throughout the entire text - Complete Text of Norm 0084 Authorizes the Central Government to cede growth space under the Fiscal Rule for 2025 to the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) MINISTRY OF FINANCE No. MH-DM-ACDO-0084-2025 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Exercising the powers conferred by articles 140, subsections 8) and 20), and 146 of the Political Constitution and Article 26 of Executive Decree No. 41641-H and its amendments.
I.—That Title IV of Law No. 9635 and its amendments, the Law for the Strengthening of Public Finances, establishes measures of responsibility in order to ensure that budget policy guarantees fiscal sustainability and, in particular, the Fiscal Rule provision, which sets limits for spending growth, subject to a proportion of the average nominal GDP growth and the debt-to-GDP ratio of the Central Government, for the budget of the entities and bodies of the non-financial public sector.
II.—That through Executive Decree No. 41641-H and its amendments, the Regulation to Title IV of Law No. 9635, denominated Fiscal Responsibility of the Republic, the regulation of the provisions of the Fiscal Rule is established.
III.—That in accordance with Article No. 17 of Executive Decree No. 41641-H and its amendments, the Ministry of Finance defines, in coordination with the Presidency of the Republic, the growth rate of current or total budget Fiscal Rule. Said growth rate must be respected both for the expenditure of the Central Government and of the decentralized entities and bodies that make up the Non-Financial Public Sector (SPNF).
IV.—That Article No. 26 of Executive Decree No. 41641-H provides for the possibility of the Central Government ceding growth space under the Fiscal Rule to decentralized entities and bodies, under the following terms:
"The Central Government may cede to entities and bodies of the SPNF, with the exception of the entities that make up the National Budget of the Republic, part of the growth space imposed on it by the Fiscal Rule in current or total exceptional spending need. The amount ceded shall not be counted within the growth limit of the entity that benefits from the cession of said growth space.
In the event that the cession originates from a Government transfer, said transfer must be duly identified in the budget of the Republic in order to provide proper follow-up.
The mechanism by which the Central Government will materialize said cession of growth space shall be an agreement of the Executive Branch, issued by the person holding the office of the Presidency of the Republic and the person holding the office of Head of the Ministry of Finance. (...)" V.—That the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) was created by Law No. 7384 of March 16, 1994, published in La Gaceta No. 62 of March 29, 1994, as a state public entity, with legal personality and its own assets.
VI.—That among the ordinary activities of INCOPESCA, it is responsible for coordinating the fisheries and aquaculture sector, promoting and organizing the development of fishing, maritime hunting, aquaculture, and research; likewise, for promoting, based on technical and scientific criteria, the conservation, exploitation, and sustainable use of the biological resources of the sea and aquaculture; regulating the rational yields, the protection of marine and aquaculture species; developing, monitoring, and following up on the application of legislation to regulate and prevent the contamination of marine and aquaculture resources as a result of fishing, aquaculture, and activities that generate contamination which threatens said resources.
VII.—That in accordance with what is indicated in official communications CARTA-DM-MAG-269-2025, CARTA-DM-MAG-357-2025, and CARTA-MAG-DM-471-2025, dated February 27, 2025, March 27, 2025, and April 29, 2025, respectively, signed by the Minister of the Ministry of Agriculture and Livestock and addressed to the Minister of Finance, regarding the cession of space under the Fiscal Rule for the Costa Rican Institute of Fisheries and Aquaculture, due to the institution's limitation in covering equipment needs for marine and land operations, improvements in user service infrastructure, and technological equipment and updating.
VIII.—That through official communications INCOPESCA-PE-0279-2025 and INCOPESCA-PE-0369-2025, the executive president of INCOPESCA justified the need for cession of space to develop projects related to equipment for maritime and land operations, improvements in infrastructure for user service, and technological equipment and updating, which are a priority for the institution and would represent an exceptional expense for the current fiscal year and for the fulfillment of its objectives.
IX.—That for these purposes, INCOPESCA requests authorization through cession of space under the Fiscal Rule for the sum of ¢400,000,000.00 (four hundred million colones), broken down into ¢104,400,000.00 (one hundred four million four hundred thousand colones) for marine operations equipment, ¢120,000,000.00 (one hundred twenty million colones) for land equipment, ¢55,600,000.00 (fifty-five million six hundred thousand colones) for improvements to buildings and offices, and ¢120,000,000.00 (one hundred twenty million colones) for technological equipment and updating.
