I.Whereas the National Commission for Risk Prevention and Emergency Management, at 16:00 on 20 July 2026, issued Alert No. 016-2026, establishing a Yellow Alert in the Caribbean and Northern Zone (Caribbean Region, canton of Turrialba) due to instability on the Caribbean slope caused by the passage of Tropical Wave No. 24, with minor impacts.
II.Whereas the National Commission for Risk Prevention and Emergency Management, at 14:00 on 28 July 2026, lifted Yellow Alert No. 016 under consecutive number No. 017-2026, following a return to the typical conditions for the season.

IV.Whereas the National Commission for Risk Prevention and Emergency Management, at 16 hours 30 minutes on 02 August 2026, issued Alert No. 019-2026, establishing a Yellow Alert for the Northern Caribbean (Pococí, Guácimo, Siquirres, and Matina), Turrialba, and a Green Alert for the Southern Caribbean (Limón, Talamanca), Northern Zone (Sarapiquí, San Carlos, Río Cuarto, Los Chiles, Guatuso, Upala), and South Pacific (Pérez Zeledón, Buenos Aires, Osa, Golfito, Puerto Jiménez, Corredores, and Coto Brus), due to atmospheric instability and high soil saturation.
V.Whereas the National Commission for Risk Prevention and Emergency Management, at 11:00 on 11 August 2026, lifted Alert No. 019 under consecutive number No. 020-2026, following a return to more stable atmospheric conditions.
VI.Whereas the National Commission for Risk Prevention and Emergency Management, at 11:30 on 13 August 2026, issued Alert No. 021-2026, establishing a Green Alert in the Caribbean Slope and Northern Zone of the country, based on information provided by the National Meteorological Institute, in view of increasing atmospheric instability and progressively increasing humidity on that slope, with variable rainfall and scattered showers with thunderstorms.
VII.Whereas the National Commission for Risk Prevention and Emergency Management, at 14:30 on 14 August 2026, issued Alert No. 022-2026, establishing a Yellow Alert for the Caribbean and Northern Zone and a Green Alert for the South Pacific, Central Pacific, and Central Valley due to increased atmospheric instability and the passage of Tropical Wave No. 32, which would strengthen the Intertropical Convergence Zone, bringing in moisture and favoring rainfall in the province of Limón and the Northern Zone, thereby creating a more unstable environment.
VIII.Whereas the National Meteorological Institute, by Meteorological Advisory issued at 09 hours 45 minutes on 15 August 2026, reported that Tropical Wave No. 32 was moving across Costa Rica and that, in addition, the Intertropical Convergence Zone was positioned over the country, maintaining high levels of instability and humidity. The highest rainfall totals over the preceding 6 hours were recorded in the mountainous regions of the Southern Caribbean, ranging from 30-75 mm, while in the Northern Caribbean, parts of the Northern Zone, and Cartago, totals ranged from 10-50 mm. In the rest of the country, totals did not exceed 20 mm. Special attention was recommended in the mountainous Caribbean watersheds, where soil saturation was between 70 – 95%, given the probability of increased precipitation on that slope. In addition, watersheds around golfo Dulce had saturation levels above 90%. Caution was advised in urban areas due to possible saturation of sewer systems.
IX.Whereas the National Meteorological Institute, by Meteorological Report No. 1 issued at 16 hours on 15 August 2026, reported that unstable and humid conditions were occurring over the weekend due to the passage of Tropical Wave No. 32, the position of the Intertropical Convergence Zone over the country, moisture carried by accelerated trade winds in the Caribbean basin, and instability at upper levels. XI.Whereas the National Commission for Risk Prevention and Emergency Management, at 18:00 on 16 August 2026, issued Alert No. 023-2026, establishing an Orange Alert for the Caribbean, Northern Zone, and canton of Turrialba, and a Yellow Alert for the South Pacific, Central Pacific, and Central Valley, in view of increased atmospheric instability and the passage of Tropical Waves, with unstable and humid conditions prevailing. Tropical Wave No. 33 was located over Panama.
