las construcciones existentes fueron realizadas con anterioridad a la entrada en vigencia de la Ley N°9242.
Ficha Artículo 7
Una vez recibida la anterior solicitud, por el funcionario responsable, éste deberá inmediatamente proceder a revisar la documentación y requisitos aportados bajo los siguientes lineamientos:
Que el formulario esté correctamente lleno, con letra legible, sin tachones, debidamente firmado por el representante legal en caso de personas jurídicas o por el solicitante en el caso de personas físicas.
La firma de la solicitud debe coincidir con el documento de identidad que lo respalde, y que esté debidamente autenticada por notario público conforme a los lineamientos establecidos en el Código Notarial (sellos, timbres u otros).
Que el uso a permisionar se encuentre indicado en la solicitud.
Que el área solicitada coincida con el área del plano.
Que se indiquen los números de mojones (en caso de existir).
Las colindancias; no deberán indicar nombres, sino referirse en general a la zona restringida o zona pública, y si fueran accesos, indicar la calidad de los mismos (calle o acceso peatonal) y su respectivo ancho.
Que en general los nombres y número de identificación de la solicitud, certificaciones, cédulas, poderes y demás requisitos coincidan y se encuentren correctamente escritos y legibles. La solicitud de Permiso de Uso de Suelo que no cuente con los requisitos estipulados en el artículo anterior será rechazada, con clara indicación mediante resolución administrativa firmada por el encargado o jefe del Departamento de ZMT sobre las razones de su no recibido.
El funcionario responsable que reciba una solicitud con todos los requisitos que señala el artículo 7, y habiendo revisado los mismos, procederá a llenar la razón de recibido, con clara indicación de: hora, fecha, lugar, documentos aportados, nombre y cédula de la persona que entrega la solicitud, nombre y firma del funcionario responsable y sello de la oficina que recibe.
Ficha Artículo 8
Las solicitudes recibidas conforme el artículo anterior, serán inmediatamente consignadas en el “Libro de Apertura de Permisos de Uso de Suelo en Zona Marítimo Terrestre”, que se encuentra resguardado en el Archivo de la Plataforma de Servicios, debiendo el funcionario que recibe solicitarlo y proceder inmediatamente al llenado de la información requerida en el mismo.
Una vez asignado el número de expediente, el Departamento de Zona Marítimo Terrestre procederá mediante resolución administrativa a informar al interesado sobre la apertura de su expediente, y el número administrativo interno asignado a su solicitud. Esta resolución se podrá notificar inmediatamente o posteriormente al lugar o medio señalado para recibir notificaciones, según se convenga con el funcionario responsable.
Ficha Artículo 9
Para el proceso de otorgamiento de Permisos de Uso a título precario, deberán cumplirse los siguientes requisitos subjetivos:
Una vez abierto el expediente administrativo, se verificará que el terreno solicitado en Permiso de Uso de Suelo, se encuentre totalmente en administración municipal en aplicación del artículo 73 de la Ley N°6043.
Para el cumplimiento de lo anterior, se solicitará al ingeniero topógrafo del Departamento de ZMT, y en ausencia de este profesional, al Departamento de Bienes Inmuebles y Valoraciones, la elaboración de los respectivos montajes sobre el plano de agrimensura del terreno solicitado, con el fin de constatar lo siguiente:
Afectación de áreas de Patrimonio Natural del Estado (PNE) de conformidad con las certificaciones emitidas por el MINAE.
Ortofoto de la parcela solicitada.
Traslapes con otras solicitudes (en casos de existir).
Dicha solicitud de montajes será gestionada por medio del Sistema Integral Municipal de Golfito (SIMGOL), a través del módulo de trámites.
Los resultados de los montajes deberán ser remitidos al Departamento de Zona Marítimo Terrestre, junto con un informe técnico elaborado por el profesional responsable de su realización. Dicho informe deberá detallar los resultados obtenidos, e indicar de forma clara si se acepta o rechaza el plano de agrimensura, y consignar las observaciones correspondientes en caso de rechazo.
Una vez verificado que el área solicitada en Permisos de Uso de Suelo corresponde en su totalidad a terrenos administrados por la Municipalidad de Golfito y que le plano cumple con todos los lineamientos técnicos, el Departamento de Zona Marítimo Terrestre procederá a elaborar una resolución administrativa donde comunica el resultado e informa sobre la procedencia de continuar con las gestiones administrativas.
