Notice 22 Delimitation of the public zone (zona pública) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) corresponding to the mangrove (manglar) of Estero Cosechas, District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste Go to the latest version Regulation Version: 1 of 1 INSTITUTO GEOGRÁFICO NACIONAL GEODESY AND GEOPHYSICS DEPARTMENT NOTICE Nº 022-2025 MARITIME-TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE OF THE MARITIME-TERRESTRIAL ZONE CORRESPONDING TO THE MANGROVE OF ESTERO COSECHAS, DISTRICT 03° VEINTISIETE DE ABRIL, CANTON 03° SANTA CRUZ, PROVINCE 05° GUANACASTE Pursuant to the provisions of articles 140 and 240 of Law Nº6227, Ley General de la Administración Pública, dated May 2, 1978, and its amendments; Law Nº59, Law on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments; Law Nº8905, Amendment to Article 2 of Law N°5695, Creation of the Registro Nacional, and its amendments; and modification of Law N°59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments, dated December 7, 2010; Law N.º6043, Law on the Maritime-Terrestrial Zone, dated March 2, 1977, along with its corresponding regulations; and articles 2 and 3 of Law N.º5695, Law on the Creation of the Registro Nacional, dated May 28, 1975, and its amendments.

1.- By virtue of Law Nº8905, Amendment to Article 2 of Law N°5695, Creation of the Registro Nacional, and its amendments; and modification of Law N°59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments of December 7, 2010, the Instituto Geográfico Nacional, hereinafter IGN, was established as a division of the Registro Nacional, which shall execute the contracts and agreements necessary for the performance of its functions. Furthermore, in accordance with Law N°59, Law on the Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments, the IGN is "the scientific and technical governing body for national cartography, tasked with the execution of the official Base Map and the basic geographic description of the Republic of Costa Rica, as well as the studies, research, activities, and development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to those works, with the aim of supporting planning processes." 2.- Law N°59 establishes the IGN permanently and on behalf of the State as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, extending its authority to activities of any kind originating from the work entrusted to it.

3.- In accordance with article 62 of Executive Decree N°7841-P, Regulations to the Law on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments, the IGN's competence to delimit the public zone of the Maritime-Terrestrial Zone is recognized, as is its official publication in the Official Gazette La Gaceta; article 63 of Executive Decree N°7841-P states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each portion of the Maritime-Terrestrial Zone in which it has demarcated the public zone." 4.- Executive Decree N°36642-MP-MOPT-MINAET, Regulations on Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, establishes in article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may use one of two implementation methodologies, described in articles 19 and 20, corresponding to delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty to interested parties.

5.- Executive Decree N°33797-MJ-MOPT declares as the official horizontal datum (datum horizontal) for Costa Rica the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007, which, among other matters, designates the National Horizontal Reference Geodetic Network CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in the country must be referenced, specifying in article 11 that: "The National Horizontal Reference Geodetic Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all surveys and cartographic and geodetic activities carried out in the national territory by any public body, person, or national or foreign private entity must be referenced."; while article 7 indicates that "As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish through appropriate channels the information that has been made official." 6.- Executive Decree Nº40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018, declares in its article 1 that "The official horizontal geodetic reference system for Costa Rica, designated as CR05 and materialized through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and updates shall be governed by the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) known as SIRGAS-CON"; while article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official system for cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this baseline being defined in accordance with articles 5, 6 and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all marine jurisdictional areas of the Costa Rican State." Furthermore, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work in the continental territory of the country must be referenced, by stating that "The CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for jurisdictional marine and island areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out in the national territory by any public body, person, or national or foreign private entity undertaking or contracting geodetic and cartographic work must be referenced, thereby helping to avoid public expenditure and obtaining, moreover, reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State." 7.- By means of Directriz DIG-01-2025, Update of Public Zone Information of the Maritime-Terrestrial Zone with respect to the CR-SIRGAS Horizontal Reference System for the measurement epoch 2014.59, dated May 28, 2025, the information in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the IGN on the Maritime-Terrestrial Zone was updated, transitioning it from the CR05 horizontal reference system to the CR-SIRGAS horizontal reference system for the measurement epoch 2014.59, CRTM05 projection, as a delimitation mechanism for the Maritime-Terrestrial Zone.

