Notice 6 Delimitation of the Public Zone (zona pública) Corresponding to the Mangrove Estuary (estero-manglar) Ecosystem of the Sector between Playa Matapalo and Estero Esterón, District 02° Savegre, Canton 06° Quepos, Province 06° Puntarenas —You are viewing the latest version of this regulation— Go to the latest version Version of the Regulation: 1 of 1 INSTITUTO GEOGRÁFICO NACIONAL DEPARTMENT OF GEODESY AND GEOPHYSICS NOTICE Nº 006-2026 MARITIME-TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO THE MANGROVE ESTUARY ECOSYSTEM OF THE SECTOR BETWEEN PLAYA MATAPALO AND ESTERO ESTERÓN, DISTRICT 02° SAVEGRE, CANTON 06° QUEPOS, PROVINCE 06° PUNTARENAS Pursuant to the provisions of Articles 140 and 240 of Ley Nº 6227, the General Public Administration Act, dated May 2, 1978, and its amendments; Ley Nº 59, the Act on the Creation and Organization of the Instituto Geográfico Nacional (IGN), dated July 4, 1944, and its amendments; Ley Nº 8905, amending Article 2 of Ley N° 5695, the National Registry Creation Act, and its amendments, and modifying Ley N° 59, on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments, dated December 7, 2010; Ley Nº 6043, the Maritime-Terrestrial Zone Act (Ley sobre la Zona Marítimo Terrestre), dated March 2, 1977, together with its implementing regulations; and Articles 2 and 3 of Ley Nº 5695, the National Registry Creation Act, dated May 28, 1975, and its amendments.

1°— In accordance with Ley N° 59, the Act on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments, the Instituto Geográfico Nacional (IGN) is "the scientific and technical agency responsible for directing national cartography, tasked with producing the official base map and basic geographic description of the Republic of Costa Rica, and with carrying out studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and related nature connected to those works, for the purpose of supporting planning processes"; the IGN is constituted on a permanent basis, and as a representative of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any kind arising from the work entrusted to it.

2°— By means of Ley Nº 8905, amending Article 2 of Ley N° 5695, the National Registry Creation Act, and its amendments, and modifying Ley N° 59, on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments, of December 7, 2010, the IGN was established as a division of the National Registry (Registro Nacional), which shall enter into the contracts and agreements necessary for the exercise of its functions.

3°— Georeferencing (georreferenciación) to the national coordinate system as a mechanism for delimiting the public zone of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) enables the accurate delimitation of the public zone for purposes of the preparation of regulatory plans, the endorsement of survey plans, the granting of concessions in the restricted zone (zona restringida), and other aspects of coastal land-use planning.

4°— The georeferenced digital information on the delimitation of the public zone of the ZMT held by the IGN is known as the IGN's Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) on the Maritime-Terrestrial Zone.

5°— The IGN's Georeferenced Digital Geodatabase (GDG) on the Maritime-Terrestrial Zone is technically grounded in the application of the regulations established by: a) Executive Decree N° 7841-P, the Regulations to Ley N° 6043 on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments; b) Executive Decree N° 33797-MJ-MOPT, declaring as the official horizontal datum (datum horizontal) for Costa Rica the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 3, 2007; c) Executive Decree N° 36642-MP-MOPT-MINAET, the Specification Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011; d) Executive Decree N° 36786-MINAET, the Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011; e) Executive Decree Nº 40962-MJP, the Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018; f) Executive Decree N° 42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems (ecosistemas de humedal), dated March 7, 2022; and g) Directive DIG-01-2025, Update of Information on the Public Zone of the Maritime-Terrestrial Zone with Respect to the Horizontal Reference System CR-SIRGAS for the Measurement Epoch 2014.59, dated May 28, 2025.

6°— In accordance with Article 62 of Executive Decree N° 7841-P, the Regulations to the Maritime-Terrestrial Zone Act, dated December 16, 1977, and its amendments, the IGN's competence to delimit the public zone of the Maritime-Terrestrial Zone is recognized, along with its official publication in the Official Gazette La Gaceta; Article 63 of Executive Decree N° 7841-P states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." 7°— Executive Decree N° 33797-MJ-MOPT, declaring as the official horizontal datum for Costa Rica the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007, designates, among other matters, the National Horizontal Reference Geodetic Network (Red Geodésica Nacional de Referencia Horizontal) CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in the country must be referenced, specifying in Article 11 that: "The National Horizontal Reference Geodetic Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all geodetic and cartographic surveys and activities carried out in the national territory by any public agency, person, or private national or foreign entity must be referenced."; while Article 7 states that "As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish through appropriate means the information that has been made official." 8°— Executive Decree N° 36642-MP-MOPT-MINAET, the Specification Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, establishes under Article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may use two methods of implementation, set out in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty to interested parties.

9°— Executive Decree Nº 40962-MJP, the Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018, declares in its Article 1 that "The official horizontal geodetic reference system for Costa Rica, designated as CR05 and materialized through the National Geodetic Network, changes its abbreviation to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and updates thereto shall be governed by the new definitions of the ITRF implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) known as SIRGAS-CON"; while Article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official system for the cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection to the territorial sea baseline in the Pacific Ocean and the Caribbean Sea, with that baseline defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum breadth of all marine jurisdictional areas of the Costa Rican State." Furthermore, Article 12 of the aforementioned decree reinforces the application of the CRTM05 cartographic projection as the sole official national coordinate system to which references throughout the continental territory of the country must be made, by stating that "The CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended to the territorial sea baseline, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the national territory by any public agency, person, or private national or foreign entity undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to the avoidance of public expenditure and, on the other hand, to obtaining reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State." 10.— By means of Directive DIG-01-2025, Update of Information on the Public Zone of the Maritime-Terrestrial Zone with Respect to the Horizontal Reference System CR-SIRGAS for the Measurement Epoch 2014.59, dated May 28, 2025, the information contained in the IGN's Georeferenced Digital Geodatabase (GDG) on the Maritime-Terrestrial Zone was updated, transitioning from the CR05 horizontal reference system to the CR-SIRGAS horizontal reference system for the measurement epoch 2014.59, CRTM05 projection, as a mechanism for delimiting the Maritime-Terrestrial Zone.

11.— Furthermore, Article 11 of Chapter I, General Provisions, of Ley N° 6043, the Maritime-Terrestrial Zone Act, dated March 2, 1977, and its amendments, establishes that the "public zone also comprises, regardless of its extent, the area occupied by all mangroves (manglares) of the continental and insular coastlines and estuaries (esteros) of the national territory." 12.— Article 16 of Ley N° 7575, Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate in the field the boundaries of the areas constituting the State Natural Heritage (Patrimonio Natural del Estado, PNE).

13.— Executive Decree N° 36786-MINAET, the Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, establishes among its objectives "To identify within the Maritime-Terrestrial Zone those lands that qualify as forests, lands of forestry aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries, rias, saltmarshes, coastal lagoons, swamps, flooded forests, salt flats), in order to certify them and incorporate them as part of the State Natural Heritage (PNE)." 14.— Executive Decree N° 36786-MINAET, in Point III — Competences for Delimitation and Certification, establishes that "The classification of lands within the ZMT shall fall to the Conservation Areas (Áreas de Conservación, AC) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) and to private professionals duly accredited by the respective Professional Associations (Colegios Profesionales) to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, rias, saltmarshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.

The validity of classification documents issued by private professionals shall be subject to approval by the Conservation Area with territorial jurisdiction. The Conservation Areas of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, inspection, boundary demarcation (deslinde), and certification of State Natural Heritage lands and protection zones.

The location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Ley 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all zones to be granted under concession within the ZMT and for the classification of the ZMT at the level of cadastral plans. Por tanto, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted within the total area available for concession." 15.— Executive Decree N° 42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems, dated March 7, 2022, establishes in its Article 14 that: "Supplementary technical considerations for mangroves. The respective Conservation Area, jointly with the Instituto Geográfico Nacional, shall verify in the field the existence of mangrove and proceed with its delimitation, in accordance with the competence of each institution as indicated by the legal framework.

