Sidewalk (Acera): Area of the terrestrial public road (vía pública) intended for use by pedestrians, to guarantee their mobility, safety and connectivity between the different parts of a specific territory. In said space, priority will be given to pedestrian circulation and the installation of services, but shared use with other means of transport will be permitted, provided its design is compatible with the prioritized use.
Accessibility (Accesibilidad): These are the measures adopted by public and private institutions to ensure that persons with disabilities have access, on an equal basis with others, to the physical environment, transport, information and communications, including information and communications systems and technologies and to other services and facilities open or provided to the public. These measures also include the identification and elimination of such barriers.
Alignment (Alineamiento): Minimum physical distance or limit for the placement of mobile commerce units (Unidades Móviles de Comercio) regarding public roads, waterways, streams, springs, lakes, lagoons, estuaries, springs (nacientes), maritime-terrestrial zone, railways, high-voltage power lines, special zones; it is issued by the competent entity.
Usable Area (Área Útil): Delimited space for the development of the commercial activity under the permitted line of business and with the authorized characteristics.
Authorization for Commerce on Wheels (Autorización de Comercio Sobre Ruedas): Authorization issued by the Municipality of Mora to establish lucrative or non-lucrative activities that will be carried out on some type of motor vehicle and occupying some type of public space such as sidewalks, parks, plazas, public roads, streets or other public places, by the licensee, provided that the obligations established in the Law for Commerce on Wheels, Law No. 10.254 and this regulation have been fulfilled.
Public Street (Calle pública): Road governed by the provisions of Law 5060, General Law of Public Roads, of August 22, 1972.
Cancellation (Cancelación): It is the administrative act by which the Municipality renders a license or permit null and void, after compliance with due process. The cancellation of the license implies the immediate closure (clausura) of the commercial establishment.
Closure (Clausura): Administrative act by which the Municipality suspends the operation of an establishment by means of drawing up a document declaring such and placing seals in visible places from the public road, at its access points, or on the establishment. The permanence of security personnel for the care of the property may be authorized in that same act, without this permitting free access to third parties or the continuity of the commercial line of business; in case of having several accesses, a single point shall be left unsealed, which may not be the main one.
Commerce on Wheels (Comercio sobre ruedas): Lucrative and non-lucrative activities, authorized for the preparation/sale of food, beverages, sale of non-credit goods and services, located in public zones/areas previously authorized by the Municipality of Mora through the due business license under the payment of the corresponding fee (canon), to be carried out on motor vehicles, trailer vehicles or towed units modified or designed for said purpose, through the respective business license.
Public Space (Espacio público): Set of flow spaces (people, communications and goods) of public domain. It is constructed both physically through the integration and connectivity of its parts, and symbolically through the social interactions that take place within it. By its nature, it is the place where the collective is expressed, reflecting the diversity of the population and the type of functioning of a society. Therefore, it is of public domain, where the right to circulate freely, to accessibility of public space, and to have a livable city is recognized: the right to the city.
Green Strip (Franja verde): Space provided between the sidewalk and the roadway for the placement of grass or shrubs, whose dimension will be in accordance with the right-of-way, but which in no case will be less than 50 centimeters. This space is of public domain, and it does not affect the layout of sidewalks, curb, gutter, roadway or other areas or spaces for pedestrian traffic, active mobility (movilidad activa) or motorized traffic.
Business License Tax (Impuesto de Patente): Tax obligation that must be fulfilled by any natural or legal person who carries out lucrative activities after approval of the corresponding municipal business license.
License for Commercial Activity (Licencia de actividad comercial): Reasoned administrative act, by which the municipality authorizes natural or legal persons the operation and functioning for the exercise of any type of economic activity for lucrative and non-lucrative purposes, which will be obtained through compliance with the requirements established both in the Law and in the regulation.
Improvement (Mejoramiento): It is the set of upgrades or modifications to the horizontal or vertical standards of roads, related to width, alignment, curvature or longitudinal slope, in order to increase the capacity of the road, travel speed and increase vehicle safety. Also included within this category are the widening of the roadway, the change of surface type from earth to exposed granular material or from this to bituminous pavement or hydraulic concrete among others, and the construction of structures such as major culverts, bridges, intersections, shoulders, sidewalks, bike lanes, ditches, curb and gutter.
Mere Verification (Mera Constatación): Conduct or material act by which public officials verify, through the simple use of their senses, the materialization of a fact, notorious, evident and manifest.
Mobility (Movilidad): Modes of displacement of people and goods, produced in a sphere or territory and referred to a specific duration, total number of displacements or trips, means of transport or modes of carrying them out, types of vehicles used and average daily traffic intensities, in specific places.