8.- Georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime-Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing Coastal Land-Use Plans (Plan Regulador Costero, PRC), the survey plan endorsement (visado de planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning.

9.- The georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone held by the IGN is referred to as the Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime-Terrestrial Zone.

10.- The Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime-Terrestrial Zone is technically grounded in the application of the regulations established by: a) Executive Decree N°7841-P, Regulations to Law No. 6043 on the Maritime-Terrestrial Zone; b) Executive Decree N°33797-MJ-MOPT, declaring as the official horizontal datum for Costa Rica the CR05 and its associated cartographic projection CRTM05; c) Executive Decree N°36642-MP-MOPT-MINAET, Regulations on Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone; d) Executive Decree Nº40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica; e) Executive Decree N°42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland (humedal) Ecosystems; and f) Directriz DIG-01-2025, Update of Public Zone Information of the Maritime-Terrestrial Zone with respect to the CR-SIRGAS Horizontal Reference System for the measurement epoch 2014.59.

11.- Article 16 of Law N°7575, Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate in the field the boundaries of the areas forming part of the State Natural Heritage (Patrimonio Natural del Estado).

12.- Article 11 of Chapter I, General Provisions, of Law N°6043, Law on the Maritime-Terrestrial Zone, dated March 2, 1977, and its amendments, establishes that the "public zone also includes, regardless of its extent, all mangroves on the continental and island coastlines and estuaries (esteros) of the national territory." 13.- Executive Decree N°36786-MINAET, Manual for the Classification of Land Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, establishes among its objectives "To identify within the Maritime-Terrestrial Zone those lands that qualify as forests, forestry-suitable land (Class VII and VIII soils), wetlands (mangroves, estuaries, rias (rías), salt marshes (marismas), coastal lagoons, swamps, flooded forests (bosques anegados), salt flats (salitrales)), in order to certify them and incorporate them as part of the State Natural Heritage (PNE)." 14.- Executive Decree N°36786-MINAET, under Point III.—Competencies for Delimitation and Certification, establishes that "The classification of lands within the ZMT shall fall to the Conservation Areas (Áreas de Conservación, AC) of SINAC and to duly accredited private professionals registered with the respective Professional Associations, so that they may classify forests, forestry-suitable land (Class VII and VIII soils), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval of the AC with territorial jurisdiction. The Conservation Areas of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, inspection, boundary demarcation (deslinde), and certification of State Natural Heritage lands and protection zones.

The location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the process of approving the Coastal Land-Use Plan (PRC), as defined by Ley 6043, since the Coastal Land-Use Plan is the land-use planning instrument that defines and locates all areas to be granted under concession within the ZMT and for the classification thereof at the level of cadastral plans. Therefore, the Coastal Land-Use Plan must clearly and expressly indicate the PNE areas so that they are not counted as part of the total area available for concession." 15.- Article 14 of Executive Decree N°42760-MINAE, Technical Criteria for the Location, Identification, Classification, and Delimitation of Wetland Ecosystems, dated March 7, 2022, establishes that: "Supplementary technical considerations for mangroves. The respective Conservation Area, together with the Instituto Geográfico Nacional, shall verify in the field the existence of mangrove and proceed with its delimitation, in accordance with the competence of each institution as provided by the legal framework.

