within the entire text - Complete Text of Regulation 45316 Creates the Lorne Ross Ashley Urban Natural Park N° 45316-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by Articles 50, 140 subsections 3) and 18) and Article 146 of the Political Constitution; Articles 25 subsection 1, 27 subsection 1 and 28 subsection 2) paragraph b) of the General Public Administration Law Nº 6227 of May 2, 1978, the Convention on Nature Protection and Wild Life Preservation in the Western Hemisphere, approved by Law N° 3763 of October 19, 1966; the Convention on Biological Diversity and Annexes I and II signed on June 13, 1992, in Rio de Janeiro, Brazil, approved by Law Nº 7416 of June 30, 1994; the Organic Environmental Law Nº 7554 of October 4, 1995; the Biodiversity Law Nº 7788 of April 30, 1998; Law N° 1542 of March 7, 1953, Assignment of the National Museum and Bolívar Park to Ministries; the Convention on the Conservation of Migratory Species of Wild Animals, approved by Law Nº 8586 of March 21, 2007, Article 3 subsection 4, Executive Decree N° 34433-MINAE, Regulation to the Biodiversity Law of March 11, 2008, Executive Decree N°42742-MINAE of February 24, 2021, Creation and Regulation of the management category called Urban Natural Parks (Parques Naturales Urbanos, PANU), and of a National Program for its promotion and implementation, Executive Decree N°37747-MINAE, Regulation to Law N° 7369, Transfer of Administration of the Bolívar Park and Santa Ana Zoos of May 7, 2013.

CONSIDERING:

Likewise, Article 89 includes among the cultural purposes of the Republic, protecting natural beauties and conserving and developing the historical and artistic heritage.

Likewise, Article 58 of the Biodiversity Law Nº 7788 defines protected wilderness areas as: ".delimited geographical zones, constituted by lands, wetlands, and portions of sea. They have been declared as such for representing special significance due to their ecosystems, the existence of threatened species, the impact on reproduction and other needs, and for their historical and cultural significance. These areas will be dedicated to conservation and protecting biodiversity, the soil, water resources, cultural resources, and ecosystem services in general.".

In accordance with the above, Articles 71 and 72 of the Regulation to the Biodiversity Law, Executive Decree Nº 34433-MINAE of March 11, 2008, establish that, for the declaration, modification, or change of management category of Protected Wilderness Areas, a technical report must be prepared, which will be coordinated by the respective instance of SINAC, as well as the content of said report, respectively.

Lorne Ross Ashley to the Costa Rican State in 1975, and the rest of the property was subsequently acquired in 1976, which is under the administration of the Ministry of Environment and Energy with farm numbers 1-252970-000, 1-252976-000, and 1-252978-000.

They will be sites that promote the relationship of the human being and their natural environment, under a modern concept of wildlife conservation and integration of the different elements of biodiversity with a cultural and environmental education focus towards the community, in which the Criteria of Environmental Public Interest and Integration will be applied.

These sites will contribute to the formation of the public on the conservation and protection of wildlife, the natural and cultural-historical heritage, and, in general, of biodiversity".

Likewise, Articles 1, 2, and 3 of Executive Decree N°42742-MINAE of February 24, 2021, Creation and Regulation of the Management Category called Urban Natural Parks (PANU), and of a National Program for its promotion and implementation, define the general aspects governing this new management model.

This generates diverse and key habitats for representative species of these regions, among these species typical of dry forest or transition areas. Currently, almost 30% of the bird species inhabiting the natural refuge fall within this category."

b)Promote the ecological rehabilitation of the site, with native species and those of the corresponding life zone, as well as those that best adapt to the environmental conditions of the site and to climate crisis scenarios. c) Mitigate the threats faced by the focal management elements of the Lorne Ross Ashley Urban Natural Park. d) Regulate and promote ecotourism and historical-architectural tourism through responsible visitation that allows the urban population, resident and visitor, to enjoy the ecosystem services it offers. e) Promote inter-institutional coordination for better environmental, social, and economic management of the Lorne Ross Ashley Urban Natural Park. f) Promote awareness and education programs on the importance of preserving natural resources in urban environments. g) Promote the participation of communities and municipalities in the use and conservation of urban natural resources. h) Serve as a site for observation, gathering, and study of Costa Rican flora and wildlife. i) Provide citizens with safe spaces for coexistence, leisure, recreation, culture, and sports activities. j) Encourage artistic and cultural expressions through the establishment of alliances with cultural actors.

