The applications submitted to administer a municipal property destined for public use shall be transferred by the Municipal Council to the Commission assigned knowledge of the application, a body that shall review and analyze the Work Plan, verify the requirements, and ensure compliance with the legality framework, as well as the absence of impediments.
The corresponding Commission shall issue an opinion, within a maximum period of one month, recommending one of the applicant organizations to the Municipal Council. The selection process shall take into consideration that social organizations are up to date in the payment of their obligations for public services, such as water, electricity, and telecommunications, among others.
Said opinion must indicate the assessments of attention to the general interest that mediated to support the recommendation, the criterion regarding the use proposal submitted, and make express mention of the conditions and the term in which the respective agreement must be established, which may not exceed three years. Likewise, it shall contain the recommendation for authorization to the Mayor's Office for the respective signing of the agreement with the interested organization.
For the selection process described in this article, priority shall be given to the Organizations attached to the property's location, and if no application exists from these, Integral Development Associations shall have priority in the administration, or failing that, any type of Association.