For the identification of a mangrove, the presence of trees of any of the species listed in Anexo I of this decree shall be taken as a parameter; likewise, the estuaries and channels existing within these ecosystems are included. The boundary is established up to where the vegetation associated with this ecosystem extends, in accordance with Anexo II of this decree. In addition to the foregoing, what is stated in Anexo III of this decree, entitled 'List of flora by wetland type according to landscape classification of Estuarine Wetlands and Flooded Salt Forests (mangroves),' must be taken into account." The mangrove delimitation process must necessarily include areas that are degraded or in the process of recovery. Furthermore, within the scope of its competence, the respective Conservation Area must implement the necessary measures to promote such recovery.

16.- The IGN used the Georeferenced Digital Delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone corresponding to the mangrove of Estero Cosechas, district 03º Veintisiete de Abril, canton 03º Santa Cruz, province 05º Guanacaste.

17.- By means of official communications ACT-OSRSCC-871-2024 dated August 1, 2024, and ACT-OSRSCC-503-2025 dated May 21, 2025, signed by Carlos Pizarro Barrantes, Orlando Matarrita Suárez, and José Joaquín Rodríguez, officers of the Sub-Regional Office of Santa Cruz - Carrillo of the Área de Conservación Tempisque, the field delimitation of the mangrove ecosystem was carried out.

18.- By means of official communications DDUR-DCT-IGN-635-09-2024 dated September 2, 2024, and DDUR-DCT-IGN-898-2025 dated May 26, 2025, signed by Alejandra Sancho Perlaza and Karina Cruz Campos, both Engineers of the Cadastre and Topography Department of the Municipalidad de Santa Cruz, the delimitation was submitted along with their respective technical reports, to which approval was granted.

19.- The delimitation of the public zone of the ZMT of the canton of Santa Cruz was carried out under the Cooperation Agreement between SINAC and the Municipalidad de Santa Cruz, and was implemented through the contracting of the company STEREOCARTO CENTROAMERICA S.A., tender 2022LA-000021-0021000001, pursuant to official communication CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCTSINAC_ACT-0630-10-2023) of October 10, 2023.

20.- By means of official communication DIG-GDF-388-2025 dated October 28, 2025, generated by the Topography Sub-Process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional, the Technical Review Report for the publication of the georeferenced delimitation of the public zone DIG-GDF-032-2025-PU-INF, dated October 28, 2025, was submitted in relation to the work carried out by SINAC-ACT regarding the delimitation of the mangrove of Estero Cosechas in Playa Junquillal, the delimitation having been technically validated for publication.

21.- Article 140 of Law N°6227, Ley General de la Administración Pública, dated May 2, 1978, and its amendments, states that "the administrative act shall take effect after it has been communicated to the administered party, except where it grants only rights, in which case it shall take effect from the time it is adopted," a provision that must necessarily be read in conjunction with numeral 240, paragraph 1) of the same body of law, which defines the appropriate instrument for communicating acts of a general nature by stating that: "General acts shall be communicated by publication, and specific acts by notification." HEREBY COMMUNICATES:

First: That, on March 13, 14, 15, and 16, 2023, SINAC-ACT carried out fieldwork for the georeferenced digital delimitation to the national coordinate system of the public zone of the mangrove of Estero Cosechas located at Playa Junquillal, district 03° Veintisiete de Abril, canton 03° Santa Cruz, province 05° Guanacaste.

Second: The Instituto Geográfico Nacional publishes the georeferenced digital delimitation of the public zone comprising 326 points that describe the mangrove of Estero Cosechas located at Playa Junquillal, district 03° Veintisiete de Abril, canton 03° Santa Cruz, province 05° Guanacaste, based on the Regulations on Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by the Área de Conservación Tempisque (SINAC-ACT).

Third: That the delimited public zone corresponds to the mangrove of Estero Cosechas located at Playa Junquillal, district 03° Veintisiete de Abril, canton 03° Santa Cruz, province 05° Guanacaste, in accordance with official communications DIG-GDF-388-2025 dated October 28, 2025, generated by the Topography Sub-Process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional; DDUR-DCT-IGN-635-09-2024 dated September 2, 2024, and DDUR-DCT-IGN-898-2025 dated May 26, 2025, signed by Alejandra Sancho Perlaza and Karina Cruz Campos, both Engineers of the Cadastre and Topography Department of the Municipalidad de Santa Cruz.