XII.Whereas the National Meteorological Institute, by Meteorological Report No. 6 issued at 10 hours 24 minutes on 16 August 2026, reported that unstable and humid conditions were prevailing and occurring on Sunday due to factors such as the position of the Intertropical Convergence Zone over the country, moisture carried by accelerated trade winds in the Caribbean basin, and instability at upper levels, with Tropical Wave No. 33 located near the border with Panama.
XIII.Whereas the National Meteorological Institute, by Meteorological Report No. 7 issued at 04 hours 07 minutes on 17 August 2026, reported that unstable and humid conditions were prevailing on Monday due to factors such as the position of the Intertropical Convergence Zone over the country, moisture carried by accelerated trade winds in the Caribbean basin, and instability at upper levels, with Tropical Wave No. 33 located near the border with Panama.
XIV.Whereas Situation Report No. 24-2026, consecutive number CME-010-024-2026, issued at 16 hours 35 minutes on 17 August 2025, reported that rainfall totals recorded on Sunday reached maxima of between 100 mm and 200 mm in the Northern Zone and Caribbean, with the highest totals in Talamanca, Guácimo, and Sarapiquí. The combined totals for Saturday and Sunday reached between 130 mm and 360 mm, with the highest in the Southern Caribbean and Turrialba, and reports of flooding caused by rivers overflowing. It expressly warned that special attention should be paid to the Caribbean watersheds, where soil saturation was between 90 – 100%, given the probability of increased precipitation on that slope. In addition, watersheds in the South Pacific had saturation levels above 85%. Caution was advised in urban areas due to possible saturation of sewer systems.
XV.Whereas Situation Report No. 2, consecutive number CME-Limón 18-2026, issued at 12 hours 45 minutes on 17 August 2025, reported that, as a result of the heavy downpours recorded during the early morning and throughout Sunday 16 August 2026, there was a significant increase in the flow of rivers and streams in the canton’s indigenous territories, particularly in the areas of Alto Chirripó and Tayní, Isla Cohen, Bajo Cuén, Suruy, Bella Vista, Gavilán, Cerere, Makua, Kalvery, Jabuy and Moi, and Cuchey, causing various impacts in the communities, mainly to their roads and principal access routes, leaving them currently completely cut off by land.
XVI.Whereas a report from the CNE Risk Management Directorate, issued at 03 hours and 56 minutes on 19 August 2026, analyzed the interaction of hydrometeorological events in the Caribbean and Northern Zone of the country during the period from 20 July to 18 August 2026. It identified the successive passage of eight tropical waves (identified as No. 24 to No. 29, No. 32, and No. 33), in combination with the recurrent strengthening of the Intertropical Convergence Zone (ZCIT) and accelerated trade winds in the Caribbean Sea basin. These factors caused repeated episodes of heavy and persistent rainfall, mainly in the Northern and Southern Caribbean (cantons of Sarapiquí, Pococí, Guápiles, Turrialba, Siquirres, Matina, and Limón), as well as in the Northern Zone, with soil saturation that repeatedly ranged from 80% to 100% and led to constant warnings about landslides, floods, and rising rivers and streams; the most intense event of the entire period corresponded to the combined passage of Tropical Wave No. 33 and the ZCIT between 16 and 17 August, with totals of up to 360 mm in 48 hours in the Southern Caribbean and Turrialba.
XVII.Whereas the State’s foremost duty is to safeguard human life, the safety of its inhabitants, and, in general, the preservation of social order.
XVIII.Whereas constitutional case law has established strict criteria for substantiating a declaration of a national state of emergency in situations of national necessity and urgency, in order to safeguard fundamental legal interests. In judgment N° 1992-3410, issued at 14:45 on 10 November 1992, it held that “(…) the weaker legal interest (the preservation of the normal order of legislative powers) must yield to the stronger legal interest (the preservation of the legal and social order, which sometimes cannot wait for a law to be processed and approved) (…)”. Accordingly, it has held that such a declaration must be absolutely necessary to address the dangers caused by the exceptional situation and must remain in effect only for the strictly necessary period.
