I.That through Decreto Ejecutivo No. 39.724 of May 2, 2016, published in Alcance Digital No. 87 of Monday, May 30, 2016 of the official newspaper La Gaceta, the Regulation for the Control of Pollutant Emissions Produced by Vehicles with an Internal Combustion Engine was issued, which established the obligation to comply with the emission standards issued by the European Union (Euro) and the Federal specifications of the United States (TIER) for new or used vehicles entering the national territory.
II.That through Decreto Ejecutivo 43166- MOPT-MINAE-S called Reform of the Regulation for the control of pollutant emissions produced by automotive vehicles with an internal combustion engine, published in Alcance 213 of La Gaceta number 202 on October twentieth, two thousand twenty-one, the entry into force of the Euro VI and Tier III emission standards is postponed.
III.That through Decreto Ejecutivo No. 43646 of July 13, 2022, called Reform of the Regulation for the control of pollutant emissions produced by automotive vehicles with an internal combustion engine, published in Alcance 174 of La Gaceta number 154 on August sixteenth, two thousand twenty-two, Article 7 of Decreto Ejecutivo No. 39.724 called Regulation for the Control of Pollutant Emissions Produced by Vehicles with an Internal Combustion Engine is reformed, postponing the entry into force of the emission standards issued by the European Union (Euro VI) and the Federal specifications of the United States (TIER III) as of January first, year two thousand twenty-seven.
IV.Currently, the country does not have the enabling conditions for the implementation of the emission standards issued by the European Union (Euro VI) and the Federal specifications of the United States (TIER III) for new or used vehicles that will enter the national territory as of January first, year two thousand twenty-seven. The Costa Rican State lacks the equipment and adequate infrastructure to achieve control and verification of compliance with the indicated standards.
V.The cost of formulating the fuels necessary for the proper functioning of the Euro VI, Tier III, or similar standards implies a significant increase in their international purchase prices, which must opportunely be passed on to consumers and will therefore make vehicle operation more expensive for Costa Ricans, apart from the volatility of the hydrocarbon market due to the existing geopolitical tensions between producing countries.

As of January first, year two thousand thirty, the emission standard EURO VI, Tier III, or higher shall enter into force.

I.Que mediante el Decreto Ejecutivo N° 39.724 del 02 de mayo de 2016, publicado en el Alcance Digital N° 87 del lunes 30 de mayo del 2016 del Diario Oficial La Gaceta, se emitió el Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna el cual estableció la obligatoriedad de acatarlos estándares de emisiones emitidos por la Unión Europea (Euro) y las especificaciones Federales de los Estados Unidos (TIER) para los vehículos nuevos o usados que ingresaban al territorio nacional.
II.Que mediante el Decreto Ejecutivo 43166- MOPT-MINAE-S denominado Reforma Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna, publicado el Alcance 213 de la Gaceta número 202 del día veinte de octubre del dos mil veintiuno se posterga la entrada en vigencia de los estándares de emisiones Euro VI y Tier III.
III.Que mediante Decreto Ejecutivo N° 43646 del 13 de julio del 2022, denominado Reforma Reglamento para el control de las emisiones contaminantes producidas por los vehículos automotores con motor de combustión interna, publicado el Alcance 174 de la Gaceta número 154 del día dieciséis de agosto del dos mil veintidós se reforma el artículo 7 del Decreto Ejecutivo N° 39.724 denominado Reglamento para el Control de las Emisiones Contaminantes Producidas por los Vehículos con Motor de Combustión Interna, se posterga la entrada en vigencia de los estándares de emisiones emitidos por la Unión Europea (Euro VI) y las especificaciones Federales de los Estados Unidos (TIER III) a partir del primero de enero del año dos mil veintisiete.
IV.Actualmente el país no cuenta con las condiciones habilitantes para la implementación delos estándares de emisiones emitidos por la Unión Europea (Euro VI) y las especificaciones Federales de los Estados Unidos (TIER III) para los vehículos nuevos o usados que ingresarán al territorio nacional a partir del primero de enero del año dos mil veintisiete. El Estado costarricense carece de equipos y de la infraestructura adecuada para lograr controlar y verificar el cumplimiento de los estándares indicados.
V.El costo de la formulación de los combustibles necesarios para el adecuado funcionamiento de los estándares Euro VI, Tier III o similares implica un incremento importante en sus precios de compra internacional, lo que oportunamente deberá ser trasladado a los consumidores y por ende encarecerá la operación de los vehículos a los costarricenses aparte de la volatilidad del mercado de hidrocarburos por las tensiones geopolíticas existentes entre países productores.

Decretan:
A partir del primero de enero del año dos mil treinta entrará en vigor el estándar de emisiones EURO VI, Tier III o superior.
Deróguese el Decreto Ejecutivo Nº 43646-MINAE-MOPT-MS del 13 de julio del 2022 "Reforma Decreto Ejecutivo Nº 43166" del 11 de agosto del 2021 Reforma Reglamento para el control de Emisiones Contaminantes Producidas por los Vehículos Automotores con Motor de Combustión Interna".
