The General Guide for Assessing the Environmental Impacts Generated by Mariculture Activity shall apply — specifically with respect to Environmental Impact Studies, Forecasts of Environmental Management Plans (Pronósticos de Planes de Gestión Ambiental), and Sworn Declarations of Environmental Commitments (Declaraciones Juradas de Compromisos Ambientales) — in accordance with the provisions of Anexo 1 of the present Regulation, for the purpose of implementing the classification of activities, works, or projects according to the category system established in this Decreto Ejecutivo. This guide applies in its entirety to activities, works, or projects that submit Environmental Assessment Document D5.

The Instructions for Assessing Environmental Impacts shall apply in accordance with the provisions of Anexo 3 of the present Regulation, for the purpose of implementing the guide for the preparation of Environmental Impact Studies, Forecasts of Environmental Management Plans, Sworn Declarations of Environmental Commitments, and the Family Social Registry of activities, works, or projects.

The D5 forms shall be made available to users on SETENA's Digital Platform, accessible at the following link: https://www.setena.go.cr/es/Viabiliad-Ambiental/d5 "Anexo 1 SCALES FOR MARICULTURE ACTIVITIES The proposed scales for the registration (registro) and environmental viability (viabilidad ambiental) process are:

1. Social-Family Aquaculture (Acuicultura Social-Familiar):

This category covers the cultivation of marine aquatic organisms carried out by a single family unit exclusively for subsistence or self-consumption purposes, or for commercial purposes to generate self-employment, as well as the cultivation of marine aquatic organisms carried out by associations, cooperatives, or other organized groups that are supported and accompanied, during at least the first two years, by at least two State institutions whose primary objective is job creation in the country's marine-coastal zones. These activities are characterized by their low potential environmental impact, including when located in marine protected areas whose legal constitutive framework permits such activities, as determined by SINAC. These projects are considered registration-category projects (D5-SF).

Production limits shall depend on each species group, as shown in Table 1, and the registration requirements are set forth in Table 2." 7 Institutional Endorsement and Commitment (aval y compromiso institucional) (for social projects only) g) A document signed and stamped by the head of each institutional unit, officially representing at least two institutions. The document must state that the institutions endorse the project and provide guidance and support to the producer associations or cooperatives. Valid only for Costa Rican public institutions whose objectives are aligned with the activity: Public Universities, INCOPESCA, IMAS, Parque Marino del Pacífico, INDER, INAMU, SBD, MAG, MTSS, MINAE, INA.

8 Solid and liquid waste management plan (plan de manejo de desechos sólidos y líquidos):

• h)A document signed by the responsible professional at the accompanying institution, which clearly describes how the waste from the crops and human activities will be managed during the project's development (Garbage, Wastewater, Sewage, Animal By-products, Hydrocarbons, Disinfectants, Antibiotics), and that these will not cause a deterioration of the surrounding ecosystems.

8 Rapid Ecological Assessment (Evaluación Ecológica Rápida, EER) h) Through diving (immersion) and by means of transects (transectos), the types and distribution of the main plant and animal taxonomic groups (grupos taxonómicos) present must be characterized, both in the water column (columna del agua) and on the seabed. The EER must be carried out and signed by a registered marine biologist (biólogo marino); photographs of this work must be provided. This work does not involve benthos (bentos) analysis.

9 Risk Diagnosis and Assessment (Diagnóstico y Evaluación de riesgos) i) Based on the technical characteristics of each marine aquaculture (acuicultura marina) project, the PMDSL, and the EER, the environmental oversight officer (regente ambiental) must provide a diagnosis of project elements as potential generators of environmental impacts (impactos ambientales) (negative and positive), as well as the environmental factors susceptible to being impacted. The officer must recommend Prevention, Mitigation, and Compensation Measures (Medidas de Prevención, Mitigación y Compensación) to establish the feasibility or non-feasibility of the project.

• k)To be conducted during a spring tide (marea viva) (during the full moon or new moon phase).
• l)Measurements must be taken every two hours during each tidal phase (incoming and outgoing), for a total of 6 data collections.
• m)Data collection must be carried out at the 4 cardinal points, at an appropriate distance (depending on the cultivation area) from the central point where the enclosures will be located.
• n)Measurements must be taken at the surface, at the bottom of the production enclosure, and at the seabed. If the depth from the enclosure to the seabed exceeds 10 meters, one measurement must be taken every additional 10 meters.
• o)The study and analysis must bear the endorsement (signature) of a marine biologist or oceanographer (oceanógrafo) duly registered with the corresponding professional licensing body.