Active Mobility (Movilidad activa): use of any non-motorized means of transport to move from one place to another, additional to pedestrian mobility, such as scooters, bicycles, wheelchairs, skates, among others.
Fine (Multa): Pecuniary administrative sanction imposed by the municipal authority for the violation of a norm or legal precept contained in Law number 10126, when applicable, or a sanction established in any other regulation concerning the lucrative activity authorized through the due business license.
Aerial Works in Rights-of-Way (Obras de aéreas en derechos de vía): Laying of electrical power, lighting and telecommunications lines in rights-of-way, which includes their supports and anchorages such as towers, posts, guy wires, struts or similar.
Obstacle on Pedestrian Path (Obstáculo en vía peatonal): Any element that interferes with fluid and continuous mobility.
Pedestrian Crossing (Paso peatonal): Conditioned space, at grade or above/below the level of the public road, with horizontal and vertical demarcation or signage, whose purpose is to facilitate and ensure pedestrian circulation and that of other active transport modes to cross a street safely.
Pedestrian Person (Persona Peatón): Person who moves on foot. Within this category are included persons with disabilities or reduced mobility, whether they use wheelchairs or other devices that do not allow reaching speeds greater than 10 km/h for their mobility.
Sustainable Active Mobility Plan (Plan de Movilidad Activa Sostenible): is a strategic plan designed to address the mobility needs of people, businesses in cities, and their surroundings for a better quality of life. It is built upon existing planning practices and must take into account the principles of integration, participation and evaluation.
Five-Year Road Conservation and Development Plan (Plan Vial Quinquenal de Conservación y Desarrollo): Tool containing the planning on road management, for a five-year term, that municipal corporations must prepare in accordance with the provisions of article 2 of Law No. 9329.
Term (Plazo): Fixed time over which the development of a commercial activity is authorized.
Property (Predio): Land, property, lot, farm or estate, registered or not in the Public Registry.
Pedestrian Priority (Prioridad peatonal): Refers to the hierarchy in the use of public roads and in mobility planning, in accordance with the promotion of more sustainable and safer modes.
Ramp (Rampa): Inclined plane arranged for ascending and descending, at different levels.
Rehabilitation (Rehabilitación): Selective repair and reinforcement of the pavement or roadway, after partial demolition of the existing structure, in order to restore its original structural capacity and ride quality. It also considers the construction or reconstruction of sidewalks, bike lanes or others necessary for road and pedestrian safety and drainage systems. Before any rehabilitation on the riding surface, it must be verified that the drainage systems function well. In the case of bridges and major culverts, rehabilitation includes major repairs such as the replacement of main structural elements or components, the replacement of the floor slab, the major repair of abutments, aprons or others. In the case of retaining walls, it refers to the repair or replacement of damaged sections or their reinforcement, following the corresponding stability analysis.
Recidivism (Reincidencia): Repetition of the same fault, of those regulated in Law 10254, committed on two or more occasions under the responsibility of the same licensee. For these purposes, a committed fault shall be understood as that which is duly accredited by the Municipality, determined by the mere verification of public officials and after completion of the appeals phase contained in the Municipal Code. In said appeals, if applicable, all confessional, testimonial or documentary evidence may be offered. In the event that the patent holder does not make use of the administrative remedies provided by law, the appeals phase shall be automatically deemed waived.
Base Salary (Salario base): For the purposes of determining fines indicated by Law No. 10254, it shall be understood to be that established for the Administrative Assistant 1 indicated in article 2 of Law No. 7337 of May 5, 1993, and its amendments.
Temporary (Temporal): License that authorizes the development of a lucrative or non-lucrative activity, previously authorized by the Municipality, for a determined period.
Mobile Commerce Units (Unidades Móviles de Comercio): Motor vehicles, trailer vehicles or towed units modified or designed for the sale and preparation of food and/or beverages, as well as for the sale of goods and services.
Public Road (Vía pública): It is any land of public domain and common use, inalienable and imprescriptible, which by provision of the administrative authority is intended for free transit in accordance with planning laws and regulations; it includes sidewalk, curb, gutter, roadway, green strip, as well as that land that is in fact already destined for that public use. Furthermore, it is intended for the installation of any channeling, artifact, apparatus or accessory belonging to a public work or destined for a public service. In accordance with the Law of Public Roads, they are classified into national road network and cantonal road network. (As amended in La Gaceta No. 89 of May 22, 2018) Pedestrian Paths or Boulevard (Vías peatonales or Bulevar): Terrestrial public road that occupies, totally or partially, the area comprised by the right-of-way prioritized for use by the pedestrian. In said roads, the use by other modes of transport shall be restricted or prohibited, with the exception of emergency vehicles and others that local or national administrations deem indispensable with their due technical justification.