Fourth: The public zone of the Maritime-Terrestrial Zone corresponding to the mangrove of Estero Cosechas at Playa Junquillal, district 03° Veintisiete de Abril, canton 03° Santa Cruz, province 05° Guanacaste, corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05 and its update with respect to the horizontal reference system from CR05 to CR-SIRGAS:

Aviso 22 Delimitación de la zona pública de la Zona Marítimo Terrestre correspondiente al manglar del estero Cosechas, Distrito 03° Veintisiete de Abril, Cantón 03° Santa Cruz, Provincia 05° Guanacaste Ir a la última versión Versión de la Norma: 1 de 1 INSTITUTO GEOGRÁFICO NACIONAL DEPARTAMENTO DE GEODESIA Y GEOFÍSICA AVISO Nº 022-2025 ZONA MARÍTIMO TERRESTRE DELIMITACIÓN DE LA ZONA PÚBLICA DE LA ZONA MARÍTIMO TERRESTRE CORRESPONDIENTE AL MANGLAR DEL ESTERO COSECHAS, DISTRITO 03° VEINTISIETE DE ABRIL, CANTÓN 03° SANTA CRUZ, PROVINCIA 05° GUANACASTE Con fundamento en lo dispuesto en los artículos 140 y 240 de la Ley Nº6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978 y sus reformas; Ley Nº59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas; Ley Nº8905 Reforma del artículo 2 de la ley N°5695, Creación del Registro Nacional, y sus reformas; y modificación de la ley N°59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; Ley N.º6043 Ley sobre la Zona Marítimo Terrestre del 2 de marzo de 1977, con su respectivo reglamento y; artículos 2 y 3 de la Ley N.º5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1.- Que mediante Ley Nº8905 Reforma del artículo 2 de la ley N°5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N°59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas del 07 de diciembre del 2010, se estableció al Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley N°59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación" 2.- Que la Ley Nº59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.- Que de conformidad con el artículo 62 del Decreto Ejecutivo N°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N°7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública." 4.- Que el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.- Que el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina a la Red Geodésica Nacional de Referencia Horizontal CR05 y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." 6.- Que el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; mientras que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." 7.- Que por medio de la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo del 2025, se procedió a actualizar la información de la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre, pasándola del sistema de referencia horizontal CR05 al sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59, proyección CRTM05, como mecanismo de delimitación de la Zona Marítimo Terrestre.

8.- Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

9.- Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.

10.- Que la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N°7841-P Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre; b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; c) el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre; d) el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica; e) Decreto Ejecutivo N°42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal; y f) la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59.

11.- Que el artículo 16 de la Ley N°7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

12.- Que el artículo 11 del Capítulo I Disposiciones Generales de la Ley N°6043 Ley sobre la Zona Marítimo Terrestre del 02 de marzo de 1977 y sus reformas, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 13.- Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 14.- Que el Decreto Ejecutivo N°36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar." 15.-Que el Decreto Ejecutivo N°42760-MINAE Criterios técnicos para la ubicación, identificación, clasificación y delimitación de ecosistemas de humedal del 07 de marzo de 2022, en su artículo 14 establece que: "Consideraciones técnicas complementarias para manglares. El Área de Conservación respectiva, en conjunto con el Instituto Geográfico Nacional, deberá verificar en el campo la existencia de manglar y proceder a su delimitación, conforme a la competencia de cada institución según lo indique ordenamiento jurídico.

Para la identificación de un manglar se tomará como parámetro la presencia de árboles de alguna de las especies indicadas en el Anexo I de este decreto; asimismo, se incluyen dentro de estos ecosistemas los esteros y canales existentes. El límite se establece hasta donde se extienda la vegetación asociada con este ecosistema, de conformidad con el Anexo II de este decreto. Además de lo anterior debe contemplarse lo indicado en el Anexo III de este decreto, denominado "Listado de flora por tipo de humedal de acuerdo con clasificación paisajística Humedales Esturianos y Bosques Inundados Salados (manglares)".

El proceso de delimitación del manglar deberá necesariamente comprender las áreas que se hallen deterioradas o en proceso de recuperación. Además, en el ámbito de su competencia, el Área de Conservación respectiva, deberá ejecutar las medidas necesarias para fomentar dicha recuperación.

16.- Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente al manglar del Estero Cosechas, distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste.

17.- Que mediante los oficios ACT-OSRSCC-871-2024 de fecha 01 de agosto de 2024 y ACT-OSRSCC-503-2025 de fecha 21 de mayo de 2025, firmado por los señores Carlos Pizarro Barrantes, Orlando Matarrita Suárez y José Joaquín Rodríguez, funcionarios de la Oficina Subregional de Santa Cruz - Carrillo del Área de Conservación Tempisque, se procedió a la delimitación en campo del ecosistema de manglar.

18.- Que mediante oficios DDUR-DCT-IGN-635-09-2024 de fecha 02 de setiembre de 2024 y DDUR-DCT-IGN-898-2025 de fecha 26 de mayo 2025 suscrito por las señoras Alejandra Sancho Perlaza y Karina Cruz Campos, ambas Ingenieras del Departamento de Catastro y Topografía de la Municipalidad de Santa Cruz; presentan la delimitación realizada con sus respectivos informes técnicos, al cual se le otorga visto bueno.

19.- Que la delimitación de la zona pública de la ZMT del cantón de Santa Cruz fue realizada bajo el Convenio de Cooperación entre el Sistema Nacional de Áreas de Conservación y la Municipalidad de Santa Cruz, y concretado por la contratación de la empresa STEREOCARTO CENTROAMERICA S.A., licitación 2022LA-000021-0021000001, según oficio CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCTSINAC_ACT-0630-10-2023) del 10 de octubre de 2023.

20.- Que mediante el oficio DIG-GDF-388-2025 del 28 de octubre de 2025, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, se remitió el Informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública DIG-GDF-032-2025-PU-INF del 28 de octubre del 2025, en relación con los trabajos realizados por SINAC-ACT relativos a la delimitación del manglar del Estero Cosechas en Playa Junquillal avalada técnicamente la delimitación realizada para su publicación.

21.- Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública del 02 de mayo de 1978 y sus reformas, señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 240 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos." COMUNICA:

Primero: Que, los días 13, 14, 15 y 16 de marzo 2023, SINAC-ACT realizó el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública del manglar del Estero Cosechas situado en Playa Junquillal, distrito 03° Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste.

Segundo: El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 326 puntos que describen el manglar del Estero Cosechas situado en Playa Junquillal, distrito 03° Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (SINAC-ACT).

Tercero: Que la zona pública delimitada corresponde al manglar del Estero Cosechas situado en Playa Junquillal, distrito 03° Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste en conformidad a los oficios DIG-GDF-388-2025 de fecha 28 de octubre de 2025, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional; DDUR-DCT-IGN-635-09-2024 de fecha 02 de setiembre de 2024 y DDUR-DCT-IGN-898-2025 de fecha 26 de mayo 2025 suscritos por las señoras Alejandra Sancho Perlaza y Karina Cruz Campos, ambas Ingenieras del Departamento de Catastro y Topografía de la Municipalidad de Santa Cruz.

Cuarto: La zona pública de la Zona Marítimo Terrestre correspondiente a manglar del Estero Cosechas en Playa Junquillal, distrito 03° Veintisiete de Abril, cantón 03° Santa Cruz, provincia 05° Guanacaste, corresponde a las coordenadas, en el sistema de proyección cartográfica oficial de Costa Rica CRTM05 y su actualización con respecto al sistema de referencia horizontal de CR05 a CR-SIRGAS, siguientes:
