Decreto Ejecutivo 45077 Amendment to Decreto Ejecutivo N° 6112 "Crea Zonas Protectoras" —You are viewing the latest version of this regulation— Go to the latest version Version of the Regulation: 1 of 1 N° 45077-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In the exercise of the powers granted to them by Articles 50, 140 subsections 3) and 18), and 146 of the Political Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; Articles 32, 33, 35, 36, and 37 of the Organic Law of the Environment No. 7554 of October 4, 1995; Articles 2 and 13 of the Ley Forestal N° 7575 of February 13, 1996; Articles 1, 22, 58, and 60 of the Biodiversity Law No. 7788 of April 30, 1998; Article 70 of the Regulations to the Biodiversity Law, Decreto Ejecutivo N° 34433-MINAE of March 11, 2008; and Decreto Ejecutivo Nº 6112-A of June 23, 1976, Crea Zonas Protectoras.
I.Article 22 of the Biodiversity Law No. 7788 provides that SINAC is a decentralized and participatory system of institutional management and coordination that integrates competencies in the areas of forestry, wildlife, and protected wild areas (áreas silvestres protegidas).
II.Article 58 of the Biodiversity Law No. 7788 establishes that: "(...) protected wild areas are delimited geographic zones consisting of land, wetlands, and portions of sea. They have been declared as such because they represent special significance for their ecosystems, the existence of threatened species, their impact on reproduction and other needs, and their historical and cultural significance. These areas shall be dedicated to conserving and protecting biodiversity, soil, water resources (recurso hídrico), cultural resources, and ecosystem services in general. (...) During the process of meeting the requirements to establish state protected wild areas, the relevant technical reports must include the appropriate recommendations and justifications to determine the most suitable management category (categoría de manejo) to which the proposed area should be subject..."
III.The Regulations to the Biodiversity Law, Decreto Ejecutivo N° 34433-MINAE of March 11, 2008, in Article 70 subsection b), defines, within the management categories of protected wild areas, Protective Zones (Zonas Protectoras) as: "Geographic areas formed by forests or land with forest potential, whose primary objective is to regulate the hydrological regime and to protect the soil and watersheds (cuencas hidrográficas)."
IV.That by means of Decreto Ejecutivo Nº 6112-A of June 23, 1976, the Cerro de la Carpintera Protective Zone was created
V.That Decreto Ejecutivo N° 29278-MINAE of January 15, 2001, proceeded to modify the original boundaries of the Cerro de la Carpintera Protective Zone, reducing the protected wild area in some zones and expanding it in other sectors.
VI.That a constitutional challenge (Acción de Inconstitucionalidad) was filed under case file number 14-005836-007-CO against Decreto Ejecutivo N° 29278-MINAE of January 15, 2001, on the grounds of Article 38 of the Organic Law of the Environment No. 7554, for having effected a reduction of the State's natural heritage (patrimonio natural del Estado) without complying with the requirements established by that provision.
VII.That by means of Resolution No. 201916793 of September 4, 2019, the Constitutional Chamber (Sala Constitucional) partially sustained the constitutional challenge and annulled the reduction of the area of the Cerro de la Carpintera Protective Zone carried out by Decreto Ejecutivo N° 29278-MINAE, leaving that Decree in force solely with respect to the expansion of the Cerro de la Carpintera Protective Zone. As a result of the foregoing, SINAC was ordered to proceed with the delimitation of the aforementioned expanded area.
VIII.That in response to that resolution, by means of official memorandum SINAC-ACC-PNE-129-2020 of July 20, 2020, the boundary modification of the Cerros de la Carpintera Protective Zone was transmitted, in accordance with the provisions of Resolution No. 201916793-2019 of the Constitutional Chamber.
IX.That the Regional Council of the Central Conservation Area, by means of official memorandum SINACCORAC-ACC-of-004-2022 of May 6, 2022, communicated that at Ordinary Session No. 003-2022 it was agreed to approve the information presented regarding the modifications to be made to the boundaries of the Carpintera Protective Zone, as ordered by Resolution 201916793 of September 4, 2019, of the Constitutional Chamber.
X.That the National Council of Conservation Areas, by means of official memorandum No. SINACCONAC-SA-135-06-2022 of June 20, 2022, at Extraordinary Session No. 14-2022, held on June 29, 2022, by means of Agreement No. 6, resolved: "To request that the Executive Director of SINAC submit this executive decree proposal for the modification of the boundaries of the Cerros de la Carpintera Protective Zone to the Legal Directorate of MINAE for subsequent transmission to the Department of Laws and Decrees of Casa Presidencial, in follow-up to Resolution No. 16793-2019 of the Constitutional Chamber."
XI.That in accordance with Article 12 bis of Decreto Ejecutivo Nº 37045-MP-MEIC of February 22, 2012, and its amendments, "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos," the first step has been completed: Section I, designated the Prior Regulatory Improvement Control, which forms part of the Cost-Benefit Assessment form; all responses given in that Section were negative, given that the present proposal does not contain any procedures or requirements that the regulated party must fulfill.

Decreto Ejecutivo 45077 Reforma Decreto Ejecutivo N° 6112 "Crea Zonas Protectoras" Ir a la última versión Versión de la Norma: 1 de 1 N° 45077 -MINAE EL PRESIDENTE DE LA REPUBLICA Y EL MINISTRO DEL AMBIENTE Y ENERGIA En el ejercicio de las facultades que les confieren los artículos 50, 140 incisos 3) y 18) y 146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública Nº 6227 del 2 de mayo de 1978; artículos 32, 33,35,36 y 37 de la Ley Orgánica del Ambiente Nº 7554 del 04 de octubre de 1995; artículos 2, y 13 de la Ley Forestal N° 7575 del 13 de febrero 1996; artículos 1, 22, 58 y 60 de la Ley de Biodiversidad N° 7788 del 30 de abril de 1998; artículo 70 del Reglamento a la Ley de Biodiversidad, el Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008, el Decreto Ejecutivo Nº 6112-A del 23 de junio de 1976, Crea Zonas Protectoras.
I.Que el artículo 22 de la Ley de Biodiversidad N° 7788, dispone que el Sistema Nacional de Áreas de Conservación (SINAC) es un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre y Áreas Silvestres Protegidas.
II.Que el artículo 58 de la Ley de Biodiversidad N° 7788, establece que: "(...) las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar. Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural. Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general. (...) Durante el proceso de cumplimiento de requisitos para establecer áreas silvestres protegidas estatales, los informes técnicos respectivos deberán incluir las recomendaciones y justificaciones pertinentes para determinar la categoría de manejo más apropiada a que el área propuesta debe someterse..."
III.Que el Reglamento a la Ley de Biodiversidad, Decreto Ejecutivo N° 34433-MINAE del 11 de marzo del 2008, en su artículo 70 inciso b), define dentro de las categorías de manejo de Áreas Silvestres Protegidas, a las Zonas Protectoras como: "Áreas geográficas formadas por los bosques o terrenos de aptitud forestal, en que el objetivo principal sea la regulación del régimen hidrológico, la protección del suelo y de las cuencas hidrográficas."
IV.Que mediante Decreto Ejecutivo Nº 6112-A del 23 de junio de 1976, se creó la Zona Protectora Cerro de la Carpintera
V.Que el Decreto Ejecutivo N° 29278-MINAE del 15 de enero de 2001, procedió a modificar los límites originales de la Zona Protectora Cerro de la Carpintera disminuyendo dicha área silvestre protegida en algunas zonas y aumentando su área en otros sectores.
VI.Que se planteó una Acción de Inconstitucionalidad expediente número 14-005836-007- CO en contra del Decreto Ejecutivo N° 29278-MINAE del 15 de enero del 2001, con sustento en el artículo 38 de la Ley Orgánica del Ambiente N° 7554 por haber operado una reducción de patrimonio natural del Estado sin cumplir con los requisitos dispuestos por dicho numeral.
VII.Que mediante Resolución N° 201916793 del 4 de setiembre de 2019, la Sala Constitucional declara parcialmente con lugar la Acción de Inconstitucionalidad interpuesta y anula la reducción del área de la Zona Protectora Cerro de la Carpintera, realizada mediante el Decreto Ejecutivo N° 29278-MINAE, quedando este Decreto vigente únicamente en lo que se refiere a la ampliación de la Zona Protectora Cerro de la Carpintera. En virtud de lo anterior, se ordena al Sistema Nacional de Áreas de Conservación proceder a delimitar el área ampliada mencionada.
VIII.Que en atención a dicha resolución, mediante oficio SINAC-ACC-PNE-129-2020 del 20 de julio 2020, se da traslado de modificación de límites de la Zona Protectora Cerros de la Carpintera, de conformidad con lo estipulado en la resolución N° 201916793-2019 de la Sala Constitucional.
IX.Que el Consejo Regional del Área de Conservación Central, mediante oficio SINACCORAC-ACC-of-004-2022 del 06 de mayo 2022 comunica que en Sesión Ordinaria N°003-2022, se acuerda aprobar la información presentada, de las modificaciones que se deben realizar en los límites de la Zona Protectora de la Carpintera, según lo ordenado en la resolución 201916793 del 4 de setiembre de 2019 de la Sala Constitucional.
X.Que el Consejo Nacional de Áreas de Conservación, mediante el oficio N° SINACCONAC-SA-135-06-2022 del 20 de junio de 2022, en la Sesión Extraordinaria N°14-2022, celebrada el 29 de junio del 2022, mediante Acuerdo No. 6 dispone: "Solicitar al Director Ejecutivo del SINAC, elevar esta propuesta de decreto ejecutivo para la modificación de límites de la Zona Protectora Cerros de la Carpintera a la Dirección Jurídica del MINAE y posterior envío al Departamento de Leyes y Decretos de Casa Presidencial, en seguimiento a la resolución de la Sala Constitucional N°16793- 2019".
XI.Que de conformidad con el artículo 12 bis del Decreto Ejecutivo Nº 37045-MP-MEIC del 22 de febrero de 2012 y sus reformas "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos" se ha completado como primer paso la Sección I denominada Control Previo de Mejora Regulatoria, que conforma el formulario de Evaluación Costo Beneficio y las respuestas brindadas en esa Sección han sido todas negativas, toda vez que la presente propuesta no contiene trámites ni requisitos que el administrado deba cumplir.
