in the entirety of the text - Complete Text of Regulation 45187 Repeals the Declaration of Public Utility for the interests of the State of the Administrative Association of the Cot de Oreamuno Aqueduct of Cartago No. 45187-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Based on the provisions set forth in articles 11, 140, subsection 18) and 146 of the Political Constitution, in articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Act No. 6227 of December 1, 1978, in article 32 of the Associations Act No. 218 of August 8, 1939, and articles 27 and subsequent articles of the Regulations to the Associations Act No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.-That article 32 of the Associations Act No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and which thereby contribute to solving a social need.
II.-That the Administrative Association of the Cot de Oreamuno Aqueduct, legal identification number three-zero zero two-two hundred ninety thousand seventy-nine, was registered in the Registry of Associations of the Public Registry on November twenty-nine, two thousand four, in volume four hundred seventy-nine, entry eleven thousand three hundred six.
III.-That article 32 of the Associations Act establishes: "(.) At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted cease to exist. (...)". Finally, numeral 33 ter of the Regulations to the "Associations Act," indicates: "In the event that any association renounces the declaration of public utility, it must submit the corresponding documentation to the Legal Advisory Office of the Ministry of Justice and Peace, which, without further procedure, shall proceed to carry out the repeal." IV.-That the Administrative Association of the Cot de Oreamuno Aqueduct was declared of public utility by the Ministry of Justice and Peace, through Executive Decree NO36120J of July first, two thousand ten, published in the Official Gazette La Gaceta, Supplement No. 157 of August thirteenth, two thousand ten.
V.-That through official communication ASADA-COT-JD-0095-2024 dated November fifth, two thousand twenty-four, the president of the board of directors of the Administrative Association of the Cot de Oreamuno Aqueduct, Mr. Carlos Luis Méndez Méndez, holder of identity card number three-zero three hundred thirty-seven-zero three hundred twenty-nine, communicated the association's renunciation of the benefit of the declaration of public utility granted by the Ministry of Justice and Peace. en la totalidad del texto - Texto Completo Norma 45187 Deroga Declara de Utilidad Pública para los intereses del Estado la Asociación Administrativa del Acueducto de Cot de Oreamuno de Cartago N° 45187-MJP EL PRESIDENTE DE LA REPÚBLICA El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública N° 6227 del 1° de diciembre de 1978, en el artículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001.
I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora del Acueducto de Cot de Oreamuno, cédula jurídica número tres-cero cero dos-doscientos noventa mil setenta y nueve, se inscribió en el Registro de Asociaciones del Registro Público el veintinueve de noviembre de dos mil cuatro, al tomo cuatrocientos setenta y nueve, asiento once mil trescientos seis.
III.-Que el artículo 32 de la Ley de Asociaciones establece: "(.) En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...) ". Finalmente, el numeral 33 ter del Reglamento a la "Ley de Asociaciones, indica: "En caso de que alguna asociación renuncie a la declaratoria de utilidad pública, deberá presentar la documentación correspondiente ante la Asesoría Jurídica del Ministerio de Justicia y Paz quien, sin más trámite, procederá a realizar la derogatoria." IV.-Que la Asociación Administradora del Acueducto de Cot de Oreamuno, fue declarada de utilidad pública por el Ministerio de Justicia y Paz, mediante Decreto Ejecutivo NO36120J del primero de julio de dos mil diez, publicado en el Diario Oficial La Gaceta, Alcance N O 157 del trece de agosto de dos mil diez.
V.-Que con oficio ASADA-COT-JD-0095-2024 de fecha cinco de noviembre de dos mil veinticuatro, el presidente de la junta directiva de la Asociación Administradora del Acueducto de Cot de Oreamuno, señor Carlos Luis Méndez Méndez, portador de la cédula de identidad número tres-cero trescientos treinta y siete-cero trescientos veintinueve, comunicó la renuncia de la asociación al beneficio de la declaratoria de utilidad pública otorgada por el Ministerio de Justicia y Paz. Por tanto,
DEROGAR LA DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO DE COT DE OREAMUNO
