RECITALS 1°- The Political Constitution of Costa Rica, in the second paragraph of Article 5, establishes that Isla del Coco, located in the Pacific Ocean, forms part of the national territory.
2°- The country has undertaken various environmental obligations as a signatory to several international agreements, including the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), Ley Nº 5605 of October 30, 1974; the Approval of the Convention on Wetlands of International Importance especially as Waterfowl Habitat (RAMSAR Convention), Ley Nº 7224 of February 2, 1971; the Convention on Biological Diversity and Annexes I and II, Ley Nº 7416, signed on June 13, 1992, in Rio de Janeiro, Brazil; the Convention for the Conservation of Biodiversity and the Protection of Priority Wildland Areas in Central America, Ley Nº 7433 of June 30, 1994; the Convention for the Protection of the World Cultural and Natural Heritage (UNESCO), Ley Nº 5980 of November 16, 1976; the Convention on Nature Protection and Wild Life Preservation in the Western Hemisphere, Ley Nº 3763 of October 19, 1966; the Approval of Costa Rica's Accession to the Convention on the Conservation of Migratory Species of Wild Animals (CMS), Ley Nº 8586 of March 21, 2007.
3°- By Decreto Ejecutivo Nº 8748 of June 22, 1978, entitled "Declares Isla del Coco and its Islets a National Park," ratified by Ley Nº 6794 of August 25, 1982, "Law on the Creation of National Parks and Biological Reserves Ratifying as Laws the Decree-Laws Creating National Parks and Biological Reserves," Article 1 declares Isla del Coco and its Islets a National Park, located in the Pacific Ocean between the North latitude parallels of five degrees thirty minutes and five degrees thirty-four minutes, and the West Greenwich meridians of eighty-seven degrees one minute and eighty-seven degrees six minutes, with an area of twenty-four square kilometers.
4°- By Article 22 of the Biodiversity Law Nº 7788 of April 30, 1998, published in La Gaceta N° 101 of May 27, 1998, the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) was created, hereinafter referred to as the System, which shall have its own legal personality; it shall be a decentralized and participatory institutional management and coordination system that integrates competencies in the areas of forestry, wildlife, protected areas, and the Ministry of Environment and Energy, with the purpose of establishing policies, planning, and implementing processes aimed at achieving sustainable management of Costa Rica's natural resources. In accordance with the foregoing, the General Directorate of Wildlife, the State Forestry Administration, and the National Parks Service shall exercise their functions and competencies as a single entity through the administrative structure of the System, without prejudice to the objectives for which they were established. Protection and conservation of the use of river basins (cuencas hidrográficas) and water systems is included as a competency of the System.
5°- By Decreto Ejecutivo Nº 30834-C of October 11, 2002, Parque Nacional Isla del Coco was declared a site of architectural and historical heritage, recognizing its high historical and cultural value by virtue of the site's particular historical identity, forged since the eighteenth century through the visits and stays of human groups from various parts of the world, and granting special protection to the rock inscriptions in the bahías Chatham y Wafer, as well as other cultural remains.
6°- By Ley N° 9500 of November 21, 2017, the Asamblea Legislativa fully ratified the Convention on the Protection of the Underwater Cultural Heritage, sponsored by the United Nations Educational, Scientific and Cultural Organization, and Decreto Ejecutivo Nº 43216 of September 10, 2021, the Regulations for the Management, Protection and Conservation of the Underwater Cultural Heritage, was subsequently promulgated.
7°- By Decreto Ejecutivo Nº 43368-MINAE of December 17, 2021, a decree was issued constituting an "Amendment to Decreto Ejecutivo N° 29834-MINAE of August 23, 2001, entitled 'Expands the Boundaries of Parque Nacional Isla del Coco'"; an Amendment to Decreto Ejecutivo N° 36452-MINAE of March 3, 2011, entitled "Creates the Montes Submarinos Marine Management Area"; and an Amendment to Decreto Ejecutivo N° 40054-MINAE of October 19, 2016, entitled "Regionalization of the Ministry of Environment and Energy and Amendment to the Regulations of the Biodiversity Law," establishing in Article 1°—Amendment of Article 1° of Decreto Ejecutivo N° 29834-MINAE of August 23, 2001, entitled "Expands the Boundaries of Parque Nacional Isla del Coco"—that it shall henceforth read: "Article 1°—The protected wildland area (Área Silvestre Protegida) under the category and designation 'Parque Nacional Isla del Coco' is hereby expanded to encompass the marine space comprising an area of approximately 54,844.172 square kilometers, located in the Pacific Ocean." 8°- By means of the erratum published in La Gaceta N°89 of May 16, 2022, a correction was made to Decreto Ejecutivo N° 29834-MINAE of August 23, 2001, entitled "Expands the Boundaries of Parque Nacional Isla del Coco." 9°- By Decreto Ejecutivo N° 44292-MINAE of November 8, 2023, an amendment was made to Article 1 of Decreto Ejecutivo Nº 29834-MINAE of August 23, 2001, entitled "Expands the Boundaries of Parque Nacional Isla del Coco," and an amendment was made to Article 1° of Decreto Ejecutivo Nº 36452-MINAE of March 3, 2011, entitled "Creates the Montes Submarinos Marine Management Area." 10°- By Resolution N°R-002-SINAC-ACMC-DR-2024, dated June 4, 2024, published in Supplement N°105 of the Official Gazette La Gaceta on Thursday, June 6, 2024, the General Management Plan (Plan General de Manejo) for Parque Nacional Isla del Coco 2024-2034 was officially adopted, and in light thereof it became necessary to enact new regulations governing public use of Parque Nacional Isla del Coco that adequately respond to the conservation and management objectives of the General Management Plan.
11°- By Resolution N°15 of Session N°01-2025 of January 22, 2025, the Consejo Nacional de Áreas de Conservación (CONAC) approved the Regulations Governing Public Use of Parque Nacional Isla del Coco, in accordance with Article 12, paragraph d) of the Regulations of the Biodiversity Law, Decreto Ejecutivo Nº 34433-MINAE of March 11, 2008.
12°- By Report of the Regulatory Improvement Directorate N° DMR-DAR-INF-153-2025 of July 11, 2025, "Regulations Governing Public Use of Parque Nacional Isla del Coco," it was concluded that the proposal complies with the principles of regulatory improvement.

CHAPTER I
The objective of these Regulations is to establish provisions governing entry to Parque Nacional Isla del Coco, the use of services provided therein, and the activities that are permitted and restricted within its boundaries.
For the purposes of these Regulations, the following nomenclatures and abbreviations shall be used:
ACMC: Área de Conservación Marina Coco.
AIS: Automatic Identification System (Sistema de identificación automático).
GPS: Global Positioning System (Sistema de Posicionamiento Global).
HF: High Frequency (Alta Frecuencia de Radio de banda lateral).
MINAE: Ministerio de Ambiente y Energía.
MOPT: Ministerio de Obras Públicas y Transportes.
MMSI: Maritime Mobile Service Identity (identidad del servicio móvil marítimo).
PNIC: Parque Nacional Isla del Coco.
SINAC: Sistema Nacional de Áreas de Conservación.
SSB: Single Side Band (Banda lateral única).
ROUV: Remotely Operated Underwater Vehicle (vehículo submarino operado remotamente).
VHF: Very High Frequency (Frecuencia muy elevada de Radio de banda lateral).
VMS: Video Management System (Sistema de Monitoreo de Embarcaciones).
For the purposes of these Regulations, the following terms are understood to mean:
1. Harass or harassment (acosar o acoso): The act of cornering, trapping, pursuing, or attempting to remove an animal from its natural habitat.
2. Abiotic (abiótico): The non-living physical and chemical components of an ecosystem.
3. Feeding aggregations (agregaciones de alimentación): Groups of species and individuals that gather simultaneously for the purpose of feeding.
4. To anchor (anclar): When a vessel is secured by means of an anchor.
5. Freediving (apnea): An aquatic sport that consists of voluntarily suspending breathing while underwater, allowing for a considerable period of autonomy in which to carry out the activity.
6. Biotic (biótico): The living components of an ecosystem.
7. Autonomous diving (buceo autónomo): The activity of carrying and breathing air stored under pressure in a tank or device by a person while submerged underwater, allowing for a considerable period of autonomy in which to carry out the activity.
8. Canoeing (canotaje): A water sport practiced by paddling in a light watercraft.
9. Hunting (caza o cacería): The act, for any purpose, of pursuing, capturing, or killing wild animals, as well as the collection of products or by-products derived from them.
10. Circumnavigation (circunnavegación): Navigating by launch, panga, or vessel around the island and its islets within PNIC.
11. Eviscerating (destripar): The extraction, evisceration, or tearing out of internal organs of living beings, including both marine and terrestrial island fauna.
12. Drone (dron): An unmanned vehicle capable of autonomously maintaining a controlled and sustained level of flight.
13. Length overall (eslora): The dimension of a vessel measured along its full length, from bow to stern.
14. Invasive alien species (especie exótica invasora): A species that, upon introduction to areas outside its natural geographic distribution range, colonizes ecosystems and reaches an abundant population level, thereby becoming a competitor, predator, parasite, or pathogen of native wild species. It becomes an agent of habitat change and has a negative effect on biological diversity. Also considered invasive are those alien species whose populations become abundant and cause harm to human activities or human health.
15. To extract (extraer): To remove or separate flora or fauna species from the place or condition in which they are found.
16. Mooring buoy (fondeo): A concrete structure used for mooring vessels, with the purpose of achieving the relative immobility of the vessel with respect to the seafloor.
17. Freezing (helar): To solidify marine fauna by means of cold.
18. Harassing (hostigar): To disturb or harass biotic organisms by means of lights, handling, excessive noise, approaching, or striking with a flexible rod (vara flexible), a whip, or another instrument, in order to cause wild species to move, gather, or disperse.
19. Direct entry (ingreso directo): The authorization granted to a natural or legal person wishing to enter PNIC with a maximum of six months' advance notice and who meets the requirements of these Regulations; this may be a regular operator user or a non-regular user.
20. Islets (islotes): Geological formations smaller than islands, found near a main island or in ocean waters, which constitute crucial habitats for the organisms and seabirds that use them for nesting and resting.
21. Beam (manga): The maximum width of a vessel.
22. To handle (manipular): To operate with the hands or with any instrument wild flora or fauna species.
23. Seamounts (montes submarinos): Geomorphological structures corresponding to elevations of the ocean floor that may reach heights of 2,000 meters without breaking the ocean surface and that act as natural biological corridors. The richness of these structures is not limited to the water column; the substrate exhibits a high degree of endemism, and the octocorals, pelagic birds, bony fishes, and cartilaginous fishes that can be identified in these ecosystems often constitute new records for science, the region, and the country.
24. Topsides (obra muerta): The part of a vessel that lies above the waterline corresponding to the hull.
25. Underwater hull (obra viva): The part of a vessel corresponding to the hull that is submerged in water.
26. Regular Operator (operador regular): A natural or legal person who owns vessels and may submit requests to reserve entry dates to PNIC; such persons must hold the Tourist Declaration for Water Transport, granted by the Instituto Costarricense de Turismo to the company or the watercraft in accordance with the provisions of Articles 4, 5, and 6 of Decreto Ejecutivo N° 41370-MEIC-TUR of July 19, 2018, Regulations on Tourism Companies and Activities.
27. Innocent Passage (paso inocente): The right applicable in the territorial sea and the marine protected area of PNIC. It consists of the right of ships of all states to navigate through another state's territorial sea, provided that the passage is continuous and expeditious with a fixed heading and constant speed. The passage is innocent as long as it is not prejudicial to the peace, good order, or security of the state, in accordance with the provisions established in the United Nations Convention on the Law of the Sea.
28. Fishing (pesca): The act of capturing, hunting, and extracting aquatic wildlife by methods or procedures approved by the competent authority.
29. Entry date reservation (reserva de fechas de ingreso): The reservation of entry dates granted to a regular operator up to two years in advance for entry into PNIC, subject to compliance with the requirements for regular operators set forth in these Regulations.
30. Salt-curing (salar): To preserve marine products with salt.
31. Mooring site (sitio de fondeo): A physical space designated for the anchoring of vessels by means of anchors or pre-established mooring buoys.
32. Snorkeling (snorkel): The practice of swimming just below the water's surface while breathing through a tube that extends above the water.
33. Diving Sites (sitios de buceo): Those areas defined by ACMC where the practice of diving is permitted.
34. Submarine (submarino): A special type of vessel capable of navigating underwater as well as on the surface by means of a variable buoyancy system; it may be crewed or uncrewed.
35. Stand-up paddleboarding (surf de remo o paddle): A water sport consisting of maintaining balance atop a board designed for this purpose, in which the participant uses a paddle or oar to move across the water.
36. Surfing (surf): A water sport consisting of maintaining balance atop a special board that glides across the crest of the waves.
37. Transfer (trasiego): The act of moving, transporting, or relocating a specific species or species from their environment, whether legally or illegally.
38. Fuel transfer (trasiego de combustible): The act of relocating hydrocarbon-derived products, petroleum, and gas.
39. Non-Regular User (usuario no regular): A natural or legal person who requests direct entry to PNIC, with a maximum of six months' advance notice and who meets the requirements of these Regulations.
40. Crewed aerial vehicle (vehículo aéreo tripulado): An aircraft that has a crew on board.
Entry to Parque Nacional Isla del Coco
CHAPTER II
Any natural or legal person wishing to enter PNIC may do so only with authorization from the Regional Directorate of ACMC, for which they must request the corresponding entry date reservation permit for regular operators or direct entry, in accordance with the provisions of Articles 5, 6, and 8 of these Regulations.
The entry authorization issued by the Regional Directorate of ACMC is granted solely within the competencies conferred by Article 22 of the Biodiversity Law Nº 7788 and does not grant any right of entry into Costa Rica; accordingly, natural and legal persons, as well as vessels of foreign origin, are required to submit an entry authorization request to the Regional Directorate of ACMC.
Any natural or legal person who owns vessels, or their duly authorized representative, wishing to become a Regular Operator of PNIC—and thereby eligible to submit requests for entry date reservations—must:
Hold the Tourist Declaration for Water Transport, granted by the Instituto Costarricense de Turismo to the company or the watercraft in accordance with the provisions of Articles 4, 5, and 6 of Decreto Ejecutivo N° 41370-MEIC-TUR of July 19, 2018, Regulations on Tourism Companies and Activities.
ACMC shall conduct a public opening through its digital platforms for the period of receipt of documentation for entry date reservations, indicating the calendar year to be reserved. The applicant must fulfill the following requirements individually for each vessel:
1. Hold the Tourist Declaration for Water Transport, granted by the Instituto Costarricense de Turismo to the company or the watercraft in accordance with the provisions of Articles 4, 5, and 6 of Decreto Ejecutivo N° 41370-MEIC-TUR of July 19, 2018, Regulations on Tourism Companies and Activities.
2. A request containing the following information: vessel name, registration number, identification number assigned by the International Maritime Organization or MMSI, flag, length overall, beam, registered activity of the vessel, purpose of the voyage, and means of notification.
3. The applicant's identity document number. If the applicant is a person other than the natural or legal person who owns the vessel, they must submit a special power of attorney (Poder Especial) to carry out the application.
A proposed schedule of dates for each trip and the number of tourists intended to be admitted on each trip.
Once the requirements for the entry authorization application to Parque Nacional Isla del Coco have been submitted, the Regional Directorate of ACMC shall have five calendar days to notify the applicant of any requirements that must be clarified or completed; the notification suspends the resolution period of the Public Administration and grants the applicant ten business days, unless a different period is prescribed by law, for compliance; otherwise, the application shall be archived.
Once the requirements and documents have been submitted in complete form, or in the event that no omission or deficiency has been noted, the Regional Directorate of ACMC shall issue the corresponding resolution within ten calendar days, taking effect from the day following submission of the application. The notification must be issued by the Administration as a whole and is binding on all officials, who may not request new requirements or note new deficiencies that were not previously identified in a timely manner, even if it is a different official who reviews the application a second time. Once the period granted to the applicant has elapsed, the computation of the remaining resolution period shall continue. In cases where the Public Administration does not receive a response from the applicant to the notification, or receives incomplete documentation, the Administration must proceed in accordance with paragraph 2) of Article 264 of the General Law of Public Administration. In cases where a duly justified material impossibility on the part of the applicant to comply with the notification exists, the Public Administration may extend the period by a term equal to that originally granted. The Public Administration shall have the duty to resolve the application always within the prescribed legal deadline.
The Regional Directorate of ACMC shall ensure that equity exists in the granting of entry date reservations and may limit the number of visitors, the number of pangas to be used per vessel, the number of visit days, or vary the visit dates to PNIC, at its discretion and taking into account factors such as tourist carrying capacity and special circumstances related to the conservation, management, and development of PNIC.
The Regional Directorate of ACMC may reserve for regular operators up to 75% of the trips permitted annually based on the tourist carrying capacity of PNIC.
The validity of the application is one year from the business day following notification of the resolution.
Regular operators who hold an approved entry reservation for PNIC must, prior to each entry and at least fifteen business days in advance, complete the entry application form, which may be downloaded from the website https://isladelcoco.go.cr, and submit it to the Regional Directorate of ACMC for the issuance of the definitive permit, together with the following requirements:
1. A sworn statement (declaración jurada) confirming that the vessel meets the following requirements:
a. Effective systems for the comprehensive management of emergencies, liquid waste, and solid waste generated during operations.
b. A marine band radio on the vessel and on the auxiliary boat.
c. The AIS or VMS system installed on the vessel and its auxiliary boat (panga or inflatable).
d. One life jacket per passenger and the equipment necessary for aquatic rescue on vessels used to transport persons to diving sites and for travel within public use zones.
e. A statement indicating that all persons who will engage in diving activities hold the respective certification, duly verified by the person requesting entry; the Regional Directorate of ACMC shall proceed to verify that such certificates are held.
2. Proof of payment of the applicable fees, as established in Decreto Ejecutivo N° 38295-MINAE "Fees for Entry Rights and Other Services Offered in Protected Wildland Areas under the Administration of SINAC and Repeal of Decreto Ejecutivo N° 34164-MINAE," of January 15, 2014, or the applicable fee decree in force at the time of issuing the resolution for entry to Parque Nacional Isla del Coco, pursuant to Articles 5, 6, 27, 32, 33, 34, and 36 of the aforementioned decree. The Administration shall internally verify that the vessel has been granted a departure clearance (zarpe) issued by a national Port Authority or marina in Costa Rica, which shall be confirmed through communication with the corresponding institution, together with the entry resolution for PNIC issued by the Regional Directorate of ACMC.
Once the requirements have been submitted, the Regional Directorate of ACMC shall have five calendar days to notify the applicant of any requirements that must be clarified or completed; the notification suspends the resolution period of the Public Administration, and the applicant shall have ten business days to rectify the requirements or documents, unless a different period is prescribed by law for compliance; otherwise, the application shall be archived.
Once the requirements and documents have been submitted in complete form, or in the event that no omission or deficiency has been noted, the Regional Directorate of ACMC shall issue the corresponding resolution within ten calendar days, taking effect from the day following submission of the application. The notification must be issued by the Administration as a whole and is binding on all officials, who may not request new requirements or note new deficiencies that were not previously identified in a timely manner, even if it is a different official who reviews the application a second time. Once the period granted to the applicant has elapsed, the computation of the remaining resolution period shall continue. In cases where the Public Administration does not receive a response from the applicant to the notification, or receives incomplete documentation, the Administration must proceed in accordance with paragraph 2) of Article 264 of the General Law of Public Administration.
In cases where a duly justified material impossibility on the part of the applicant to comply with the notification exists, the Public Administration may extend the period by a term equal to that originally granted, provided that such a request is made before the expiration of the period originally granted. The Public Administration shall have the duty to resolve the application always within the prescribed legal deadline.
The Regional Directorate of ACMC shall ensure that equity exists in the granting of date reservations, and may limit the number of visitors, the number of pangas to be used per vessel, the days of visitation, or vary the dates of visitation to the PNIC, according to its convenience and taking into account factors such as tourist carrying capacity (capacidad de carga turística), as well as special situations related to the conservation, management, and development of the PNIC.
The Regional Directorate of ACMC may reserve for regular operators up to 75% of the trips permitted annually, based on the tourist carrying capacity of the PNIC. The validity of the proceeding is one year from the working day following notification of the resolution.
Ficha Artículo 8
When the Regional Directorate of ACMC determines that a regular operator has failed to comply with at least 25% of the dates in the reserved year, whether on a continuous or non-continuous basis, the Administration may, without State liability, impose the following measure:
Cancel the approved reservations for the vessel for the year in which the non-compliance occurred.
The application of such measure shall not prevent the natural or legal person from processing direct-entry requests to the PNIC.
Ficha Artículo 9
For the processing of a direct-entry permit (permiso de ingreso directo) for vessels without a reservation, the natural or legal person who is the owner of the vessel, or their respective legal representative, wishing to enter the PNIC must:
a. Effective systems for the comprehensive management of emergencies and of liquid and solid waste generated during its operation.
b. Sufficient operational range (autonomía) for entry to and departure from the PNIC.
c. A marine-band radio on the vessel and on the auxiliary boat.
d. An AIS or VMS system on the vessel and its auxiliary boat (panga or inflatable).
e. One life jacket per passenger and the necessary equipment for aquatic rescue on the vessels used to transport persons to diving sites and for movement within the public-use zones.
f. A statement that all persons who will engage in diving activities hold the respective certification, duly verified by the person requesting entry; the Regional Directorate of ACMC shall proceed to confirm that such certificates are in fact held.
The Administration shall verify internally that the vessel holds a departure clearance (zarpe) granted by the National Port Captain's Office (Capitanía de Puerto Nacional) or marinas of Costa Rica, which shall be confirmed through communication with the relevant institution, along with the resolution authorizing entry to the PNIC issued by the Regional Directorate of ACMC.
All documentation requested shall be verified internally by the Regional Directorate of ACMC of the PNIC.
Once the above-listed requirements have been submitted, the Regional Directorate of ACMC shall have a period of five calendar days to notify the applicant of any requirements to be clarified or completed; such notification suspends the Administration's resolution period and grants the applicant a period of ten working days—unless a different period is established by law—within which to remedy the requirements or documents; otherwise, the application shall be archived.
Once the requirements and documents have been submitted in full, or in the event that no omission or deficiency has been noted, the Regional Directorate of ACMC shall issue the corresponding resolution within ten calendar days, taking effect from the day following the date on which the application was submitted. The notification must be issued by the Administration as a whole and is binding on all officials; they may not request new requirements or note new deficiencies that were not timely flagged, even if a different official reviews the application a second time. Once the period granted to the applicant has elapsed, the count of the remaining resolution period shall resume. In cases where the Public Administration does not receive a response from the applicant to the notification issued, or receives incomplete documentation, the Administration must proceed pursuant to section 2) of article 264 of the Ley General de la Administración Pública. In cases where a duly justified material impossibility prevents the applicant from complying with the notification, the Public Administration may extend the period by a term equal to that initially granted, provided such a request is made before the expiry of that period. The Public Administration shall have the duty to resolve the proceeding within the statutory period indicated.
The Regional Directorate of ACMC shall ensure that equity exists in the granting of date reservations, and may limit the number of visitors, the number of pangas to be used per vessel, the days of visitation, or vary the dates of visitation to the PNIC, according to its convenience and taking into account factors such as tourist carrying capacity, as well as special situations related to the conservation, management, and development of the PNIC.
The validity of the proceeding is one year from the working day following notification of the resolution.

The authorized natural person or legal representative may submit documentation electronically, accompanied by a notarial certification bearing a digital signature, in compliance with the provisions established in Ley N°8454 Ley de certificaciones, firmas digitales y documentos electrónicos of August 30, 2005, articles 1, 2 subsections a), b), c), and d), 3, 4, 5 subsections c) and d); and Ley N°7764, Código Notarial of April 17, 1998, articles 30, 31, 80, 108, 110, 120, and 121.

On Permitted and Prohibited Activities
Regulation of Permitted Activities
CHAPTER III
SECTION I
For the management of activities and permits, the PNIC shall maintain service hours from 8:00 a.m. to 16:00 hours, without exception.
Ficha Artículo 12
At the PNIC, in accordance with the applicable General Management Plan and current regulations, only research, training, and low-impact ecotourism activities are permitted, in the zones and under the conditions previously authorized by the administration. Accordingly, in addition to the entry permit for persons and vessels to the PNIC, the interested party must request a permit for the conduct of the permitted activities. These permits may be processed together with the entry permit. Such permits shall be granted by means of an administrative resolution issued by the Regional Directorate of ACMC according to the nature of each activity.
The types of permit that the Regional Directorate of ACMC may grant for the PNIC are:
Ecotourism permits:
Surface aquatic activities: snorkeling, canoeing (canotaje), freshwater swimming and beach swimming, seaplane water landing (amarizaje), circumnavigation.
Underwater activities: Recreational scuba diving (buceo recreativo con sistema autónomo) and freediving (apnea).
Land activities: Hiking on trails, lookout points, and beaches; these must be authorized by the PNIC administration.
These activities may be conducted between 06:00 hours and 17:00 hours.
Research permits:
Scientific research.
Commercial or scientific filming.
Operation of submarines, mini-submarines, and ROUVs.
Ficha Artículo 13
Every vessel authorized to enter Parque Nacional Isla del Coco must:
1. Report its arrival to the PNIC 30 miles before reaching the bay. Said report must be made by radio, using channel 16 or 25 on the VHF marine band, on HF at frequency 8325.0 SSB, or by any other available means.
2. Before engaging in any activity, all persons on board must await the visit of PNIC officials during service hours from 08:00 to 16:00 hours.
3. All personnel on board the vessel (crew and passengers) must be present at the welcome orientation (charla de bienvenida) for PNIC visitors, which shall be conducted in coordination with PNIC officials. The vessel's captain shall ensure the presence of all persons on board and provide the available audiovisual equipment.
4. Proceed to the mooring site (fondeo) or anchorage assigned by the park administration.
5. Once a vessel has entered the PNIC, its departure from the protected area is prohibited until the established departure date, unless authorized by the Park administration.
6. Channel 16 and 25 on the VHF and HF marine band, or frequency 8325.0 SSB, must remain available to transmit or receive any urgent or necessary messages from the PNIC Administration to vessels present in the area; they must therefore be used only for as long as is strictly necessary.
7. Chatham Bay and Wafer Bay are designated as the mooring sites to be used by the various vessels. The PNIC Administration may authorize daytime anchoring at Bahía Yglesias in special cases, provided that a prior request accompanied by its justification has been submitted. In all cases, vessels must always return to Chatham Bay and Wafer Bay in the afternoon hours.
Ficha Artículo 14
Vessels used for transporting persons to diving sites and for movement within the PNIC administrative area must be more than 3 meters and less than 9 meters in hull length (eslora), equipped with a communications radio, VMS, or AIS—all of which must remain on at all times—along with safety equipment, and powered by a motor. Where their nature so requires, they must hold the permits to navigate in Costa Rican territorial waters.
Vessels used for transporting persons to diving sites and for movement within the PNIC administrative area may not travel within Chatham Bay and Wafer Bay at a speed greater than 7 knots.
Ecotourism activities related to cetaceans are governed by the provisions of Decreto Ejecutivo Nº 32495-MINAE-MOPT-MSP-MAG of January 20, 2005, entitled "Reglamento para la Operación de Actividades Relacionadas con Cetáceos en Costa Rica," or whichever regulation is currently in force.
Ficha Artículo 15
Vessels used to transport persons to snorkeling sites must meet the following requirements:
1. One life jacket per passenger.
2. The necessary equipment for aquatic rescue.
3. An AIS or VMS system in operation on the vessel.
4. One guide or person responsible for the group.
5. The activity must be conducted in groups of two to twenty persons, including the guide.
6. Snorkeling may be conducted at the following sites: Wafer Bay: at Barco Hundido, Roca Gissler, and in front of Wafer Waterfall; and Chatham Bay: Manuelita Somero and Ulloa. The administration may enable or close snorkeling sites.
Ficha Artículo 16
Every person wishing to engage in scuba diving (buceo autónomo) at the PNIC must be certified as a diver, holding the applicable license for the dive sites, issued by a nationally or internationally recognized scuba diving agency, and may only conduct the activity at the sites authorized by the Regional Directorate of ACMC in the entry resolution or by the PNIC Administration upon request by the interested party at the site.
Scuba diving and freediving activities must be conducted in groups of two or more persons, not exceeding 13 persons including the dive guide; scuba diving groups must be supervised by at least one divemaster holding a valid license, duly identified by the PNIC administration.
Dives may begin as of 06:00 hours and must conclude before 17:00 hours. When a vessel has more than one panga for diving, these must depart at least 30 minutes apart, ensuring that there is always one panga available to assist the other group in the event of an emergency.
Scuba diving and freediving activities must be conducted at the sites authorized by the Regional Directorate of ACMC, which may enable new sites and hours for the practice of these activities.
Vessels used for transporting persons to scuba diving and freediving sites and for movement within the PNIC administrative area must be more than 3 meters in hull length, with a minimum engine power of 15 HP and less than 9 meters in hull length, appropriate for the number of group members; they must carry the dive flag (red with white), a communications radio, safety equipment, and AIS or VMS—always on.
Said vessel must be properly crewed by at least one mobile equipment operator (operador de equipo móvil) who shall remain on board at all times and at a distance that allows them to visually monitor the location of the divers throughout the entire dive. Where their nature so requires, they must hold the permits to navigate in Costa Rican territorial waters.
Vessels conducting ecotourism activities (including diving, freediving, snorkeling, canoeing, and circumnavigation) must inform the PNIC administration of their departure from and return to the visited site.
Ficha Artículo 17
PNIC officials or volunteers duly authorized and identified by the PNIC who hold valid dive certification and current dive insurance may accompany scuba diving groups on their vessels, whenever deemed appropriate, for the purpose of overseeing, monitoring, and controlling the activities carried out.
To this end, all vessels must provide a space on the boats and a tank of air or gas mixture suited to the dive to be performed, for the officials or volunteers referred to above.
Ficha Artículo 18
Canoeing in bays may only be conducted with prior authorization from the PNIC, in groups of a minimum of 2 persons and no more than 12 persons, within Chatham Bay or Wafer Bay, provided that weather conditions permit; the wearing of a life jacket is mandatory.
When the group exceeds 3 canoes, the canoeing activity must have a guide or person responsible for the group, and the group must move together.
Canoeing beyond the bays may only be conducted with prior authorization from the PNIC; this activity is permitted only with the escort of a safety boat, in groups of no more than 12 persons, with each participant carrying an emergency position-indicating radio beacon (EPIRB) to alert search and rescue services; all persons must wear a life jacket, and landing at locations not authorized by the Regional Directorate of the Área de Conservación Marina Coco is prohibited.
Ficha Artículo 19
As a requirement for the authorization of hikes, visitors and guides must carry basic safety equipment, including at least one portable radio per group, closed-toe footwear, appropriate hiking clothing, water, and a first-aid kit.
Land visits shall only be authorized at the following locations:
1. Trail from Chatham Bay to Wafer Bay to Pájara Lookout and back (Sendero Las Bahías).
2. Gissler Caves Trail (Sendero Cavernas de Gissler).
3. Wafer Waterfall (Catarata Wafer).
4. Velo de Novia Waterfall (Catarata Velo de Novia).
5. Trail to Cerro Yglesias (visits to this trail may only be made in coordination with and with the authorization of the PNIC duty administrator, who shall assess whether the hike is safe and on which day it should be conducted).
6. Doña Dulce Trail (Sendero Doña Dulce).
7. The surroundings of the base at Wafer Bay and Chatham Bay.
8. Any other trail enabled by the Regional Directorate of ACMC.
The administration may close or open trails as it deems appropriate.
Hikes may be conducted in groups of a maximum of 24 persons. Groups of up to 12 persons must have one guide; if the group exceeds 12 persons and up to a maximum of 24, two guides must accompany them. Such outings must be conducted with prior authorization from the administration, without deviating from the marked trails and on the established routes. All hikes must begin no earlier than 8:00 a.m. and no later than 14:00 hours. Some activities may begin earlier, with prior authorization from the PNIC administration.
During land visits to the PNIC, swimming is only authorized at the following sites: Wafer and Chatham Beaches, at a distance of no more than 20 meters from the tide line; the pool at Copey Bridge on Río Genio; the pool at Chatham Bay; and the pool at Wafer Waterfall. The administration may close or open swimming sites as it deems appropriate.
Each group conducting land activities must be accompanied by at least one crew member, who shall be responsible for the group. The vessel's captain shall communicate to the park administrator the name of the person who will assume this role; that person must comply with the safety and orientation instructions given by the PNIC official.
Ficha Artículo 20
For the conduct of commercial filming—on land, in the air, at sea, or underwater—the user must process the permit with ACMC at least 15 working days in advance, submitting the following requirements:
1. Pay the applicable fees.
2. Submit the information requested on the official form designated for this purpose, which can be downloaded from the website https://isladelcoco.go.cr.
3. A copy of the passport in the case of non-residents; for foreign residents, a copy of the Immigration and Foreigners Document (DIMEX). If the applicant is a person other than the natural or legal person who owns the vessel, a Special Power of Attorney must be provided in order to carry out the proceeding.
4. A copy of the filming script.
Once the requirements have been submitted, the Regional Directorate of ACMC shall have a period of five calendar days to notify the applicant of any requirements to be clarified or completed; such notification suspends the Administration's resolution period and grants the applicant a period of ten working days to remedy the requirements or documents, unless a different period is established by law; otherwise, the application shall be archived.

If filming permits are restricted for reasons of maintenance, protection, or conservation, filming for scientific research purposes and for management activities shall take priority over commercial filming.
Filming of a scientific, cultural, or educational nature with no commercial purpose, and filming by tourists intended solely to preserve a memento of their visit to the protected wilderness area (área silvestre protegida), shall be exempt from fee payment pursuant to the provisions of Decreto Ejecutivo Nº 38295-MINAE of January 15, 2014, entitled "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y Derogatoria del Decreto Ejecutivo Nº 34164-MINAE," or whichever decree is currently in force.
Ficha Artículo 21
Research activities shall be governed by the provisions of articles 11, 12, 13, 14, 15, 16, 17, 18, and 19 of Decreto Ejecutivo N°32553-MINAE of March 29, 2005, entitled "Manual de Procedimientos para realizar Investigación en Biodiversidad y Recursos Culturales en las Áreas de Conservación," or whichever is currently in force. If research activities require the use of submarines, mini-submarines, and ROUVs, the provisions of article 23 of these regulations must additionally be complied with.
Ficha Artículo 22
The operation of submarines, mini-submarines, and ROUVs shall be permitted for the purposes established in article 36, subsection i), of Decreto Ejecutivo N° 38295-MINAE, entitled "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y derogatoria del Decreto Ejecutivo N° 34164-MINAE," of January 15, 2014, or whichever is currently in force.
An entry and operation permit for submarines, extended by the Regional Directorate of ACMC, must be requested and obtained.
Ficha Artículo 23
The interested party must fill out the submarine operation request form for the PNIC, which can be downloaded from the website https://isladelcoco.go.cr, and submit it to the Regional Directorate of ACMC prior to the date of entry to the PNIC.
In addition, they must submit the submarine operation request form, which shall include the following information:
1. Name and personal details of the applicant.
2. Full name (identity card number and/or passport number, nationality, and date of birth of the pilots).
3. Dive schedule, including objectives, sites, dates, time, and estimated dive duration, for the duration of their stay in the PNIC.
4. Name, registration number, model, serial number, capacity, and basic characteristics of the submarine, mini-submarine, or ROUV.
5. Contact information for notifications.
6. If the applicant is a person other than the natural or legal person who owns the submarine, a Special Power of Attorney must be submitted to the Regional Directorate of ACMC in order to carry out the proceeding.
Once the above-listed requirements have been submitted, the Regional Directorate of ACMC shall have a period of five calendar days to notify the applicant of any requirements to be clarified or completed; such notification suspends the Administration's resolution period and grants the applicant a period of ten working days—unless a different period is established by law—within which to remedy the requirements or documents; otherwise, the application shall be archived.
Once the requirements and documents have been submitted in full, or in the event that no omission or deficiency has been noted, the Regional Directorate of ACMC shall issue the corresponding resolution within ten calendar days, taking effect from the day following the date on which the application was submitted. The notification must be issued by the Administration as a whole and is binding on all officials; they may not request new requirements or note new deficiencies that were not timely flagged, even if a different official reviews the application a second time. Once the period granted to the applicant has elapsed, the count of the remaining resolution period shall resume. In cases where the Public Administration does not receive a response from the applicant to the notification issued, or receives incomplete documentation, the Administration must proceed pursuant to section 2) of article 264 of the Ley General de la Administración Pública. In cases where a duly justified material impossibility prevents the applicant from complying with the notification, the Public Administration may extend the period by a term equal to that initially granted, provided such a request is made before the expiry of that period. The Public Administration shall have the duty to resolve the proceeding within the statutory period indicated.
The Regional Directorate of ACMC shall ensure that equity exists in the granting of date reservations, and may limit the number of visitors, the number of pangas to be used per vessel, the days of visitation, or vary the dates of visitation to the PNIC, according to its convenience and taking into account factors such as tourist carrying capacity, as well as special situations related to the conservation, management, and development of the PNIC.
The Regional Directorate of ACMC may reserve for regular operators up to 75% of the trips permitted annually, based on the tourist carrying capacity of the PNIC.
The validity of the proceeding is one year from the working day following notification of the resolution.
Ficha Artículo 24
The use of crewed aerial vehicles (vehículos aéreos tripulados) is permitted in the PNIC; the request must be submitted together with the vessel entry permit, and the respective permits from the Dirección General de Aviación Civil to fly in the country must be presented—these shall be verified internally by the Regional Directorate of ACMC. In addition, the applicable fees must be paid pursuant to subsection d) of article 34 of Decreto Ejecutivo Nº38295-MINAE, entitled "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y derogatoria del Decreto Ejecutivo N° 34164-MINAE," of January 15, 2014, or whichever is currently in force.
Ficha Artículo 25
These permits must be processed before the Comisión Arqueológica Nacional, in accordance with the provisions of articles 8, 9, and 12 of Decreto Ejecutivo N° 43216-MCJ-MINAE-RREE of September 10, 2021, "Reglamento para la gestión, protección y conservación del Patrimonio Cultural Subacuático." The interested party must attach a copy of the permit granted to their entry application to the PNIC and present the original to PNIC officials upon arrival.
Ficha Artículo 26
The Regional Directorate of ACMC shall authorize the presence of persons in the PNIC in accordance with the provisions established by visitor flow studies—both terrestrial and marine—or any other visitor management methodology. Such studies and methodologies are conducted by ACMC and formally adopted by the Regional Directorate of ACMC on a periodic basis.
Circumnavigation by vessels, launches, or pangas may only be carried out between 06:00 and 17:00 hours, in prior coordination with the PNIC administration, provided that weather conditions allow and within the public-use zone established in the PNIC General Management Plan. The carrying of life jackets, communications equipment (channel 16 or 25 on VHF or HF band at frequency 8325.0 SSB), safety equipment, AIS or VMS, or GPS location support is mandatory.
The Regional Directorate of ACMC may authorize the entry of vessels into the PNIC for ecotourism purposes for a maximum of 10 consecutive calendar days. No visitor may exceed the time authorized in their entry permit, except in cases of a fortuitous event (caso fortuito) or force majeure (fuerza mayor). In the case of vessels conducting filming or research authorized by the conservation area, this permit may be extended for a longer period as determined by the corresponding resolution.

The vessel captain must coordinate daily with the PNIC administration regarding the activities to be carried out within the limits of the PNIC.
Ficha Artículo 28
Regulation of Prohibited Activities and Exceptions
SECTION II
The following are prohibited and restricted from entry into the PNIC:
1. The entry and presence of all types of vessels within the limits of the PNIC is prohibited, unless they hold the corresponding authorization and comply with the approved entry and exit.
2. The presence of fishing vessels within the limits of the PNIC is prohibited.
3. In the case of tourism vessels that carry fishing gear (artes de pesca) and their accessories (fishing equipment, outriggers, rods, reels, and lures), all such equipment is prohibited from being visible during the stay in the PNIC.
4. Navigation by vessels with a length overall (eslora) equal to or greater than 10 meters is prohibited in the following zones: The area between Islote Manuelita, known as the channel, Islote Pájara, Islote Roca Vikinga, Islote Muela or taza de té, Islote Juan Bautista, Islote Silverado, Islote Montagne, Islote Dos Amigos Pequeño, Islote Dos Amigos Grande, and Isla del Coco.
5. Nighttime navigation within the limits of the PNIC for recreational activities is totally prohibited between 18:00 and 06:00 hours.
The foregoing provisions do not apply to fortuitous events or emergencies duly authorized by the PNIC Administration.
Ficha Artículo 29
The following activities are absolutely prohibited:
1. Any type of fishing.
2. Making any type of mark on trees, rocks, or any other element.
3. The carrying and use of any type of weapon (whether firearms, compressed air, spring-loaded, etc.).
4. The entry, sale, and consumption of drugs within the limits of the PNIC. Excluded from this provision are substances used for medical treatment, as well as the consumption of alcoholic beverages aboard tourism vessels, provided that consumers remain aboard while under the effects of alcohol and do not engage in activities that disturb public order.
5. Camping and lighting bonfires.
6. Nudism.
7. Any type of environmental contamination caused by solid waste or wastewater (aguas servidas), chemicals, or fuels.
8. The discharge of wastewater, bilge water (sentinas), soapy water, or ballast water (aguas de lastre) at any point within the protected wildlife area (área silvestre protegida, ASP).
9. Conducting fuel transfers, maintenance, and repair of vessels of any type or equipment in general, unless there is express authorization from the PNIC administration.
10. Performing vessel cleaning activities on both the underwater hull (obra viva) and the above-waterline hull (obra muerta), and any equipment cleaning that results in the discharge of wastewater into the sea.
11. Dumping organic and inorganic waste.
12. Having fishing equipment visible (including outriggers), except for equipment used for research purposes approved by the Regional Directorate of ACMC.
13. The use of external and deck lighting and the use of submerged lights that reach the water surface, during the period from 19:30 to 06:00 hours.
14. Generating excessive noise that causes noise pollution (contaminación sónica).
15. Sporting activities such as paddle surfing or paddleboarding, surfing, jet skis, hang gliding, paragliding, skydiving, and the use of marine competition vehicles.
16. Entering caves, except those approved by the Regional Directorate of ACMC.
17. The extraction and handling of any element of the historical and cultural heritage.
18. Disembarking at locations not authorized by the administration.
19. The entry of pets into the PNIC, except for guide dogs or canine units.
20. The commercial and profit-driven use of videos and photographs taken within the protected wildlife area without the corresponding filming permits, by any person, whether tourists, volunteers, researchers, collaborators, crew members, or guides.
21. Using the PNIC as a base of operations for activities outside its limits.
22. Leaving and re-entering the PNIC during the authorized days.
23. Nighttime navigation within the limits of the PNIC is totally prohibited between 18:00 and 06:00 hours.
Failure to comply with these prohibitions will result in immediate expulsion from the protected wildlife area.
Ficha Artículo 30
With respect to wildlife species, the following are strictly prohibited within the PNIC:
1. Extracting or handling any species, product, or by-product of biotic wildlife (Kingdom Protista, Kingdom Monera, Kingdom Fungi, Kingdom Plantae, and Kingdom Animalia).
2. Extracting any type of abiotic material: organic or inorganic.
3. The trade and transfer of any product of marine and terrestrial wildlife.
4. Fishing, hunting, extracting, handling, harassing, and disturbing individuals of any marine or terrestrial species.
5. Icing, salting, or gutting wild marine species.
6. The use of cages for observing marine fauna.
7. Scuba diving (buceo autónomo) and snorkeling in megafauna feeding aggregations (pajareras or manchas or "baitballs"), as well as approaching such aggregations in vessels, launches, pangas, boats, or canoes, to within less than 100 meters of them.
8. Feeding marine and terrestrial organisms.
9. Making physical contact with any marine or terrestrial organism.
10. The introduction of any species.
Ficha Artículo 31
Within the PNIC area, vessels dedicated to any type of fishing will not be permitted to remain, except in the cases of fortuitous event or force majeure established in Article 34 of this Regulation, or for innocent passage (paso inocente) as indicated in Article 3, subsection 27.
The use of personal torpedo-type underwater vehicles (vehículos personales tipo torpedo) is authorized only in cases of disability for participating in group scuba diving activities, and as a research instrument. For the use of such vehicles, authorization shall be issued through the administrative entry resolution granted by the Regional Directorate of ACMC.
Within the marine and terrestrial area of the PNIC, the use of unmanned aerial vehicles, including drones, will not be permitted, except for research, control, surveillance, and filming purposes, duly authorized through the entry resolution issued by the Regional Directorate of ACMC. In any case, for the purpose of evaluating the request, it must carry the relevant permits granted by the Dirección General de Aviación Civil.
Ficha Artículo 32
The following vessels are exempt from the prohibition on entry and presence:
1. Those belonging to the Sistema Nacional de Áreas de Conservación.
2. Those belonging to the Benemérito Cuerpo de Bomberos de Costa Rica.
3. Those belonging to the Servicio Nacional de Guardacostas.
4. Those belonging to natural or legal persons authorized by ACMC, who enter for the purpose of conducting ecological tourism activities.
5. Vessels used in research projects previously approved by the Conservation Area.
6. Those vessels in which a force majeure or fortuitous event occurs, in accordance with Article 34 of this Public Use Regulation, which must be verified by the PNIC Administration. If the absence of an emergency is confirmed, immediate departure of the vessel from the limits of the National Park shall be ordered.
7. Vessels flying international flags with permission from the Asamblea Legislativa.
Ficha Artículo 33
All vessels that do not carry permits to enter the PNIC and that must enter due to a fortuitous event or force majeure may do so, after prior communication by radio using channel frequency 16 or 25 operating on the VHF marine band, or on the HF marine band at frequency 8325.0 SSB, or by telephone with the PNIC administration, which shall be responsible for authorizing entry.
The authorized vessel must remain at the mooring (fondeo) assigned by the PNIC administration for a maximum of 8 hours, except when the emergency has not been resolved, in which case the PNIC administration may authorize a longer period of stay, which must be determined under the principles of logic and reasonableness. The PNIC administration will indicate the time of departure from the protected marine area. If the stay exceeds 8 hours, a written report must be submitted to the administration explaining why the emergency has not been resolved.
The emergency or fortuitous event situation will be verified by the PNIC Administration, and if the absence of an emergency is confirmed, immediate departure of the vessel from the limits of the PNIC shall be ordered.

Zoning
SECTION III
For the purpose of authorizing and applying the activities permitted under this regulation, the zoning established in numeral 3, subsection 2) of the General Management Plan of the Parque Nacional Isla del Coco, found in Resolución-002-SINAC-ACMC-DR-2024 of June 4, 2024, shall be considered binding, in accordance with the following classification:
Island Zoning:
1. Minimal or no intervention zone 2. Low intervention zone 3. Medium intervention zone 4. High intervention zone Marine Zoning:
1. No intervention.
2. Minimal intervention.
3. Low intervention.
4. Medium intervention.
5. High intervention.
Ficha Artículo 35
In accordance with the provisions of numerals 2 and 3 of the General Management Plan of the Parque Nacional Isla del Coco, found in Resolución-002-SINAC-ACMC-DR-2024 of June 4, 2024, the objectives of each zone are stipulated as follows:
Island Zoning of the PNIC:
- Minimal: Its objective is to ensure the continuity of the ecological, ethological, and evolutionary processes of resident, endemic, and migratory species present in the island area. Use of this zone is highly restrictive; for exceptional situations indicated in the zoning, a specific permit from the PNIC administration is required.
- Low Intervention: Its objective is grounded in the management of designated areas for carrying out operational activities such as control, administration, tourism with varying degrees of specialization, and the protection of the PNIC's natural, archaeological, and cultural heritage.
- Medium Intervention: The objective of these areas is to facilitate administrative activities at the operational bases of ACMC staff on the island territory, providing energy, structural, and communications conditions for the proper functioning of the PNIC.
- High Intervention: Likewise, the objective is to facilitate administrative activities at the operational bases of PNIC staff on the island territory in a more intensive manner than medium intervention, providing energy, structural, and communications conditions for the proper functioning of the ASP.
Marine Zoning of the PNIC:
- No Intervention: The objective of this zone is based on the conservation of the ethological and ecological processes of marine flora and fauna species that develop in these coastal island, benthic, and pelagic ecosystems. Scientific research that contributes to knowledge of the functioning of the ecosystems present within this zone is promoted, with the least possible disturbance.
- Minimal Intervention: Its objective is to promote scientific tourism and underwater exploration of seamounts or areas of interest in the deep sea.
- Low Intervention: The objective of this zone is to promote navigation for control, protection, research, and tourism purposes, ensuring the continuity of the ethological, ecological, and evolutionary processes of marine flora and fauna species present within the PNIC.
- Medium Intervention: Its objective is grounded in the management of permitted tourist activities within the PNIC for the enjoyment and recreation of tourists and ASP collaborators, without significantly interfering with the ecological dynamics of the ecosystems present in the area.
- High Intervention: The objective of these areas is to facilitate administrative activities at the operational bases of PNIC staff in the marine territory, providing structural and communications conditions for the proper functioning of the ASP.

Biosecurity (Bioseguridad)
Section IV
For entry into the PNIC, all provisions set forth in the current biosecurity protocols (protocolos de bioseguridad) of the Área de Conservación Marina Coco must be followed. These biosecurity protocols are developed and officially issued by the Regional Directorate of ACMC on a periodic basis.

Powers of the Administration
CHAPTER IV
ACMC personnel are responsible for ensuring compliance with the provisions of Article 22 of the Biodiversity Law No. 7788, of April 30, 1998, published in La Gaceta No. 101 of May 27, 1998, as well as the provisions of numeral 4 of the General Management Plan of the Parque Nacional Isla del Coco, found in Resolución-002-SINAC-ACMC-DR-2024 of June 4, 2024.
Ficha Artículo 38
The Regional Directorate of ACMC shall have the following powers:
1. To define, manage, and assign mooring (fondeo), anchorage (anclaje), and landing sites within the PNIC.
2. To authorize the opening of new sites and schedules for ecotourism activities, as well as to close those sites deemed necessary for management or conservation purposes.
3. To order the temporary or permanent closure of public use activities in the PNIC.
4. To restrict public use activities and sites, following the conservation and protection principles and objectives established in numerals 1, 4, 5, and 6 of the General Management Plan of the Parque Nacional Isla del Coco, found in Resolución-002-SINAC-ACMC-DR-2024 of June 4, 2024.
5. To cancel visitation permits or expel from the PNIC those visitors or companies that engage in prohibited activities or fail to follow instructions. Likewise, entry and activity permits may be suspended due to adverse weather conditions or any other duly justified reason, without this generating liability for the Administration.
6. To impose administrative sanctions or file the corresponding complaints, as well as civil claims for environmental damage.
Ficha Artículo 39
PNIC personnel, duly identified, may, when deemed necessary, board any air, water, or underwater means of transport arriving at the PNIC, for the following purposes:
1. To deliver the briefing or show the video containing general rules to visitors entering the PNIC, prior to the start of any authorized activity.
2. To provide any other relevant information about the PNIC.
3. To ensure proper compliance with the permits granted. To this end, they may accompany tourists or researchers in the activities to be carried out, both on land and at sea.
4. To verify information regarding the vessel's characteristics (permits, registration number, size, tonnage, vessel load capacity, and any other data considered relevant).
5. To verify information about persons on board, including visitors and crew members, for the purpose of confirming the PNIC entry permit.
6. To conduct any other inspection, as well as to request any type of information or documentation that the Administration deems necessary to comply with this regulation and with the provisions of Article 22 of the Biodiversity Law No. 7788, of April 30, 1998, published in La Gaceta No. 101 of May 27, 1998.
7. To issue and serve administrative records in the event of any unlawful act.
8. To issue police reports and collect the corresponding documentation, and to forward them to the ACMC Legal Advisory Office to continue with the respective judicial or administrative proceedings.
9. To develop prevention, early warning, control, and eradication actions for biological invasions in accordance with the relevant technical management plan and/or technical and scientific criteria.
Ficha Artículo 40
Volunteer activities shall be governed by the provisions of Decreto Nº 36812-MINAET "Reglamento de las acciones de voluntariado en el Sistema Nacional de Áreas de Conservación y Derogación del Decreto Ejecutivo N° 32443-MINAE del 01 de marzo del 2025" and the ACMC Volunteer Plan.

Final Provisions
CHAPTER V
Every person entering the Parque Nacional Isla del Coco must comply with the provisions set forth in this Public Use Regulation, as well as with the directives issued by the Ministerio de Ambiente y Energía through SINAC and the Directorate of ACMC.
Ficha Artículo 42
For all matters not addressed by this decree, the Ley General de Administración Pública and related environmental legislation shall apply on a supplementary basis.
Ficha Artículo 43
Decreto Ejecutivo N°37023-MINAET "Reglamento de Uso Público del Parque Nacional Isla del Coco y Derogatoria del Decreto Ejecutivo N° 29537-MINAE del 20 de abril del 2001 denominado 'Reglamento para Uso Público del Parque Nacional Isla del Coco' y del Decreto Ejecutivo N° 30838-MINAE del 21 de noviembre del 2002 denominado 'Prohibición para el ingreso y estadía de las embarcaciones y vertido de sustancias o desechos contaminantes dentro de los límites marinos protegidos del Parque Nacional Isla del Coco'" of January 23, 2012, is hereby repealed.
Ficha Artículo 44 Transitional Provision I.- Entry by Reservation.
Entry reservation rights authorized under the provisions of Decreto Ejecutivo N°37023-MINAET of January 23, 2012, constitute final administrative acts and shall not be affected by the entry into force of this Regulation; however, the process for obtaining the final permit, as well as the operating rules, shall be governed by this regulation.
Ficha Artículo 1 Transitorio Transitional Provision II.- Tourist Carrying Capacity (capacidad de carga turística) of the PNIC.
The Regional Directorate of ACMC must officially establish, within a maximum period of one year from the date of publication of this regulation, the terrestrial and marine tourist carrying capacity studies referred to in this regulatory body in Articles 6, 9, 22, 26, and 39. Until such time as the foregoing is officially established, the Regional Directorate of ACMC may permit the following:
Ficha Artículo 2 Transitorio Transitional Provision III.- AIS on Diving Pangas.
Regular operators will have a period of six months from the publication of this regulation to equip their diving pangas with the AIS devices. Direct-entry users may make a single entry without carrying the devices; any subsequent permit will require the AIS devices to be on board.
Ficha Artículo 3 Transitorio
This Regulation shall enter into force upon its publication in the Diario Oficial La Gaceta.

Por tanto:
DECRETAN
CAPITULO I
Disposiciones Generales
El objetivo del presente Reglamento es establecer las disposiciones para el ingreso, el uso de los servicios brindados, las actividades permitidas y las actividades restringidas dentro de los límites del Parque Nacional Isla del Coco.
Ficha Artículo 1
Para efectos del presente Reglamento se utilizarán las siguientes nomenclaturas y abreviaturas:
ACMC: Área de Conservación Marina Coco.
AIS: Automatic Identification System (Sistema de identificación automático).
GPS: Global Positioning System (Sistema de Posicionamiento Global).
HF: High Frequecy (Alta Frecuencia de Radio de banda lateral).
MINAE: Ministerio de Ambiente y Energía.
MOPT: Ministerio de Obras Públicas y Transportes.
MMSI: Maritime Mobile Service Identity (identidad del servicio móvil marítimo).
PNIC: Parque Nacional Isla del Coco.
SINAC: Sistema Nacional de Áreas de Conservación.
SSB: Single Side Band (Banda lateral única).
ROUV: Remotely operated underwater vehicle (vehículo submarino operado remotamente).
VHF: Very High Frequency (Frecuencia muy elevada de Radio de banda lateral).
VMS: Video Management System (Sistema de Monitoreo de Embarcaciones).
Ficha Artículo 2
Para los efectos del presente Reglamento, se entiende por:
1. Acosar o acoso: Acción de acorralar, atrapar, perseguir o tratar de extraer del hábitat natural a un animal.
2. Abiótico: Componente físicos y químicos no vivos en el ecosistema.
3. Agregaciones de alimentación: Grupo de especies e individuos que se agrupan de manera simultánea con fines de alimentación.
4. Anclar: Cuando una nave queda sujeta por medio de un ancla.
5. Apnea: Es una modalidad deportiva acuática que consiste en suspender voluntariamente la respiración bajo el agua, permitiendo un tiempo de autonomía considerable para ejecutar la actividad.
6. Biótico: Componentes vivos en el ecosistema.
7. Buceo autónomo: Consiste en la actividad de transportar e ir respirando el aire almacenado a presión en una botella o dispositivo, por una persona, mientras se encuentra sumergida bajo el agua, permitiendo un tiempo de autonomía considerable para ejecutar la actividad.
8. Canotaje: Deporte acuático que se practica remando en una embarcación ligera.
9. Caza o cacería: La acción, con cualquier fin, de acosar, apresar o matar animales silvestres, así como la recolección de productos o subproductos derivados de estos.
10. Circunnavegación: Navegar con lancha, panga o embarcación alrededor de la isla y sus islotes en el PNIC.
11. Destripar: Extraer, eviscerar, desgarrar órganos internos de seres vivos tanto de fauna marina como terrestre insular.
12. Dron: Es un vehículo sin tripulación, capaz de mantener de manera autónoma un nivel de vuelo controlado y sostenido.
13. Eslora: Dimensión de una embarcación tomado a su largo, desde la proa hasta la popa.
14. Especie exótica invasora: Aquella que al introducirse en sitios fuera de su ámbito de distribución geográfica natural coloniza los ecosistemas y su población llega a ser abundante, siendo así un competidor, predador, parásito o patógeno de las especies silvestres nativas. Se convierte en un agente de cambio de hábitat y tiene un efecto negativo sobre la diversidad biológica. Se considera invasora también a aquellas especies exóticas cuyas poblaciones llegan a ser abundantes y producen un daño en las actividades del ser humano o la salud humana.
15. Extraer: Quitar o apartar del sitio o condición en que se hallan las especies de flora o fauna.
16. Fondeo: Estructura de hormigón que se utiliza para el amarre de las embarcaciones, con el fin de lograr la inmovilidad relativa de la embarcación con respecto al fondo.
17. Helar: Solidificar por la acción del frío fauna marina.
18. Hostigar: Molestar o acosar organismos bióticos, mediante el uso de luces, manipulación, sonidos excesivos, acercamientos o dar golpes con una fusta (vara flexible), un látigo u otro instrumento, para hacer mover, juntar o dispersar las especies de vida silvestre.
19. Ingreso directo: Es la autorización que se le otorga a una persona física o jurídica que desee ingresar al PNIC con un máximo de seis meses de antelación y que cumpla con los requisitos del presente reglamento, puede ser un usuario operador regular o usuario no regular.
20. Islotes: Formaciones geológicas más pequeñas que las islas, que se encuentran cerca de una isla principal o en aguas oceánicas y que constituyen hábitats cruciales para los organismos y aves marinas que los utilizan para anidar y descansar.
21. Manga: Máxima anchura del barco.
22. Manipular: Operar con las manos o con cualquier instrumento especies de flora o fauna silvestre.
23. Montes submarinos: Estructuras geomorfológicas que corresponden a elevaciones de lecho marino que pueden alcanzar los 2 000 metros de altura sin emerger a la superficie oceánica y que actúan como corredores biológicos naturales. La riqueza de estas estructuras no se limita a la columna de agua, el sustrato presenta un alto grado de endemismo; los octocorales, aves pelágicas, peces óseos y peces cartilaginosos que se logran identificar en estos ecosistemas muchas veces constituyen nuevos registros para la ciencia, la región y el país.
24. Obra muerta: Es parte de la embarcación que se encuentra por encima de la línea de flotación que corresponda al casco.
25. Obra viva: Es parte de la embarcación que corresponde al casco, que se encuentra sumergida en el agua.
26. Operador Regular: Persona física o jurídica propietaria de embarcaciones, que podrán realizar la solicitud de reservas fechas de ingreso al PNIC, las cuales deben contar con la Declaratoria Turística de Transporte Acuático, otorgada por el Instituto Costarricense de Turismo a la empresa o a la nave acuática de conformidad con lo establecido en los artículos 4, 5 y 6 del Decreto Ejecutivo N° 41370-MEIC-TUR del 19 de julio de 2018, Reglamento de Empresas y Actividades Turísticas.
27. Paso Inocente: Es el que se aplica en el mar territorial y el área marina protegida del PNIC. Consiste en que los barcos de todos los Estados pueden navegar por el mar territorial de otro, siempre que se trate de un paso rápido e ininterrumpido con rumbo fijo y velocidad constante. El paso es inocente mientras no sea perjudicial para la paz, el buen orden y la seguridad del Estado, de conformidad con las disposiciones establecidas en la Convención de las Naciones Unidas sobre el Derecho del Mar.
28. Pesca: Acto que consiste en capturar, cazar y extraer vida silvestre acuática, por métodos o procedimientos aprobados por la autoridad competente.
29. Reserva de fechas de ingreso: Es la reserva de fechas que se le otorga a un operador regular con dos años de antelación, para el ingreso al PNIC y que cumpla con los requisitos de operador regular de acuerdo con el presente reglamento.
30. Salar: Preservar con sal productos marinos.
31. Sitio de fondeo: Espacio físico dispuesto para el anclaje de embarcaciones por medio de anclas o fondeos preestablecidos.
32. Snorkel: El snorkel es la práctica de nadar justo debajo de la superficie del agua mientras se respira a través de un tubo que se extiende fuera del agua.
33. Sitios de Buceo: Son aquellos espacios definidos por el ACMC donde se permite la práctica de la actividad de buceo.
34. Submarino: Tipo especial de buque capaz de navegar bajo el agua además de la superficie, mediante un sistema de flotabilidad variable, puede ser tripulado o no tripulado.
35. Surf de remo o Paddle: Deporte náutico que consiste en mantenerse en equilibrio encima de una tabla para este fin, en la que el navegante utiliza una pala o remo para desplazarse sobre el agua.
36. Surf: Deporte náutico que consiste en mantenerse en equilibrio encima de una tabla especial que se desplaza sobre la cresta de las olas.
37. Trasiego: Acción de trasladar, transportar o cambiar de lugar, una especie o especies determinadas de su entorno de manera licita o ilícita.
38. Trasiego de Combustible: Acción de cambiar de lugar productos derivados de hidrocarburos, petróleo y gas.
39. Usuario No Regular: Persona física o jurídica que solicita ingreso directo al PNIC, con un máximo de seis meses de antelación y que cumpla con los requisitos del presente reglamento.
40. Vehículo aéreo tripulado: Es una aeronave que cuenta con una tripulación a bordo.
Ficha Artículo 3
Del Ingreso al Parque Nacional Isla del Coco
CAPITULO II
Toda persona física o jurídica que desee ingresar al PNIC podrán hacerlo sólo con la autorización de la Dirección Regional del ACMC, para lo cual deberá solicitar el respectivo permiso de reserva de fechas para operador regular o ingreso directo de conformidad a lo estipulado en los artículos 5, 6 y 8 del presente reglamento.
La autorización de ingreso emitida por la Dirección Regional del ACMC lo es únicamente dentro de las competencias otorgadas por el artículo 22 de la Ley de Biodiversidad Nº 7788 y no otorga ningún derecho de ingreso a Costa Rica; para lo cual, las personas físicas y jurídicas, así como las embarcaciones de origen extranjero están obligados a realizar la solicitud de autorización de ingreso ante la Dirección Regional del Área de Conservación Marina Coco.
Ficha Artículo 4
Toda Persona física o jurídica propietaria de embarcaciones o su respectivo apoderado, que deseen ser Operador Regular del PNIC, el cual podrá realizar la solicitud de reservas fechas de ingreso deberá:
Contar con la Declaratoria Turística de Transporte Acuático, otorgada por el Instituto Costarricense de Turismo a la empresa o a la nave acuática de conformidad con lo establecido en los artículos 4, 5 y 6 del Decreto Ejecutivo N° 41370-MEIC-TUR del 19 de julio de 2018, Reglamento de Empresas y Actividades Turísticas.
Ficha Artículo 5
El ACMC realizará una apertura pública a través de sus plataformas digitales del periodo de recepción de documentación para la reserva de fechas de ingreso, donde se indicará el año calendario a ser reservado, el interesado deberá cumplir con los siguientes requisitos de forma individual para cada embarcación:
1. Contar con la Declaratoria Turística de Transporte Acuático, otorgada por el Instituto Costarricense de Turismo a la empresa o a la nave acuática de conformidad con lo establecido en los artículos 4, 5 y 6 del Decreto Ejecutivo N° 41370-MEIC-TUR del 19 de julio de 2018, Reglamento de Empresas y Actividades Turísticas.
2. Solicitud con los siguientes datos: nombre de la embarcación, matrícula, número de identificación asignado por la Organización Marítima Internacional o MMSI, bandera, eslora, manga, actividad inscrita del barco, motivo del viaje, medio de notificación.
3. Número del documento de identidad del solicitante. Si la persona solicitante es distinta a la persona física o jurídica propietaria de la embarcación, deberá aportar un Poder Especial para realizar el trámite.
Propuesta de calendario de fechas de cada viaje y cantidad de turistas que se pretende ingresar en cada viaje.
Ficha Artículo 6
Una vez presentado los requisitos de solicitud de autorización para ingreso al Parque Nacional Isla del Coco, la Dirección Regional del ACMC contará con un plazo de cinco días naturales para prevenir al ciudadano de los requisitos que debe aclarar o completar, la prevención suspende el plazo de resolución de la Administración Pública y otorga al ciudadano un plazo de diez días hábiles, salvo que por ley se fije otro distinto para su cumplimiento de lo contrario se archivará la solicitud.
Una vez aportados los requisitos y documentos en forma completa, o en el caso de que no haya sido señalada ninguna omisión o falta, la Dirección Regional del ACMC emitirá la resolución correspondiente en un plazo de diez días naturales, comenzando a regir a partir del día siguiente en que se presentó la solicitud. La prevención debe ser realizada por la Administración como un todo, válida para los funcionarios, siendo que no podrán solicitar nuevos requisitos o señalar nuevos defectos que no fueron prevenidos oportunamente, aun cuando sea otro funcionario el que lo califique por segunda vez. Transcurrido el plazo otorgado al ciudadano se continuará el cómputo del plazo restante previsto para resolver. En los casos en que la Administración Pública no reciba respuesta del ciudadano a la prevención señalada o reciba documentación incompleta, la administración debe proceder conforme al inciso 2) del artículo 264 de la Ley General de la Administración Pública. En los casos en que opere una imposibilidad material debidamente justificada por el ciudadano para cumplir con la prevención, la Administración Pública podrá prorrogar el plazo por un término igual al otorgado. La Administración Pública tendrá el deber de resolver el trámite siempre dentro del plazo legal señalado.
La Dirección Regional del ACMC, velará porque exista equidad en el otorgamiento de reservas de fechas, y podrá limitar el número de visitantes, el número de pangas a utilizar por embarcación, días de visita o variar las fechas de visita al PNIC, de acuerdo con su conveniencia y considerando factores como la capacidad de carga turística, situaciones especiales relacionadas con la conservación, manejo y desarrollo del PNIC.
La Dirección Regional del ACMC podrá reservar a los operadores regulares hasta un 75% de los viajes permitidos anualmente con base en la capacidad de carga turística del PNIC.
La vigencia del trámite es de un año a partir del día hábil siguiente a la notificación de la resolución.
Ficha Artículo 7
Los operadores regulares que cuenten con reserva de ingreso al PNIC aprobada, deberán, previo a cada ingreso y al menos con quince días hábiles de anticipación, llenar el formulario de solicitud de ingreso el cual se puede descargar en la página web https://isladelcoco.go.cr y presentarlo ante la Dirección Regional del ACMC para el otorgamiento del permiso definitivo, junto con los siguientes requisitos:
1. Declaración jurada en donde conste que la embarcación cuenta con los siguientes requerimientos:
a. Sistemas efectivos para el manejo integral de emergencias, residuos líquidos y sólidos producidos durante su operación.
b. Un radio con banda marina en la embarcación y en el bote auxiliar.
c. Portar el sistema AIS o VMS en la embarcación y su bote auxiliar (panga o inflable).
d. Un chaleco salvavidas por pasajero y el equipamiento necesario para el rescate acuático en las embarcaciones para el transporte de personas a los sitios de buceo y desplazamiento dentro de las zonas de uso público.
e. Debe indicar que todas las personas que van a realizar actividades de buceo cuentan con la certificación respectiva, debidamente verificadas por quien solicita el ingreso, la Dirección Regional del ACMC procederá a comprobar que se cuenta con dichos certificados.
2. Comprobante de pago de las tarifas correspondientes, según lo establecido en el Decreto Ejecutivo N° 38295-MINAE "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y derogatoria del Decreto Ejecutivo N° 34164-MINAE", del 15 de enero del 2014, o decreto de tarifas vigente al momento de dictar la resolución para el ingreso al Parque Nacional Isla del Coco, según lo estipulado en los artículos 5, 6, 27, 32, 33, 34 y 36 del supracitado decreto. La Administración verificará a lo interno que la Embarcación cuente con zarpe otorgado por Capitanía de Puerto Nacional o marinas de Costa Rica la cual se comprobará en comunicación con la Institución correspondiente y la resolución de ingreso al PNIC emitida por la Dirección Regional del ACMC.
Una vez presentado los requisitos, la Dirección Regional del ACMC contará con un plazo de cinco días naturales para prevenir al ciudadano de los requerimientos que debe aclarar o completar, la prevención suspende el plazo de resolución de la Administración Pública, el interesado contará con un plazo de diez días hábiles para subsanar los requisitos o documentos, salvo que por ley se fije otro distinto para su cumplimiento, de lo contrario se archivará la solicitud.
Una vez aportados los requisitos y documentos en forma completa, o en el caso de que no haya sido señalada ninguna omisión o falta, la Dirección Regional del ACMC emitirá la resolución correspondiente en un plazo de diez días naturales, comenzando a regir a partir del día siguiente en que se presentó la solicitud. La prevención debe ser realizada por la Administración como un todo, válida para los funcionarios, siendo que no podrán solicitar nuevos requisitos o señalar nuevos defectos que no fueron prevenidos oportunamente, aun cuando sea otro funcionario el que lo califique por segunda vez. Transcurrido el plazo otorgado al ciudadano se continuará el cómputo del plazo restante previsto para resolver. En los casos en que la Administración Pública no reciba respuesta del ciudadano a la prevención señalada o reciba documentación incompleta, la administración debe proceder conforme al inciso 2) del artículo 264 de la Ley General de la Administración Pública. En los casos en que opere una imposibilidad material debidamente justificada por el ciudadano para cumplir con la prevención, la Administración Pública podrá prorrogar el plazo por un término igual al otorgado, siempre que tal solicitud se realice antes del vencimiento del plazo otorgado. La Administración Pública tendrá el deber de resolver el trámite siempre dentro del plazo legal señalado.
La Dirección Regional del ACMC, velará porque exista equidad en el otorgamiento de reservas de fechas, y podrá limitar el número de visitantes, el número de pangas a utilizar por embarcación, días de visita o variar las fechas de visita al PNIC, de acuerdo con su conveniencia y considerando factores como la capacidad de carga turística, situaciones especiales relacionadas con la conservación, manejo y desarrollo del PNIC.
La Dirección Regional del ACMC podrá reservar a los operadores regulares hasta un 75% de los viajes permitidos anualmente con base en la capacidad de carga turística del PNIC. La vigencia del trámite es de un año a partir del día hábil siguiente a la notificación de la resolución.
Ficha Artículo 8
Cuando la Dirección Regional del ACMC determine que un operador regular incumpliera con al menos un 25% de las fechas del año reservado, de forma continua o discontinua, la Administración podrá, sin responsabilidad para el Estado, disponer de la siguiente medida:
Cancelar las reservas aprobadas de la embarcación para el año del incumplimiento.
La aplicación de dicha medida no impedirá que la persona física o jurídica tramite solicitudes de ingreso directo al PNIC.
Ficha Artículo 9
Para el trámite de permiso de ingreso directo de embarcaciones sin reserva, la persona física o jurídica propietario de la embarcación o su respectivo apoderado que deseen ingresar al PNIC deberá:
1)Llenar el formulario de solicitud de ingreso el cual se puede descargar en la páginaweb https://isladelcoco.go.cr y presentarlo ante la Dirección Regional del ACMC,en un plazo máximo de seis meses y un mínimo de quince días hábiles deanticipación a la fecha prevista de ingreso al PNIC, para el otorgamiento delpermiso definitivo.
2)Presentar copia del pasaporte en caso de no residentes, en caso de residentes copiadel Documento de Migración y Extranjería (DIMEX).
3)Presentar Acreditación (licencia) vigente del capitán de la embarcación.
4)Si la persona solicitante es distinta a la persona física o jurídica propietaria de laembarcación, deberá aportar un Poder Especial del dueño de la embarcación, pararealizar el trámite.
5)Declaración jurada en donde consten que la embarcación cuenta con los siguientesrequerimientos:
a.Sistemas efectivos para el manejo integral de emergencias, residuos líquidosy sólidos producidos durante su operación.
b.Autonomía suficiente para el ingreso y salida al PNIC.
c.Un radio con banda marina en la embarcación y en el bote auxiliar.
d.Portar el sistema AIS o VMS en la embarcación y su bote auxiliar (panga oinflable).
e.Un chaleco salvavidas por pasajero y el equipamiento necesario para el rescateacuático en las embarcaciones para el transporte de personas a los sitios debuceo y desplazamiento dentro de las zonas de uso público.
f.Debe indicar que todas las personas que van a realizar actividades de buceocuentan con la certificación respectiva, debidamente verificadas por quiensolicita el ingreso, la Dirección Regional del ACMC procederá a comprobarque se cuenta con dichos certificados.
6)Comprobante de pago de las tarifas correspondientes, según lo estipulado en losartículos 5, 6, 27, 32, 33, 34 y 36 del Decreto Ejecutivo N° 38295-MINAE"Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas SilvestresProtegidas bajo la administración del Sistema Nacional de Áreas de Conservacióny derogatoria del Decreto Ejecutivo N° 34164-MINAE" del 15 de enero del 2014,conforme lo indique la resolución que otorga el permiso definitivo, la cual severificará a lo interno.
La Administración verificará a lo interno que la Embarcación cuente con zarpe otorgado por Capitanía de Puerto Nacional o marinas de Costa Rica la cual se verificará en comunicación con la Institución correspondiente y la resolución de ingreso al PNIC emitida por la Dirección Regional del ACMC.
Toda la documentación solicitada se verificará a lo interno en la Dirección Regional del ACMC del PNIC.
Una vez presentado los requisitos supra indicados, la Dirección Regional del ACMC contará con un plazo de cinco días naturales para prevenir al ciudadano de los requisitos que debe aclarar o completar, la prevención suspende el plazo de resolución de la Administración Pública y otorga al ciudadano un plazo de diez días hábiles, salvo que por ley se fije otro distinto para su cumplimiento para subsanar los requisitos o documentos, de lo contrario se archivará la solicitud.
Una vez aportados los requisitos y documentos en forma completa, o en el caso de que no haya sido señalada ninguna omisión o falta, la Dirección Regional del ACMC emitirá la resolución correspondiente en un plazo de diez días naturales, comenzando a regir a partir del día siguiente en que se presentó la solicitud. La prevención debe ser realizada por la Administración como un todo, válida para los funcionarios, siendo que no podrán solicitar nuevos requisitos o señalar nuevos defectos que no fueron prevenidos oportunamente, aun cuando sea otro funcionario el que lo califique por segunda vez. Transcurrido el plazo otorgado al ciudadano se continuará el cómputo del plazo restante previsto para resolver. En los casos en que la Administración Pública no reciba respuesta del ciudadano a la prevención señalada o reciba documentación incompleta, la administración debe proceder conforme al inciso 2) del artículo 264 de la Ley General de la Administración Pública. En los casos en que opere una imposibilidad material debidamente justificada por el ciudadano para cumplir con la prevención, la Administración Pública podrá prorrogar el plazo por un término igual al otorgado, siempre que tal solicitud se realice antes del vencimiento del plazo otorgado. La Administración Pública tendrá el deber de resolver el trámite siempre dentro del plazo legal señalado.
La Dirección Regional del ACMC, velará porque exista equidad en el otorgamiento de reservas de fechas, y podrá limitar el número de visitantes, el número de pangas a utilizar por embarcación, días de visita o variar las fechas de visita al PNIC, de acuerdo con su conveniencia y considerando factores como la capacidad de carga turística, situaciones especiales relacionadas con la conservación, manejo y desarrollo del PNIC.
La vigencia del trámite es de un año a partir del día hábil siguiente a la notificación de la resolución.
Ficha Artículo 10
La persona física autorizada o representante legal podrá presentar la documentación en forma electrónica acompañada con una certificación notarial con firma digital, en cumplimiento con lo establecido en la Ley N°8454 Ley de certificaciones, firmas digitales y documentos electrónicos del 30 de agosto del 2005, articulado 1, 2 incisos a), b), c) y d), 3, 4, 5 inciso c) y d); Ley N°7764, Código Notarial del 17 de abril de 1998 artículos 30, 31, 80, 108, 110, 120 y 121.

Sobre las actividades permitidas y prohibidas

CAPITULO III
SECCION I
Para la gestión de actividades y permisos, el PNIC contará con un horario de atención de 8:00 am a las 16:00 horas, sin excepción.
Ficha Artículo 12
En el PNIC, según lo establecido en el respectivo Plan General de Manejo y la normativa vigente, solo se permiten actividades de investigación, capacitación y ecoturismo de bajo impacto, en las zonas y condiciones autorizadas previamente por la administración. Por ende, además del permiso de ingreso al PNIC de personas y embarcaciones, el interesado deberá solicitar permiso para la realización de las actividades permitidas. Estos permisos se podrán tramitar en forma conjunta con el permiso de ingreso. Dichos permisos serán otorgados mediante resolución administrativa emitida por la Dirección Regional del ACMC según su naturaleza.
Los tipos de permiso que la Dirección Regional del ACMC puede otorgar para el PNIC son:
Permisos de ecoturismo:
Actividades acuáticas de superficie: snorkel, canotaje, natación en agua dulce y playas, amarizaje, circunnavegación.
Actividades subacuáticas: Buceo recreativo con sistema autónomo y apnea.
Actividades terrestres: Caminatas por los senderos, miradores y playas, estos deben ser autorizados por la administración del PNIC.
Estas actividades podrán realizarse en el horario de las 06:00 horas y hasta las 17:00 horas.
Permisos de investigación:
Investigación científica.
Filmación comercial o científica.
Operación de submarinos, mini-submarinos y ROUV.
Ficha Artículo 13
Toda embarcación que esté autorizada para ingresar al Parque Nacional Isla del Coco deberá:
1. Reportar su arribo al PNIC, 30 millas antes de la llegada a bahía. Dicho reporte deberá realizarse por medio de la radio, haciendo uso de la frecuencia de canal 16 o 25 que opera en la banda marina VHF, en la HF en la frecuencia 8325.0 SSB o cualquier otro medio disponible.
2. Antes de cualquier actividad, deberán esperar la visita de los funcionarios del PNIC en un horario de atención de 08:00 a 16:00 horas.
3. Todo el personal a bordo de la embarcación (tripulantes y pasajeros) deberá estar presente en la charla de bienvenida para visitantes al PNIC, misma que se hará en coordinación con los funcionarios del PNIC. El capitán de la embarcación facilitará la presencia de todas las personas a bordo y los medios audiovisuales disponibles.
4. Ubicarse en el sitio de fondeo o lugar de anclaje asignado por la administración del parque.
5. Una vez la embarcación ingresa al PNIC queda prohibida su salida del área protegida hasta su fecha de salida establecida. Salvo autorización de la administración del Parque.
6. El canal 16 y 25 que operan en la banda marina VHF y HF o la frecuencia 8325.0 SSB, deben estar disponibles para transmitir o atender cualquier mensaje urgente o necesario de la Administración del PNIC a las embarcaciones presentes en la zona, por tanto, deben utilizarse por el tiempo que sea estrictamente necesario.
7. Se definen las Bahías de Chatham y Wafer como sitios de fondeo a utilizar por las diferentes embarcaciones. La Administración del PNIC, podrá autorizar el fondeo/anclaje, durante el día en Bahía Yglesias, en casos especiales, siempre y cuando medie una solicitud previa con su debida justificación. Para todos los casos, siempre deben retornar en horas de la tarde a las Bahías de Chatham y Wafer.
Ficha Artículo 14
Las embarcaciones utilizadas para el transporte de personas a los sitios de buceo y desplazamiento al área administrativa del PNIC deberán ser mayores a 3 metros y menores a 9 metros de eslora, con radio de comunicación, VMS o AIS, los cuales deben permanecer siempre encendidos, equipo de seguridad y propulsados por motor. Cuando su naturaleza lo requiera, deberán contar con los permisos para poder navegar en aguas territoriales costarricenses.
Las embarcaciones utilizadas para el transporte de personas a los sitios de buceo y desplazamiento al área administrativa del PNIC, no podrán navegar dentro de las Bahías Chatham y Wafer, a una velocidad mayor a los 7 nudos.
Las actividades de ecoturismo relacionadas con cetáceos se rigen según lo dispuesto en el Decreto Ejecutivo Nº 32495-MINAE-MOPT-MSP-MAG del 20 de enero de 2005 denominado "Reglamento para la Operación de Actividades Relacionadas con Cetáceos en Costa Rica" o el que se encuentre vigente.
Ficha Artículo 15
Las embarcaciones que se utilicen para el transporte de personas a los sitios de snorkel, deben cumplir con los siguientes requerimientos:
1. Un chaleco salvavidas por pasajero.
2. El equipamiento necesario para el rescate acuático.
3. Sistema AIS o VMS en funcionamiento en la embarcación.
4. Un guía o responsable del grupo.
5. La actividad debe realizarse en grupo de dos a veinte personas incluyendo el guía.
6. Se podrá realizar snorkel en los siguientes sitios: Bahía Wafer: en Barco Hundido,Roca Gissler y frente a catarata Wafer y en Bahía Chatham: Manuelita Somero yUlloa. La administración podrá habilitar o cerrar sitios de snorkel.
Ficha Artículo 16
Toda persona que desee realizar buceo autónomo en el PNIC deberá estar acreditada como buzo, con la debida licencia según los sitios de buceo, por una agencia de buceo autónomo reconocida a nivel nacional o internacional y solo podrá realizar la actividad en los sitios autorizados por la Dirección Regional del ACMC, en la resolución de ingreso opor la Administración del PNIC a solicitud del interesado en el sitio.
La actividad de buceo autónomo y apnea deberá hacerse en grupos iguales o mayores a 2 personas y no mayores a 13 personas incluyendo al guía de buceo, los grupos para buceo autónomo deberán estar bajo la tutela de al menos un guía de buceo (divemaster), con licencia vigente, debidamente identificado por la administración del PNIC.
Las inmersiones podrán iniciar a partir de las 06:00 horas y deben concluir antes de las 17:00 horas. Cuando una embarcación cuente con más de una panga para buceo, estas deben de salir con al menos 30 minutos de diferencia, cerciorándose que siempre haya una panga que pueda auxiliar al otro grupo en caso de emergencia.
La actividad de buceo y apnea se deberán realizar en los sitios autorizados por la Dirección Regional del ACMC, misma que podrá habilitar nuevos sitios y horarios para la práctica de estas actividades.
Las embarcaciones utilizadas para el transporte de personas a los sitios de buceo y apnea y desplazamiento al área administrativa del PNIC deberán ser mayores a 3 metros de eslora, con un motor de 15 HP mínimo de potencia y menores a 9 metros de eslora adecuado al número de integrantes del grupo, portar la bandera de buceo (rojo con blanco), radio de comunicación, equipo de seguridad, AIS o VMS, siempre encendidos.
Dicha embarcación deberá estar debidamente tripulada por al menos un operador de equipo móvil quien se mantendrá siempre abordo y a una distancia que le permita visualizar la ubicación de los buzos durante toda la inmersión. Cuando su naturaleza lo requiera, deberán contar con los permisos para poder navegar en aguas territoriales costarricenses.
Las embarcaciones que realicen las actividades de ecoturismo (incluye buceo, apnea, snorkel, canotaje, circunnavegación) deberán informar a la administración del PNIC la salida y el regreso del sitio visitado.
Ficha Artículo 17
Los funcionarios del PNIC o voluntarios autorizados por el PNIC debidamente identificados, que cuenten con acreditación de buceo y seguro de buceo al día, podrán acompañar a los grupos de buceo autónomo en sus embarcaciones, cuando lo estimen conveniente, con el fin de fiscalizar, controlar y monitorear las actividades que estos realicen.
Para lo anterior, todas las embarcaciones deben proveer un espacio en los botes y el tanque con aire o mezcla según el buceo a realizar, para los funcionarios o voluntarios señalados.
Ficha Artículo 18
La práctica de canotaje en bahías, solo se podrá realizar previa autorización del PNIC, en grupos mínimos de 2 personas y no mayores a 12 personas, dentro de la Bahía Chatham o la Bahía Wafer siempre y cuando las condiciones climáticas lo permitan, es obligatorio portar el chaleco salvavidas.
Cuando el grupo sea mayor a 3 canoas, la actividad de canotaje deberá contar con un guía o responsable y movilizarse en grupo.
La práctica de canotaje más allá de las bahías solo se podrá realizar previa autorización del PNIC, esta actividad solo se permitirá con la escolta de un bote de seguridad, en grupos no mayores de 12 personas y con el uso de equipos para la emisión de señales de socorro que alerte a los servicios de búsqueda y rescate (EPIRB por sus siglas en ingles) para cada participante, todas las personas deben portar un chaleco salvavidas y queda prohibido el desembarco en lugares que no estén autorizados por la Dirección Regional del Área de Conservación Marina Coco.
Ficha Artículo 19
Para la autorización de caminatas, es requisito que los visitantes y guías cuenten con el equipamiento básico de seguridad, incluyendo al menos un radio portátil por grupo, zapatos cerrados, ropa de caminata, agua y botiquín de primeros auxilios.
Solamente se autorizará visita terrestre en:
1. Sendero Bahía de Chatham-Bahía Wafer-Mirador Pájara y viceversa (SenderoLas Bahías).
2. Sendero Cavernas de Gissler 3. Catarata Wafer 4. Catarata Velo de Novia 5. Sendero a Cerro Yglesias (La visita a este sendero solo se puede realizar trascoordinación y permiso del administrador en turno del PNIC, será este quienvalore si es seguro realizar la caminata y qué día se debe realizar la misma).
6. Sendero Doña Dulce.
7. Alrededores de la base en Bahía Wafer y la bahía Chatham.
8. Cualquier otro sendero que la Dirección Regional del ACMC habilite.
La administración podrá cerrar o habilitar senderos según lo considere oportuno.
Las caminatas podrán realizarse en grupos de un máximo de 24 personas. Los grupos de hasta 12 personas deberán contar con un guía; si el grupo supera las 12 personas y hasta un máximo de 24, deberán acompañarse por dos guías. Dichos recorridos deberán realizarse previa autorización de la administración, sin desviarse de los senderos demarcados y en las rutas establecidas. Toda caminata deberá iniciar a partir de las 8:00 am y antes de las 14:00 horas. Algunas actividades podrán iniciar antes, previa autorización de la administración del PNIC.
Durante las visitas terrestres al PNIC solamente se autoriza la natación en los siguientes sitios: Playas Wafer y Chatham a una distancia no mayor de 20 metros de la línea de marea, la poza del puente Copey en el Río Genio, la poza en Bahía Chatham y poza de Catarata Wafer. La administración podrá cerrar o habilitar sitios para natación según lo considere oportuno.
Cada grupo que realice actividades terrestres deberá ser acompañado por al menos una persona miembro de la tripulación, quien será la responsable del grupo. El Capitán de la embarcación comunicará al administrador del parque el nombre de la persona que asumirá dicho rol, quien deberá acatar las indicaciones de seguridad y orientación dadas por el funcionario del PNIC.
Ficha Artículo 20
Para la realización de filmación comercial terrestre, aérea, marina o submarina, el usuario deberá tramitar con un plazo mínimo de 15 días hábiles de anticipación, el permiso ante el ACMC con los siguientes requerimientos:
1. Pagar los derechos correspondientes.
2. Deberá presentar la información solicitada en el formulario oficial destinado paradicho fin, el cual se puede descargar en la página web https://isladelcoco.go.cr 3. Copia del pasaporte en caso de no residentes, en caso de extranjeros residentescopia del Documento de Migración y Extranjería (DIMEX). Si la personasolicitante es distinta a la persona física o jurídica propietaria de la embarcación,deberá aportar un Poder Especial para realizar el trámite.
4. Copia del guion de filmación.
Una vez presentado los requisitos, la Dirección Regional del ACMC contará con un plazo de cinco días naturales para prevenir al ciudadano de los requisitos que debe aclarar o completar, la prevención suspende el plazo de resolución de la Administración Pública y otorga al ciudadano un plazo de diez días hábiles para subsanar los requerimientos o documentos, salvo que por ley se fije otro distinto para su cumplimiento de lo contrario se archivará la solicitud.
Una vez aportados los requisitos y documentos en forma completa, o en el caso de que no haya sido señalada ninguna omisión o falta, la Dirección Regional del ACMC emitirá la resolución correspondiente en un plazo de diez días naturales, comenzando a regir a partir del día siguiente en que se presentó la solicitud. La prevención debe ser realizada por la Administración como un todo, válida para los funcionarios, siendo que no podrán solicitar nuevos requisitos o señalar nuevos defectos que no fueron prevenidos oportunamente, aun cuando sea otro funcionario el que lo califique por segunda vez. Transcurrido el plazo otorgado al ciudadano se continuará el cómputo del plazo restante previsto para resolver. En los casos en que la Administración Pública no reciba respuesta del ciudadano a la prevención señalada o reciba documentación incompleta, la administración debe proceder conforme al inciso 2) del artículo 264 de la Ley General de la Administración Pública. En los casos en que opere una imposibilidad material debidamente justificada por el ciudadano para cumplir con la prevención, la Administración Pública podrá prorrogar el plazo por un término igual al otorgado, siempre que tal solicitud se realice antes del vencimiento del plazo otorgado. La Administración Pública tendrá el deber de resolver el trámite siempre dentro del plazo legal señalado.
La Dirección Regional del ACMC, velará porque exista equidad en el otorgamiento de reservas de fechas, y podrá limitar el número de visitantes, el número de pangas a utilizar por embarcación, días de visita o variar las fechas de visita al PNIC, de acuerdo con su conveniencia y considerando factores como la capacidad de carga turística, situaciones especiales relacionadas con la conservación, manejo y desarrollo del PNIC.
Si por razones de mantenimiento, protección o conservación se restringen los permisos de filmación, tendrá prioridad la filmación por motivos de investigación científica y las actividades de manejo sobre la filmación comercial.
Las filmaciones de carácter científico, cultural o educativo sin fines comerciales y filmaciones de turistas que pretendan únicamente la preservación de un recuerdo de la visita al área silvestre protegida, estarán exentas de pago de tarifa según lo dispuesto en el Decreto Ejecutivo Nº 38295-MINAE del 15 de enero del 2014 denominado "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y Derogatoria del Decreto Ejecutivo Nº 34164-MINAE", o el que se encuentre vigente.
Ficha Artículo 21
Las actividades de investigación se regirán según lo establecido en los artículos 11, 12, 13, 14, 15, 16, 17, 18 y 19 del Decreto Ejecutivo N°32553-MINAE del 29 de marzo del 2005 denominado "Manual de Procedimientos para realizar Investigación en Biodiversidad y Recursos Culturales en las Áreas de Conservación.", o el que se encuentre vigente. Si las actividades de investigación requieren el uso de submarinos, mini-submarinos y ROUV, se debe cumplir adicionalmente con lo señalado en el artículo 23 del presente reglamento.
Ficha Artículo 22
La operación de submarinos, mini-submarinos, y ROUV se permitirá con los fines establecidos en el artículo 36 inciso i) del Decreto Ejecutivo N° 38295-MINAE denominado "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y derogatoria del Decreto Ejecutivo N° 34164-MINAE" del 15 de enero del 2014 o el que se encuentre vigente.
Se deberá solicitar y contar con el permiso de ingreso y operación de submarinos extendido por la Dirección Regional del ACMC.
Ficha Artículo 23
El interesado deberá llenar el formulario de solicitud de operación de submarinos en el PNIC, el cual se puede descargar en la página web https://isladelcoco.go.cr y presentarlo a la Dirección Regional del ACMC, previo a la fecha de ingreso al PNIC.
Además, deberá presentar el formato de solicitud de operación de submarinos el cual consignará los siguientes datos:
1. Nombre y calidades del solicitante.
2. Nombre completo (número de cédula y/o pasaporte, nacionalidad, fecha de nacimiento de los pilotos).
3. Programa de inmersiones, incluyendo, objetivos, sitios, fechas, hora, tiempo estimado de inmersión, durante su permanencia en el PNIC.
4. Nombre, matrícula, modelo, número de serie, capacidad y características básicas del submarino, mini-submarino o ROUV.
5. Medio para notificaciones.
6. Si la persona solicitante es distinta a la persona física o jurídica propietaria del submarino, deberá presentar un Poder Especial ante la Dirección Regional del ACMC para realizar el trámite.
Una vez presentado los requisitos supra indicados, la Dirección Regional del ACMC contará con un plazo de cinco días naturales para prevenir al ciudadano de los requisitos que debe aclarar o completar, la prevención suspende el plazo de resolución de la Administración Pública y otorga al ciudadano un plazo de diez días hábiles para subsanar los requisitos o documentos, salvo que por ley se fije otro distinto para su cumplimiento de lo contrario se archivará la solicitud.
Una vez aportados los requisitos y documentos en forma completa, o en el caso de que no haya sido señalada ninguna omisión o falta, la Dirección Regional del ACMC emitirá la resolución correspondiente en un plazo de diez días naturales, comenzando a regir a partir del día siguiente en que se presentó la solicitud. La Dirección Regional del ACMC, velará porque exista equidad en el otorgamiento de reservas de fechas, y podrá limitar el número de visitantes, el número de pangas a utilizar por embarcación, días de visita o variar las fechas de visita al PNIC, de acuerdo con su conveniencia y considerando factores como la capacidad de carga turística, situaciones especiales relacionadas con la conservación, manejo y desarrollo del PNIC.
La Dirección Regional del ACMC podrá reservar a los operadores regulares hasta un 75% de los viajes permitidos anualmente con base en la capacidad de carga turística del PNIC.
La vigencia del trámite es de un año a partir del día hábil siguiente a la notificación de la resolución.
Ficha Artículo 24
El uso de vehículos aéreos tripulados es permitido en el PNIC, la solicitud debe presentarse en conjunto con el permiso de ingreso de la embarcación, y se deben presentar los permisos respectivos de la Dirección General de Aviación Civil para volar en el país las cuales se verificarán a lo interno de la Dirección Regional del ACMC. Además, se deberán pagar las tarifas correspondientes según el inciso d) del artículo 34 del Decreto Ejecutivo Nº38295-MINAE, denominado "Tarifas por derechos de ingreso y otros servicios ofrecidos en las Áreas Silvestres Protegidas bajo la administración del Sistema Nacional de Áreas de Conservación y derogatoria del Decreto Ejecutivo N° 34164-MINAE" del 15 de enero del 2014 o el que se encuentre vigente.
Ficha Artículo 25
Estos permisos deberán tramitarse ante la Comisión Arqueológica Nacional, según lo establecido en los artículos 8, 9 y 12, del Decreto Ejecutivo N° 43216-MCJ-MINAE-RREE del 10 de setiembre de 2021, "Reglamento para la gestión, protección y conservación del Patrimonio Cultural Subacuático". El interesado deberá adjuntar a su solicitud de ingreso al PNIC copia del permiso otorgado y presentar el original a los funcionarios del PNIC a su arribo.
Ficha Artículo 26
La Dirección Regional del ACMC, permitirá la presencia de personas en el PNIC, siguiendo las disposiciones que establezcan los estudios de flujo de visitantes terrestre y marina o cualquier otra metodología de manejo de visitantes. Estos estudios y metodologías son realizados por el ACMC y oficializados por la Dirección Regional del ACMC de forma periódica.
La circunnavegación de embarcaciones, lanchas o pangas, solo se podrá realizar entre las 06:00 y las 17:00 horas previa coordinación con la administración del PNIC, siempre y cuando las condiciones climáticas lo permitan y dentro de la zona de uso público establecida en el Plan General de Manejo del PNIC. Es obligatorio portar chalecos salvavidas, equipo de comunicación (canal 16 o 25 de VHF o Banda HF de frecuencia 8325.0 SSB), equipo de seguridad, AIS o VMS o soporte de localización GPS.
La Dirección Regional del ACMC podrá autorizar el ingreso al PNIC a embarcaciones con fines ecoturísticos hasta por un máximo de 10 días naturales consecutivos. Ningún visitante podrá exceder el tiempo autorizado en su permiso de ingreso, salvo caso fortuito ofuerza mayor. En caso de embarcaciones que realicen filmación o investigaciónautorizadas por el área de conservación, este permiso se podrá extender por un plazo mayor según lo disponga la resolución respectiva.
Ficha Artículo 27
El capitán de la embarcación deberá coordinar diariamente con la administración del PNIC las actividades a realizar dentro de los límites del PNIC.
Ficha Artículo 28
Regulación Actividades Prohibidas y excepciones
SECCION II
Serán prohibido y restringido el ingreso al PNIC de lo siguiente:
1. Se prohíbe el ingreso y estadía de todo tipo de embarcaciones dentro de los límitesdel PNIC salvo que cuenten con la autorización respectiva y cumplan con laentrada y salida aprobada.
2. Se prohíbe la estadía de embarcaciones pesqueras dentro de los límites del PNIC.
3. En caso de embarcaciones de turismo que cuenten con artes de pesca y susaccesorios (equipos de pesca, abridores (outrigger), cañas, carretes, señuelos), seprohíbe que todos estos equipos estén visibles durante la estadía en el PNIC.
4. Se prohíbe la navegación de embarcaciones con una eslora igual o superior a 10metros en las siguientes zonas: El área comprendida entre el Islote Manuelitaconocida como el canal, Islote Pájara, Islote Roca Vikinga, Islote Muela o taza deté, Islote Juan Bautista, Islote Silverado, Islote Montagne, Islote Dos AmigosPequeño, Islote Dos Amigos Grande y la Isla del Coco.
5. La navegación nocturna dentro de los límites del PNIC en actividades recreativasestá totalmente prohibida entre las 18:00 y las 06:00 horas.
Se exceptúan de las anteriores disposiciones, los casos fortuitos o de emergencia debidamente autorizados por la Administración del PNIC.
Ficha Artículo 29
Queda absolutamente prohibido realizar las siguientes actividades:
1. Cualquier tipo de pesca.
2. Realizar cualquier tipo de marca en árboles, rocas y cualquier otro elemento.
3. La portación y el uso de cualquier tipo de arma (sean estas de fuego, airecomprimido o resorte, etc.)
4. El ingreso, venta y consumo de drogas dentro de los límites del PNIC. Seexceptúan de la presente disposición aquellas sustancias de tratamiento médico;así como el consumo de bebidas alcohólicas dentro de las embarcacionesturísticas, siempre y cuando, los consumidores permanezcan en éstas mientras seencuentren bajo los efectos del licor y no realicen actividades que alteren el ordenpúblico.
5. Acampar y encender fogatas.
6. El nudismo.
7. Cualquier tipo de contaminación ambiental, producida por desechos sólidos oaguas servidas, químicos o combustibles.
8. La descarga de aguas servidas, sentinas, aguas jabonosas, aguas de lastre encualquier punto dentro del área silvestre protegida.
9. Realizar trasiego de combustible, mantenimiento y reparación de embarcacionesde cualquier tipo o equipo en general, salvo que exista autorización expresa de laadministración del PNIC.
10. Realizar labores de limpieza de embarcaciones tanta obra viva (casco), obramuerta y cualquier limpieza de equipo que conlleve el descargue de aguasresiduales hacia el mar.
11. Botar residuos orgánicos e inorgánicos.
12. Tener a la vista equipo de pesca, (Incluyendo abridores "out rigger"), a excepcióndel equipo utilizado con fines de investigación aprobados por la DirecciónRegional del ACMC.
13. El uso de iluminación externa y de cubierta y el uso de luces sumergidas, quealcance la superficie del agua, durante el periodo comprendido desde las 19:30 ylas 06:00 horas.
14. La generación de ruidos excesivos que produzcan contaminación sónica.
15. Las actividades deportivas tales como surf de remo o paddle, surf, motos acuáticas, alas delta, parapente, paracaidismo y el uso de vehículos de competencia marina.
16. El ingreso a cavernas, excepto las aprobadas por la Dirección Regional del ACMC.
17. La extracción y manipulación de cualquier elemento del patrimonio histórico y cultural.
18. Desembarcar en lugares no autorizados por la administración.
19. El ingreso de mascotas al PNIC, salvo el caso de perros guía o unidades caninas.
20. El uso con fines comerciales y de lucro de videos y fotografías, que hayan sido tomadas en el área silvestre protegida sin los permisos respectivos de filmación, por parte de cualquier persona sean turistas, voluntarios, investigadores, colaboradores, tripulantes y guías.
21. Hacer uso del PNIC como base de operaciones para la realización de actividades fuera de sus límites.
22. Salir y volver a ingresar del PNIC, durante los días autorizados.
23. La navegación nocturna dentro de los límites del PNIC está totalmente prohibida entre las 18:00 y las 06:00 horas.
El incumplimiento de estas prohibiciones conllevará a la expulsión inmediata del ASP.
Ficha Artículo 30
Respecto a las especies de vida silvestre, dentro del PNIC queda estrictamente prohibido:
1. Extraer o manipular cualquier especie o producto o subproducto de vida silvestre biótico (Reino Protista, el reino Monera, el reino Fungi, el reino Plantae y el reino Animalia.)
2. Extraer cualquier tipo de material abiótico: orgánico o inorgánico.
3. El comercio y trasiego de cualquier producto de vida silvestre de origen marino y terrestre.
4. Pescar, cazar, extraer, manipular, acosar y hostigar a individuos de cualquier especie marina o terrestre.
5. Helar, salar o destripar especies silvestres marinas.
6. El uso de jaulas para la observación de fauna marina, 7. El buceo autónomo y snorkel en las agregaciones de alimentación de megafauna (pajareras o manchas o "baitballs"), así como acercarse en embarcaciones, lanchas, pangas, botes o canotaje, a una distancia menor a 100 metros de éstas.
8. Alimentar a los organismos marinos y terrestres.
9. Tener contacto físico con cualquier organismo marino o terrestre.
10. La introducción de cualquier especie.
Ficha Artículo 31
Dentro del área del PNIC, no se permitirá la permanencia de embarcaciones dedicadas a cualquier tipo de pesca, salvo las excepciones dadas por caso fortuito, fuerza mayor establecidas en el artículo 34 del presente Reglamento o por paso inocente según lo señalado en el artículo 3 inciso 27.
El uso de vehículos personales tipo torpedo, solamente está autorizado en casos de discapacidad para realizar la actividad grupal de buceo autónomo y como instrumento de investigación. Para el uso de dichos vehículos, la autorización se emitirá mediante la resolución administrativa del ingreso otorgada por la Dirección Regional del ACMC.
Dentro del área marina y terrestre del PNIC, no se permitirá el uso de vehículos aéreos no tripulados incluyendo drones, salvo para fines investigativos, de control, vigilancia y filmación, debidamente autorizados mediante la resolución de ingreso, emitida por la Dirección Regional del ACMC. En todo caso, a efectos de valorar la solicitud esta deberá contar con los permisos pertinentes otorgados por la Dirección General de Aviación Civil.
Ficha Artículo 32
Se exceptúan de la prohibición de ingreso y estadía, a las siguientes embarcaciones:
1. Las pertenecientes al Sistema Nacional de Áreas de Conservación.
2. Las pertenecientes al Benemérito Cuerpo de Bomberos de Costa Rica.
3. Las pertenecientes al Servicio Nacional de Guardacostas.
4. Las pertenecientes a personas físicas o jurídicas autorizadas por el ACMC, que ingresen con el objeto de realizar actividades de turismo ecológico.
5. Las embarcaciones utilizadas en proyectos de investigación que hayan sido previamente aprobados por el Área de Conservación.
6. Aquellos navíos en los que ocurra alguna situación de fuerza mayor o caso fortuito de conformidad con el artículo 34 de este Reglamento de Uso Público, la cual deberá ser comprobada por la Administración del PNIC. De comprobarse la inexistencia de la emergencia, se ordenará la salida inmediata de la nave fuera de los límites del Parque Nacional.
7. Las embarcaciones con banderas internacionales con permiso de la Asamblea Legislativa.
Ficha Artículo 33
Todas aquellas embarcaciones que no porten los permisos para ingresar al PNIC y que deban ingresar a éste por caso fortuito o fuerza mayor, podrán hacerlo, previa comunicación por medio de la radio, haciendo uso de la frecuencia de canal 16 o 25 que opera en la banda marina VHF, o banda marina HF en la frecuencia 8325.0 SSB, o vía telefónica con la administración del PNIC quien será la encargada de autorizar el ingreso.
La embarcación autorizada deberá permanecer en el fondeo asignado por la administración del PNIC, hasta un máximo de 8 horas, excepto cuando la emergencia no haya sido superada, caso en que la administración del PNIC podrá habilitar un término mayor de estadía el cual debe dictarse bajo los principios de lógica y razonabilidad. La administración del PNIC indicará la hora de salida del área marina protegida. En caso de que supere las 8 horas de estadía, deberá entregarse a la administración un reporte por escrito de las razones por las cuales no han resuelto la emergencia.
La situación de emergencia o caso fortuito será comprobada por la Administración del PNIC y de comprobarse la inexistencia de la emergencia, se ordenará la salida inmediata de la embarcación fuera de los límites del PNIC.
Ficha Artículo 34
Zonificación
SECCION III
Para efectos de autorización y aplicación de las actividades permitidas en el presente reglamento se considerará con carácter vinculante la zonificación establecida en numeral 3 inciso 2) del Plan General de Manejo del Parque Nacional Isla del Coco, el cual se encuentra en la Resolución-002-SINAC-ACMC-DR-2024 del 04 de junio del 2024, de conformidad con la siguiente clasificación:
Zonificación Insular:
1. Zona de mínima o nula intervención 2. Zona de baja intervención 3. Zona de mediana intervención 4. Zona de alta intervención Zonificación marina:
1. Nula intervención.
2. Mínima intervención.
3. Baja intervención.
4. Media intervención.
5. Alta intervención.
Ficha Artículo 35
De conformidad con lo establecido en el numeral 2 y 3 del Plan General de Manejo del Parque Nacional Isla del Coco, el cual se encuentra en la Resolución-002-SINAC-ACMC-DR-2024 del 04 de junio del 2024, se estipula que los objetivos de cada zonificación son los siguientes:
Zonificación insular del PNIC:
- Mínima: Su objetivo es velar por la continuidad de los procesos ecológicos, etológicos y evolutivos de las especies residentes, endémicas y migratorias presentes en el área insular. El uso de esta zona es altamente restrictivo y para situaciones excepcionales indicadas en la zonificación, se requiere un permiso especifico de la administración del PNIC.
- Baja Intervención: Su objetivo está fundamentado en la administración de las áreas designadas para realizar actividades operativas como el control, administración, turismo con diferentes grados de especialización y resguardo del patrimonio natural, arqueológico y legado cultural del PNIC.
- Media Intervención: El objetivo de estas áreas es facilitar las actividades administrativas en las bases de operación de los funcionarios del ACMC en el territorio insular. Brindando las condiciones energéticas, estructurales y de comunicación, para la adecuada operatividad del PNIC.
- Alta Intervención: De igual forma el objetivo es facilitar las actividadesadministrativas en las bases de operación de los funcionarios del PNIC en elterritorio insular en forma más intensiva que la media intervención, brindando lascondiciones energéticas, estructurales y de comunicación, para la adecuadaoperatividad del ASP.
Zonificación marina del PNIC:
- Nula Intervención: El objetivo de esta zona se basa en la conservación de losprocesos etológicos y ecológicos de las especies de flora y fauna marina que sedesarrollan en estos ecosistemas insular costeros, bentónicos y pelágicos. Sepromueve la investigación científica que contribuya con el conocimiento delfuncionamiento de los ecosistemas presentes dentro de esta zona, con la menorperturbación posible.
- Mínima Intervención: Su objetivo es promover el turismo científico y laexploración submarina de los montes submarinos o áreas de interés del marprofundo.
- Baja Intervención: El objetivo de esta zona es favorecer la navegación con finesde control, protección, investigación y turismo, velando por la continuidad de losprocesos etológicos, ecológicos y evolutivos de las especies de flora y faunamarina presentes dentro del PNIC.
- Media Intervención: Su objetivo se fundamenta en el ordenamiento deactividades turísticas permitidas dentro del PNIC para el disfrute y esparcimientode los turistas y colaboradores del ASP, sin interferir de manera significativa enla dinámica ecológica de los ecosistemas presentes en el área.
- Alta Intervención: El objetivo de estas áreas es facilitar las actividadesadministrativas en las bases de operación de los funcionarios del PNIC en elterritorio marino, brindando las condiciones estructurales y de comunicación, parala adecuada operatividad del ASP.
Ficha Artículo 36
Bioseguridad
Sección IV
Para el ingreso al PNIC se debe acatar todas las disposiciones indicadas en los protocolos de bioseguridad vigentes del Área de Conservación Marina Coco. Estos protocolos de bioseguridad son realizados y oficializados por la Dirección Regional del ACMC de forma periódica.
Ficha Artículo 37
Potestades de la Administración
CAPITULO IV
El personal del ACMC es el encargado de velar por el cumplimiento de los estipulado en el artículo 22 de la Ley de Biodiversidad Nº 7788, del 30 de abril de 1998, publicada en La Gaceta N° 101 del 27 de mayo de 1998, así como de lo establecido en el numeral 4 del Plan General de Manejo del Parque Nacional Isla del Coco, el cual se encuentra en la Resolución-002-SINAC-ACMC-DR-2024 del 04 de junio del 2024.
Ficha Artículo 38
La Dirección Regional del ACMC tendrá las siguientes potestades:
1. Definir, administrar y asignar los sitios de fondeo, anclaje y desembarque dentrodel PNIC.
2. Autorizar la apertura de nuevos sitios y horarios destinados para la realización delas actividades ecoturísticas, así como cerrar aquellos sitios que considerenecesarios para fines de manejo o conservación.
3. Ordenar el cierre temporal o permanente de las actividades de uso público en elPNIC.
4. Restringir las actividades y sitios de uso público, ello siguiendo los principios deconservación, protección y objetivos establecidos en el numeral 1, 4, 5 y 6 delPlan General de Manejo del Parque Nacional Isla del Coco, el cual se encuentraen la Resolución-002-SINAC-ACMC-DR-2024 del 04 de junio del 2024, 5. Cancelar los permisos de visitación o expulsar del PNIC, a aquellos visitantes oempresas que efectúen actividades prohibidas u omitan obedecer indicaciones.Así mismo podrá suspender los permisos de ingreso y realización de actividadesotorgados por motivo de condiciones climáticas adversas o cualquier otra razóndebidamente justificada sin que ello genere responsabilidad para laAdministración.
6. Aplicar sanciones administrativas o interponer las denuncias respectivas, así comolos reclamos civiles por daño ambiental.
Ficha Artículo 39
El personal del PNIC, debidamente identificado, podrá cuando lo estime necesario, abordar cualquier medio de transporte aéreo, acuático o subacuático que arribe al PNIC, con los siguientes propósitos:
1. Dar la charla o mostrar el video con reglas generales a los visitantes que ingresenal PNIC, previo al inicio de cualquier actividad autorizada.
2. Ofrecer cualquier otra información sobre el PNIC que corresponda.
3. Velar por el correcto cumplimiento de los permisos otorgados. Para ello podránacompañar a los turistas o investigadores en las actividades a desarrollar, tantoterrestre como marinas.
4. Corroborar la información sobre las características de la embarcación (permisos,matrícula, tamaño, tonelaje, capacidad de carga de la embarcación y cualquierotro dato que se considere relevante).
5. Verificar la información sobre el personal a bordo, incluyendo visitantes ytripulación, para la verificación de permiso de ingreso al PNIC.
6. Realizar cualquier otra inspección, así como solicitar cualquier tipo deinformación o documentación que la Administración considere necesaria para darcumplimiento al presente reglamento y a lo estipulado en el artículo 22 de la Leyde Biodiversidad Nº 7788, del 30 de abril de 1998, publicada en La Gaceta N°101 del 27 de mayo de 1998.
7. Emitir y notificar las actas administrativas en caso de que se presente algún ilícito.
8. Emitir los informes policiales y recabar la documentación respectiva, trasladarlaa la Asesoría Legal del ACMC, para continuar con los procesos respectivos víajudicial o administrativa.
9. Desarrollar acciones de prevención, alerta temprana, control y erradicación deinvasiones biológica según el Plan de manejo técnico respectivo y/o criteriostécnicos y científicos.
Ficha Artículo 40
Las actividades de voluntariado se regirán según lo establecido en Decreto Nº36812-MINAET "Reglamento de las acciones de voluntariado en el Sistema Nacional de Áreas de Conservación y Derogación del Decreto Ejecutivo N° 32443-MINAE del 01 de marzo del 2025" y el Plan de Voluntariado del ACMC.

CAPITULO V
Disposiciones Finales
Toda persona que ingrese al Parque Nacional Isla del Coco, debe cumplir con las disposiciones indicadas en el presente Reglamento de Uso Público, así como con las directrices que emita el Ministerio de Ambiente y Energía a través del Sistema Nacional de Áreas de Conservación y de la Dirección del Área de Conservación Marina Coco.
Ficha Artículo 42
En todo lo no dispuesto por este decreto, aplíquese supletoriamente la Ley General de Administración Pública, y legislación conexa ambiental.
Ficha Artículo 43
Deróguense el Decreto Ejecutivo N°37023-MINAET "Reglamento de Uso Público del Parque Nacional Isla del Coco y Derogatoria del Decreto Ejecutivo N° 29537-MINAE del 20 de abril del 2001 denominado "Reglamento para Uso Público del Parque Nacional Isla del Coco" y del Decreto Ejecutivo N° 30838-MINAE del 21 de noviembre del 2002 denominado "Prohibición para el ingreso y estadía de las embarcaciones y vertido de sustancias o desechos contaminantes dentro de los límites marinos protegidos del Parque Nacional Isla del Coco" del 23 de enero del 2012.
Ficha Artículo 44
Las reservas de derecho de ingreso autorizadas conforme a las disposiciones del Decreto Ejecutivo N°37023-MINAET del 23 de enero del 2012, constituyen actos administrativos firmes y no serán afectadas por la entrada en vigor del presente Reglamento, sin embargo, el proceso para obtener el permiso definitivo, así como las normas de operación se regirán conforme al presente reglamento.
Ficha Artículo 1 Transitorio
La Dirección Regional del ACMC deberá oficializar en un plazo máximo de un año a partir de la fecha de publicación del presente reglamento, los estudios de capacidad de carga turística terrestre y marina a los que se refiere este cuerpo normativo en los artículos 6, 9, 22, 26 y 39. Hasta el momento en que se oficialice lo dispuesto anteriormente, la Dirección Regional del ACMC, podrá permitir lo siguiente:
Ficha Artículo 2 Transitorio
Los operadores regulares tendrán un plazo de seis meses desde la publicación de este reglamento para contar con los dispositivos en sus pangas de buceo. Los usuarios por ingreso directo podrán hacer un único ingreso sin portar los dispositivos, cualquier permiso posterior tendrá la obligación de contar con los dispositivos AIS.

Este Reglamento rige a partir de su publicación en el Diario Oficial La Gaceta.