3.2 Area of influence and expected impact of the distribution of unconsumed feed and nitrogenous waste excreted by the organisms (hereinafter referred to as suspended solids (sólidos suspendidos)):

Methodology:

. Present an analysis of the transport of suspended solids by currents. The estimated percentages of expected unconsumed feed must be indicated.

. Present a diagram (sketch) showing the surface (culture enclosures), the water column influenced by the cultivation, the dispersion flow of the dissolved solids, and the seabed area that the dissolved solids could reach via currents.

. Provide an ecological description of the general characteristics of the water column and the seabed area defined in the preceding point. In the water column, describe the taxonomic groups present and the approximate quantity per group. For the seabed, lists of taxonomic groups present must be included, along with the approximate quantity per group, the coverage area in approximate square meters, and the percentage of habitat of each group within the total area.

. Estimate the potential impact of excreta and feed on the taxonomic groups in the area of influence. The study and analysis must bear the endorsement (signature) of a marine biologist duly registered with the corresponding professional licensing body.

3.3 Basic physicochemical composition of the water at the surface, at the bottom of the enclosures, and in the area of influence at the seabed.

The following parameters must be described at the central coordinate of the potential cultivation site:

. Dissolved oxygen (Oxígeno disuelto) . Temperature . pH . Turbidity (Turbidez) (surface) . Salinity (Salinidad) . BOD (DBO) 3.4 Rapid Ecological Assessment (EER):

Through diving (immersion) and by means of transects, the types and distribution of the main plant and animal taxonomic groups present must be characterized, both in the water column and on the seabed. The EER must be carried out and signed exclusively by a registered marine biologist; photographs of this work must be provided, clearly showing the participation of the marine biologist, as well as the diving license or a certified copy thereof. Does not include benthos analysis.

4 Socioeconomic Environment (Ambiente Socioeconómico) - With respect to the socioeconomic environment, the following must be described:

. Marine activities carried out in the area of influence (such as fishing and tourism).

. Demographic, cultural, social, and economic characteristics of the nearest population that uses or passes through the site selected for cultivation. The possible interactions between the cultivation and the population must be indicated (e.g., market, supply of products and services).

. Local perception 5 Environmental Diagnosis (Diagnóstico ambiental) - Diagnosis of potential environmental impacts: Prevention, mitigation, and compensation measures for potential environmental impacts:

Based on the technical characteristics of each marine aquaculture project, the PMDSL, and the EER, the environmental consultant must provide a diagnosis of project elements as potential generators of environmental impacts (positive and negative), as well as the environmental factors susceptible to being impacted.

6 Environmental Management Plan (Plan de Gestión Ambiental, PGA):

6.1 Based on the diagnosis of potential environmental impacts, the Environmental Consultant must indicate which prevention, mitigation, and compensation measures will be applied during the development of the cultivation, as well as the contingency plan (plan de contingencia) and a summary of environmental commitments. This must include the Solid and Liquid Waste Management Plan (PMDSL) (Garbage, Wastewater, Sewage, Animal By-products, Hydrocarbons, Disinfectants, Antibiotics), which must ensure that no deterioration of the surrounding ecosystems will occur.

7 Professional team required to prepare the PGA 7.1 Environmental consultants participating in the evaluation processes for mariculture (Maricultura) must be duly registered in SETENA's Consultants Registry. This requirement does not apply to professionals who are hired to prepare specific studies as required by the instrument. The studies and recommendations included will be the specific responsibility of each professional who signs them, while the administration is responsible for reviewing them, in accordance with the contents established in this proposed Regulation.

Methodology:

. To be conducted during a spring tide (spring tide (marea viva)) (during full or new moon phase) 5.1 . Sampling must be conducted every two hours during each tidal phase (incoming and outgoing), for a total of 6 data readings.

. Data collection must be carried out at the 4 cardinal points at an appropriate distance (depending on the cultivation area) from the central point where the enclosures will be located.

. Sampling must be conducted at the surface, at the bottom of the productive enclosure, and at the seabed. If the depth from the bottom of the enclosure to the seabed exceeds 10 meters, a measurement must be taken for each additional 10 meters.

. The study and analysis must bear the endorsement (signature) of a marine biologist or oceanographer duly registered with the corresponding professional association.

Area of influence and waste excreted by the organisms (hereafter referred to as suspended solids (solidos suspendidos)).

5.2 Methodology:

. Submit an analysis of the transport of suspended solids by currents. It must indicate the estimated percentages of unconsumed feed expected.

. Submit a diagram (croquis) showing the surface (cultivation enclosures), the water column (columna del agua) influenced by the cultivation operation, the dispersion flow of dissolved solids, and the seabed area where dissolved solids could be deposited by currents.

. Provide an ecological description of the general characteristics of the water column and the seabed area defined in the preceding point. For the water column, describe the taxonomic groups (grupos taxonómicos) present and the approximate quantity per group. For the seabed, lists of taxonomic groups present must be included, along with the approximate quantity per group, coverage area in approximate square meters, and the percentage of habitat of each group within the total area.

. Estimate the potential impact of excretions and feed on the taxonomic groups within the area of influence.

The study and analysis must bear the endorsement (signature) of a marine biologist duly registered with the corresponding professional association.

5.3 Basic physicochemical composition of the water at the surface, at the bottom of the enclosures, and in the area of influence at the seabed:

Describe the following parameters at the central coordinate of the potential cultivation site:

. Dissolved oxygen . Temperature . pH . Turbidity (surface) . Salinity . BOD (Biochemical Oxygen Demand) Conductivity 5.4 Analysis of the potential impact of the cultivation operation on key species:

These must be officially recorded as present within the area of influence determined by the suspended solids dispersion study and the area covered by floating infrastructure. Marine species included in Appendix I of CITES (endangered species).

5.5 Rapid Ecological Assessment (EER) (Evaluación Ecológica EER):

Through immersion (diving) and transects, the types and distribution of the principal taxonomic groups — both plant and animal — present in the water column and on the seabed must be characterized. The EER must be conducted and signed exclusively by a registered marine biologist; photographs of the work must be provided, clearly showing the participation of the marine biologist, as well as the diving license or a duly certified copy thereof. It must also include a biological analysis of the benthos (bentos).

6 Socioeconomic Environment (Ambiente Socioeconómico) - With respect to the socioeconomic environment, the following must be described:

. Marine activities conducted within the area of influence (fishing, tourism, and others).

. Characteristics of the nearest population that uses or passes through the site chosen for the cultivation operation. Demographic, cultural, social, and economic characteristics. Indicate the possible interactions between the cultivation operation and the population (e.g., markets, supply of products and services, and others).

. Local perception: Using quantitative methodologies.

7 Environmental Diagnosis (Diagnóstico Ambiental) 7.1 Project elements generating environmental impacts 7.2 Environmental factors susceptible to being impacted 7.3 Diagnosis of possible environmental impacts:

Based on the technical characteristics of each marine aquaculture project, the PMDSL, and the EER, the environmental compliance officer (regente ambiental) must provide a diagnosis of project elements such as:

. Possible generators of environmental impacts (negative and positive) . Environmental factors susceptible to being impacted.

. Environmental impacts that the Project will produce, and its options.

. Selection of the project option.

. Environmental susceptibility map covering all components of the Project.

8 Environmental Management Plan (Plan de Gestión Ambiental, PGA):

8.1 Based on the diagnosis of possible environmental impacts, the Environmental Consultant (Consultor Ambiental) must indicate which prevention and mitigation measures will be applied during the development of the cultivation operation, as well as the contingency plan and synthesis of environmental commitments. This must include the solid and liquid waste management plan (PMDSL) (Plan de Manejo de Desechos Sólidos y Líquidos) covering organic and inorganic waste, wastewater, blackwater, animal by-products, hydrocarbons, disinfectants, and antibiotics.

8.2 Impact Assessment and Environmental Control Measures (Evaluación de Impacto y Medidas de control ambiental): Impact and environmental control measures for the:

. Physical Environment (Medio Físico) (for each of the components analyzed in the physical chapter) . Biotic Environment (Medio Biótico) (for each of the components analyzed in the biological chapter) . Socioeconomic Environment (Medio Socioeconómico) (for each of the components analyzed in the socioeconomic chapter) . Analysis of the synergistic effects of other similar projects that are under construction and in operation within the direct and indirect area of influence.

8.3 Environmental Management Plan Summary Table 8.4 Monitoring and Environmental Oversight (Regencia) 8.5 Contingency Plan (Plan de Contingencia, PC) 8.6 Total Investment Amount (including equipment and infrastructure costs).

9 Professional team that should prepare the environmental impact study (EsIA) - Environmental consultants participating in mariculture (Maricultura) evaluation processes must be duly registered in SETENA's Consultants Registry. This requirement does not apply, however, to professionals hired to prepare specific studies as required by the instrument. For the EsIA, the developer of the activity, work, or project must engage the services of an inter- and multidisciplinary team of professionals duly registered in the registry maintained by SETENA, to prepare the Environmental Impact Study (Estudio de Impacto Ambiental). The studies and recommendations included therein will be the specific responsibility of each professional who signs them, while the administration will be responsible for reviewing them in accordance with the content requirements established in this proposed Regulation.

"1.6. Environmental Consultant (Consultor Ambiental): A natural or legal person registered in SETENA's consultants registry to provide technical advisory services to a developer of activities, works, or projects and who is responsible for preparing the environmental impact assessments (EIA) (evaluación de impacto ambiental, EIA) submitted to SETENA.

1.7. Sworn Declaration of Environmental Commitments (Declaración Jurada de Compromisos Ambientales, DJCA): A statement made under oath in which the developer of the activity, work, or project commits to fully and completely comply with all terms and conditions stipulated in the Environmental Management Plan, or any other guidelines issued through the environmental impact assessment (EIA) process.

1.8. Developer (Desarrollador): The natural or legal person, public or private, who is legally authorized to carry out the activity, work, or project and who acts as its developer before SETENA and has a direct interest in carrying it out. The developer is likewise the party who will assume the environmental commitments and bear direct responsibility for their fulfillment.

1.9. Potential Environmental Impact (Impacto Ambiental Potencial, IAP): A latent positive or negative environmental effect that the execution of an activity, work, or project would cause on the environment. It may be pre-established, taking as a reference point the environmental impact caused by the generality of similar activities, works, or projects already in operation.

1.10. Registry (Registro): A form by which natural or legal persons, public or private, register before SETENA fishing and aquaculture activities carried out for educational promotion and research purposes, in order to assume the environmental commitment in accordance with the provisions of the Code of Good Environmental Practices (Código de Buenas Prácticas Ambientales) (Decreto Ejecutivo N°32079)".

1.11. Environmental Viability (License) (Viabilidad (Licencia) Ambiental, VLA): Represents the condition of harmonization or acceptable balance, from the standpoint of environmental load, between the development and execution of an activity, work, or project and its potential environmental impacts, and the environment of the geographic area where implementation is desired. From an administrative and legal standpoint, it corresponds to the act by which the environmental impact assessment (EIA) process is approved, whether at the phase of Initial Environmental Assessment (Evaluación Ambiental Inicial), Environmental Impact Study (Estudio de Impacto Ambiental), or other EIA document." Article Record 1

The fees for the forms and instruments for assessing the environmental impacts generated by the activity of Maricultura, for submission to the National Environmental Technical Secretariat (Secretaría Técnica Nacional Ambiental, SETENA), shall be as follows:

a. D5 Social Family Registry (Registro Social Familiar, SF): US$ 0 (no associated fee) b. D5 Small Scale (Pequeña Escala, PE) (DJCA): US$ 200 c. D5 Medium Scale (Mediana Escala, ME) (P PGA): US$ 500 d. D5 Large Scale (Gran Escala, GE) (EsIA): US$ 1500 For Activities, Works, or Projects (AOP) classified under the D5 Social Family Registry form and the D5 Small Scale (PE) (DJCA), the payment of an environmental bond (garantía ambiental) does not apply. For the remaining instruments, the provisions set forth in CHAPTER XII "Compliance and Performance Bonds (Garantías de Cumplimiento y Funcionamiento)" of Decreto Ejecutivo N°43898-MINAE-S-MOPT-MAG-MEIC shall apply.

State institutions shall not be required to pay the fee for the forms and instruments for assessing the environmental impacts generated by the activity of Maricultura.

SETENA, in accordance with the provisions of current regulations, shall update the fee schedule for the review process of the assessment of environmental impacts generated by the activity of Maricultura every four years, by means of an executive decree, and shall publish it in the official gazette La Gaceta.

"Article 7°— Time limits for form review. The time limits for technical review are as follows:

a. Review period for the Social Family Registry by SETENA: No more than 7 calendar days, subject to compliance with the requirements requested in table 3.

The relevant department of SETENA must conduct the technical verification within a maximum period of 2 business days, at the end of which it must issue the result of the review, either as a technical report or a request for missing information. Once the technical report has been issued, SETENA shall, within a maximum period of 3 business days, issue the administrative resolution. In the event that the conditions are not met, the Technical Departments shall issue a single notice of deficiency (oficio de prevención), for the purpose of remedying the missing information, and a reasonable period shall be granted at SETENA's discretion, which may not be less than 20 business days and may be extended if necessary. This notice suspends the review period.

SETENA shall have a period of 7 calendar days to review the response to the notice of deficiency, as indicated in the preceding paragraph. If the requested information is not submitted within the established period, the file (expediente) shall be archived. Once the review is concluded, a Technical Report and the final Resolution shall be issued, which shall be notified to the interested parties.

b. The relevant department of SETENA must conduct the technical verification of the D5-PE-DJCA file within a maximum period of 14 calendar days, in accordance with the requirements requested in table 8; for the D5-ME-P-PGA form, within a maximum period of 21 calendar days in accordance with the requirements requested in table 9; and for the D5-GE-EsIA form, within a maximum period of 28 calendar days in accordance with the requirements requested in table 10. At the end, the result of the review must be issued, either as a technical report or a request for missing information.

Once the technical report has been issued, SETENA shall, within a maximum period of 7 calendar days, issue the administrative resolution. In the event that the conditions are not met, the Technical Departments shall issue a single notice of deficiency, for the purpose of remedying the missing information, and a reasonable period shall be granted at SETENA's discretion, which may not be less than 20 business days and may be extended if necessary. 8 Evaluación Ecológica Rápida EER h) Por medio de inmersión (buceo) y a través de transectos, se debe caracterizar los tipos y distribución de los principales grupos taxonómicos vegetales y animales presentes, tanto en la columna del agua cómo en el fondo marino. La EER debe ser efectuada y firmada por un biólogo marino colegiado, se deben aportar fotografías de dicho trabajo. Este trabajo no implica estudio del bentos.

9 Diagnóstico y Evaluación de riesgos i) Con base a las características técnicas de cada proyecto de acuicultura marina, al PMDSL y a la EER el regente ambiental debe aportar un diagnóstico de elementos del proyecto cómo posibles generadores de impactos ambientales (negativos y positivos) así como los factores del medio ambiente susceptibles de ser impactados. En éste debe recomendar las Medidas de Prevención, Mitigación y Compensación que establezcan la viabilidad o no del proyecto.

• l)Los muestreos se deben realizar durante cada dos horas en cada fase (creciente y decreciente), 6 toma de datos.
• m)La toma de datos debe hacerse en los 4 puntos cardinales a una distancia adecuada (dependiendo del área de cultivo) del punto central donde se ubicarán los recintos.
• n)Los muestreos deben hacerse en la superficie, en el fondo de recinto productivo y en el fondo. En caso de la que profundidad del recinto al fondo exceda los 10 metros debe hacerse una medición cada 10 metros adicionales.
• o)El estudio y análisis debe poseer el aval (firma) de un biólogo marino u oceanógrafo debidamente incorporado en el colegio profesional correspondiente 3.2 Área de influencia e impacto esperado de la distribución de alimento no consumido y desechos nitrogenados excretados por los organismos (solidos suspendidos en adelante):

Metodología:

. Presentar un análisis del transporte de solidos suspendidos por las corrientes. Debe indicar los porcentajes estimados de alimento no consumido esperados.

. Presentar un esquema (croquis) que muestre la superficie (recintos de cultivo), columna del agua influida por el cultivo, flujo de dispersión de los sólidos disueltos y área de fondo donde por corrientes podría llegar los sólidos disueltos).

. Hacer una descripción ecológica de las características generales de la columna del agua y del área de fondo marino definida en el punto anterior. En la columna describir los grupos taxonómicos presentes y cantidad aproximada por grupo. En el fondo se deben incluir listas de grupos taxonómicos presentes, cantidad aproximada por grupo, área de cobertura en metros cuadrados aproximados y porcentaje de habitad de cada grupo en el total del área.

. Estimar el impacto potencial de las excretas y alimento en los grupos taxonómicos en el área de influencia. El estudio y análisis debe poseer el aval (firma) de un biólogo marino debidamente incorporado en el colegio profesional correspondiente.

3.3 Composición básica fisicoquímica del agua en la superficie, fondo de los recintos y área de influencia en el fondo.

Describir en la coordenada central del sitio potencial de cultivo los siguientes parámetros:

. Oxígeno disuelto . Temperatura . pH . Turbidez (superficie) . Salinidad . DBO 3.4 Evaluación Ecológica Rápida EER:

Por medio de inmersión (buceo) y a través de transectos, se debe caracterizar los tipos y distribución de los principales grupos taxonómicos vegetales y animales presentes, tanto en la columna del agua cómo en el fondo marino. La EER debe ser efectuada y firmada únicamente por un biólogo marino colegiado, se deben aportar fotografías de dicho trabajo donde se aprecie la participación clara del biólogo marino, así como la licencia buceo o su respectiva copia certificada. No incluye análisis del bentos.

4 Ambiente Socioeconómico - Respecto al ambiente socioeconómico se debe describir:

. Actividades marinas desarrolladas en el área de influencia (tales como pesca y turismo).

. Características de la población más cercana que utiliza o transita por el sitio elegido para el cultivo. Demográficas, Culturales, Sociales y económicas. Indicar las posibles interacciones entre el cultivo y la población (ej: Mercado, abasto de productos y servicios).

. Percepción local 5 Diagnóstico ambiental - Diagnóstico de posibles impactos ambientales: Medidas de prevención, mitigación y compensación de potenciales impactos ambientales:

En base a las características técnicas de cada proyecto de acuicultura marina, al PMDSL y a la EER el consultor ambiental debe aportar un diagnóstico de elementos del proyecto cómo posibles generadores de impactos ambientales (positivos y negativos) así como los factores del Medio Ambiente susceptibles de ser impactados.

6 Plan de Gestión Ambiental (PGA):

6.1 En base al diagnóstico de posibles impactos ambientales el Consultor Ambiental debe indicar cuáles serán las medidas de prevención, mitigación y compensación que se aplicarán durante el desarrollo del cultivo, así como, el plan de contingencia y síntesis de compromisos ambientales. En este debe incluir el plan de manejo de desechos sólidos y líquidos PMDSL (Basura, Aguas residuales, Aguas negras, Subproducto animal, Hidrocarburos, Desinfectantes, Antibióticos), el cual debe asegurar que no se causara un detrimento de los ecosistemas circundantes.

6.2 Cuadro Plan de Gestión Ambiental:

Metodología:

. Su ejecución en una marea viva (en fase de luna llena o nueva) 5.1 . Los muestreos se deben realizar durante cada dos horas en cada fase (creciente y decreciente), 6 toma de datos, . La toma de datos debe hacerse en los 4 puntos cardinales a una distancia adecuada (dependiendo del área de cultivo) del punto central donde se ubicarán los recintos.

. Los muestreos deben hacerse en la superficie, en el fondo de recinto productivo y en el fondo. En caso de la que profundidad del recinto al fondo exceda los 10 metros debe hacerse una medición cada 10 metros adicionales.

. El estudio y análisis debe poseer el aval (firma) de un biólogo marino u oceanógrafo debidamente incorporado en el colegio profesional correspondiente.

Área de influencia e impacto esperado de la distribución de alimento no consumido y desechos nitrogenados excretados por los organismos (solidos suspendidos en adelante).

5.2 Metodología:

. Presentar un análisis del transporte de solidos suspendidos por las corrientes. Debe indicar los porcentajes estimados de alimento no consumido esperados.

. Presentar un esquema (croquis) que muestre la superficie (recintos de cultivo), columna del agua influida por el cultivo, flujo de dispersión de los sólidos disueltos y área de fondo donde por corrientes podría llegar los sólidos disueltos).

. Hacer una descripción ecológica de las características generales de la columna del agua y del área de fondo marino definida en el punto anterior. En la columna describir los grupos taxonómicos presentes y cantidad aproximada por grupo. En el fondo se deben incluir listas de grupos taxonómicos presentes, cantidad aproximada por grupo, área de cobertura en metros cuadrados aproximados y porcentaje de habitad de cada grupo en el total del área.

. Estimar el impacto potencial de las excretas y alimento en los grupos taxonómicos en el área de influencia.

El estudio y análisis debe poseer el aval (firma) de un biólogo marino debidamente incorporado en el colegio profesional correspondiente 5.3 Composición básica fisicoquímica del agua en la superficie, fondo de los recintos y área de influencia en el fondo:

Describir en la coordenada central del sitio potencial de cultivo los siguientes parámetros:

. Oxígeno disuelto . Temperatura . pH . Turbidez (superficie) . Salinidad . DBO Conductividad 5.4 Análisis de impacto potencial del cultivo en especies clave:

Deben estar registradas oficialmente cómo presentes en el área de influencia determinada por el estudio de dispersión de solidos suspendidos y área de la infraestructura flotante. Especies marinas incluidas en el apéndice I de Cites (en peligro de extinción).

5.5 Evaluación Ecológica EER:

Por medio de inmersión (buceo) y a través de transectos, se debe caracterizar los tipos y distribución de los principales grupos taxonómicos vegetales y animales presentes, tanto en la columna del agua cómo en el fondo marino. La EER debe ser efectuada y firmada únicamente por un biólogo marino colegiado, se deben aportar fotografías de dicho trabajo donde se aprecie la participación clara del biólogo marino, así como la licencia buceo o su respectiva copia certificada. Debe además incluir un análisis biológico del bentos.

6 Ambiente Socioeconómico - Respecto al ambiente socioeconómico se debe describir:

. Actividades marinas desarrolladas en el área de influencia (pesca, turismo, otros).

. Características de la población más cercana que utiliza o transita por el sitio elegido para el cultivo. Demográficas, Culturales, Sociales y económicas. Indicar las posibles interacciones entre el cultivo y la población (ej: Mercado, abasto de productos y servicios, otros).

. Percepción local: Mediante metodologías cuantitativas.

7 Diagnóstico ambiental 7.1 Elementos del proyecto generadores de impactos ambientales 7.2 Factores del Medio Ambiente susceptibles de ser impactados 7.3 Diagnóstico de posibles impactos ambientales:

Con base a las características técnicas de cada proyecto de acuicultura marina, al PMDSL y a la EER el regente ambiental debe aportar un diagnóstico de elementos del proyecto cómo:

. Posibles generadores de impactos ambientales (negativos y positivos) . Factores del Medio Ambiente susceptibles de ser impactados.

. Impactos Ambientales que producirá el Proyecto y sus opciones . Selección de la opción del proyecto . Mapa de susceptibilidad ambiental en donde se contemplen todos los componentes del Proyecto.

8 Plan de Gestión Ambiental (PGA):

8.1 Con base al diagnóstico de posibles impactos ambientales el Consultor Ambiental debe indicar cuáles serán las medidas de prevención y mitigación que se aplicarán durante el desarrollo del cultivo, así como, el plan de contingencia y síntesis de compromisos ambientales. En este debe incluir el plan de manejo de desechos sólidos y líquidos PMDSL (residuos orgánicos e inorgánicos, Aguas residuales, Aguas negras, Subproducto animal, Hidrocarburos, Desinfectantes, Antibióticos).

8.2 Evaluación de Impacto y Medidas de control ambiental: Impacto y medidas de control ambiental en:

. Medio Físico (en cada uno de los componentes analizados en el capítulo físico) . Medio Biótico (en cada uno de los componentes analizados en el capítulo biológico) . Medio Socioeconómico (en cada uno de los componentes analizados en el capítulo socioeconómico) . Análisis de los efectos sinérgicos de otros proyectos similares que se encuentren en construcción y operación dentro del área de influencia directa e indirecta.

8.3 Cuadro del Plan de Gestión Ambiental:

8.4 Monitoreo y Regencia 8.5 Plan de contingencia (PC) 8.6 Monto Global de Inversión (incluyendo costo equipo e infraestructura).

9 Equipo profesional, que debería elaborar el EsIA - Los consultores ambientales que participen en los procesos de evaluación de Maricultura, deberán estar debidamente inscritos en el Registros de Consultores de la SETENA. No así, los profesionales que elaboren y que sean contratados para elaboración de estudios específicos según el instrumento. En el EsIA, el desarrollador de la actividad, obra o proyecto deberá contar con los servicios de un equipo inter y multidisciplinario de profesionales debidamente inscritos en el Registro que lleva la SETENA, para preparar el Estudio de Impacto Ambiental. Los estudios y recomendaciones incluidas, serán responsabilidad específica de cada profesional que los firma, siendo la administración responsable de la revisión de los mismos, de acuerdo con los contenidos que se establecen en la presente propuesta de Reglamento.

10 Otros términos:

10.1 Presentación del comprobante del depósito de pago (Cuenta BNCR): Comprobante de transferencia emitido por el Banco.

"1.6. Consultor Ambiental: Persona física o jurídica que se encuentra inscrita en el registro de consultores de la SETENA, para brindar asesoría técnica a un desarrollador de actividades, obras o proyectos y que es responsable de la elaboración de las EIA que se presenten a la SETENA.

1.7. Declaración Jurada de Compromisos Ambientales (DJCA): Manifestación que se hace bajo juramento, en la que desarrollador de la actividad, obra o proyecto, se compromete a cumplir íntegra y totalmente con los términos y condiciones estipuladas en el Plan de Gestión Ambiental, o bien aquellos otros lineamientos emanados del proceso de Evaluación de Impacto Ambiental.

1.8. Desarrollador: Es la persona física o jurídica, pública o privada, que legalmente está facultada para llevar a cabo la actividad, obra o proyecto y quien funge como desarrollador de esta ante la SETENA y tiene interés directo en llevarla a cabo. Es asimismo quien asumirá los compromisos ambientales y será el responsable directo de su cumplimiento 1.9. Impacto Ambiental Potencial (IAP): Efecto ambiental positivo o negativo latente que ocasionaría la ejecución de una actividad, obra o proyecto sobre el ambiente. Puede ser preestablecido, tomando como base de referencia el impacto ambiental causado por la generalidad de actividades, obras o proyectos similares, que ya se encuentran en operación.

1.10. Registro: Formulario mediante el cual las personas físicas o jurídicas, públicas o privadas, registran ante la SETENA las actividades pesqueras y acuícolas de fomento didáctica y con fines investigativos, con el fin de adquirir el compromiso ambiental de acuerdo con lo establecido en el Código de Buenas Prácticas Ambientales (Decreto Ejecutivo N°32079)".

1.11. Viabilidad (Licencia) Ambiental (VLA): Representa la condición de armonización o de equilibrio aceptable, desde el punto de vista de carga ambiental, entre el desarrollo y ejecución de una actividad, obra o proyecto y sus impactos ambientales potenciales, y el ambiente del espacio geográfico donde se desea implementar. Desde el punto de vista administrativo y jurídico, corresponde al acto en que se aprueba el proceso de Evaluación de Impacto Ambiental, ya sea en su fase de Evaluación Ambiental Inicial, o de Estudio de Impacto Ambiental o de otro documento de EIA." Ficha Artículo 1

Las tarifas por los formularios e instrumentos de la valoración de los impactos ambientales generados por la actividad de Maricultura, para presentar a la Secretaría Técnica Nacional Ambiental, serán los siguientes:

a. D5 Registro Social Familiar (SF): US$ 0 (sin tarifa asociada) b. D5 Pequeña Escala (PE) (DJCA): US$ 200 c. D5 Mediana Escala (ME) (P PGA): US$ 500 d. D5 Gran Escala (GE) (EsIA): US$ 1500 Para las Actividades, Obras o Proyectos (AOP) clasificados como formulario D5 Registro Social Familiar y el D5 Pequeña Escala (PE) (DJCA) no aplica el pago de la garantía ambiental. Para el resto de los instrumentos aplica lo indicado en el CAPÍTULO XII "Garantías de Cumplimiento y Funcionamiento" del Decreto Ejecutivo N°43898-MINAE-S-MOPT-MAG-MEIC.

Las instituciones del Estado no deberán cancelar la tarifa del formulario e instrumentos de la valoración de los impactos ambientales generados por la actividad de Maricultura.

La SETENA, en concordancia con lo establecido por la normativa vigente, actualizará cada cuatro años la tabla de tarifas por el proceso de revisión de la valoración de los impactos ambientales generados por a actividad de Maricultura, mediante decreto ejecutivo y la publicará en el diario oficial La Gaceta.

"Artículo 7° Plazos para revisión de formularios. El plazo para la revisión técnica son los siguientes:

a. Tiempo de revisión del Registro Social Familiar por la SETENA: No mayor a 7 días naturales, según el cumplimento de los requisitos solicitados en el cuadro 3.

El departamento respectivo de la SETENA deberá realizar la verificación técnica, en el plazo máximo de 2 días hábiles, y al final del cual deberá emitir el resultado de la revisión, ya sea informe técnico o solicitud de información faltante. Una vez emitido el informe técnico, la SETENA en un plazo máximo de 3 días hábiles emitirá la resolución administrativa. En el caso de que las condiciones no sean cumplidas, los Departamentos Técnicos realizarán un oficio de prevención por única vez, a efectos que se subsane la información faltante y se le otorgará un plazo razonable a juicio de SETENA, el cual no podrá ser menor de 20 días hábiles y que podrá prorrogarse en caso necesario. Esta prevención suspende el plazo de revisión.

La SETENA dispondrá de un plazo de 7 días naturales para la revisión de la respuesta al oficio de prevención, según lo indicado en el punto anterior. En caso de que la información solicitada no se presente en el plazo establecido, el expediente será archivado. Una vez concluida la revisión se procederá a emitir Informe Técnico y la Resolución final misma que será notificada a las partes interesadas.

b. El departamento respectivo de la SETENA deberá realizar la verificación técnica del expediente D5-PE-DJCA, el plazo máximo de 14 días naturales, según el cumplimiento de los requisitos solicitados en el cuadro 8; en el formulario D5-ME-P-PGA, en el plazo máximo de 21 días naturales según el cumplimiento de los requisitos solicitados en el cuadro 9; y el formulario D5 -GE-EsIA, en un plazo máximo de 28 días naturales según el cumplimiento de los requisitos solicitados en el cuadro 10. Al final se deberá emitir el resultado de la revisión, ya sea informe técnico o solicitud de información faltante.

Una vez emitido el informe técnico, la SETENA en un plazo máximo de 7 días naturales emitirá la resolución administrativa. La SETENA dispondrá de un plazo de 7 días naturales para la revisión de la respuesta al oficio de prevención, según lo indicado en el punto anterior. En caso de que la información solicitada no se presente en el plazo establecido, el expediente será archivado. Una vez concluida la revisión se procederá a emitir Informe Técnico y la Resolución final misma que será notificada a las partes interesadas".

"Artículo 8°- Instrumentos y Medios de Control y Seguimiento Ambiental (ICOS). Los ICOS están conformados por, el nombramiento del responsable ambiental, la Bitácora Digital Ambiental y la garantía ambiental.