For the identification of a mangrove, the presence of trees belonging to any of the species listed in Anexo I of this decree shall be used as a parameter; likewise, the estuaries and channels present within these ecosystems are included. The boundary is established to the extent of the vegetation associated with this ecosystem, in accordance with Anexo II of this decree. In addition to the foregoing, the provisions set out in Anexo III of this decree, entitled 'Flora List by Wetland Type According to Landscape Classification: Estuarine Wetlands and Saltwater Flooded Forests (mangroves)', must also be taken into account. The mangrove delimitation process must necessarily include areas that are degraded or in the process of recovery. Furthermore, within the scope of its competence, the respective Conservation Area shall implement the necessary measures to promote such recovery." 16.— The IGN used the Georeferenced Digital Delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone corresponding to the mangrove estuary ecosystem of the sector between Playa Matapalo and Estero Esterón, District 02° Savegre, Canton 06º Quepos, Province 06° Puntarenas.

17.— The delimitation of the public zone of the ZMT between Playa Matapalo and Estero Esterón, corresponding to the mangrove estuary ecosystem located in the canton of Quepos, was carried out in accordance with the ruling of the Constitutional Chamber (Sala Constitucional) under Resolution N° 2021002741 of 09:15 hours on February 12, 2021, which ordered the Área de Conservación Pacífico Central (ACOPAC) and the Instituto Geográfico Nacional (IGN) to: "jointly and in a coordinated manner carry out the corresponding actions to delimit the mangrove ecosystem of the Quepos area." 18.— By means of official communication DIG-GDF-0187-2023 of December 19, 2023, prepared by the Topography Sub-process of the Department of Geodesy and Topography of the IGN, the Topographic Survey Report for the Delimitation of the Mangrove Ecosystem in the Canton of Quepos, in the sector between Playa Matapalo and Estero Esterón, was issued, a work carried out jointly with the Área de Conservación Pacífico Central.

19.— By means of CARTA-SINAC-ACOPAC-DR-0646-2025 of September 2, 2025, signed by licenciado Álvaro Conejo Arias, Acting Director (Director a.i.) of the Regional Office of the Área de Conservación Pacífico Central, the Technical Report on the delimitation of the mangrove estuary ecosystem carried out in the field, SINAC-ACOPAC-PNMA-RBS-TT-030-2024 of June 20, 2024, was delivered, entitled "Partial report on field visits for the verification of indicators and conditions of estuarine ecosystems (mangrove-estuary) observed through photointerpretation of aerial images from the years 1949–2005." 20.— By means of an email at 09:55 a.m. on December 22, 2025, Mr. Joel García Medina, of the Wetlands Program Liaison of the Regional Office of the Área de Conservación Pacífico Central, delivered the mangrove estuary ecosystem delimitation report INF-SINAC-ACOPAC-PNMA-RBS-TT-070-2025 of December 22, 2025, entitled Agreement for the Field Verification of Mangrove and Estuary Ecosystems Identified in Report SINAC-ACOPAC-PNMA-RBS-TT-030-2024, the Playa Linda Sector in the sequence of boundary markers M702 to M531 and the Esterón Sector M569–M562; said agreement was reached at the meeting of October 24, 2025, and was granted approval.

21.— In accordance with INF-SINAC-ACOPAC-PNMA-RBS-TT-070-2025 of December 22, 2025, field verification was carried out of the elements forming part of the mangrove ecosystem, and the presence of hydrophilic vegetation (vegetación hidrófila) was confirmed in areas where the boundary marker demarcation does not cover the findings observed; as well as a review of State Natural Heritage certification ACOPAC-D-PNE-ZMT-CERT.002-2011 of September 22, 2011, as a result of which the report recommends the removal of boundary markers.

22.— By means of official communication DIG-GDF-039-2026 of February 18, 2026, generated by the Topography Sub-process of the Department of Geodesy and Geophysics of the IGN, the Technical Review Report for the Publication of the Georeferenced Digital Delimitation of the Public Zone, DIG-GDF-006-2026-PU-INF, dated January 28, 2026, was submitted to the Directorate of the IGN, in relation to the work carried out by ACOPAC concerning the delimitation of a sector of the mangrove estuary ecosystem between Playa Matapalo and Estero Esterón, technically endorsing the delimitation carried out for publication.

23.— Article 140 of Ley N° 6227, the General Public Administration Act, dated May 2, 1978, and its amendments, states that "an administrative act shall take effect after it has been communicated to the party concerned, except where it exclusively confers rights, in which case it shall take effect from the moment it is adopted"; this provision must necessarily be read in conjunction with numeral 240, paragraph 1) of the same body of law, which defines the appropriate instrument for communicating acts of a general nature by stating that: "General acts shall be communicated by publication and specific acts by notification." HEREBY GIVES NOTICE:

1°— During the weeks of December 4–8 and December 11–15, 2023, joint field work was carried out between the IGN and ACOPAC to delimit the mangrove estuary ecosystem belonging to the public zone between Playa Matapalo and Estero Esterón, District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas.

2°— The Instituto Geográfico Nacional publishes the georeferenced digital delimitation of the public zone of the sector between Playa Matapalo and Estero Esterón, which forms part of the mangrove estuary ecosystem located in District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas, based on the Specification Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by ACOPAC.

3°— The delimited public zone corresponds to the mangrove estuary ecosystem belonging to the public zone between Playa Matapalo and Estero Esterón, in District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas, in accordance with official communications DIG-GDF-039-2026 of February 18, 2026, generated by the Topography Sub-process of the Department of Geodesy and Geophysics of the IGN, and SINAC-ACOPAC-PNMA-RBS-TT-030-2024 of June 20, 2024, and INF-SINAC-ACOPAC-PNMA-RBS-TT-070-2025 of December 22, 2025, both issued by ACOPAC.

4°— With this delimitation, boundary markers M719, M720, and M721, published in Notice N° 2008-07, page 6 of the Official Gazette La Gaceta N° 204 of October 22, 2008, and boundary markers M565 through M569, published in Notice N° 03-43, page 14 of the Official Gazette La Gaceta N° 230 of November 28, 2003, are hereby eliminated.

5°— The public zone of the Maritime-Terrestrial Zone pertaining to the mangrove estuary ecosystem sector located in District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas, verified and delimited by the Área de Conservación Pacífico Central, corresponds to the polygon defined by the following coordinates in the official cartographic projection system of Costa Rica CRTM05 and its update from the CR05 to the CR-SIRGAS CRTM05 horizontal reference system:

GEOREFERENCED DIGITAL DELIMITATION OF THE PUBLIC ZONE OF THE MARITIME-TERRESTRIAL ZONE CORRESPONDING TO THE MANGROVE ESTUARY ECOSYSTEM OF THE SECTOR BETWEEN PLAYA MATAPALO AND ESTERO ESTERÓN

6°— The sectors located in District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas that, as of the date of this notice, already have a delimitation of the public zone of the ZMT through the placement of boundary markers with the respective publication in the Official Gazette La Gaceta, retain their official status.

7°— The official technical data for the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone in District 02º Savegre, Canton 06º Quepos, Province 06º Puntarenas, have been recorded in the IGN's Georeferenced Digital Geodatabase (GDG) on the Maritime-Terrestrial Zone (ZMT), in a file in vector shape format, under the classification: Public Zone Digital Lines. Publish.

8°— This notice takes effect upon publication.

1. 1Que de conformidad con la Ley N° 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas, el Instituto Geográfico Nacional (IGN) es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación"; constituyéndose de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
2. 2Que mediante Ley Nº 8905 Reforma del artículo 2 de la ley N°5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas del 07 de diciembre del 2010, se estableció al IGN como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones.
3. 3Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre (ZMT), posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
4. 4Que la información digital georreferenciada sobre delimitación de la zona pública de la ZMT con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.
5. 5Que la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas; b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 03 de marzo de 2007; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio de 2011; d) Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011; e) Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018; f) Decreto Ejecutivo N° 42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal del 07 de marzo del 2022; y g) Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo de 2025.
6. 6Que de conformidad con el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública."
7. 7Que el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina a la Red Geodésica Nacional de Referencia Horizontal CR05 y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en el artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
8. 8Que el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
9. 9Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; mientras que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." 10.-Que por medio de la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo del 2025, se procedió a actualizar la información de la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre, pasándola del sistema de referencia horizontal CR05 al sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59, proyección CRTM05, como mecanismo de delimitación de la Zona Marítimo Terrestre.

