in the entirety of the text - Complete Text of Norm 45478 Repeals Regulation for the Operation and Marketing of Live Cattle at Auction and Issuance of the Veterinary Operation Certificate No. 45478 MAG-MEIC-SP THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK, THE MINISTRESS OF ECONOMY, INDUSTRY AND TRADE, AND THE MINISTER OF PUBLIC SECURITY Pursuant to the powers conferred by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25 and 27 subsection 1), and 28 subsection 2), subparagraph b) of Law No. 6227, General Public Administration Law of May 2, 1978; Law No. 8495 of April 6, 2006, General Law of the National Animal Health Service, and articles 2, 5, 6 and 9, of Law No. 8799 of April 17, 2010 and its amendments, Law for the Control of Bovine Livestock, Prevention and Punishment of Its Theft, Larceny and Receiving Stolen Property.
I.—That, in accordance with the Political Constitution, the Executive Branch has the power to regulate laws, as well as to repeal those decrees that for various reasons of legality or convenience or timeliness have become obsolete.
II.—That, the National Animal Health Service (SENASA) has the purpose of conserving, promoting, protecting and restoring animal health in order to ensure greater well-being and productivity in harmony with the environment and is therefore authorized to issue veterinary or sanitary measures for the control of the safety and wholesomeness of products and by-products of animal origin, in the stages of capture, production, industrialization and marketing.
III.—That, Executive Decree No. 34976-MAG-MEIC-SP of July 21, 2008, "Regulation for the Operation and Marketing of Live Cattle at Auction and Issuance of the Veterinary Operation Certificate", of July 21, 2008 published in the Official Gazette La Gaceta No. 21 of January 30, 2009; has been tacitly repealed by Executive Decree No. 45285-MAG of September 25, 2025, and it is therefore necessary to carry out its express repeal in order to avoid legal confusion in its application.
IV.—That, in accordance with the second and third paragraphs of article 12 of the Regulation to the Law for the Protection of the Citizen from Excessive Regulatory Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements or formalities, and therefore does not require the regulatory improvement process. Therefore, THEY DECREE:

en la totalidad del texto - Texto Completo Norma 45478 Deroga Reglamento para el Funcionamiento y Comercialización de Ganado en Pie en Subasta y Otorgamiento del Certificado Veterinario de Operación N° 45478 MAG-MEIC-SP EL PRESIDENTE DE LA REPÚBLICA, EL MINISTRO DE AGRICULTURA Y GANADERÍA, LA MINISTRA DE ECONOMÍA, INDUSTRIA Y COMERCIO, Y EL MINISTRO DE SEGURIDAD PÚBLICA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18), y 146 de la Constitución Política; los artículos 25 y 27 inciso 1), y 28 inciso 2), acápite b) de la Ley N° 6227, Ley General de la Administración Pública del 2 de mayo de 1978; la Ley N° 8495 del 06 de abril del 2006, Ley General del Servicio Nacional de Salud Animal, y los artículos 2°, 5°, 6° y 9°, de la Ley N° 8799 del 17 de abril del 2010 y sus reformas, Ley de Control de Ganado Bovino, Prevención y Sanción de su Robo, Hurto y Receptación.
I.-Que, de conformidad con la Constitución Política, el Poder Ejecutivo tiene la potestad de reglamentar las leyes, así como de derogar aquellos decretos que por diferentes razones de legalidad o conveniencia u oportunidad han perdido vigencia.
II.-Que, el Servicio Nacional de Salud Animal (SENASA) tiene por objeto conservar, promover, proteger y restablecer la salud de los animales a fin de procurar mayor bienestar y productividad en armonía con el medio ambiente y por ello está habilitado para dictar medidas veterinarias o sanitarias sobre el control de la seguridad e inocuidad de los productos y subproductos de origen animal, en las etapas de captura, producción, industrialización y comercialización.
III.-Que, el Decreto Ejecutivo N° 34976-MAG-MEIC-SP del 21 de julio de 2008, "Reglamento para el Funcionamiento y Comercialización de Ganado en Pie en Subasta y Otorgamiento del Certificado Veterinario de Operación", del 21 de julio del 2008 publicado en el Diario Oficial La Gaceta N° 21 del 30 de enero de 2009; ha sido tácitamente derogado por el Decreto Ejecutivo N° 45285-MAG del 25 de setiembre del 2025, por lo que es necesario realizar su derogación expresa a f in de evitar confusión jurídica en su aplicación.
IV.-Que, de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045- MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos, por lo que no requiere del trámite de mejora regulatoria. Por tanto,
