in the entirety of the text - Full Text of Standard 45492 Repeals Standard RTCR 321:1998 Registration and Examination of Equipment for the Application of Chemical, Biological, Biochemical Substances or Similar to Any of the Foregoing for Agricultural Use N° 45492-MAG-MEIC THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK, AND THE MINISTRESS OF ECONOMY, INDUSTRY AND COMMERCE Pursuant to the powers and authorities conferred in Articles 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 27, subsection 1) and 28, subsection 2), subparagraph b) of the General Law of Public Administration, N° 6227 of May 2, 1978; Articles 2, subsection e), 5, subsections d) and o), and related articles of the Plant Protection Law, N° 7664 of April 8, 1997; Article 35, subsection a) of the Law for the Promotion of Agricultural Production FODEA and Organic Law of the Ministry of Agriculture and Livestock (MAG), N° 7064 of April 29, 1987.
I.-That, with the growing commercial exchange, due to the opening of markets among countries, the possibilities for imports of application equipment have increased and therefore the respective regulations are required to guarantee the quality standards of the equipment.
II.-That pursuant to the provisions of Article 23 of the Plant Protection Law, N° 7664 of April 8, 1997, it is an essential function of the State Phytosanitary Service (SFE) to regulate the use and handling of equipment for application in agriculture, as well as its registration, importation, quality, and residues, while seeking to protect human health and the environment, establishing the phytosanitary requirements and the necessary controls for imports of equipment samples.
III.-That Executive Decree N° 27037-MAG-MEIC of January 5, 1998, named, Standard RTCR 321:1998 Registration and Examination of Equipment for the Application of Chemical, Biological, Biochemical Substances or Similar to Any of the Foregoing for Agricultural Use, Regulation, published in Supplement N° 59A to the Official Gazette La Gaceta N° 174 of September 7, 1998; has been tacitly repealed by Executive Decree N° 45244-MAG of September 30, 2025, published in Supplement N° 137 to the Official Gazette La Gaceta N° 200 of October 24, 2025, therefore it is necessary to carry out its express repeal in order to avoid legal confusion in its application.
IV.-That pursuant to Article 65 of Executive Decree N° 44908-MEIC of January 21, 2025, Regulation to Chapters I and II, Section I of Chapter V of the Law of the National System for Quality, by means of official letter CARTA-MAG-DM-1221-2025 of December 2, 2025, the Technical Secretariat of the National Council for Technical Regulation (ST-Conart) was notified of the present Decree prior to its signing, the Technical Secretariat responding by means of official letter CARTA-MEIC-STCONART-0024-2025 of December 11, 2025, in which they acknowledged receipt of the notification of said repeal proposal, without including recommendations in this regard.
V.-That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of February 22, 2012; the present Decree does not create or modify procedures, requirements, or formalities, therefore it does not require the Regulatory Improvement Process. Therefore, They Decree:
REPEAL OF EXECUTIVE DECREE N° 27037-MAG-MEIC OF JANUARY 5, 1998, STANDARD RTCR 321:1998 REGISTRATION AND EXAMINATION OF EQUIPMENT FOR THE APPLICATION OF CHEMICAL, BIOLOGICAL, BIOCHEMICAL SUBSTANCES OR SIMILAR TO ANY OF THE FOREGOING FOR AGRICULTURAL USE.

Regulation, which was published in Supplement N° 59a to the Official Gazette La Gaceta N° 174 of September 7, 1998, is repealed.

en la totalidad del texto - Texto Completo Norma 45492 Deroga Norma RTCR 321:1998 Registro y Examinación de Equipos de Aplicación de Sustancias Químicas, Biológicas, Bioquímicas o Afines a cualquiera de los anteriores de uso agrícola N° 45492-MAG-MEIC EL PRESIDENTE DE LA REPÚBLICA, EL MINISTRO DE AGRICULTURA Y GANADERÍA, Y LA MINISTRA DE ECONOMÍA, INDUSTRIA Y COMERCIO Con fundamento en las atribuciones y facultades conferidas en los artículos 140, incisos 3) y 18), y 146 de la Constitución Política; los artículos 27, inciso 1) y 28 inciso 2), acápite b) de la Ley General de la Administración Pública, N° 6227 del 2 de mayo de 1978; los artículos 2° inciso e), 5°, incisos d) y o), concordantes de la Ley de Protección Fitosanitaria, N° 7664 del 8 de abril de 1997; artículo 35, inciso a) de la Ley de Fomento a la Producción Agropecuaria FODEA y Orgánica del Ministerio de Agricultura y Ganadería (MAG), N° 7064 del 29 de 1987.
I.-Que, con el creciente intercambio comercial, por la apertura de mercados entre los países, las posibilidades de importaciones de equipos de aplicación se han incrementado y por ende se requiere de las respectivas regulaciones para garantizar los estándares de calidad del equipo.
II.-Que conforme a lo dispuesto en el artículo 23 la Ley de Protección Fitosanitaria, N° 7664 del 08 de abril de 1997, es función esencial del Servicio Fitosanitario del Estado (SFE) regular el uso y manejo de equipos para aplicar en la agricultura, así mismo su registro, importación, calidad y residuos, procurando al mismo tiempo proteger la salud humana y el ambiente, estableciendo los requisitos fitosanitarios y los controles necesarios a las importaciones de muestras de equipos.
III.-Que el Decreto Ejecutivo N° 27037-MAG-MEIC del 05 de enero de 1998, denominado, Norma RTCR 321:1998 Registro y Examinación de Equipos de Aplicación de Sustancias Químicas, Biológicas, Bioquímicas o Afines a cualquiera de los anteriores de uso agrícola, Reglamento, publicado en el Alcance N° 59A del Diario Oficial La Gaceta N° 174 del 07 de setiembre de 1998; ha sido tácitamente derogado por el Decreto Ejecutivo N° 45244-MAG del 30 de setiembre del 2025, publicado en el Alcance N° 137 del Diario Oficial La Gaceta N° 200 del 24 de octubre de 2025, por lo que es necesario realizar su derogación expresa a fin de evitar la confusión jurídica en su aplicación.
IV.-Que conforme al artículo 65 del Decreto Ejecutivo N° 44908-MEIC del 21 de enero de 2025, Reglamento a los Capítulos I y II, Sección I del Capítulo V de la Ley del Sistema Nacional para la Calidad, mediante oficio CARTA-MAG-DM-1221-2025 de 02 de diciembre de 2025, se notificó a la Secretaria Técnica del Consejo Nacional de Reglamentación Técnica (ST-Conart) el presente Decreto previo a su firma, dando respuesta la Secretaria Técnica mediante el oficio CARTA-MEIC-STCONART-0024-2025 de 11 de diciembre de 2025, en el cual acusaron el recibido de la notificación de dicha propuesta de derogatoria, sin contemplar recomendaciones al respecto.
V.-Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto,
DEROGATORIA DEL DECRETO EJECUTIVO N° 27037-MAG-MEIC DEL 05 DE ENERO DE 1998, NORMA RTCR 321:1998 REGISTRO Y EXAMINACIÓN DE EQUIPOS DE APLICACIÓN DE SUSTANCIAS QUÍMICAS, BIOLÓGICAS, BIOQUÍMICAS O AFINES A CUALQUIERA DE LOS ANTERIORES DE USO AGRÍCOLA.