11.-Que, en complemento, el artículo 11 del Capítulo I Disposiciones Generales de la Ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 02 de marzo de 1977 y sus reformas, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.-Que el artículo 16 de la Ley N° 7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

13.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 14.-Que el Decreto Ejecutivo N° 36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar." 15.-Que el Decreto Ejecutivo N° 42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal del 07 de marzo de 2022, en su artículo 14 establece que: "Consideraciones técnicas complementarias para manglares. El Área de Conservación respectiva, en conjunto con el Instituto Geográfico Nacional, deberá verificar en el campo la existencia de manglar y proceder a su delimitación, conforme a la competencia de cada institución según lo indique ordenamiento jurídico.

Para la identificación de un manglar se tomará como parámetro la presencia de árboles de alguna de las especies indicadas en el Anexo I de este decreto; asimismo, se incluyen dentro de estos ecosistemas los esteros y canales existentes. El límite se establece hasta donde se extienda la vegetación asociada con este ecosistema, de conformidad con el Anexo II de este decreto. Además de lo anterior debe contemplarse lo indicado en el Anexo III de este decreto, denominado "Listado de flora por tipo de humedal de acuerdo con clasificación paisajística Humedales Esturianos y Bosques Inundados Salados (manglares)". El proceso de delimitación del manglar deberá necesariamente comprender las áreas que se hallen deterioradas o en proceso de recuperación. Además, en el ámbito de su competencia, el Área de Conservación respectiva, deberá ejecutar las medidas necesarias para fomentar dicha recuperación.

16.-Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente al ecosistema de estero-manglar del sector entre Playa Matapalo y Estero Esterón, distrito 02° Savegre, cantón 06º Quepos, provincia 06° Puntarenas.

17.-Que la delimitación de la zona pública de la ZMT entre el Playa Matapalo Estero Esterón corresponde al ecosistema de estero-manglar ubicado en el cantón de Quepos, se realizó de conformidad a lo indicado por la Sala Constitucional según Resolución N° 2021002741 de las 09:15 horas del 12 de febrero de 2021, la cual ordenó al Área de Conservación Pacífico Central (ACOPAC) y al Instituto Geográfico Nacional (IGN) que: "de manera conjunta y coordinada realicen las actuaciones correspondientes para que, delimiten el ecosistema de manglar de la zona de Quepos." 18.-Que mediante oficio DIG-GDF-0187-2023 del 19 diciembre 2023 elaborado por el Subproceso Topografía del Departamento Geodesia y Topografía del IGN, se emitió el Informe topográfico del levantamiento para la delimitación del ecosistema de manglar en el cantón de Quepos, en el sector entre Playa Matapalo y Estero Esterón, trabajo realizado en conjunto con el Área de Conservación Pacífico Central.

19.-Que mediante CARTA-SINAC-ACOPAC-DR-0646-2025 del 02 setiembre de 2025 de firmado por el licenciado Álvaro Conejo Arias, Director a.i. de la Oficina Regional del Área de Conservación Pacífico Central hace entrega del Informe Técnico de la delimitación del ecosistema de estero-manglar realizada en campo SINAC-ACOPAC-PNMA-RBS-TT-030-2024 del 20 de junio de 2024, denominado "Informe parcial de visitas de campo para constatación de indicios y condiciones de ecosistemas estuarinos (manglar-estero) observado mediante la fotointerpretación de imágenes aéreas del año 1949-2005".