Si el resultado de las verificaciones fuera negativo, ya sea por defectos como errores de amarres, diferencias en área del polígono del plano, afectación parcial por áreas de PNE, traslape de vías públicas, traslape con otras solicitudes de Permiso de Uso, u otros defectos determinados por el profesional encargado de los montajes, el Departamento de Zona Marítimo Terrestre deberá prevenir a los interesados, mediante resolución administrativa, sobre los defectos encontrados. Los interesados dispondrán de un plazo de 30 días hábiles para atender lo prevenido. Este plazo podrá prorrogarse por periodos iguales, previa solicitud expresa y debidamente justificada por parte del interesado.
Una vez presentado el plano de agrimensura que atienda la prevención indicada en el punto anterior, este será reenviado al encargado de los montajes, a fin de corroborar que se han subsanado las observaciones señaladas en el informe técnico.
Cumplidas todas las prevenciones y subsanados todos los defectos, a sabiendas que el terreno solicitado se encuentra en su totalidad en administración municipal, el Departamento de Zona Marítimo Terrestre emitirá una resolución administrativa donde comunica al interesado la procedencia del pago de la suma correspondiente por concepto de inspección de campo, con indicación del monto a cancelar y los medios disponibles para hacerlo (cuentas bancarias, caja recaudadora municipal u otro), así como indicar el procedimiento para reportarlo (correos electrónicos u otro medio digital) y la importancia de que el interesado a la hora de pagar señale claramente quien deposita (el titular de la solicitud) y para que se cancela la suma (concepto de inspección y número de expediente). Los interesados dispondrán de un plazo de 30 días hábiles para realizar el pago de la inspección de campo. Este plazo podrá prorrogarse por periodos iguales, previa solicitud expresa y debidamente justificada por parte del interesado.
Los montos aplicables para el cobro de la inspección de campo serán los establecidos en el Reglamento de Cobro por Inspecciones para el Cantón de Golfito, vigente.
Una vez realizado el pago correspondiente por la inspección de campo y registrado en el Sistema Integral Municipal, el funcionario responsable contará con el plazo máximo de ocho días hábiles para adjuntar al expediente una copia del recibo de pago y gestionar la inspección ante la Unidad de Inspectores. En caso de ausencia de esta unidad, la gestión deberá dirigirse al Departamento de Desarrollo y Control Urbano, ya sea mediante oficio o a través del módulo de trámites del Sistema Integral Municipal de Golfito (SIMGOL). A dicha solicitud se deberá adjuntar el formulario establecido por el Departamento de Zona Marítimo Terrestre para este efecto, así como una copia del plano de agrimensura de la parcela a inspeccionar.
Los detalles sobre la hora y fecha de la inspección de campo serán proporcionados por el departamento responsable de las inspecciones, según la programación establecida en el cronograma de giras, y se comunicarán al interesado vía telefónica.
Fecha y hora en que se realizó la inspección.
Fecha y hora de la elaboración del informe.
Nombre y número de cédula de los inspectores responsables, así como de cualquier otra persona que haya estado presente o participado en la inspección.
Número de expediente al que corresponde la inspección.
Nombre completo y número de cédula del solicitante.
Ubicación exacta de la parcela: dirección, nombre de la playa, distrito, cantón, provincia y coordenadas geográficas.
Cantidad de metros frente a Zona Pública.
Cantidad de metros frente a calle pública.
Área solicitada en metros cuadrados o hectáreas.
Número de mojones visibles en la zona pública frente al área solicitada, indicando la cantidad y el año de colocación de los mismos (deberá incluirse fotografía del estado de cada mojón). ? Colindancias de la parcela (norte, sur, este y oeste).
Tiempo de ocupación, si es manifestado por el interesado.
Uso solicitado para la parcela.
Descripción topográfica de la parcela, indicando si coincide o no con la representación gráfica del plano aportado.
Indicación sobre eventuales conflictos surgidos durante la inspección, o si previamente se ha realizado inspección en el mismo sitio por parte de otro permisionario.
Existencia de cultivos y tipo especifico de cultivo.
Existencia de mejoras y su descripción detallada, incluyendo: cantidad, área, materiales utilizados, si se encuentran habitadas y para qué uso, cantidad de pisos, estado de conservación, número de aposentos (si es posible), cercas o tapias, tipo de vegetación existente, número aproximado de habitantes (si es posible), antigüedad aparente, cercanía a cuerpos de agua como esteros, manglares, ríos o quebradas, así como si se ubican en Zona Pública o Zona Restringida.
Existencia de calles en la parcela: ancho, estado, tipo de material, y servicios públicos disponibles (agua potable, electricidad, alumbrado público, telefonía, televisión por cable, internet, recolección de residuos sólidos, entre otros).
Existencia de Declaratoria Aptitud Turística.
Comentarios, observaciones y cualquier otra información relevante.

Una vez que el inspector municipal entregue el informe de la inspección al Departamento de Zona Marítimo Terrestre, esté contará con un plazo máximo de ocho días hábiles para trasladar el resultado del mismo al interesado, mediante resolución administrativa. Lo anterior con la intención que el interesado manifieste su conformidad o disconformidad para con el informe, aplicando la conformidad tácita en caso de no recibirse manifestaciones en el transcurso de 10 días hábiles posteriores a su notificación.
Una vez realizada la inspección municipal y constatada la existencia de construcciones, el Departamento de Zona Marítimo Terrestre contará con un plazo de diez días hábiles para efectuar el análisis correspondiente, con el fin de determinar si dichas construcciones pueden ser conservadas conforme a la normativa vigente en la materia. Para esta verificación, el funcionario responsable deberá considerar el requisito establecido en el inciso g) del artículo 7 del presente reglamento, los antecedentes que consten en el expediente administrativo y el informe de inspección de campo.
De acuerdo con el resultado del análisis previamente mencionado, se determinarán las siguientes acciones a seguir:
• En caso de comprobarse fehacientemente que las construcciones existentes se encuentran amparadas por la Ley para la Regularización de las Construcciones existentes en la Zona Restringida de la Zona Marítimo Terrestre N°9242, podrán ser conservadas, salvo a disposiciones de reformas a la normativa que regula la materia, o la implementación de un Plan Regulador Costero que amerite modificar o eliminar dichas construcciones.
• Las construcciones existentes reguladas en el artículo 4 de la Ley N°9242, podrán ser utilizadas a título precario siempre que medie el pago de un canon por el uso de suelo fijado por la municipalidad, el cual no generará derecho alguno al administrado.
• En caso de comprobarse que las construcciones existentes fueron realizadas con posterioridad a la entrada en vigencia de la Ley N°9242, el Departamento de Zona Marítimo Terrestre deberá proceder con estricto apego a lo dispuesto en el artículo 13 de la Ley sobre la Zona Marítimo Terrestre N°6043, además de interponer las denuncias correspondientes ante los Tribunales de Justicia por la usurpación de Bienes de Dominio Público.
Los servicios municipales constituyen una contraprestación autorizada por el artículo 83 del Código Municipal; por tanto, los administrados están en la obligación de pagarlos. De manera que de constatarse la existencia de construcciones en parcelas que se encuentren en estado de solicitud o con Permisos de Uso ya autorizados, y siembre que exista certeza de que en el sector se brinda el servicio de recolección de residuos, el Departamento de Zona Marítimo Terrestre procederá a registrar en el sistema SIMGOL los servicios correspondientes de recolección de residuos sólidos, así como de traslado y disposición final. Para ello, el funcionario responsable dispondrá de un plazo de ocho días hábiles para realizar dicha inclusión e informar al interesado mediante resolución administrativa sobre la actuación municipal.
En el caso de construcciones ilegales sujetas a un procedimiento de desalojo y demolición, el cobro del servicio se mantendrá vigente hasta que la administración municipal ejecute dicho procedimiento.
El pago de servicios de recolección de residuos sólidos, traslado y disposición final no generará derecho subjetivo alguno a favor del titular, dado que, como se indicó previamente, se trata de una contraprestación por un servicio efectivamente brindado.
Los montos pendientes por concepto de estos servicios serán incluidos en el sistema a partir del trimestre en curso al momento de realizar dicha labor.
Una vez corroborado que no existe conflictos según el informe de inspección de campo ni construcciones sujetas a un procedimiento de desalojo y demolición, el Departamento de Zona Marítimo Terrestre contará con un plazo de ocho días hábiles para solicitar al ingeniero topógrafo del Departamento de ZMT, y en ausencia de este profesional, al Departamento de Bienes Inmuebles y Valoraciones, la elaboración del avalúo de la parcela pretendida, ya sea mediante oficio o a través del módulo de trámites del Sistema Integral Municipal de Golfito (SIMGOL). A dicha solicitud se deberá adjuntar el formulario establecido por el Departamento de Zona Marítimo Terrestre para este efecto, así como una copia del plano de agrimensura de la parcela a valorar.
Elaborado el avalúo y remitido al Departamento de Zona Marítimo Terrestre, el funcionario responsable contará con el plazo de ocho días hábiles para trasladarlo al interesado de conformidad con lo dispuesto en el artículo 51 del Decreto Ejecutivo N°7841-P, este traslado se realizará mediante resolución administrativa. Lo anterior con la intención que el interesado manifieste su conformidad o disconformidad para con el avalúo, aplicando la conformidad tácita en caso de no recibirse oposición en el plazo estipulado.
Es caso de presentarse algún tipo de recurso ordinario en contra de la valoración realizada, estos serán tramitados conforme con lo dispuesto en el artículo 19 de la Ley de Impuesto sobre Bienes Inmuebles N°7509.
Una vez que los interesados hayan cumplido con todos los requisitos subjetivos previamente establecidos, el Departamento de Zona Marítimo Terrestre contará con un plazo de ocho días hábiles para comunicar a la Alcaldía Municipal, mediante informe técnico, que el trámite cumple con todos los requisitos formales y legales para la obtención del Permiso de Uso de Suelo.
Una vez que la Alcaldía Municipal cuente con ambos dictámenes favorables, tanto el técnico como el legal, deberá remitir al Concejo Municipal, mediante oficio, la recomendación para el otorgamiento del Permiso de Uso de Suelo, adjuntando el expediente administrativo correspondiente. k) Acuerdo del Concejo Municipal.
Una vez conocida la recomendación emitida por la Alcaldía, el Concejo Municipal trasladará el trámite a la Comisión de Zona Marítimo Terrestre para su respectivo análisis.
La comisión deberá emitir un dictamen en el que recomiende al Concejo la aprobación o improbación del Permiso de Uso de Suelo.
El Concejo Municipal conocerá el dictamen de la Comisión en la siguiente sesión y resolverá la solicitud conforme corresponda. En el acuerdo que adopte, deberá autorizar al Alcalde para la elaboración y firma de la resolución administrativa que comunique al interesado la aprobación o el rechazo del permiso de uso de suelo.
Finalmente, la Secretaría del Concejo Municipal transcribirá el acuerdo correspondiente y notificará a la Alcaldía sobre el resultado.
Una vez recibido el acuerdo del Concejo Municipal, la Alcaldía procederá con la elaboración y firma unilateral de la resolución administrativa que formalice el permiso de uso aprobado o, en su defecto, comunique su rechazo.
La resolución administrativa que formalice la aprobación del permiso de uso deberá estar debidamente fundamentada y contener las cláusulas que regulan dicho permiso. La denegatoria de una solicitud de permiso de uso también deberá ser debidamente motivada.
La resolución será notificada al medio señalado por el administrado en el Formulario de Registro Único Tributario (RUT).
En caso disconformidad, el solicitante tendrá derecho a impugnar el fondo de lo resuelto, conforme a lo establecido en el artículo 171 del Código Municipal.