X.—That the Minister of Finance, through official communication No. MH-DM-OF-0348-2024 dated March 21, 2024, determined that the growth of current and total expenditure at the budget level for the 2025 period, for the entities and bodies that make up the Non-Financial Public Sector (SPNF), could not exceed 3.75%. Furthermore, the cited growth rate must be applied to both current expenditure and total expenditure.
XI.—That the Minister of Finance, through official communication MH-DM-OF-1020-2025 of June 27, 2025, indicates that after verification with the Dirección General de Presupuesto Nacional (which is responsible for following up on the due compliance with the Fiscal Rule in the Central Government), it was determined that for 2025 the Central Government is in a position to grant INCOPESCA a cession of space under the Fiscal Rule for a total amount of ¢400,000,000.00 (four hundred million colones), which the institution may apply to the total expenditure according to its need.
XII.—That the request made does not require a transfer of funds from the Central Government, but only the cession of growth space under the Fiscal Rule, in order to normalize the budgetary situation of INCOPESCA for the year 2025.
XIII.—That taking into account all the foregoing considerations, it is necessary to cede to INCOPESCA the growth space imposed by the Fiscal Rule in the total expenditure so that it can budget the free surplus resources from prior periods, thereby allowing it to finance the capital expenditures required for the different activities. Therefore, THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE AGREE:
Considering:

I.-Que el Título IV de la Ley N.° 9635 y sus reformas, Ley de Fortalecimiento de las Finanzas Públicas, establece medidas de responsabilidad con el fin de lograr que la política presupuestaria garantice la sostenibilidad fiscal y, en particular, la disposición de la Regla Fiscal, la cual establece límites para el crecimiento del gasto, sujeto a una proporción del promedio del crecimiento del PIB nominal ya la relación de deuda del Gobierno Central a PIB, para el presupuesto de los entes y los órganos del sector público no financiero.
II.-Que mediante el Decreto Ejecutivo N.° 41641-H y sus reformas, Reglamento al Título IV de la Ley N.° 9635, denominado Responsabilidad Fiscal de la República, se establece la reglamentación de las disposiciones de la Regla Fiscal.
III.-Que de acuerdo con el artículo N.° 17 del Decreto Ejecutivo N.° 41641-H y sus reformas, el Ministerio de Hacienda define, en coordinación con la Presidencia de la República, la tasa de crecimiento del gasto corriente o total presupuestario, el cual no puede superar el techo establecido en la Regla Fiscal. Dicha tasa de crecimiento debe ser respetada tanto para el gasto del Gobierno Central como de los entes y órganos descentralizados que conforman el Sector Público No Financiero (SPNF).
IV.-Que en el artículo N.° 26 del Decreto Ejecutivo N.° 41641-H se dispone la posibilidad de que el Gobierno Central ceda espacio de crecimiento de la Regla Fiscal a los entes y órganos descentralizados, en los siguientes términos:
"El Gobierno Central podrá ceder a entidades y órganos del SPNF, con excepción de las entidades que conforman el Presupuesto Nacional de la República, parte del espacio de crecimiento que le impone (a Regla Fiscal en el gasto corriente o total, según corresponda, con el fin de que la entidad pueda satisfacer una necesidad de gasto excepcional. El monto cedido no será computado dentro del límite de crecimiento de la entidad que se beneficia de la cesión de dicho espacio de crecimiento.
En caso de que la cesión provenga de una transferencia del Gobierno, dicha transferencia deberá quedar debidamente identificada en el presupuesto de la República a fin de darle el debido seguimiento.
El mecanismo mediante el cual el Gobierno Central materializará dicha cesión de espacio de crecimiento será un acuerdo del Poder Ejecutivo, emitido por quien ocupe el cargo de la Presidencia de la República y quien ocupe el cargo de Jerarca del Ministerio de Hacienda. (...)" V.-Que el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) fue creado mediante la Ley N.° 7384 del 16 de marzo de 1994, publicada en La Gaceta N. 62 del 29 de marzo de 1994, como un ente público estatal, con personalidad jurídica, patrimonio propio.