20.-Que mediante correo electrónico de las 09:55 am del 22 diciembre de 2025, el señor Joel García Medina, del Enlace Programa de Humedales de la Oficina del Área de Conservación Pacífico Central, hace entrega del informe de delimitación del ecosistema de estero-manglar INF-SINAC-ACOPACPNMA-RBS-TT-070-2025 del 22 de diciembre de 2025, titulado Acuerdo de Verificación de campo de ecosistemas de manglar y estero identificado en el informe SINAC-ACOPAC-PNMA-RBS-TT-0302024, el sector de Playa Linda en la secuencia de mojones M702 al M531 y sector Esterón M569 M562, dicho acuerdo tomado en la reunión del 24 de octubre de 2025, al cual se le otorga visto bueno.

21.-De conformidad al INF-SINAC-ACOPAC-PNMA-RBS-TT-070-2025 del 22 de diciembre de 2025, se realizó la verificación en campo de los elementos que forman parte del ecosistema de manglar, y se constató la presencia de vegetación hidrófila, en sectores donde la demarcación con mojones no llega a cubrir los hallazgos encontrados, así como, la revisión de la certificación de Patrimonio Natural del Estado ACOPAC-D-PNE-ZMT-CERT.002-2011 del 22 de septiembre de 2011 por lo que, el informe recomienda la eliminación de mojones.

22.-Que mediante el oficio DIG-GDF-039-2026 del 18 de febrero de 2026, generado por el Subproceso Topografía del Departamento Geodesia y Geofísica del IGN, se remitió a la Dirección del IGN, el Informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública DIG-GDF-006-2026-PU-INF del 28 de enero del 2026, en relación con los trabajos realizados por la el ACOPAC, relativos a la delimitación de un sector de ecosistema estero-manglar entre Playa Matapalo y Estero Esterón, avalando técnicamente la delimitación realizada para su publicación.

23.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública del 02 de mayo de 1978 y sus reformas, señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 240 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos." COMUNICA:

1. 1Que, durante las semanas del 04 al 08 de diciembre y 11 al 15 de diciembre de 2023, se realizó el trabajo de campo conjunto entre el IGN y ACOPAC para delimitar el ecosistema de esteromanglar perteneciente a la zona pública entre Playa Matapalo y Estero Esterón, distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas.

2º-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública del sector entre Playa Matapalo y Estero Esterón, que forma parte del ecosistema de estero-manglar ubicado en el distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y la metodología usada y validada por el ACOPAC

1. 3Que la zona pública delimitada corresponde al ecosistema de estero-manglar perteneciente a la zona pública entre Playa Matapalo y Estero Esterón, en el distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas en conformidad a los oficios DIG-GDF-039-2026 de fecha 18 de febrero de 2026, generado por el Subproceso Topografía del Departamento Geodesia y Geofísica del IGN y los oficios SINAC-ACOPAC-PNMA-RBS-TT-030-2024 de fecha 20 de junio de 2024 y INF-SINAC-ACOPAC-PNMA-RBS-TT-070-2025 del 22 de diciembre de 2025, ambos emitidos por ACOPAC.

4º-Con esta delimitación quedan eliminados los mojones número M719, M720 y M721, publicados en el Aviso N° 2008- 07, página 6 del Diario Oficial La Gaceta N° 204 del 22 de octubre de 2008, y los mojones del M565 al M569 publicados en el Aviso N° 03-43, página 14 del Diario Oficial La Gaceta N° 230 del 28 de noviembre de 2003.

1. 5Que la zona pública de la Zona Marítimo Terrestre concerniente al sector del ecosistema de estero-manglar ubicado en el distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas, verificado y delimitado por el Área de Conservación Pacífico Central, corresponde al polígono determinado con sus coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05 y su actualización con respecto al sistema de referencia horizontal de CR05 a CR-SIRGAS CRTM05, siguientes:

6º-Los sectores ubicados en el en el distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas que a la fecha cuentan con delimitación de la zona pública de la ZMT a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

7º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de en el distrito 02º Savegre, cantón 06º Quepos, provincia 06º Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: Zona Pública Líneas Digitales. Publicar.

8º-Rige a partir de su publicación.