El carácter de los permisos de uso es temporal, puesto que se otorgan ante la imposibilidad de conceder concesiones. Una vez aprobado el plan regulador costero del área concedida, el permiso de uso cesará en vigencia y no otorgará ningún derecho a favor del titular.
Ficha Artículo 11
El otorgamiento de un permiso de uso es un acto discrecional y unilateral de la Municipalidad, dirigido al bien público, por ello deberá manifestarse mediante resolución administrativa debidamente motivada con referencia al interés público que los justifica. La denegatoria de una solicitud de permiso de uso también debe ser motivada y fundamentada.
Ficha Artículo 12
El otorgamiento de un permiso de uso es un acto discrecional y unilateral de la Municipalidad, dirigido al bien público, por ello deberá manifestarse mediante resolución administrativa debidamente motivada con referencia al interés público que los justifica. La denegatoria de una solicitud de permiso de uso también debe ser motivada y fundamentada.
Ficha Artículo 13
Dado el carácter temporal del permiso de uso, la Municipalidad a través de un acuerdo del Concejo Municipal, podrá revocarlo en cualquier momento, con fundamento en razones de oportunidad o conveniencia, mediante acto administrativo debidamente motivado en atención al interés público. Conforme a lo dispuesto en el artículo 154 de la Ley General de la Administración Pública N°6227, en la respectiva resolución se fijará un plazo mínimo a partir del cual entrará en vigencia la revocatoria. Dicho acto de anulación o revocación no genera responsabilidad alguna para la Administración salvo que actúe arbitrariamente y no al amparo del interés público.