VI.-Que entre las actividades ordinarias al INCOPESCA le corresponde coordinar el sector pesquero y el de acuicultura, promover y ordenar el desarrollo de la pesca, la caza marítima, la acuicultura y la investigación; asimismo, fomentar, sobre la base de criterios técnicos y científicos, la conservación, el aprovechamiento y el uso sostenible de los recursos biológicos del mar y de la acuicultura; normar el aprovechamiento racional de los recursos pesqueros, que tiendan a lograr mayores rendimientos económicos, la protección de las especies marinas y de la acuicultura; elaborar, vigilar y dar seguimiento a la aplicación de la legislación, para regular y evitar la contaminación de los recursos marítimos y de acuicultura, como resultado del ejercicio de la pesca, de la acuicultura y de las actividades que generen contaminación, la cual amenace dichos recursos.
VII.-Que de acuerdo con lo indicado en los oficios CARTA-DM-MAG-269-2025, CARTA-DM-MAG-357-2025 y CARTA-MAG-DM-471-2025, de fecha 27 de febrero de 2025, 27 de marzo de 2025 y 29 de abril de 2025, respectivamente, suscritos por el Ministro del Ministerio de Agricultura y Ganadería y dirigidos al Ministro de Hacienda, sobre la cesión de espacio en Regla Fiscal para el Instituto Costarricense de Pesca y Acuicultura, por la limitación de la institución para cubrir las necesidades de equipamiento para operaciones marinas y terrestres, mejoras en infraestructura de atención de usuarios y equipamiento y actualización tecnológica.
VIII.-Que por medio de los oficios INCOPESCA-PE-0279-2025 e INCOPESCA-PE-0369-2025, el presidente ejecutivo del INCOPESCA justificó la necesidad de cesión de espacio para desarrollar proyectos vinculados al equipamiento para operaciones marítimas y terrestres, mejoras en infraestructura de atención a usuarios y equipamiento y actualización tecnológica, los cuales son prioritarios para la institución y serían un gasto excepcional para el presente ejercicio económico y para el cumplimiento de sus objetivos.
IX.-Que para esos efectos el INCOPESCA solicita se autorice por cesión de espacio en Regla Fiscal la suma de ¢400.000.000,00 (cuatrocientos millones de colones), desglosado en ¢104,400,000.00 (ciento cuatro millones cuatrocientos mil colones) para equipamiento de operaciones marinas, ¢120,000,000.00 (ciento veinte millones de colones) para equipamiento terrestre, ¢55,600,000.00 (cincuenta y cinco millones seiscientos mil colones) para mejoras en los edificios y oficinas y ¢120,000,000.00 (ciento veinte millones de colones) millones en equipamiento y actualización tecnológica.
X.-Que el Ministro de Hacienda, mediante oficio N.° MH-DM-OF-0348-2024 de fecha 21 de marzo del 2024, determinó que el crecimiento del gasto corriente y total a nivel presupuestario del periodo 2025, de las entidades y órganos que conforman el Sector Público no Financiero (SPNF), no podría sobrepasar el 3,75%. Además, la citada tasa de crecimiento debe aplicarse tanto al gasto corriente como al gasto total.
XI.-Que el Ministro de Hacienda, mediante oficio MH-DM-OF-1020-2025 del 27 de junio de 2025, indica que una vez verificado con la Dirección General de Presupuesto Nacional (a quien compete dar el seguimiento para el debido cumplimiento de la Regla Fiscal en el Gobierno Central), se determinó que para el 2025 el Gobierno Central está en la capacidad de otorgar al INCOPESCA, una cesión de espacio en Regla Fiscal por un monto total de ¢400.000.000,00 (cuatrocientos millones de colones), que la institución puede aplicar en el gasto total conforme a su necesidad.
XII.-Que la solicitud planteada no requiere de transferencia de fondos del Gobierno Central, sino únicamente la cesión de espacio de crecimiento de la Regla Fiscal, en aras de normalizar la situación presupuestaria del INCOPESCA del año 2025.
XIII.-Que tomando en cuenta todas las consideraciones anteriores, es necesario ceder al INCOPESCA espacio de crecimiento que le impone la Regla Fiscal en el gasto total para que pueda presupuestar los recursos del superávit libre provenientes de periodos anteriores, permitiendo con ello financiar los gastos de capital que requieren en las diferentes actividades. Por tanto, EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA ACUERDAN:
