Decreto Ejecutivo 45746 Repeals the Regulation on the Right and Use of the SIREA Emblem (distintivo) and the Creation of the Environmental Recognition System (SIREA) —You are viewing the latest version of this regulation— Go to the latest version Version of the Regulation: 1 of 1 N° 45746-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers conferred by Articles 140, paragraphs 3) and 18), and 146 of the Political Constitution, as well as Articles 25, paragraph I; 27, paragraph l); and 28, paragraph 2), subparagraph b), of Law N° 6227, the General Law of Public Administration, of May 2, 1978,
1.—That by means of Decreto Ejecutivo N° 37109 of February 13, 2012, MINAE officially enacted the "Regulations of the Environmental Recognition System (SIREA) and Repeal of Decreto Ejecutivo N° 33525-MINAE, Regulations for Granting the Bandera Ecológica Certificate, of November 27, 2006," which was subsequently repealed by Decreto Ejecutivo N° 41594 of January 15, 2019, "Creation of the Environmental Recognition System (SIREA)," published in Alcance N° 101 a La Gaceta 83 of May 7, 2019.
2.—That the Regulation on the Right and Use of the SIREA emblem was officially enacted by means of Resolution R-1 19-2022-MINAE of May 6, 2022, published in La Gaceta N° 100 of May 31, 2022.
3.—That since the establishment of the Environmental Recognition System (SIREA), significant changes have occurred in the environmental and social context that originally justified its creation, the primary purpose of which was to consolidate and regulate the various environmental awards (galardones) granted by both public and private entities, in response to the proliferation of awards and environmental seals (sellos ambientales) of the time, thereby seeking to ensure adherence to evaluation criteria based on specific and coherent technical guidelines and to prevent practices in which environmental criteria are established without a scientific basis.
4.—That the response in terms of applications for inclusion in SIREA has been notably low throughout its operation, with the participation of the Programa Bandera Azul Ecológica being the only notable example, and that, according to the inventory conducted to identify environmental awards, it has been concluded that the number of awards is limited, and those that do exist, even after being consolidated over several years, did not perceive sufficient benefit to apply for membership in the system.
5.—That the SIREA promotional activities carried out in 2023 with various public and private sector actors revealed divergences in expectations regarding SIREA, which was expected to serve as a recognition granted by MINAE to entities demonstrating a commitment to environmental sustainability, and not merely a logo endorsing the organizer of an award.
6.—That MINAE has decided to redirect its efforts toward the promotion and strengthening of voluntary environmental management instruments, such as Producción más Limpia agreements and environmental labeling (etiquetado Ambiental), with the aim of contributing to the fulfillment of Sustainable Development Goal (SDG) 12 on Sustainable Production and Consumption and advancing toward the targets established in the 2030 Agenda, reflecting the ongoing commitment to sustainable and effective environmental practices in Costa Rica.
7.—That, in response to these challenges and recognizing the evolution of environmental needs, the Technical Advisory Committee (Comité Técnico Consultivo) of SIREA agreed, at its session of March 14 of the current year, to recommend the repeal (derogatoria) of the "Regulation on the Right and Use of the SIREA Emblem," officially enacted by Resolution R-119-2022-MINAE, as well as of Decreto Ejecutivo 41594-MINAE, "Creation of the Environmental Recognition System (SIREA)," published in Alcance N° 101 a La Gaceta N° 83 of May 7, 2019.
