1That the National Animal Health Service (Servicio Nacional de Salud Animal, SENASA), pursuant to the provisions of articles 6 and 8 of Law Nº 8495 of April 6, 2006, is a minimally deconcentrated body of the Ministry of Agriculture and Livestock, which has instrumental legal personality and has within its powers to administer, plan, direct and take pertinent measures throughout the country to fulfill its services, programs and campaigns in matters of prevention, control and eradication of pests and diseases of animals; to control and guarantee the health of domestic, aquatic, wild or other animals of different species, as well as the safety of products, by-products and derivatives for human or animal consumption, and to establish sanitary controls in all slaughter plants, processes and industrialization of said products.
2That through article 1 of Decree Nº 44394-MAG of February 6, 2024, called "Implementation of Official or Officially Recognized Inspection Personnel by SENASA in Animal Slaughter Establishments; Other Control Measures in Establishments for Products of Animal Origin", it was established that, for sanitary control purposes, all animal slaughter establishments must have an official or officially recognized veterinary doctor by SENASA.
3That article 8 of the aforementioned Decree Nº 44394-MAG provided that said regulation would take effect as of December 1, 2024.
4That for various operational reasons, it has not been possible to achieve the implementation of the official or officially recognized veterinary doctor by SENASA in all obligated establishments, and it is therefore convenient to grant an extended period that allows compliance with said sanitary obligation.
5That, in accordance with the second and third paragraphs of article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree Nº 37045-MP-MEIC of February 22, 2012; this Decree does not create or modify procedures, requirements or formalities, and therefore does not require the Regulatory Improvement procedure. Therefore,
THEY DECREE:

1Que el Servicio Nacional de Salud Animal (SENASA), conforme a lo dispuesto en los artículos 6 y 8 de la Ley Nº 8495 del 06 de abril del 2006, es un órgano de desconcentración mínima del Ministerio de Agricultura y Ganadería, el cual cuenta con personalidad jurídica instrumental y tiene dentro de sus competencias administrar, planificar, dirigir y tomar medidas pertinentes en todo el país para cumplir con sus servicios, programas y campañas en materias de prevención, control y erradicación de plagas y enfermedades de los animales; controlar y garantizar la salud de los animales domésticos, acuáticos, silvestres u otros de las diferentes especies, así como la inocuidad de los productos, subproductos y derivados para consumo humano o animal, así como establecer controles sanitarios en todas las plantas de sacrificio, procesos e industrialización de dichos productos.
2Que mediante artículo 1 del Decreto Nº 44394-MAG del 06 de febrero del 2024, denominado "Implementación del personal inspector oficial u oficializado por el SENASA en establecimientos de sacrificios de animales; otras medidas de control en establecimientos de productos de origen animal" , se estableció que, para efectos de control sanitario, todos los establecimientos de sacrificio de animales deberán contar con un médico veterinario oficial u oficializado por el SENASA.
3Que el artículo 8 del Decreto Nº 44394-MAG antes referido dispuso que dicha normativa empezaría a regir a partir del 01 de diciembre de 2024.
4Que por diversas razones de carácter operativo no ha sido posible lograr la implementación del médico veterinario oficial u oficializado por el SENASA en todos los establecimientos obligados, por lo que resulta conveniente conceder un plazo extendido que p ermita el cumplimiento de dicha obligación de carácter sanitario.
5Que, de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica trámites, requisitos o procedimientos, por lo que no requiere del trámite de Mejora Regulatoria. Por tanto,
