a. Major tender: this procedure shall be applied under the procedural and substantive rules defined by the law, the Public Procurement Regulation, and this regulation, it being reiterated that the department requesting the good or service shall be responsible for defining the technical conditions of the statement of conditions (pliego de condiciones), admissibility requirements, evaluation elements, the delivery period, and, in general, any technical aspect related to the contractual object. Once the technical, financial, and legal aspects are included in the statement of conditions, the institutional procurement department shall assume direction of the procurement process, in coordination with the pertinent administrative units. At the bid reception stage, after their opening, the sealed proposals (plicas) will be transferred to the Management and Legal Advisory Directorate for review of the legal aspects and to the requesting or specialized unit to determine the defects or clarifications related to the technical aspects of the bids. This analysis must be carried out within a maximum period of three business days. Once this procedure is completed, the procurement department shall group the defects noted by the Financial Management Directorate, the Management and Legal Advisory Directorate, and the requesting unit, and shall issue a single prevention order within a reasonable period that may not exceed ten business days for the bidders to correct or clarify their bid. After the bid corrections, they shall be transferred to the department that requested the good, service, or public works for it to perform the technical evaluation and price reasonableness analysis, within a maximum period of five business days. Subsequently, within a maximum period of two business days, the procurement department shall determine which bids are eligible. The corresponding technical unit or the requesting department shall be responsible for applying the weighted bid scoring system, which shall be carried out within a maximum period of three business days. The procurement department, in accordance with the studies issued and the bid evaluation, shall prepare a recommendation for a final act in an official transfer note, accompanied by the indication of the procurement file (expediente) number to refer the matter to the Municipal Council, for its cognizance and issuance of the final act within a maximum period of ten business days. The award agreement shall be communicated by the Council's secretariat to the procurement department via the unified digital system, so that the Procurement Department may proceed immediately to notify the final act to the bidders.
b Minor tender: it shall proceed in accordance with the thresholds established in article 36 of the Law of Public Procurement and the resolution adjusting thresholds issued by the Comptroller General of the Republic (Contraloría General de la República, CGR) and, for its processing, the procedure indicated by the Regulation to the Law of Public Procurement (RLCP) shall be followed, with the department requesting the good, service, or works being responsible for defining the technical specifications of the statement of conditions (pliego de condiciones), admissibility requirements, evaluation elements, the delivery period, and, in general, any technical aspect related to the contractual object. This procedure shall also apply to procurement under the delivery-on-demand modality, provided that a consumption limit for the procurement is established that does not exceed the minor tender threshold. Once the technical and legal aspects are included in the statement of conditions, the institutional procurement department shall assume direction of the procurement process, in coordination with the pertinent administrative units. At the bid reception stage, after opening, the sealed proposals (plicas) will be immediately transferred to the Management and Legal Advisory Directorate for review of the legal aspects and to the requesting or specialized unit to determine if prevention orders must be issued for formal aspects or if clarifications must be requested from the bidders. This analysis must be carried out within a maximum period of three business days. Once this procedure is completed, the procurement department shall group the defects noted by the legal advisory and the requesting unit, and shall issue a single prevention order within a period of up to five business days for the bidders to correct or clarify their bid. After the corrections, the bids shall be transferred to the department that requested the good, service, or works for it to perform the technical evaluation and the price reasonableness analysis, within a maximum period of three business days. Subsequently, within a maximum period of two business days, the procurement department shall determine which bids are eligible. The corresponding technical unit or the requesting department shall be responsible for applying the weighted bid scoring system, which shall be carried out within a maximum period of two business days. The procurement department, in accordance with the bid evaluation and the technical and legal criteria, shall prepare a recommendation for a final act to refer to the Interdisciplinary Public Procurement Commission, for the issuance of the final act, which must be issued within a maximum period of five business days. The final act agreement shall be included in the Sicop platform, so that the Procurement Department may proceed immediately to notify the final act to the bidders.
c Reduced tender: it shall proceed in accordance with the thresholds established in article 36 of the LCP and the resolution adjusting thresholds issued by the CGR, and for its processing, the procedure indicated by the LCP, the RLCP, and this regulation shall be followed. This procedure shall also apply to procurement under the delivery-on-demand modality, provided that a consumption limit for the procurement is established that does not exceed the reduced tender threshold, as provided in article 28 of this regulation. In this type of procurement, the department requiring the good/service or the specialized unit must, in the first instance, review the bids and determine if there are defects or clarifications related to the technical aspects that must be corrected. Once the procurement department has sent the corresponding correction requests and the period to respond to said prevention orders expires, the bids shall be sent to the requesting unit for the technical analysis, and it shall issue an opinion within a maximum period of three business days, likewise, it shall perform the bid evaluation within a maximum period of two business days. The procurement department shall, within a maximum period of one business day, forward the recommendation to the Municipal Mayor for the purpose of issuing the final act. The final act must be issued within a maximum period of three business days.
d. Exception procedures. This procedure shall be applied under the procedural and substantive rules defined by the law, the Public Procurement Regulation, and this regulation. In this type of procurement, the department requiring the good/service or the specialized unit must review the bids and, when applicable, inform the Procurement Department if there are defects or clarifications related to the technical aspects that must be corrected. Once the procurement department has sent the corresponding correction requests and the period to respond to said prevention orders expires, the bids shall be sent to the requesting unit for the technical analysis of the bid and the evaluation of price reasonableness, and it shall issue an opinion within a maximum period of one business day. The procurement department shall, within a maximum period of one business day, forward the recommendation to the Municipal Mayor or Municipal Council, as applicable, for the purpose of issuing the final act. The final act must be issued within a maximum period of two business days; this term shall apply in the case of procurement that is not awarded by the Municipal Council. When the award is issued by the Municipal Council, the period shall be 10 business days.
