The purpose of this law is to promote and foster marine and coastal education within the national community. In particular, efforts shall be made to enhance awareness and learning at the levels of preschool education, basic general education, diversified education, higher education, and in the non-formal sphere, respecting the autonomy and competencies established in the Political Constitution and other regulations related to the educational sphere.

The application of the provisions of this law, regarding the definition of content and study programs, is subject to the exclusive approval of the Higher Education Council (Consejo Superior de Educación, CSE), for formal education, and to the university autonomy recognized in the Political Constitution, as well as to the regulations and competencies of the corresponding institutions.

For the purposes of this law, marine-coastal education is understood as the set of formative processes and actions aimed at:

• a)Increasing knowledge about marine-coastal environments, biodiversity, with special emphasis on endemic species, the ecosystems that comprise them, and the ecological processes encompassing this subject at the local, national, and global levels.
• b)Forming criteria and responsible behaviors for the understanding and conservation of marine-coastal ecosystems, as well as the importance of the environmental services (servicios ambientales) they provide.
• c)Developing multiplying agents of knowledge and the protection of marine-coastal ecosystems and their ecosystem services.
• d)Promoting conservation practices and sustainable management of marine-coastal resources within the socioeconomic activities carried out in coastal communities.
• e)Studying and disseminating the impacts of the problems of climate change, plastic pollution, and biodiversity loss, including the decline and disappearance of endangered species, as well as the factors contributing to their threat, in marine-coastal spaces, and promoting prevention and mitigation actions to address these problems.
• f)Understanding the importance of marine spatial planning as a tool for planning and appropriate use of activities carried out in the territorial sea and the exclusive economic zone.

Declare June 8 as World Oceans Day, as a day of national interest. It is urged that this date be incorporated into the calendar of school activities and that spaces for reflection and awareness on marine-coastal education be promoted, within the framework of freedom and autonomy corresponding to the Higher Education Council (CSE) and each educational center.

Likewise, higher education institutions, municipalities, and civil society organizations are empowered so that, within the scope of their autonomy and competencies, they carry out commemorative activities that reinforce the protection and conservation of marine-coastal resources.

The Department of Health and Environmental Education, of the Ministry of Public Education (Ministerio de Educación Pública, MEP), shall be responsible for the creation of the Marine-Coastal Education Program. Once completed, said program shall be submitted to the Higher Education Council (CSE) for its eventual approval or rejection.

During the process of formulation, design, and validation of the National Marine-Coastal Education Program, the active participation of higher education institutions, both public and private, must be guaranteed, recognizing their fundamental role in the generation of knowledge, specialized pedagogy, and educational innovation on marine-coastal topics.

Said program shall have the following functions:

• a)Promote the incorporation of marine-coastal education into curricular actions and the national curriculum of the Costa Rican educational system in the formal sphere, in adherence to the regulations, functions, and educational policies of the Higher Education Council (CSE) in its capacity as the governing body of Costa Rican education.
• b)Promote, in coordination with the competent bodies of higher education, such as the National Council of Rectors (Consejo Nacional de Rectores, Conare) and the National Council of Private University Higher Education (Consejo Nacional de Enseñanza Superior Universitaria Privada, Conesup), the incorporation of marine-coastal education content into their academic programs, respecting their autonomy and specific regulations.
• c)Contribute to the marine-coastal education of the population, through training aimed at the knowledge, valuation, protection, conservation, and responsible and sustainable use of marine-coastal ecosystems with social and ethical responsibility, in favor of a sustainable development of these resources in the country.
• d)Strengthen a social, scientific, and technological culture for the integral and sustainable development of the marine-coastal communities of Costa Rica, through the articulation and promotion of innovative marine-coastal research projects.
• e)Promote social, scientific, and technological research in marine-coastal education, as well as the training of specialists, in coordination with higher education institutions and relevant research centers.
• f)Disseminate information and educational practices on marine biodiversity and its surrounding ecosystems, the conservation of marine wealth, the state of the country's marine-coastal zone, the importance of implementing responsible marine-coastal ecotourism, and sustainable aquaculture and fishing.
• g)Have a permanently updated marine-coastal virtual platform to facilitate consultations and the exchange of information through the network.
• h)Foster spaces for citizen participation for the analysis and search for comprehensive solutions to the marine-coastal problems of our country.
• i)Establish alliances with civil organizations whose area of action includes the marine-coastal zone and international marine education societies to achieve the established objectives.
• j)Develop program monitoring indicators and conduct periodic evaluations on the results.

The program shall receive, annually, sufficient budget for its timely execution. Said budget shall come from the resources that constitutionally must be allocated to education.

The Marine-Coastal Literacy Program is empowered to receive donations (in cash, services, or materials), both from the public sector (Executive Branch, state enterprises, autonomous or semi-autonomous institutions) and from the private sector, national or international, for the exclusive purpose of executing said program.

It shall take effect upon its publication.

La presente ley tiene por objeto promover y fomentar la educación marina y costera en la comunidad nacional. En particular, se procurará potenciar la sensibilización y el aprendizaje en los niveles de educación preescolar, educación general básica, educación diversificada, educación superior y en el ámbito no formal, respetando la autonomía y las competencias establecidas en la Constitución Política y demás normativa relacionada con el ámbito educativo.

La aplicación de las disposiciones de esta ley, en lo que refiere a la definición de contenidos y programas de estudio, está supeditada a la aprobación exclusiva del Consejo Superior de Educación (CSE), para la educación formal, y a la autonomía universitaria reconocida en la Constitución Política, así como a las regulaciones y competencias de las instituciones correspondientes.

A los efectos de la presente ley, se entiende por educación marino-costera el conjunto de procesos y acciones formativas destinadas a:

• a)Incrementar el conocimiento sobre los ambientes marino-costeros, la biodiversidad, con especial énfasis en las especies endémicas, los ecosistemas que los integran y los procesos ecológicos que engloban esta temática a nivel local, nacional y global.
• b)Formar criterio y conductas responsables para la comprensión, conservación de los ecosistemas marino-costeros, así como la importancia de los servicios ambientales que estos ofrecen.
• c)Desarrollar agentes multiplicadores del conocimiento y la protección de los ecosistemas marino-costeros y sus servicios ecosistémicos.
• d)Promover prácticas de conservación y manejo sostenible de los recursos marino-costeros, dentro de las actividades socioeconómicas que se realicen en las comunidades costeras.
• e)Estudiar y difundir los impactos de las problemáticas de cambio climático, contaminación por plástico y pérdida de biodiversidad, incluyendo la disminución y desaparición de especies en peligro, así como los factores que contribuyen a su amenaza, en los espacios marino-costeros, así como promover las acciones de prevención y mitigación frente a estas problemáticas.
• f)Comprender la importancia del ordenamiento espacial marino, como herramienta de planificación y uso adecuado de las actividades que se realizan en el mar territorial y la zona económica exclusiva.

Declárese el 8 de junio como Día Mundial de los Océanos, como un día de interés nacional. Se insta a que esta fecha se incorpore en el calendario de actividades escolares y se promuevan espacios de reflexión y sensibilización sobre la educación marino-costera, en el marco de la libertad y autonomía que corresponde al Consejo Superior de Educación (CSE) y a cada centro educativo.

Asimismo, se faculta a las instituciones de educación superior, a las municipalidades y a las organizaciones de la sociedad civil para que, en el ámbito de su autonomía y competencias, realicen actividades conmemorativas que refuercen la protección y conservación de los recursos marino-costeros.

El Departamento de Educación en Salud y Ambiente, del Ministerio de Educación Pública (MEP), tendrá a su cargo la creación del Programa de Educación Marino-Costera. Una vez finalizado, dicho programa será remitido al Consejo Superior de Educación (CSE) para su eventual aprobación o improbación.

Durante el proceso de formulación, diseño y validación del Programa Nacional de Educación Marino-Costera se deberá garantizar la participación activa de las instituciones de educación superior, tanto públicas como privadas, reconociendo su rol fundamental en la generación de conocimiento, pedagogía especializada e innovación educativa en temas marino-costeros.

Dicho programa deberá contar con las siguientes funciones:

• a)Impulsar la incorporación de la educación marino-costera en las acciones curriculares y en el currículo nacional del sistema educativo costarricense en el ámbito formal, en apego a la normativa, funciones y políticas educativas del Consejo Superior de Educación (CSE) en su calidad de órgano rector de la educación costarricense.
• b)Promover, en coordinación con los entes competentes de la educación superior, como el Consejo Nacional de Rectores (Conare) y el Consejo Nacional de Enseñanza Superior Universitaria Privada (Conesup), la incorporación de contenidos de educación marino-costera en sus programas académicos, respetando su autonomía y normativa específica.
• c)Contribuir con la educación marino-costera de la población, mediante la capacitación dirigida al conocimiento, valoración, protección, conservación y aprovechamiento responsable y sostenible de los ecosistemas marino-costeros con responsabilidad social y ética, a favor de un desarrollo sostenible de estos recursos en el país.
• d)Fortalecer una cultura social, científica y tecnológica para el desarrollo integral y sostenible de las comunidades marino-costeras de Costa Rica, mediante la articulación y promoción de proyectos innovadores de investigación marinocosteros.
• e)Impulsar la investigación social, científica y tecnológica en materia de educación marino-costera, así como la formación de especialistas, en coordinación con las instituciones de educación superior y centros de investigación pertinentes.
• f)Difundir la información y prácticas educativas sobre la biodiversidad marina y sus ecosistemas aledaños, la conservación de la riqueza marina, el estado de la zona marino-costera del país, la importancia de la implementación del ecoturismo marino-costero responsable y la acuicultura y pesca sostenible.
• g)Contar con una plataforma virtual marino-costera permanentemente actualizada, para favorecer la realización de consultas y el intercambio de información a través de la red.
• h)Fomentar espacios de participación ciudadana, para el análisis y la búsqueda de soluciones integrales a las problemáticas marino-costeras de nuestro país.
• i)Establecer alianzas con las organizaciones civiles cuya área de acción contemple la zona marino-costera y sociedades internacionales de educación marina, para el logro de los objetivos establecidos.
• j)Desarrollar indicadores de seguimiento del programa y realizar evaluaciones periódicas sobre el resultado.

El programa deberá recibir, anualmente, presupuesto suficiente para su oportuna ejecución. Dicho presupuesto será proveniente de los recursos que constitucionalmente se deben destinar a educación.

Se faculta al Programa de Alfabetización Marino-Costera para que reciba donaciones (en efectivo, servicios u materiales), tanto del sector público (Poder Ejecutivo, empresas estatales, instituciones autónomas o semiautónomas) como del sector privado, nacionales o internacionales, con el fin exclusivo de la ejecución de dicho programa.