These management instruments must consider at all times the heritage status of the property, for which the Ministry of Culture, through the Heritage Office, will participate in its formulation and implementation process, through the coordination and governance spaces that are established.

For this, it will work on the formulation and implementation of local sustainable development strategies that involve the Lorne Ross Ashley Urban Natural Park, which will be financed with resources from the national parks stamp, in accordance with the provisions of Article 43 of the Biodiversity Law Nº. 7788. SINAC will establish the technical and coordination mechanisms necessary for the granting of contracts for essential services Nº and other forms of participation for the communities in the benefits of the protected wilderness area.

CONSIDERANDO:

Asimismo, el artículo 89 incluye entre los fines culturales de la República, proteger las bellezas naturales y conservar y desarrollar el patrimonio histórico y artístico.

Asimismo, el artículo 58 de la Ley de Biodiversidad Nº 7788, define áreas silvestres protegidas como: ".zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar. Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural. Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general.".

En concordancia con lo anterior, los artículos 71 y 72 del Reglamento a la Ley de Biodiversidad Decreto Ejecutivo Nº 34433-MINAE del 11 de marzo del 2008, establecen que, para la declaratoria, modificación o cambio de categoría de manejo de Áreas Silvestres Protegidas, deberá elaborarse un informe técnico, que estará coordinado por la instancia respectiva de SINAC, así como el contenido de dicho informe, respectivamente.

Serán sitios que promuevan la relación del ser humano y su entorno natural, bajo un concepto moderno de conservación de vida silvestre e integración de los diferentes elementos de la biodiversidad con un enfoque cultural y de educación ambiental hacia la comunidad, en los que se aplicarán los Criterios de Interés Público Ambiental y de Integración.

Estos sitios contribuirán a la formación del público sobre la conservación y protección de la vida silvestre, el patrimonio natural y cultural-histórico, y en general, de la biodiversidad".

Asimismo, los artículos 1, 2 y 3 el Decreto Ejecutivo N°42742-MINAE del 24 de febrero del 2021, Creación y Regulación de la Categoría de Manejo denominada Parques Naturales Urbanos (PANU), y de un Programa Nacional para su promoción e implementación, define los aspectos generales que rigen este nuevo modelo de gestión.

Esto genera hábitats diversos y clave para especies representativas de estas regiones, entre estas especies típicas de bosque seco o áreas de transición. Actualmente casi un 30% de las especies de aves que habitan el refugio natural se enmarcan en esta categoría."

b)Promover la rehabilitación ecológica del sitio, con especies nativas y de la zona de vida correspondiente, así como aquellas que mejor se adapten a las condiciones ambientales del sitio y a escenarios de crisis climática. c) Mitigar las amenazas que enfrentan los elementos focales de manejo del Parque Natural Urbano Lorne Ross Ashley. d) Regular y promover el ecoturismo y turismo histórico-arquitectónico por medio de una visitación responsable que permita a la población urbana, residente y visitante, el disfrute de los servicios ecosistémicos que ofrece. e) Promover la coordinación interinstitucional para una mejor gestión ambiental, social y económica del Parque Natural Urbano Lorne Ross Ashley. f) Impulsar programas de sensibilización y educación sobre la importancia de preservar los recursos naturales en entornos urbanos. g) Promover la participación de las comunidades y municipalidades en el uso y conservación de los recursos naturales urbanos. h) Servir de sitio de observación, reunión y estudio de la flora y la fauna silvestre costarricense. i) Proveer a la ciudadanía de espacios seguros de convivencia, esparcimiento, recreación, cultura y para las prácticas deportivas. j) Incentivar las expresiones artísticas y culturales mediante el establecimiento de alianzas con actores culturales.

Estos instrumentos de gestión deberán considerar en todo momento la condición patrimonial del inmueble, para lo cual el Ministerio de Cultura a través de la Oficina de Patrimonio, participarán en su proceso de formulación e implementación, por medio de los espacios de coordinación y gobernanza que se establezcan.

Para esto trabajará en la formulación e implementación de estrategias locales de desarrollo sostenible que involucren al Parque Natural Urbano Lorne Ross Ashley, que se financiarán con recursos provenientes del timbre de parques nacionales, conforme a lo establecido en el artículo 43 de la Ley de Biodiversidad Nº. 7788. El SINAC, establecerá los mecanismos técnicos y de coordinación necesarios para el otorgamiento de contratos de servicios Nº esenciales y otras formas de participación de las comunidades de los beneficios del área silvestre protegida.

Creation of the Lorne Ross Ashley Urban Natural ParkCrea el Parque Natural Urbano Lorne Ross Ashley

Artículo 2 — That Article 50 of the Political Constitution of the Republic of Costa Rica establishes the right to a healthy and ecologically balanced environment.

Artículo 9 — That the Centro de Conservación Santa Ana is constituted by farm number 1-252974-000, which was partly donated by Mr.

Artículo 1 — Declare a Protected Wilderness Area under the category and denomination "Lorne Ross Ashley Urban Natural Park", on the state-owned property occupied by plans SJ-893998-1990, SJ 280319-1995, and SJ-280318-1995 located in the Province: San José.

Artículo 3 — The National System of Conservation Areas may establish agreements and covenants with public and private counterparts to consolidate the governance model of the Lorne Ross Ashley Urban Natural Park, in accordance with current legislation.

Artículo 5 — The objectives that will guide the planning and management of the Lorne Ross Ashley Urban Natural Park are the following: a) Guarantee the conservation and sustainable use of the natural resources present on the site.

Artículo 6 — Within the Lorne Ross Ashley Urban Natural Park, activities may be authorized in accordance with its management category, the General Management Plan, and the Public Use Regulation (Reglamento de Uso Público) that is defined, in a participatory manner.

Artículo 8 — SINAC, through the Central Conservation Area, will have a predominant role in the management and sustainability of the protected wilderness area.

Transitorio I — The Central Conservation Area of SINAC must have the General Management Plan for the Lorne Ross Ashley Urban Natural Park, approved by CONAC within a period of twenty-four months from the publication of this decree.

Transitorio II — Once the General Management Plan for the Lorne Ross Ashley Urban Natural Park is made official in the Official Gazette La Gaceta, within a period of 6 months the Central Conservation Area of SINAC must establish the Tourism Plan for the Lorne Ross Ashley Urban Natural Park.

Artículo 10 — It shall come into effect upon its publication.

Artículo 2 — Que el artículo 50 de la Constitución Política de la República de Costa Rica, establece el derecho a un ambiente sano y ecológicamente equilibrado.

Artículo 1 — Declárese Área Silvestre Protegida bajo la categoría y denominación "Parque Natural Urbano- Lorne Ross Ashley", en el espacio propiedad estatal que ocupan los planos SJ-893998-1990, SJ 280319-1995 y SJ-280318-1995 ubicados en la Provincia: San José.

Artículo 3 — El Sistema Nacional de Áreas de Conservación podrá establecer acuerdos y convenios con contrapartes públicas y privadas, para consolidar el modelo de gobernanza del Parque Natural Urbano Lorne Ross Ashley, conforme a la legislación vigente.

Artículo 5 — Los objetivos que orientarán la planificación y gestión del Parque Natural Urbano Lorne Ross Ashley son los siguientes: a) Garantizar la conservación y uso sostenible de los recursos naturales presentes en el sitio.

Artículo 6 — Dentro del Parque Natural Urbano Lorne Ross Ashley podrán autorizarse actividades conforme a su categoría de manejo, al Plan General de Manejo y al Reglamento de Uso Público que se defina, de forma participativa.

Artículo 8 — El SINAC, a través del Área de Conservación Central tendrá un rol predominante en la gestión y sostenibilidad del área silvestre protegida.

Transitorio I — El Área de Conservación Central del SINAC, deberá contar con el Plan General de Manejo del Parque Natural Urbano Lorne Ross Ashley, aprobado por el CONAC en el plazo de veinticuatro meses, a partir de la publicación del presente decreto.

Transitorio II — Una vez oficializado en el Diario Oficial La Gaceta el Plan General de Manejo del Parque Natural Urbano Lorne Ross Ashley, en un plazo de 6 meses el Área de Conservación Central del SINAC, deberá establecer el Plan de Turismo del Parque Natural Urbano Lorne Ross Ashley.

Artículo 10 — Rige a partir de su publicación.