XIX.Whereas the National Law on Risk Prevention and Emergency Management provides that, in the event of a public calamity caused by natural events that cannot be controlled, managed, or overcome using the ordinary powers available to the Government, the Executive Branch may declare a national emergency in any part of the national territory in order to integrate and define the responsibilities and functions of all public and private bodies and entities, and to provide a solution commensurate with the magnitude of the disaster.
XX.Whereas, in light of the foregoing, it is necessary to enact a legal framework for adopting the exceptional measures set out in the Political Constitution and the National Law on Risk Prevention and Emergency Management, to address the effects caused by this hydrometeorological phenomenon and mitigate the consequences of its impact in the different areas of the country. Therefore;
THEY HEREBY DECREE:

All of this must be included in the General Emergency Plan approved by the Board of Directors of the National Commission for Risk Prevention and Emergency Management in order to qualify for attention under the concept of an emergency.

a)To give priority to the inclusion of recovery and reconstruction projects, the competent public institutions shall have a period of thirty calendar days from the effective date of this decree to submit a duly substantiated official report of the damage requiring priority attention.
b)Upon expiration of the stated 30-day period, the CNE Technical Units shall verify the reported damage to confirm the causal link between the impacts and the event, for approval by the CNE Board of Directors.
c)The CNE Board of Directors shall issue the General Emergency Plan covering those projects for which the causal link has been duly confirmed.
d)The competent institutions may also submit reports of damage caused by the event for an additional period of up to thirty calendar days following the initial period specified in subsection a) of this Article, thereby complying with the two-month period stipulated by Law N° 8488 for submitting the information. These reports shall likewise be assessed by the CNE Technical Units, which shall verify the damage to confirm the causal link within thirty days after expiration of the stated two-month period.
e)Once verification is complete, the CNE Board of Directors shall issue an amendment to the General Emergency Plan based on all reports submitted for which the causal link has been duly demonstrated.

For that purpose, it may designate the institutions with corresponding competence, or itself, as implementing units.

They shall likewise be authorized to coordinate the implementation of their contributions. To ensure that this effort succeeds, they may take the measures necessary to simplify or eliminate ordinary procedures or requirements that are not strictly necessary to have a positive impact in favor of affected persons and to facilitate construction and repairs to the damage, without detriment to legality, as provided in Articles 4 and 10 of the General Law on Public Administration, in order to provide more efficient responses to the needs of persons and families affected by this emergency. Where actions require administrative procurement procedures, they are instructed to use the emergency procedures authorized by law and regulated in Article 66 of the General Public Procurement Law and Article 66 of its Regulations.

V.Que la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias al ser las 11:00 horas del 11 de agosto de 2026, realizó el levantamiento de la Alerta No. 019 mediante consecutivo No. 020-2026, por retorno a las condiciones atmosféricas más estables.
VI.Que la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias al ser las 11:30 horas del día 13 de agosto del 2026, emitió Alerta No. 021-2026, estableciendo Alerta Verde en la Vertiente Caribe y Zona Norte del país, con base en la información brindada por el Instituto Meteorológico Nacional, ante el aumento de la inestabilidad atmosférica y aumento progresivo de humedad en esa vertiente, con ocurrencias de lluvias variables y aguaceros dispersos con tormenta.
VII.Que la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias al ser las 14:30 horas del día 14 de agosto del 2026, emitió Alerta No. 022-2026, estableciendo Alerta Amarilla para el Caribe, Zona Norte y Alerta Verde para el Pacífico Sur, Pacífico Central y Valle Central por aumento de la inestabilidad atmosférica y paso de la Onda Tropical No. 32 que reforzará la Zona de Convergencia Intertropical, con ingreso de humedad, favoreciendo lluvias en la provincia de Limón y Zona Norte, generando un ambiente más inestable.
VIII.Que el Instituto Meteorológico Nacional mediante Aviso Meteorológico de las 09 horas 45 minutos del 15 de agosto de 2026 informó que la Onda Tropical No. 32 transita Costa Rica, aunado a ello, la Zona de Convergencia Intertropical se posiciona sobre el país, lo que mantiene altos valores de inestabilidad y humedad. Los acumulados máximos de las últimas 6 horas se registran en las regiones montañosas del Caribe Sur, con valores oscilando entre 30-75 mm, mientras que, en el Caribe Norte, sectores de la Zona Norte y Cartago los valores oscilan entre 10-50 mm. En el resto del país los acumulados no superan los 20 mm. Se recomendó especial atención en las cuencas montañosas del Caribe, donde la saturación del suelo se encuentra entre 70 – 95%, además ante la probabilidad del aumento de las precipitaciones en esta vertiente. Aunado a esto, las cuencas en los alrededores del golfo Dulce presentan saturaciones superiores al 90%. Precaución en zonas urbanas ante posible saturación de los sistemas de alcantarillado.
IX.Que el Instituto Meteorológico Nacional mediante Informe Meteorológico No. 1 de las 16 horas del 15 de agosto de 2026 informó que las condiciones inestables y húmedas se están presentado durante este fin de semana, debido al paso de la onda tropical No. 32, la posición de la Zona de Convergencia Intertropical sobre el país, el arrastre de humedad debido a los vientos alisios acelerado en la cuenca del Caribe y la inestabilidad en niveles altos. Los acumulados máximos de las últimas 6 horas se registran en el Caribe y la Zona Norte, con valores oscilando entre 10-45 mm, mientras que, en el resto del país los acumulados oscilan 5-30 mm. Se recomendó especial atención en las cuencas montañosas del Caribe, donde la saturación del suelo se encuentra entre 70–100%, además ante la probabilidad del aumento de las precipitaciones en esta vertiente. Aunado a esto, las cuencas en los alrededores del golfo Dulce presentan saturaciones superiores al 90%. Precaución en zonas urbanas ante posible saturación de los sistemas de alcantarillado.
X.Que el Instituto Meteorológico Nacional mediante Informe Meteorológico No. 5 de las 16 horas del 16 de agosto de 2026 informó que prevalecían las condiciones inestables y húmedas que se están presentado durante el domingo, debido a factores como la posición de la Zona de Convergencia Intertropical sobre el país, el arrastre de humedad por los vientos alisios acelerados en la cuenca del Caribe y la inestabilidad en niveles altos, ubicando la Onda Tropical No. 33 en Panamá.
XI.Que la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias al ser las 18:00 horas del día 16 de agosto del 2026, emitió la Alerta No. 023-2026, estableciendo Alerta Naranja para el Caribe, Zona Norte, Cantón de Turrialba y Alerta Amarilla en el Pacífico Sur, Pacífico Central y Valle Central, ante el aumento de la inestabilidad atmosférica y paso de Ondas Tropicales, prevaleciendo condiciones inestables y húmedas. La Onda Tropical No. 33 se encuentra ubicada sobre Panamá.
XII.Que el Instituto Meteorológico Nacional mediante Informe Meteorológico No. 6 de las 10 horas 24 minutos del 16 de agosto de 2026, informó que prevalecen las condiciones inestables y húmedas se están presentado durante este domingo, debido a factores como la posición de la Zona de Convergencia Intertropical sobre el país, el arrastre de humedad por los vientos alisios acelerados en la cuenca del Caribe y la inestabilidad en niveles altos, ubicando la Onda Tropical No. 33 cerca de la frontera con Panamá.
XIII.Que el Instituto Meteorológico Nacional mediante Informe Meteorológico No. 7 de las 04 horas 07 minutos del 17 de agosto de 2026, informó que prevalecen las condiciones inestables y húmedas durante este lunes, debido a factores como la posición de la Zona de Convergencia Intertropical sobre el país, el arrastre de humedad por los vientos alisios acelerados en la cuenca del Caribe y la inestabilidad en niveles altos, ubicando la Onda Tropical No. 33 cerca de la frontera con Panamá.
XIV.Que mediante Informe de Situación No. 24-2026, consecutivo CME-010-024-2026 de las 16 horas 35 minutos del día 17 de agosto del 2025, se informa que, los montos de lluvias acumulados el domingo registraron máximos entre 100 mm a 200 mm en Zona Norte y Caribe, los mayores en sector de Talamanca, Guácimo y Sarapiquí. Los acumulados de sábado y domingo juntos alcanzaron montos entre 130 mm a 360 mm, los mayores en Caribe Sur y Turrialba, con reportes de inundaciones por desbordes de ríos. Se indicó expresamente la advertencia de prestar especial atención en las cuencas del Caribe, donde la saturación del suelo se encuentra entre 90 – 100%, además ante la probabilidad del aumento de las precipitaciones en esta vertiente. Aunado a esto, las cuencas en el Pacífico Sur presentan saturaciones superiores al 85%. Precaución en zonas urbanas ante posible saturación de los sistemas de alcantarillado.
XV.Que mediante Informe de Situación No. 2, consecutivo CME-Limón 18-2026, de las 12 horas 45 minutos del día 17 de agosto del 2025, se informa que, como consecuencia de los fuertes aguaceros registrados durante la madrugada y el transcurso del domingo 16 de agosto de 2026, se presentó un incremento significativo en el caudal de los ríos y quebradas de los territorios indígenas del cantón, particularmente en los sectores de Alto Chirripó y Tayní, Isla Cohen, Bajo Cuén, Suruy, Bella Vista, Gavilán, Cerere, Makua, Kalvery, Jabuy y Moi, Cuchey, generando diversas afectaciones en las comunidades, principalmente en sus vías y principales accesos, provocando que actualmente se encuentren totalmente incomunicadas por vía terrestre.
XVI.Que mediante Informe de la Dirección de Gestión del Riesgo de la CNE, de las 03 horas con 56 minutos del 19 de agosto de 2026, se analizó la interacción de eventos hidrometeorológicos en el Caribe y la Zona Norte del país, en el período comprendido entre el 20 de julio y el 18 de agosto de 2026, en el que se identificó el paso sucesivo de ocho ondas tropicales (identificadas como No. 24 a No. 29, No. 32 y No. 33), en combinación con el reforzamiento recurrente de la Zona de Convergencia Intertropical (ZCIT) y vientos alisios acelerados en la cuenca del mar Caribe. Estos factores generaron episodios reiterados de lluvia fuerte y persistente, principalmente en el Caribe Norte y Sur (cantones de Sarapiquí, Pococí, Guápiles, Turrialba, Siquirres, Matina y Limón), así como en la Zona Norte, con saturaciones del suelo que oscilaron de forma recurrente entre 80% y 100% y que motivaron advertencias constantes por deslizamientos, inundaciones y crecidas de ríos y quebradas; siendo el evento de mayor intensidad de todo el período correspondió al paso combinado de la onda tropical No. 33 y la ZCIT entre el 16 y el 17 de agosto, con acumulados de hasta 360 mm en 48 horas en el Caribe Sur y Turrialba.
XVII.Que es deber máximo del Estado velar por la protección de la vida humana, por la seguridad de los habitantes y, en general, por la conservación del orden social.
XVIII.Que la jurisprudencia constitucional ha establecido parámetros estrictos para la fundamentación de una declaratoria de emergencia nacional, en estados de necesidad y urgencia nacional, a efectos de salvaguardar bienes jurídicos primordiales. En sentencia N° 1992-3410 de las 14:45 horas del 10 de noviembre de 1992, dispuso que “(…) el bien jurídico más débil (la conservación del orden normal de las competencias legislativas) debe ceder ante el bien jurídico más fuerte (la conservación de orden jurídico y social, que, en ocasiones, no permite esperar a que se tramite y apruebe una ley) (…)”. Por ello, se ha pronunciado en el sentido de que esta debe ser absolutamente necesaria para lograr atender los peligros provocados por la situación excepcional, debiendo prolongarse únicamente el tiempo estrictamente necesario.
XIX.Que la Ley Nacional de Prevención de Riesgos y Atención de Emergencias dispone que en caso de calamidad pública ocasionada por hechos de la naturaleza que no puedan ser controlados, manejados ni dominados con las potestades ordinarias de que dispone el Gobierno, el Poder Ejecutivo podrá declarar emergencia nacional en cualquier parte del territorio nacional, a fin de integrar y definir las responsabilidades y funciones de todos los organismos, entidades públicas, privadas y poder brindar una solución acorde a la magnitud del desastre.
XX.Que debido a lo expuesto se hace necesaria la promulgación de un marco jurídico para tomar las medidas de excepción que señala la Constitución Política y la Ley Nacional de Prevención de Riesgos y Atención de Emergencias, para hacerle frente a los efectos ocasionados por este fenómeno hidrometeorológico y mitigar las consecuencias que ocasionó su impacto en las diferentes zonas del país. Por tanto;

Todo lo cual debe constar en el Plan General de la Emergencia aprobado por la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, para poder ser objeto de atención conforme al concepto de emergencia.

las afectaciones más urgentes provocadas por el fenómeno hidrometeorológico señalado; se establecen las siguientes regulaciones para la recopilación y evaluación de la información atinentes a los daños provocados por el evento:
a)Para la inclusión prioritaria de proyectos de recuperación y reconstrucción, las instituciones públicas competentes tendrán un plazo de treinta días naturales a partir de la vigencia del presente decreto para remitir debidamente justificado el reporte oficial de los daños que requieran de atención prioritaria.
b)Vencido el plazo de los 30 días señalados, las Unidades Técnicas de la CNE realizarán la verificación de los daños reportados, con el fin de comprobar el nexo de causalidad de los impactos para su debida aprobación por la Junta Directiva de la CNE.
c)La Junta Directiva de la CNE emite el Plan General de la Emergencia con aquellos proyectos cuyo nexo de causalidad haya sido debidamente comprobado.
d)Las instituciones competentes pueden además remitir reportes de daños provocados por el evento hasta por un plazo adicional de treinta días naturales posteriores al primer plazo indicado en el inciso a) del presente artículo, cumpliendo así el plazo estipulado por la Ley N° 8488 de dos meses para la presentación de la información. Estos reportes serán igualmente valorados por las Unidades Técnicas de la CNE, que realizarán la verificación de los daños con el fin de comprobar el nexo de causalidad en un plazo de treinta días posteriores al vencimiento del plazo de dos meses señalado.
e)Finalizada la verificación, la Junta Directiva de la CNE emitirá una ampliación del Plan General de la Emergencia con base en la totalidad de reportes presentados y cuyo nexo de causalidad haya sido debidamente demostrado.

Asimismo, estarán autorizadas para ejecutar sus aportes de forma coordinada y para que esta labor sea exitosa, pueden tomar las medidas necesarias para simplificar o eliminar los trámites o requisitos ordinarios, que no sean estrictamente necesarios para lograr impactar positivamente a favor de las personas damnificadas y facilitar la construcción y reparación de los daños, sin detrimento de la legalidad, tal como lo establecen los artículos 4 y 10 de la Ley General de la Administración Pública, a fin de brindar respuestas más eficientes a las necesidades de las personas y familias afectadas por esta emergencia. En los casos que las acciones requieran de los trámites de contratación administrativa, se les instruye a utilizar los procedimientos de urgencia autorizados por la Ley y regulados en el artículo 66 de la Ley General de Contratación Pública y 66 de su Reglamento.