El permiso de uso autorizado podrá extinguirse por cualquiera de las siguientes causales: a) Por vencimiento del plazo de vigencia del permiso de uso, sin que medie solicitud de prórroga por parte del interesado.
Ficha Artículo 15
Los permisos de uso se otorgarán por un plazo de cinco años (60 meses), prorrogables por períodos iguales, previa aprobación del Concejo Municipal y a solicitud del interesado. Dichos permisos podrán mantenerse vigentes hasta tanto no se apruebe el Plan Regulador Costero del área respectiva.
Ficha Artículo 16
Las áreas mínimas de las parcelas donde se otorguen permisos de uso se ajustarán a las dimensiones establecidas en el reglamento de la Ley. Por lo demás se otorgarán por las áreas solicitadas en cada expediente de solicitud de permiso de uso, sujetas a modificación una vez aprobado el Plan Regulador para la zona.

Los usos permitidos para el otorgamiento de permisos de uso se autorizarán conforme a las condiciones particulares de cada solicitud y deberán ajustarse a las siguientes especificaciones:

Los cánones que deberán pagar los permisionarios de la Zona Marítimo Terrestre se regularán conforme a los porcentajes establecidos en el artículo 49 del Decreto Ejecutivo N.°7841-P, los cuales se aplicarán sobre los respectivos avalúos.

Con base al artículo 13 de la Ley de la Zona Marítimo Terrestre N°6043, y artículo 22 del Reglamento a la Ley (Decreto Ejecutivo N°7841-P), se aplicarán las sanciones a los permisionarios infractores de la Zona Marítimo Terrestre.

Sobre las prohibiciones y obligaciones
CAPITULO IV
• A extranjeros que hayan residido en el país menos de 5 años en forma continua, según conste en certificación extendida para tales efectos por las autoridades nacionales de Migración. • A sociedades anónimas con acciones al portador.
• A sociedades o entidades domiciliadas en el exterior.
• A las entidades constituidas en el país por extranjeros.
• A entidades cuyas acciones o cuotas o capital, corresponden en más de cincuenta por ciento a extranjeros.
• A cualquier otro tipo de entidad, no comprendida en los incisos anteriores, en que más de la mitad de sus miembros no sean costarricenses.
• A las personas físicas, nacionales o extranjeras con más de una solicitud de permiso de Uso de Suelo otorgada, para lo cual regirá la discrecionalidad de la Municipalidad para el otorgamiento de dicho permiso.
Ficha Artículo 21
El permiso de uso de suelo a título precario generará las siguientes obligaciones al permisionario: • Si por alguna razón el permisionario decide no continuar haciendo uso del permiso otorgado, deberá comunicar su renuncia por escrito a la Municipalidad, a fin de que esta retome el bien y determine el destino que considere conveniente para la parcela en cuestión. Al momento de presentar la renuncia, el permisionario deberá encontrarse al día con el pago del canon correspondiente.
• El pago de canon debe ser cancelado en forma anual o trimestral, bajo la condición de que será de manera puntual y adelantada durante los primeros cinco días hábiles de cada año o trimestre.
• En caso de atraso en el pago de canon, la permisionaria deberá pagar intereses moratorios que serán definidos por el artículo 57 del Código de Normas y Procedimientos Tributarios Ley N°4755.
• En el caso de las personas jurídicas, toda cesión o traspaso de cuotas o acciones, deberá reportarse al Departamento de Zona Marítima Terrestre de la Municipalidad, su inobservancia provocará la revocatoria inmediata del permiso otorgado.
• Aceptar y dar fiel cumplimiento a las cláusulas contenidas en la resolución administrativa que autorizó el permiso de uso de suelo.
• Se compromete a dar mantenimiento de limpieza a la porción zona pública frente al terreno permisionado (si tuviese frente a zona pública) y a garantizar su libre tránsito y a mantener en óptimas condiciones de limpieza y cuidado del terreno.
• En caso de que la permisionaria cambiare de lugar o medio para recibir notificaciones, lo hará saber inmediatamente por escrito a la Municipalidad.
• Se compromete a permitir el libre acceso de los inspectores municipales quienes están facultados para verificar el cumplimiento del permiso de uso otorgado.

Prórrogas de permisos de uso
CAPITULO V
Las personas físicas o jurídicas interesadas en renovar un Permiso de Uso de Suelo deberán presentar ante el Departamento de Zona Marítimo Terrestre la solicitud de prórroga con al menos seis meses de antelación al vencimiento del permiso vigente. Para ello, deberán cumplir con los siguientes requisitos:
Certificación de personería jurídica original (emitida por el Registro Nacional o por Notario Público) con menos de tres meses de extendida.
Certificación de distribución de Capital Social con vista del libro de accionistas con menos de tres meses de extendida.
En caso de que no se presenten los requisitos previamente indicados, el Departamento de Zona Marítimo Terrestre contará con un plazo de ocho días hábiles para prevenir al interesado, mediante resolución administrativa, sobre la omisión de los requisitos faltantes, si los hubiera, o sobre cualquier duda relacionada con la información aportada.
Ficha Artículo 23
Para el proceso de otorgamiento de prórrogas de permisos de Uso, deberán cumplirse los siguientes requisitos:
Verificación de montajes (en caso de haberse recalificado la certificación de PNE).
Actualización de la inspección de campo.
Actualización del avalúo.
Informe técnico del Departamento de Zona Marítimo Terrestre que comunique a la Alcaldía el cumplimiento de los requisitos formales y legales para la obtención de la prórroga de permiso de uso de suelo.
Criterio de la Asesoría Legal sobre la procedencia de autorizar la prórroga de permiso de uso. ? Oficio de la Alcaldía recomendando al Concejo Municipal el otorgamiento de la prórroga del permiso de uso.
Acuerdo del Concejo que autorice la prórroga del permiso de uso.
Resolución administrativa de la Alcaldía que formalice la prórroga del permiso de uso.
Ficha Artículo 24
Causales de cierre de expedientes administrativos
CAPITULO VI
Los expedientes administrativos de trámites de permisos de uso podrán ser cerrados por las siguientes causales:
? Por renuncia expresa del interesado.
? Por la aplicación de lo estipulado en el artículo 33 del Decreto Ejecutivo N°7841-P. ? Por incumplimiento de prevenciones en el plazo estipulado.
? Por fallecimiento del titular.
? Por disolución de la sociedad, en caso de tratarse de una persona jurídica.
? Permisos de Uso revocados por incumplimientos de las cláusulas estipuladas.
Una vez detectadas las causales previamente indicadas, el encargado del Departamento de Zona Marítimo Terrestre municipal procederá mediante resolución administrativa al cierre y archivo del respectivo expediente y remitirá un informe a la Alcaldía para su conocimiento.

Aplicación, supletoriedad, derogatoria y vigencia
CAPITULO VII
Disposiciones finales
El Departamento de Zona Marítimo Terrestre es el encargado de la aplicación del presente reglamento, para lo cual se contará con la asistencia obligatoria de los Departamentos de Bienes Inmuebles y Valoración, Desarrollo y Control Urbano, Asesoría Legal y los demás que la Alcaldía designe según la naturaleza de su función.

En todo lo no previsto en el presente reglamento, se regirán las disposiciones contenidas en la Ley sobre la Zona Marítimo Terrestre y su Reglamento (Decreto Ejecutivo N°7841-P).

Este reglamento deroga todos los anteriores. Adquiriendo validez con la aprobación del Concejo Municipal Ficha Artículo 28
