Regulation for the Use of the Commission for FNA Credit Management PERMANENT COMMISSION OF SELF-MANAGEMENT COOPERATIVES NATIONAL SELF-MANAGEMENT FUND REGULATION FOR THE USE OF THE COMMISSION FOR FNA CREDIT MANAGEMENT

1º—The Permanent Commission of Self-Management Cooperatives, hereinafter CPCA, is the entity that represents and promotes self-management cooperativism in Costa Rica, as established in article 140 of Law 4179.

2º—The Permanent Commission of Self-Management Cooperatives (CPCA) is an organization that supports and provides various services to the self-management cooperatives of Costa Rica, in addition to defining the administration and operation policies (subsection b, article 140, Law 4179) of the National Self-Management Fund (FNA), with which credits are granted to cooperatives, under favorable conditions for their development.

3º—The National Fund for Self-Management Guarantees and Sureties, hereinafter FONAGA, is a guarantee fund created to facilitate access to financing and promote the inclusion of self-management cooperatives.

4º—Through article 142 of Law No. 4179 and its amendments, the FNA is created to finance the activities inherent to the development of self-management cooperatives.

5º—Article 15, subsection a), of Law No. 8292, General Internal Control Law, provides, in relation to control activities, that the duties of the head and subsidiary officers shall include, among others, the following: documenting, keeping updated, and internally disseminating the policies, standards, and control procedures that guarantee compliance with the institutional internal control system and the prevention of any aspect that may divert the objectives and goals set by the institution in the performance of its functions.

6º—Regulations constitute a component of the control system that govern responsibilities, activities, and the application of policies for the orderly execution of the different operations carried out in an organization during the budget process. They are a fundamental factor for the achievement of institutional objectives, insofar as they establish a regulatory framework and internal criteria that guarantee the entity’s control.

7º—In accordance with article 1 of the Operating Regulation of the Permanent Commission of Self-Management Cooperatives, the Plenary is responsible for approving the regulations for its operation.

8º—The plenary of the Permanent Commission of Self-Management Cooperatives, in its capacity as the highest head of the CPCA, issues this regulation that governs and guides matters related to the use of resources from the commission charged for credit management in the FNA.

Reglamento para el uso de la Comisión por la gestión de crédito del FNA COMISIÓN PERMANENTE DE COOPERATIVAS DE AUTOGESTIÓN FONDO NACIONAL DE AUTOGESTIÓN REGLAMENTO PARA EL USO DE LA COMISIÓN POR LA GESTIÓN DE CRÉDITO DEL FNA

1º-La Comisión Permanente de Cooperativas de Autogestión, en adelante CPCA, es el ente que representa y promueve el cooperativismo autogestionario en Costa Rica, según lo establece el artículo 140 de la Ley 4179.

2º-La Comisión Permanente de Cooperativas de Autogestión (CPCA), es una organización que apoya y brinda diferentes servicios a las cooperativas autogestionarias de Costa Rica, además de definir las políticas de administración y funcionamiento (inciso b, artículo 140, Ley 4179) del Fondo Nacional de Autogestión (FNA), con el que se brindan créditos a las cooperativas, con condiciones favorables para su desarrollo.

3º-El Fondo Nacional de Avales y Garantías de Autogestión, en adelante FONAGA, es un fondo de avales creado para facilitar el acceso al financiamiento y promover la inclusión de las cooperativas de autogestión.

4º-Mediante el artículo 142 de la Ley N° 4179 y sus reformas, se crea el FNA, para financiar las actividades propias del desarrollo de las cooperativas de autogestión.

5º-El artículo 15, inciso a), de la Ley N° 8292, Ley General de Control Interno, se dispone, en relación con las actividades de control, que serán deberes del jerarca y de los titulares subordinados, entre otros, las siguientes: documentar, mantener actualizados y divulgar internamente, las políticas, las normas y los procedimientos de control que garanticen el cumplimiento del sistema de control interno institucional y la prevención de todo aspecto que conlleve a desviar los objetivos y las metas trazados por la institución en el desempeño de sus funciones.

6º-Los reglamentos constituyen un componente del sistema de control que, norman las responsabilidades, actividades y la aplicación de las políticas, para la ejecución ordenada de las distintas operaciones que se realizan en una organización en el desarrollo del proceso presupuestario. Son un factor fundamental para la consecución de los objetivos institucionales, en el tanto se establece un marco normativo y los criterios internos que garanticen el control de la entidad.

7º-De conformidad con el artículo 1 del Reglamento de Funcionamiento de la Comisión Permanente de Cooperativas de Autogestión, le compete al Plenario aprobar los reglamentos para su funcionamiento.

8º-El plenario de la Comisión Permanente de Cooperativas de Autogestión, en su condición de Jerarca máximo de la CPCA, emite el presente reglamento que regula y orienta lo relativo al uso de los recursos por la comisión que se cobra por la gestión de créditos en el FNA.
