Considerandos:

article 140 of Law 4179.

4179 and its amendments, the FNA is created to finance the activities inherent to the development of self-management cooperatives.

8292, General Internal Control Law, provides, in relation to control activities, that the duties of the head and subsidiary officers shall include, among others, the following: documenting, keeping updated, and internally disseminating the policies, standards, and control procedures that guarantee compliance with the institutional internal control system and the prevention of any aspect that may divert the objectives and goals set by the institution in the performance of its functions.

They are a fundamental factor for the achievement of institutional objectives, insofar as they establish a regulatory framework and internal criteria that guarantee the entity’s control.

Artículo 1 — The Permanent Commission of Self-Management Cooperatives, hereinafter CPCA, is the entity that represents and promotes self-management cooperativism in Costa Rica, as established in

Artículo 7 — In accordance with article 1 of the Operating Regulation of the Permanent Commission of Self-Management Cooperatives, the Plenary is responsible for approving the regulations for its operation.

Artículo 8 — The plenary of the Permanent Commission of Self-Management Cooperatives, in its capacity as the highest head of the CPCA, issues this regulation that governs and guides matters related to the use of resources from the commission charged for credit management in the FNA.

Artículo 2 — —Scope of Application: This regulation establishes the applicable rules for the administration of the resources from the percentage of the commission for FNA credit management that are transferred to the CPCA.

Artículo 4 — —Definitions and Abbreviations: Credit management commissions: Refers to the payment made by Self-Management cooperatives to the CPCA for the services rendered in managing a credit with the FNA.

Artículo 5 — —Responsible Party: Responsibility for the approval and distribution of resources shall be in charge of the executive management (dirección ejecutiva), which shall oversee the correct use of resources adjusted to the internal control parameters stipulated in this regulation.

Artículo 6 — —A commission established in article 45 of the general credit regulation of the CPCA shall be charged for each new credit operation approved by the Credit Commission of the National Self-Management Fund.

Artículo 8 — —The commission shall be charged at the same time as the credit disbursement, through an automatic deduction (rebajo) from the amount to be disbursed and only once for each new operation generated.

Artículo 9 — —For each commission charge, a proof of payment must be provided to the cooperative, detailing the deducted amount and the credit operation number to which the respective deduction (rebajo) corresponds.

Artículo 10 — —The amounts received from this commission shall be recorded in an accounting account separate from other CPCA income.

Artículo 11 — —The Executive Management (Dirección Ejecutiva) must annually present to the Board of Directors of the CPCA a detailed budget at the beginning of the period and an annual settlement of the use of commission resources on credits granted during the period.

Artículo 12 — —The executive director shall be responsible for duly monitoring compliance with the provisions defined in this regulation.

Artículo 13 — —Amendments to this regulation shall be resolved by the plenary of the CPCA by a vote of two-thirds of its members.

Artículo 14 — —It shall take effect upon its publication in the official gazette La Gaceta.

Artículo 1 — La Comisión Permanente de Cooperativas de Autogestión, en adelante CPCA, es el ente que representa y promueve el cooperativismo autogestionario en Costa Rica, según lo establece el artículo 140 de la Ley 4179.

Artículo 3 — El Fondo Nacional de Avales y Garantías de Autogestión, en adelante FONAGA, es un fondo de avales creado para facilitar el acceso al financiamiento y promover la inclusión de las cooperativas de autogestión.

Artículo 4 — Mediante el artículo 142 de la Ley N° 4179 y sus reformas, se crea el FNA, para financiar las actividades propias del desarrollo de las cooperativas de autogestión.

Artículo 7 — De conformidad con el artículo 1 del Reglamento de Funcionamiento de la Comisión Permanente de Cooperativas de Autogestión, le compete al Plenario aprobar los reglamentos para su funcionamiento.

Artículo 8 — El plenario de la Comisión Permanente de Cooperativas de Autogestión, en su condición de Jerarca máximo de la CPCA, emite el presente reglamento que regula y orienta lo relativo al uso de los recursos por la comisión que se cobra por la gestión de créditos en el FNA.

Artículo 2 — Ámbito de aplicación: Este reglamento establece las normas aplicables para la administración de los recursos del porcentaje por la comisión por gestión de crédito del FNA que son trasladados a la CPCA.

Artículo 4 — Definiciones y abreviaturas: Comisiones por gestión del crédito: Corresponde al pago que realizan las cooperativas Autogestionarias a la CPCA, por los servicios realizados en la gestión de un crédito con el FNA.

Artículo 5 — Responsable: La responsabilidad de la aprobación y distribución de los recursos estará a cargo de la dirección ejecutiva, la cual fiscalizará la correcta utilización de los recursos ajustados a los parámetros de control interno estipulados en el presente reglamento.

Artículo 6 — Se cobrará una comisión establecida en el artículo 45 del reglamento general de crédito de la CPCA, por cada nueva operación de crédito aprobado por la Comisión de Crédito del Fondo Nacional de Autogestión.

Artículo 8 — La comisión se cobrará en el mismo acto del desembolso del crédito, mediante rebajo automático del monto a desembolsar y por una única vez por cada nueva operación generada.

Artículo 9 — De cada cobro de comisión deberá entregarse a la cooperativa un comprobante de pago, en donde se detalle el monto rebajado y el número de operación de crédito a que corresponde el respectivo rebajo.

Artículo 10 — Los montos recibidos producto de esta comisión serán registrados en una cuenta contable separada de los otros ingresos de la CPCA.

Artículo 11 — La Dirección Ejecutiva deberá presentar anualmente al Directorio de la CPCA, un presupuesto detallado a inicio del periodo y liquidación anual del uso de los recursos de la comisión sobre los créditos otorgados en el período.

Artículo 12 — El director ejecutivo, será el responsable de dar el debido seguimiento al cumplimiento de las disposiciones definidas en el presente reglamento.

Artículo 13 — Las reformas del presente reglamento serán resueltas por el plenario de la CPCA por votación de dos tercios de sus miembros.

Artículo 14 — Rige a partir de su publicación en el diario oficial La Gaceta.
