I.- That the Ministry of Culture and Youth is the highest authority in matters of historical architectural heritage and intangible cultural heritage, and has auxiliary bodies to facilitate its performance.
II.- That, through Law No. 5619 of December 4, 1974, the Juan Santamaría Historical Cultural Museum was created as a body of the Ministry of Culture and Youth responsible for conserving elements of the historical cultural heritage.
III.- That museums, as institutions of a historical cultural nature, promote social dynamics and community integration, and allow for the conservation, exhibition and dissemination of cultural and natural testimonies characteristic of Costa Rican identity.
IV.- That culture, as a source of knowledge, is expressed in regional manifestations that represent diverse areas of heritage conservation and historical events that have defined the identity of peoples.
V.- That article 3 of Law No. 5619 provided that all objects and documents related to the heroic deed of the years 1856 and 1857 form part of the heritage of the Juan Santamaría Historical Cultural Museum, VI.- That one of the most significant historical sites in the province of Guanacaste is the Casona de Santa Rosa, the setting of the Battle of Santa Rosa, where a museum dedicated to highlighting the events of the 1856 deed through which the Costa Rican people defended their freedom operates.
VII.- That, by Executive Decree No. 25722-C-MINAE of November 13, 1996, the Santa Rosa Historical Museum was created in Santa Rosa National Park, in the province of Guanacaste.
VIII.- That the Santa Rosa Historical Museum has a mixed administrative and financial scheme under the responsibility of the Ministry of Environment and Energy and the National Parks Foundation, which allows integrating its management with the conservation policies of Santa Rosa National Park and ensures resources and an administration coherent with the mission of the National System of Conservation Areas (Sistema Nacional de Areas de Conservación), and in turn the Technical Directorate of the Santa Rosa Historical Museum is in charge of the Juan Santamaría Historical Cultural Museum of the Ministry of Culture and Youth, which guarantees that the museological, curatorial, educational, and cultural heritage conservation criteria conform to national standards and to the best practices in historical preservation, research, and dissemination.
IX.- That among the reasons for creating the Santa Rosa Historical Museum are to contribute to the recovery and conservation of Costa Rican identity; to promote knowledge of the historical events of 1856; to highlight the cultural and natural diversity of the surroundings; to promote community development projects; to carry out cultural and artistic dissemination activities; to facilitate academic and research exchanges; to encourage cultural participation for greater human and sociocultural development; and to offer visitors the opportunity to learn about the history and biodiversity of Santa Rosa National Park.
X.- That the National Museum of Costa Rica was founded by Agreement No. 60 of May 4, 1887 and through its Regional and Community Museums Program, seeks to guide, advise and promote the development of the country's museums, whether public or private.
XI.- That the objectives of the Regional and Community Museums Program are to define museological guidelines for the creation and monitoring of regional and community museums; to evaluate their work in accordance with the directives of the National Museum of Costa Rica; to collaborate with the development of museums that promote research and conservation of local culture; and to provide advice and technical support for their creation and strengthening.
XII.- That it is essential to articulate the management of natural heritage, under the responsibility of the Ministry of Environment and Energy, with the management of historical and cultural heritage, under the responsibility of the Ministry of Culture and Youth, in order to guarantee the integrated management of the site and the museum.

I.-Que el Ministerio de Cultura y Juventud es la máxima autoridad en materia de patrimonio histórico arquitectónico y patrimonio cultural inmaterial, y cuenta con órganos auxiliares para facilitar su desempeño.
II.-Que, mediante la Ley Nº 5619 del 4 de diciembre de 1974, se creó el Museo Histórico Cultural Juan Santamaría, como órgano del Ministerio de Cultura y Juventud responsable de conservar elementos del patrimonio histórico cultural.
III.-Que los museos, como instituciones de carácter histórico cultural, promueven la dinámica social y la integración comunitaria, y permiten la conservación, la exhibición y la divulgación de testimonios culturales y naturales propios de la identidad costarricense.
IV.-Que la cultura, como fuente de conocimiento, se expresa en manifestaciones regionales que representan diversas áreas de conservación patrimonial y hechos históricos que han definido la identidad de los pueblos.
V.-Que el artículo 3 de la Ley Nº 5619 dispuso que forman parte del patrimonio del Museo Histórico Cultural Juan Santamaría todos los objetos y documentos relacionados con la gesta heroica de los años 1856 y 1857, VI.-Que uno de los sitios históricos de mayor trascendencia en la provincia de Guanacaste es la Casona de Santa Rosa, escenario de la Batalla de Santa Rosa, donde funciona un museo dedicado a destacar los hechos de la gesta de 1856 mediante la cual el pueblo costarricense defendió su libertad.
VII.-Que, por Decreto Ejecutivo Nº 25722-C-MINAE del 13 de noviembre de 1996, se creó el Museo Histórico Santa Rosa en el Parque Nacional Santa Rosa, en la provincia de Guanacaste.
VIII.-Que el Museo Histórico Santa Rosa cuenta con un esquema mixto administrativo y financiero bajo la responsabilidad del Ministerio de Ambiente y Energía y de la Fundación de Parques Nacionales, lo cual permite integrar su gestión con las políticas de conservación del Parque Nacional Santa Rosa y asegura recursos y una administración coherente con la misión del Sistema Nacional de Areas de Conservación, y a su vez la Dirección Técnica del Museo Histórico Santa Rosa está a cargo del Museo Histórico Cultural Juan Santamaría del Ministerio de Cultura y Juventud, lo que garantiza que los criterios museológicos, curatoriales, educativos y de conservación del patrimonio cultural se ajusten a los estándares nacionales y a las mejores prácticas en preservación, investigación y difusión histórica.
IX.-Que entre los motivos de creación del Museo Histórico Santa Rosa se encuentran contribuir a la recuperación y conservación de la identidad costarricense; promover el conocimiento de los hechos históricos de 1856; destacar la diversidad cultural y natural del entorno; impulsar proyectos de desarrollo comunal; realizar actividades de difusión cultural y artística; facilitar intercambios académicos y de investigación; fomentar la participación cultural para un mayor desarrollo humano y sociocultural; y ofrecer a las personas visitantes la oportunidad de conocer la historia y la biodiversidad del Parque Nacional Santa Rosa.
X.-Que el Museo Nacional de Costa Rica fue fundado por Acuerdo Nº 60 del 04 de mayo de 1887 y mediante su Programa de Museos Regionales y Comunitarios, procura orientar, asesorar y promover el desarrollo de los museos del país, ya sean públicos o privados.
XI.-Que el Programa de Museos Regionales y Comunitarios tiene por objetivos definir lineamientos museísticos para la creación y el seguimiento de museos regionales y comunitarios; evaluar sus labores conforme a las directrices del Museo Nacional de Costa Rica; colaborar con el desarrollo de museos que impulsen la investigación y la conservación de la cultura local; y brindar asesoría y respaldo técnico para su creación y fortalecimiento.
XII.-Que resulta indispensable articular la gestión del patrimonio natural, bajo responsabilidad del Ministerio de Ambiente y Energía, con la gestión del patrimonio histórico y cultural, bajo responsabilidad del Ministerio de Cultura y Juventud, a fin de garantizar el manejo integral del sitio y del museo.

"Artículo 4.-El Museo Nacional de Costa Rica, del Ministerio de Cultura y Juventud, por medio del Programa de Museos Regionales y Comunitarios, brindará asesoría profesional en capacitación comunitaria, divulgación, técnicas de conservación, investigación e inventario de colecciones. Asimismo, asesorará y apoyará en el diseño de materiales gráficos para promover el acceso, la educación y la actualización de la imagen institucional del Museo Histórico Santa Rosa."
