The purpose of these regulations is to establish the rules governing the proper use, conservation, and protection of the green areas, infrastructure, urban furniture, and natural elements that make up the Jorge Debravo Municipal Public Recreational Park, located in the canton of Turrialba, situated in the Urbanización Jorge De Bravo, adjacent to the senior citizens' home.

The Jorge Debravo Municipal Public Recreational Park constitutes a municipal public domain asset, intended for leisure, recreation, physical, civic, and cultural activities, and community coexistence. Its use is subject to the general interest and the protection of the environment.

These regulations are mandatory for all persons who enter or make use of the park, whether visitors, residents, organizations, merchants, or other actors.

It is the responsibility of the Mayor's Office to directly administer the public parks and to ensure their maintenance and conservation, while the Municipal Council shall be responsible for granting authorizations to natural or legal persons who request their use, with the exception of emergency cases as detailed in these Regulations.

In the event of exceptional circumstances, such as a duly verified emergency or extreme urgency, the Mayor's Office may authorize the use of the park, dispensing with the authorization of the Municipal Council. In this case, the Mayor's Office must inform the Municipal Council, at the next ordinary session, about the use of the park.

The Local Government may designate commissions, administrative units, or officials responsible for control and surveillance.

Hours, entry, and general use

The park shall be open to the public. Only the basketball court is subject to hours, its use being permitted until 11 p.m. Outside of these hours, access is restricted unless expressly authorized by the municipality.

Entry to the park shall be free and open. No charges may be established for access, except in the case of special events duly authorized by the Municipal Council.

The use of the park must be compatible with the principles of community coexistence, civic-cultural activities, respect for the environment, public safety, and conservation of the common good. Any action that threatens public order, health, or the general interest is prohibited.

Duties and prohibitions

Every user must:

• a)Use the infrastructure, furniture, green areas, and recreational zones responsibly.
• b)Keep the place clean and deposit waste in the appropriate containers.
• c)Respect the vegetation, trees, gardens, and wildlife.
• d)Maintain respectful conduct towards other users.
• e)Supervise minors under their responsibility.
• f)Comply with the instructions of municipal or police authorities.
• g)Bring to the attention of the competent authorities any act contrary to the law, morals, or good customs.

The following is prohibited in the park:

• a)Causing damage, painting, scratching, or modifying the infrastructure or green areas.
• b)Consuming alcoholic beverages, drugs, smoking, or vaping in unauthorized spaces.
• c)Carrying out activities that generate excessive or disturbing noise, according to the decibels established by the Ministry of Health.
• d)Sleeping or staying overnight inside the park without authorization.
• e)Circulating with motor vehicles inside the park.
• f)Lighting bonfires or cooking in non-designated areas.
• g)Abandoning pets or failing to pick up their waste.

Special activities and commerce

Any activity that involves the exclusive use of spaces, the gathering of people, or the installation of equipment, training, or rehearsals must be requested in advance in writing to the Municipal Council, which shall authorize it based on availability, impact, and safety.

Any for-profit activity within the park must have a municipal permit in accordance with patent regulations and the public property regime. Informal commerce without authorization is prohibited.

Surveillance, control, and sanctions

Inter-institutional coordination for the application of the regulations.

The municipal administration, in coordination with the Municipal Police and the Public Force, shall have the authority and responsibility to enforce the provisions established in these regulations. These authorities may carry out inspections, interventions, warnings, or evictions when the rules contained herein are violated, ensuring public order, citizen security, and the protection of the communal property.

Persons who violate these regulations may be sanctioned with:

• a)Verbal warning.
• b)Immediate removal from the park.
• c)Fines in accordance with the sanctioning regime of the Código Municipal or other related regulations.
• d)Report to the competent authorities in case of damage to public property or criminal acts.

Anyone who causes material damage to park property must assume the cost of repair, replacement, or restoration, according to the value determined by the Municipality, without prejudice to other civil or criminal liabilities.

The Municipality is released from all civil, criminal, administrative, and any other kind of liability for accidents or damages caused to third parties from the use of the park during the activities to be carried out.

Final provisions

It takes effect upon its second publication in the Official Gazette La Gaceta. In accordance with the provisions of Article 43 of the Código Municipal, these regulations are considered for external use and are therefore subject to a non-binding public consultation for a period of ten business days.

El presente reglamento tiene como finalidad establecer las normas que regulan el uso adecuado, la conservación y la protección de las áreas verdes, infraestructura, mobiliario urbano y elementos naturales que conforman el Parque Público Municipal Recreativo Jorge Debravo, ubicado en el cantón de Turrialba, ubicado en la Urbanización Jorge De Bravo, anexo a la casa del adulto mayor.

El Parque Público Municipal Recreativo Jorge Debravo constituye un bien de dominio público municipal, destinado al esparcimiento, la recreación, la actividad física, cívicas, culturales y la convivencia ciudadana. Su uso se encuentra sujeto al interés general y a la protección del ambiente.

Este reglamento es de aplicación obligatoria para todas las personas que ingresen o hagan uso del parque, ya sean visitantes, residentes, organizaciones, comerciantes u otros actores.

Corresponde a la Alcaldía Municipal administrar directamente los parques públicos, velar por su mantenimiento y conservación, mientras el Concejo Municipal será el encargado de otorgar las autorizaciones a personas físicas o jurídicas que soliciten su uso, con la excepción de los casos de emergencia que se detallarán en este Reglamento.

Ante hechos excepcionales, tales como emergencia o extrema urgencia debidamente comprobada, la Alcaldía Municipal podrá autorizar el uso del parque, dispensando de la autorización del Concejo Municipal. En este caso, deberá informar la Alcaldía al Concejo Municipal, en la sesión ordinaria siguiente, sobre el uso del parque.

El Gobierno Local podrá designar comisiones, unidades administrativas o funcionarios responsables del control y vigilancia.

Horario, ingreso y uso general

El parque estará abierto al público. Únicamente está sujeta a horario, la cancha de basketball, cuyo horario de uso será hasta las 11 p.m. Fuera de este horario, el acceso se encuentra restringido salvo autorización municipal

El ingreso al parque será libre y gratuito. No se podrá establecer cobros por el acceso, salvo en el caso de eventos especiales debidamente autorizados por el Concejo Municipal.

El uso del parque debe ser compatible con los principios de convivencia ciudadana, actividades cívico-culturales, respeto al medio ambiente, seguridad pública y conservación del bien común. Se prohíbe toda acción que atente contra el orden público, salud o el interés general.

Deberes y prohibiciones

Toda persona usuaria deberá:

• a)Utilizar de forma responsable la infraestructura, mobiliario, áreas verdes y zonas recreativas.
• b)Conservar la limpieza del lugar y depositar los residuos en los recipientes adecuados.
• c)Respetar la vegetación, los árboles, jardines y vida silvestre.
• d)Mantener una conducta respetuosa hacia los demás usuarios.
• e)Supervisar a los menores de edad bajo su responsabilidad.
• f)Cumplir las instrucciones de las autoridades municipales o policiales.
• g)Hacer de conocimiento de las autoridades competentes cualquier acto contrario a la ley, moral o buenas costumbres.

Queda prohibido en el parque:

• a)Causar daños, pintar, rayar o modificar la infraestructura o áreas verdes.
• b)Consumir bebidas alcohólicas, drogas, fumar o vapear en espacios no autorizados.
• c)Realizar actividades que generen ruidos excesivos o perturbadores, según los decibeles establecidos por el Ministerio de Salud.
• d)Dormir o pernoctar dentro del parque sin autorización.
• e)Circular con vehículos motorizados dentro del parque.
• f)Encender fogatas o cocinar en zonas no habilitadas.
• g)Abandonar mascotas o no recoger sus desechos.

Actividades especiales y comercio

Cualquier actividad que implique uso exclusivo de espacios, aglomeración de personas o instalación de equipos, entrenamientos o ensayos, deberá ser solicitada previamente mediante escrito al Concejo Municipal, el cual autorizará según disponibilidad, impacto y seguridad.

Toda actividad con fines de lucro dentro del parque deberá contar con permiso municipal conforme a la normativa de patentes y el régimen de bienes públicos. Se prohíbe el comercio informal sin autorización.

Vigilancia, control y sanciones

Coordinación interinstitucional para la aplicación del reglamento.

La administración municipal, en coordinación con la Policía Municipal y la Fuerza Pública, tendrá la potestad y responsabilidad de hacer cumplir las disposiciones establecidas en el presente reglamento. Estas autoridades podrán realizar inspecciones, intervenciones, amonestaciones o desalojos cuando se infrinjan las normas aquí contenidas, velando por el orden público, la seguridad ciudadana y la protección del bien comunal.

Las personas que infrinjan este reglamento podrán ser sancionadas con:

• a)Amonestación verbal.
• b)Retiro inmediato del parque.
• c)Multas conforme al régimen sancionador del Código Municipal u otra normativa conexa.
• d)Denuncia ante las autoridades competentes en caso de daños a propiedad pública o actos delictivos.

Quien cause daño material a bienes del parque deberá asumir el costo de reparación, reposición o restauración, según el valor determinado por la Municipalidad, sin perjuicio de otras responsabilidades civiles o penales.

La Municipalidad se libera de toda responsabilidad civil, penal, administrativa y de cualquier otra índole, por accidentes o afectaciones que se generen a terceros por el uso del parque durante las actividades a desarrollar.

Rige a partir de su segunda publicación en el Diario Oficial La Gaceta. Conforme a lo establecido en el artículo 43 del Código Municipal, este reglamento es considerado de uso externo, por lo que se somete a consulta pública no vinculante por un plazo de diez días hábiles.
